The Agriculture and Rural Development Sector's List of State Secrets classified as Top Secret includes the following information and documents:

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to Decree No. 33/2002/ND-CP dated March 28, 2002 of the Government detailing the implementation of the Law on Protection of State Secrets;

Considering the proposal of the Minister of Agriculture and Rural Development and the Minister of Public Security,

DECISION:

Article 1. The List of State Secrets classified as Top Secret for the Agriculture and Rural Development Sector includes the following information and documents:

1. Documents concerning mountainous areas, border regions, islands, and inland areas under the jurisdiction of the Agriculture and Rural Development Sector related to national defense.

2. Plans for participation in national defense by the Agriculture and Rural Development Sector; Plans for mobilizing fishing vessels to cooperate with the Ministry of National Defense in responding to wartime situations.

3. Absolute data regarding national strategic reserves, key projects, and facilities particularly relevant to national defense and security within the Agriculture and Rural Development Sector.

4. Content prepared for negotiations related to delineating maritime zones and joint fishing areas at sea between Vietnam and neighboring countries.

5. Documents using information from other agencies' and organizations' Lists of State Secrets classified as Top Secret.

Article 2. The List of State Secrets classified as Highly Confidential for the Agriculture and Rural Development Sector includes the following information and documents:

1. Types of aerial photographs, coordinate data, altitude data, and maps serving the investigation and planning work of the Agriculture and Rural Development Sector related to national defense and security objectives.

2. Inventions, patents, useful solutions, and new technological secrets in the Agriculture and Rural Development Sector that are particularly important for national defense and security, economic and social development, science and technology, not yet disclosed or not intended for disclosure.

3. Information and documents related to projects and programs in the Agriculture and Rural Development Sector preparing for international bidding, not yet disclosed or not intended for disclosure.

4. Plans, content prepared for negotiations, negotiation documents, and results of negotiations and agreements on agriculture and rural development with foreign countries or international organizations (excluding information and documents specified in Clause 4, Article 1 of this Decision), not yet disclosed or not intended for disclosure.

5. Information and documents about marine resources, valuable specimens collected from abroad, not yet disclosed or not intended for disclosure.

6. Plans for importing and exporting special items holding significant positions in the Agriculture and Rural Development Sector related to national defense and security, not yet disclosed or not intended for disclosure.

7. Plans for dispatching ships and boats to fish in the East Sea and the Spratly Islands in special situations to protect national sovereignty for national defense and security purposes (excluding information and documents specified in Clause 2, Article 1 of this Decision).

8. Documents using information and documents included in the List of Top Secret State Secrets of other agencies and organizations.

Article 3. Effectiveness

1. This Decision takes effect from January 1, 2010, and replaces Decisions No. 110/2003/QD-TTg dated June 6, 2003 of the Prime Minister on the List of State Secrets classified as Top Secret and Highly Confidential for the Fisheries Sector; No. 22/2004/QD-TTg dated February 25, 2004 of the Prime Minister on the List of State Secrets classified as Top Secret and Highly Confidential in the Agriculture and Rural Development Sector.

2. The Minister of Agriculture and Rural Development and the Minister of Public Security shall be responsible for guiding and supervising the implementation of this Decision.

3. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for enforcing this Decision./.
