THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 45/2003/ND-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Inspection Work Regulation of the Ministry of Home Affairs issued together with Decision No. 147/TCCP-TTPC dated November 21, 1995 of the Minister, Head of the Party and State Cadre Organization Department (now the Ministry of Home Affairs);

Pursuant to the 2004 Work Program of the Ministry of Home Affairs;

At the proposal of the Inspector General of the Ministry of Home Affairs,

DECISION:

Article 1: Now hereby issues together with this Decision the "Supervision and Inspection Plan for State Organizational and Cadre Work in 2004".

Article 2: The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3: Heads of units under the Ministry of Home Affairs, Directors of Personnel Departments of Ministries, agencies at ministerial level, and agencies under the Government; Directors of Provincial People's Committees' Personnel Departments have the responsibility to implement this Decision./.

PLAN

INSPECTION AND AUDIT OF STATE ORGANIZATIONAL AND CADRE WORK IN 2004
(issued together with Decision No. 13/2004/QĐ-BNV dated February 20, 2004 of the Minister of Home Affairs)

In 2004, the Ministry of Home Affairs will focus on advising the Government to continue improving the system of regulatory legal documents on organization, personnel, and operational mechanisms of the administrative apparatus, creating fundamental changes in reforming management mechanisms in areas within the scope of the Ministry's management according to the spirit of strong decentralization, high autonomy, and socialization of public service activities. Simultaneously, the Ministry of Home Affairs will also strengthen inspection and audit work to implement regulatory legal documents in the organizational cadre field proposed and promulgated by the Ministry to have a basis for amending, supplementing, and perfecting them to meet the requirements of administrative reform.

To effectively perform the advisory function for leaders at all levels in identifying and proposing measures to promptly address shortcomings in the work of the sector, in addition to continuing to implement regularly assigned tasks according to their functions and responsibilities, the inspection and audit work of the state organizational and cadre sector in 2004 needs to focus on the following contents:

I. KEY CONTENTS OF INSPECTION AND AUDIT IN 2004

1. Inspect and audit the implementation of procedures and organization of elections for representatives of People's Councils at all levels for the 2004-2009 term as stipulated in the new Law on the Organization of People's Councils and People's Committees and the Law on Elections of Representatives of People's Councils, combined with auditing the implementation of the Regulations on grassroots democracy;

2. Inspect and audit the implementation of provisions of the Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Cadres and Civil Servants 2003 and Decrees No. 114/2003/NĐ-CP dated October 10, 2003 on cadres and civil servants in communes, wards, and towns; Decree No. 115/2003/NĐ-CP dated October 10, 2003 on the reserve civil servant system; Decree No. 116/2003/NĐ-CP dated October 10, 2003 on recruitment, utilization, and management of cadres and civil servants in public institutions; Decree No. 117/2003/NĐ-CP dated October 10, 2003 on recruitment, utilization, and management of cadres and civil servants in state agencies; Decree No. 121/2003/NĐ-CP dated October 21, 2003 on policies and benefits for cadres and civil servants in communes, wards, and towns, and circulars guiding implementation issued by the Ministry of Home Affairs;

3. Audit the implementation of the project to reform salary policy and social assistance, applying new pay scales and allowances;

4. Inspect and audit the implementation of staff reduction in administrative agencies and public institutions according to Resolution No. 09/2003/NQ-CP dated July 28, 2003 on amending and supplementing Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government and Circular Jointly Issued No. 73/2000/TTLT-BTCCBCP-BTC dated December 28, 2000 of the Ministry of Home Affairs and the Ministry of Finance;

5. Inspect and audit examinations for recruitment and promotion to senior specialist positions in 2004 to ensure compliance with regulations;

6. Inspect and audit the implementation of the "one-stop" mechanism in provincial and district-level state administrative agencies, and propose solutions to simplify administrative procedures to serve the needs of citizens and businesses in certain sectors and fields;

7. Inspect and audit the handling of complaints and appeals from cadres and civil servants, especially decisions disciplining civil servants according to the Law on Complaints and Appeals; Decree No. 67/1999/NĐ-CP dated August 7, 1999 of the Government and other relevant laws.

II. IMPLEMENTATION

1. For the Personnel Departments of Ministries, agencies at ministerial level, and agencies under the Government:

The Personnel Departments of Ministries and agencies should develop plans to inspect organizational and cadre work in 2004 based on the above inspection and audit contents and in accordance with the key tasks and requirements of organizational and cadre work of their respective ministries and agencies to submit to the Minister or the head of the agency for approval.

