RESOLUTION

Regarding the regular meeting of the Government in October 2004

On November 1, 2004, the Government held its regular monthly meeting in October to discuss and adopt the following issues:

1. The Government heard the Minister of Justice present the draft Resolution of the Standing Committee of the National Assembly on civil transactions concerning residential property with foreign elements established before July 1, 1991; and heard the Head of the Government Office report on the consolidated opinions of the Government members regarding the draft Resolution.

The Standing Committee of the National Assembly issued Resolution No. 58/1998/NQ-UBTVQH10 dated August 20, 1998 on civil transactions concerning residential property established before July 1, 1991; however, the Resolution does not apply to civil transactions concerning privately-owned residential property established from July 1, 1991 involving overseas Vietnamese citizens, individuals, or organizations from foreign countries. In recent times, this issue has caused difficulties in issuing certificates of ownership for houses, resolving renovation, upgrading, new construction, or disputes over residential property; affecting urban planning and the development of the real estate market. Some localities, due to their frustration with this issue, have made separate resolutions and handling measures leading to inconsistencies in national policy. This practical situation requires a Resolution of the Standing Committee of the National Assembly as a legal basis for resolving civil transactions concerning privately-owned residential property with foreign elements established before July 1, 1991; ensuring consistency and synchronization in state policy and guaranteeing full implementation of the Civil Code.

The Ministry of Justice is tasked to lead, coordinate with the Government Office, the Ministry of Construction, and related agencies, to incorporate the opinions of the Government members, perfect the draft Resolution, and submit it to the Prime Minister for consideration and decision on presenting it to the Standing Committee of the National Assembly. The content of the Resolution must be specific and clear so that after being adopted by the Standing Committee of the National Assembly, it will have sufficient grounds for immediate implementation without the need for the Government to issue guiding documents.

2. The Government heard the Ministry of Public Security present the draft Ordinance on Security Protection; and heard the Head of the Government Office report on the consolidated opinions of the Government members regarding the draft Ordinance.

Ensuring absolute safety for important agencies, high-ranking leaders, and international guests of the Party and State has always been a crucial task directly related to the political stability of the country and the external and internal activities of the Party and State. Throughout each historical period, the Party and State have timely issued regulations on the requirements and tasks of security protection work suitable for each revolutionary stage, directing the absolute safety of important agencies and high-ranking leaders. However, these documents still lack specificity and do not have high legal value. To create a legal framework and concretize the policies of the Party and State on security protection work; enhance the responsibility and strength of the security protection force, it is necessary to promptly issue the Ordinance on Security Protection.

The Ministry of Public Security is tasked to lead, coordinate with the Government Office, the Ministry of Justice, the Ministry of Defense, and related agencies, to incorporate the opinions of the Government members, perfect the draft Ordinance; the Minister of Public Security, acting on behalf of the Prime Minister, shall submit this draft Ordinance to the Standing Committee of the National Assembly.

3. The Government heard the Minister of Labor, Invalids, and Social Affairs present the draft Ordinance on Preferential Treatment for Persons Contributing to the Revolution; and heard the Head of the Government Office report on the consolidated opinions of the Government members regarding the draft Ordinance.

The Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs, and Their Families, War Invalids, War Veterans, Anti-War Activists, and Those Who Have Assisted the Revolution, issued in 1994, has created unity and consensus among the people in implementing the policies of the Party and State; deeply influencing education on tradition, emotions, and responsibilities of every citizen and society in caring for those who have contributed to the revolution; enhancing political stability and promoting the country's renewal process. During the implementation, to align with current realities, the Ordinance has been amended many times, but there are still some points that need further revision and supplementation under the new name "Ordinance on Preferential Treatment for Persons Contributing to the Revolution."

The Ministry of Labor, Invalids, and Social Affairs is tasked to lead, coordinate with the Government Office, the Ministry of Justice, and related agencies, to incorporate the opinions of the Government members, perfect the draft Ordinance; the Minister of Labor, Invalids, and Social Affairs, acting on behalf of the Prime Minister, shall submit this draft Ordinance to the Standing Committee of the National Assembly.

4. The Government discussed the proposal of the Minister of Construction in Circular No. 1175/BXD-KTTC dated July 30, 2004, regarding the capital mechanism for cement production investment projects.

To encourage investors to produce cement in difficult areas, while assisting localities in restructuring their economies, the Government agrees with the policy that cement production investment projects producing clinker in difficult regions (mountainous areas, remote and far-flung areas) can borrow development credit from the State up to 30% of the total project investment cost for clinker production and purchasing domestic production equipment. This policy only applies to new projects. Cement production must follow the plan, ensure profitability, and support local economic restructuring and social development.

5. The Government heard the Ministry of Planning and Investment report on the results of production, import-export, and investment in October and the socio-economic situation in the first ten months of 2004; the Ministry of Trade report on the trade situation in October 2004; the Ministry of Home Affairs report on the preliminary assessment of one year of implementing the "one-stop-shop" mechanism according to Decision No. 181/2003/QD-TTg dated September 4, 2003 of the Prime Minister; and the Government Inspectorate report on inspection work and complaints and grievances resolution in the third quarter of 2004.

The Government agrees to approve the above Reports.

The economic and social situation in October and the first ten months of the year continues to improve positively; industrial production maintains a high growth rate, agriculture develops, especially food crops; the service sector makes significant progress, exports increase strongly, the trade deficit decreases; state budget revenue ensures the schedule, meeting expenditure requirements; many aspects of social activities develop in a positive direction. The ASEM 5 Conference held in our country was highly successful, this is the most positive contribution we have made to ASEM so far and also affirms our proactive policy of international integration, contributing to enhancing our country's position and prestige on the international stage.

However, there are still latent difficulties both domestically and internationally, such as rising prices of imported materials and goods, particularly gasoline and oil, complex weather conditions, low disbursement progress of investment capital, including credit and government bond funds, serious social evils and traffic accidents continue to occur...

The Government requests ministries, sectors, and localities to closely follow actual developments, handle them promptly, strictly direct the implementation of economic and social development measures proposed by the Government in Resolution No. 01/2004/NQ-CP, Decision No. 51/2004/QĐ-TTg, resolutions of regular meetings of the Government, and other guiding documents for management issued by the Government and the Prime Minister, with particular attention to measures to control price increases, prevent natural disasters and diseases affecting humans and livestock; strengthen inspection and audit of investment projects, strictly implement the investment supervision process, promptly identify and address any issues and violations arising during basic construction; fully exploit all factors promoting growth in all fields and products to successfully fulfill the 2004 plan tasks.
