PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Law on Protection and Development of Forests dated August 12, 1991;
Considering the proposal of the Ministry of Agriculture and Rural Development (Circular No. 4012/BNN-KL dated December 24, 2001), the People's Committee of Can Tho City (Circular No. 39/TTr.UB dated November 13, 2001); the opinion of the Ministry of Science, Technology and Environment (Circular No. 3535/BKHCNMT-MTg dated December 6, 2001),
DECISION:
Article 1. Establishing the Lung Ngoc Hoang Natural Wetland Reserve located in Phung Hiep District, Can Tho City, within the system of special-use forests in Vietnam.
The name of the Reserve is: Lung Ngoc Hoang Natural Wetland Reserve.
Article 2. Location, geographic coordinates, and area of the Lung Ngoc Hoang Natural Wetland Reserve:
1. Geographic location:
The Lung Ngoc Hoang Natural Wetland Reserve includes the land area of Phuong Ninh Forest Station, in Phung Hiep District, Can Tho City.
To the North, it borders Phuong Binh Commune; to the South, it borders Phuong Phu Commune; to the East, it borders Tan Phuoc Hung Commune (in Phung Hiep District); to the West, it borders Long My District.
Geographic Coordinates:
- From 09041'to 09045' degrees North latitude.
- From 105039' to 105043' degrees East longitude.
3. Scale of area and functional zones:
The total area of the reserve is: 2,805.37 hectares
Including:
- Strict protection zone: 976.28 hectares
- Ecological restoration zone: 963.45 hectares
- Administrative, service, and tourism zone: 404.61 hectares
- Scientific experimentation zone: 461.03 hectares
The buffer zone of the Lung Ngoc Hoang Natural Wetland Reserve has an area of 8,836.07 hectares, surrounding the Lung Ngoc Hoang Natural Wetland Reserve. To the North, it borders Lai Hieu Canal; to the South, it borders Quan Lo-Phung Hiep Canal; to the East, it borders Bung Tau Canal and Xeo Xu Canal; to the West, it borders Cau Nam Canal.
Article 3. Objectives and tasks of the Lung Ngoc Hoang Natural Wetland Reserve:
- Preserving typical and unique natural habitats, biodiversity, and the habitat of native species in the wetland ecosystem of the western floodplain of the Hau River. At the same time, contributing to the preservation of cultural, historical, and human values in the Mekong Delta region.
- Reasonably utilizing and exploiting natural resources and the potential of the wetland ecosystem to serve the local people's livelihoods, contributing to poverty reduction and the implementation of socio-economic development programs in Can Tho City.
- Contributing to maintaining ecological balance and increasing forest coverage, ensuring environmental security and sustainable development of the Mekong Delta.
Article 4. Entrusting the People's Committee of Can Tho City with direct management of the Lung Ngoc Hoang Natural Wetland Reserve.
The Chairman of the People's Committee of Can Tho City shall instruct the submission of the Investment Project for Construction and Development of the Lung Ngoc Hoang Natural Wetland Reserve and the Investment Project for Construction and Development of the Buffer Zone of the Lung Ngoc Hoang Natural Wetland Reserve to the competent authority for review, approval in accordance with current regulations.
At the same time, the People's Committee of Can Tho City shall instruct the preparation of a project for ecotourism activities in accordance with Decision No. 08/2001/QĐ-TTg dated January 11, 2001 of the Prime Minister on the management regulations for special-use forests, protective forests, and naturally produced production forests, to be submitted to the competent authority for review and approval for implementation.
Annually, from the budget funds allocated for investment in Can Tho City, the Ministry of Planning and Investment and the Ministry of Agriculture and Rural Development shall clearly record the capital allocation for projects under the Lung Ngoc Hoang Natural Wetland Reserve mentioned above, to ensure that the implementation adheres to the approved project content and schedule.
Article 5. Regarding the organization and staffing of the Lung Ngoc Hoang Natural Wetland Reserve:
Entrusting the Chairman of the People's Committee of Can Tho City to decide on the organization and staffing of the Lung Ngoc Hoang Natural Wetland Reserve based on the provisions of the Management Regulations for Special-Use Forests, Protective Forests, and Naturally Produced Production Forests issued together with Decision No. 08/2001/QĐ-TTg dated January 11, 2001 of the Prime Minister and the consensus of the Ministry of Agriculture and Rural Development and the Government's Organizational and Cadre Affairs Office.
Article 6. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
The Ministers, Heads of ministerial-level agencies, and heads of government-affiliated agencies, and the Chairman of the People's Committee of Can Tho City are responsible for implementing this Decision.