Based on the approved inspection plan, the Director of the Personnel Department shall decide to establish inspection teams for organizational and cadre work at units under the administrative supervision of the Ministry, agency at ministerial level, or agency under the Government.

2. For the Personnel Departments of provinces and centrally-administered cities:

The Personnel Departments of provinces and centrally-administered cities should develop plans for inspection and audit of organizational and cadre work in 2004 in line with political tasks and the requirements of organizational and cadre work of their respective localities to submit to the Chairman of the Provincial People's Committee for approval.

Depending on the requirements and contents of inspections, the Chairman of the Provincial People's Committee may decide to establish or authorize the Director of the Personnel Department to establish inspection teams according to the key contents mentioned above.

Based on the inspection content and subjects, the Personnel Departments of provinces and centrally-administered cities shall take the lead in coordinating with relevant agencies to conduct inspections and audits according to the key contents of the 2004 inspection work for agencies, organizations, and individuals under the administrative supervision of the Provincial People's Committee.

3. For the Inspectorate of the Ministry of Home Affairs:

3.1. Advise the Minister to perfect and submit to the Government for approval the Draft Decree on inspection work of state organizations and organize its implementation upon issuance of the Decree; advise the Minister on guiding the functions, tasks, powers, and organizational structure of the Department of Inspection under the Ministry of Home Affairs;

3.2. Take the lead and coordinate with functional departments and units under the Ministry of Home Affairs to implement inspection and supervision campaigns in key areas of work in 2004 according to plans approved by the Ministry's leadership;

3.3. Develop and submit to the Minister for promulgation regulations on handling complaints, grievances, and public reception by the Ministry of Home Affairs and subordinate units;

3.4. Prepare training materials for inspection work, complaint and grievance resolution, and organize pilot training courses for civil servants involved in inspecting state personnel work at ministries, sectors, and localities according to new programs and curricula;

3.5. Assist the Minister in supervising, urging, and guiding the Organization and Cadre Department of ministries, sectors, provincial Departments of Home Affairs, the National Archives and Records Administration, and the National Academy of Public Administration to implement inspection and supervision plans for organizational and cadre work in 2004 to identify and promptly correct deficiencies in organizational and cadre work;

3.6. Inspect the handling of disciplinary decisions against civil servants according to the provisions of the Law on Complaints and Petitions and Decree No. 67/1999/NĐ-CP dated August 7, 1999; Decree No. 62/2002/NĐ-CP dated June 14, 2002 of the Government, focusing on inspecting and recommending solutions to complaints about disciplinary decisions against civil servants based on the Prime Minister's directives;

3.7. Take the lead and coordinate with the Police General Corps of the Ministry of Public Security to conduct inspections and supervision on seal management and usage according to legal provisions;

4. For functional departments under the Ministry of Home Affairs:

4.1. In 2004, each functional department under the Ministry of Home Affairs shall organize at least two (02) inspections of the implementation of legal normative documents related to state organizational and cadre work that the department has advised, drafted, and proposed for issuance;

4.2. Take the lead and coordinate with the Ministry's Inspectorate to organize inspection campaigns on the implementation of legal provisions in the fields assigned to them;

5. For the National Archives and Records Administration and the National Academy of Public Administration:

5.1. The National Archives and Records Administration shall take the lead and coordinate with the Ministry of Home Affairs' Inspectorate to organize inspection campaigns on the implementation of legal provisions of the National Archives Ordinance and Government Decrees on archival and record-keeping work for central and local archives and record-keeping organizations;

5.2. The National Academy of Public Administration shall take the lead and coordinate with the Ministry of Home Affairs' Inspectorate, the Training and Capacity Building Department for State Civil Servants to organize inspection campaigns on the organization of training and capacity-building sessions, focusing on training sessions for knowledge management of state administration for clerical and senior clerical positions for ministries, sectors, and localities;

The Organization and Cadre Departments of ministries, agencies equivalent to ministries, government agencies, and provincial Departments of Home Affairs; the National Archives and Records Administration, and the National Academy of Public Administration shall send their approved inspection and supervision plans for organizational and cadre work to the Ministry of Home Affairs for monitoring and coordination;

During the implementation process, the Organization and Cadre Departments of ministries, agencies equivalent to ministries, government agencies, and provincial Departments of Home Affairs shall organize mid-year summaries and annual reviews of their own ministry, sector, and local inspection work and submit reports to the Ministry of Home Affairs for consolidation, evaluation, and general lessons learned./.
