OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
CHAIRMAN
GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
- Pursuant to Decree-Law No. 50-SL dated June 18, 1949 organizing the Ministry of National Defense;
- Pursuant to Decree No. 33 dated March 22, 1946 and Decree-Law No. 71 dated May 22, 1946 organizing and establishing rules for the Vietnamese National Army;
- Upon the proposal of the Minister of National Defense,
- Pursuant to the resolution of the Council of Ministers and after consultation with the Standing Committee of the National Assembly;
ISSUES THE FOLLOWING DECREE-LAW:
Article 1- All male Vietnamese citizens are subject to military service from age 18 to 45.
Article 2- During this period, they must serve two years in the National Army, but during wartime, they may be mobilized for military service until the end of the war.
Article 3- Exemption from military service is granted:
1- Those who have a certificate from a government physician certifying that they do not meet physical and health conditions when called up,
2- Only children whose father or mother is disabled or over 65 years old.
If the family has multiple sons of military age with a disabled parent or one who is over 65, the eldest son may be exempted.
3- Those with six children under 16 years old.
Article 4- The order for call-up to military service shall be determined by the Minister of National Defense after review by the Council of Ministers.
Article 5- Forms of performing military service outside the period of active duty shall be established by the Minister of National Defense.
Article 6- Those who volunteer for military service will follow the regulations set forth in Decree-Law No. 71-SL dated May 22, 1946.
Article 7- The Minister of National Defense and the Minister of Health shall issue a decree establishing cases of exemption from military service due to lack of physical and health conditions.
Article 8- A subsequent decree will specify penalties for those who evade military duties.
Article 9- The Ministers of National Defense, Interior, Justice, and Health shall implement this Decree-Law accordingly./.
