Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 25/2008/NĐ-CP dated March 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Considering the proposal of the Minister of Natural Resources and Environment.

Article 1. Position and Functions

1. The National Hydro-Meteorological Center (hereinafter referred to as the Center) is a state-run public service organization directly under the Ministry of Natural Resources and Environment, performing the function of assisting the Minister of Natural Resources and Environment in managing and exploiting the national hydro-meteorological network (including basic survey activities, forecasting, meteorological and hydrological data), monitoring air and water environments for disaster prevention and mitigation, economic and social development, ensuring national security and defense throughout the country.

2. The Center has legal personality, its own seal, separate account as prescribed by law, and its headquarters in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Center shall perform the following tasks and powers:

1. Submitting to the Minister of Natural Resources and Environment the strategic development plan, programs, annual plans, projects of the Center, and organizing their implementation after approval.

2. Participating in drafting legal documents, technical standards, economic and technical norms related to hydro-meteorology.

3. Organizing the implementation of planning for developing the basic survey network concerning surface meteorology, upper-air meteorology, agricultural meteorology, marine meteorology, continental hydrology, and marine hydrology (hereinafter collectively referred to as hydro-meteorology); developing plans to implement the overall national strategy on forecasting and warning natural disasters within the Center's scope of responsibility.

4. Organizing observation and collection of data from the hydro-meteorological observation system; conducting surveys and investigations on hydro-meteorology, changes in riverbed and estuary topography, and coastal areas to supplement basic survey data in areas lacking observation stations, places frequently hit by typhoons, floods, and other dangerous natural disasters; implementing the task of monitoring air and water environments according to the division of work by the Minister of Natural Resources and Environment.

5. Implementing hydro-meteorological forecasting work; issuing official information about weather conditions, tropical depressions, typhoons, floods, and high tides according to the law; organizing observation and transmission of sea level data to serve tsunami warning, flood prevention, saltwater intrusion prevention, and climate change impacts, environmental landscape changes.

6. Dispatching authorized representatives of the Center to participate in Provincial Flood Control and Search and Rescue Command Bureaus.

7. Organizing the evaluation of the quality of basic surveys and hydro-meteorological forecasts within the Center's management; managing and storing hydro-meteorological data; organizing the provision of hydro-meteorological data information according to the law.

8. Developing and expanding the electronic information system for hydro-meteorology and technologies serving basic surveys, hydro-meteorological forecasting, and natural disaster warnings within the national hydro-meteorological network.

9. Organizing the selection, testing, calibration, and verification of hydro-meteorological measurement instruments; protecting technical safety corridors and relocating hydro-meteorological facilities according to the law.

10. Participating in reviewing the use of basic survey data on hydro-meteorology for key national construction projects and projects under the investment decision-making and management authority of the Minister, Deputy Ministers, Heads of ministerial-level agencies, Chairmen of provincial and municipal People's Committees, according to the division of work by the Minister of Natural Resources and Environment.

11. Participating in activities related to climate change according to the division of work by the Minister of Natural Resources and Environment.

12. Organizing the implementation of international cooperation programs, projects on hydro-meteorology after approval; participating in multilateral, bilateral activities, international treaties, and agreements on hydro-meteorology according to the division of work by the Minister of Natural Resources and Environment.

13. Conducting scientific research, applying, and transferring technology on hydro-meteorology according to the law.

14. Promoting awareness among the community on disaster prevention and mitigation according to the division of work by the Minister of Natural Resources and Environment.

15. Jointly operating or independently providing and exploiting services on hydro-meteorology and environment according to the law.

16. Implementing administrative reform according to the program and plan of the Ministry of Natural Resources and Environment.

17. Implementing anti-corruption measures, thrift, and waste prevention; resolving complaints, denunciations, and citizen suggestions within the Center's jurisdiction according to the law.

18. Managing organizational structures and staffing; implementing salary systems and incentive policies, commendations, and rewards; training professional skills for staff members under the classification of the Ministry of Natural Resources and Environment and according to the law.

19. Managing financial resources and assets assigned according to the classification of the Ministry of Natural Resources and Environment and according to the law.

20. Performing other tasks and powers assigned by the Minister of Natural Resources and Environment and as prescribed by law.

The Minister of Natural Resources and Environment decides on the establishment of self-financing public service organizations under the Center according to the provisions of the law.

Article 4. Leadership

1. The Center's leadership consists of a General Director and no more than three Deputy General Directors.

2. The General Director and Deputy General Directors are appointed and relieved of their duties by the Minister of Natural Resources and Environment in accordance with the provisions of the law.

3. The General Director stipulates the functions, tasks, powers, and organizational structure of the subordinate organizations of the Center.

4. The General Director is responsible before the law and before the Minister of Natural Resources and Environment for all activities of the Center; Deputy General Directors are responsible before the General Director for the areas of work assigned to them.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

2. Abolish Decision No. 15/2003/QĐ-BTNMT dated January 9, 2003 of the Minister of Natural Resources and Environment regarding the functions, tasks, powers, and organizational structure of the National Meteorological and Hydrological Center.

3. The Minister of Natural Resources and Environment, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government, and the General Director of the National Meteorological and Hydrological Center are responsible for implementing this Decision./.
