JOINT CIRCULAR

Guidelines for Implementing Preferential Treatment for Students and Trainees in Traditional and Special Art Subjects at Cultural and Art Schools

Pursuant to Decision No. 82/2005/QĐ-TTg dated April 18, 2005 of the Prime Minister on preferential treatment for students and trainees in traditional and special art subjects at cultural and art schools;

After obtaining the unified opinion of the Ministry of Education and Training, the Ministry of Culture, Sports and Tourism and the Ministry of Finance jointly issue guidelines for implementing preferential treatment for students and trainees in traditional and special art subjects at cultural and art schools as follows:

I. GENERAL PROVISIONS

1. The subjects entitled to preferential treatment under this Circular are students and trainees studying traditional and special art subjects at public cultural and art schools established pursuant to the decision of the competent authority, including: opera, cheo, cải lương (reformed hat戏改良剧), court music and dance, circus, vocal music, wind instruments, string instruments, percussion instruments, cinema, fine arts. Students and trainees in non-formal education systems (part-time, distance learning, self-study with guidance), staff attending studies, doctoral candidates, master's degree students, short-term training course participants, and those exempted or granted reduced tuition fees according to Circular No. 23/TT-LB dated October 24, 1996 of the Ministry of Education and Training and the Ministry of Finance are not covered by this Circular.

2. The funds for implementing preferential treatment for students and trainees in traditional and special art subjects at cultural and art schools shall be allocated from the annual regular budget estimate for training and other lawful revenues of the unit.

II. SPECIFIC PROVISIONS

1. Each year, the funds for implementing preferential treatment for students and trainees in traditional and special art subjects at cultural and art schools as stipulated in Articles 2, 3, and 4 of Decision No. 82/2005/QĐ-TTg dated April 18, 2005 of the Prime Minister shall be prepared and consolidated into the training budget of cultural and art schools and submitted to the supervisory agency for review and consolidation before reporting to the financial agency at the same level in accordance with the State Budget Law and related guiding documents.

2. Tuition reduction shall be applied to students and trainees studying certain traditional and special art subjects as follows:

a. Students and trainees studying opera, cheo, cải lương, and court music and dance shall have their tuition reduced by seventy percent of the current prescribed amount.

b. Students and trainees studying circus and dance shall have their tuition reduced by fifty percent of the current prescribed amount.

3. Vocational allowance for students and trainees studying traditional and special art subjects shall be implemented as follows:

a. Amount of vocational allowance:

- Students and trainees majoring in opera, cheo, cải lương, court music and dance, circus, vocal music, wind instruments, and dance shall receive a monthly vocational allowance equivalent to forty percent of the full scholarship value prescribed for their respective majors.

- Students and trainees majoring in film production and fine arts shall receive a monthly vocational allowance equivalent to thirty percent of the full scholarship value prescribed for their respective majors.

- Students and trainees majoring in string instruments, percussion instruments, and other specialized fields of cinema (excluding film production) shall receive a monthly vocational allowance equivalent to twenty percent of the full scholarship value prescribed for their respective majors.

b. Method of payment for vocational allowance:

- The vocational allowance shall be paid at the end of each month and shall not apply during summer break.

- The vocational allowance as specified in paragraph a, point 3, Section II of this Circular shall be paid for months with ten or more days of actual study. For months with fewer than ten days of actual study, the allowance shall be paid at fifty percent of the prescribed monthly rate.

4. Study equipment for students and trainees specializing in opera, cheo, cải lương, court music and dance, circus, dance, and fine arts at cultural and art schools shall be provided in kind as follows:

a. For students and trainees in dance and court music and dance:

- One (01) set of cotton clothing for folk dance.

- One (01) set of T-shirt for ballet.

- Four (04) pairs of soft ballet shoes and four (04) pairs of hard ballet shoes.

- One (01) pair of character boots (for classical dance practice over four years). This provision applies to all students and trainees specializing in classical dance currently being trained at cultural and art schools.

- Nine (09) pairs of socks.

b. For students and trainees in circus:

- One (01) set of long-sleeved T-shirt.

- One (01) set of short-sleeved T-shirt.

- Two (02) pairs of canvas shoes.

- One (01) pair of high-top leather shoes for acrobatics practice.

- Four (04) pairs of socks.

c. For students and trainees specializing in opera, cheo, cải lương:

- One (01) set of practice clothing.

- One (01) pair of canvas shoes.

- Two (02) pairs of socks.

d. For students and trainees specializing in fine arts:

- One (01) apron.

- Two (02) pairs of gloves for sculpture and graphic design students.

- Two (02) masks for sculpture and graphic design students.

The study equipment for students and trainees specializing in opera, cheo, cải lương, court music and dance, circus, dance, and fine arts mentioned above shall be provided with a usage period of twelve months, including vacation time, and shall be issued once within one month from the start of the academic year.

5. For the academic year 2005, the budget for implementing preferential policies for students studying traditional and special arts subjects in cultural-art schools as stipulated in Articles 2, 3, and 4 of Decision No. 82/2005/QĐ-TTg dated April 18, 2005 of the Government shall be arranged by the cultural-art schools within the allocated budget and other legitimate sources of income of the schools. In cases where the budget remains insufficient after such arrangement, the cultural-art schools shall submit a report to the higher management authority for consolidation and submission to the financial authority for consideration and resolution within their jurisdiction or for presentation to the competent authority for decision.

6. The provision of study equipment for students eligible for preferential treatment shall be carried out as follows:

a. Cultural-art schools shall independently purchase study equipment for students according to the levels specified in this Circular, ensuring that the provision of equipment is synchronized, economical, effective, compliant with regulations, and meets time requirements while maintaining consistency among schools within each province.

b. The procurement of study equipment for students shall be conducted in accordance with current regulations on the procurement of goods applicable to administrative agencies and public service units.

7. Principles for managing and using study equipment:

a. Students who are entitled to receive study equipment must manage and use the provided equipment for its intended purpose.

b. Study equipment that is damaged or lost due to any cause will not be replenished. In all cases of damage or loss, students must purchase replacement equipment according to the prescribed model to use during their studies.

c. It is strictly prohibited to use the budget for providing study equipment for students eligible for preferential treatment for purposes other than those intended.

8. Settlement procedures:

The settlement and finalization of the budget for implementing preferential policies for students studying traditional and special arts subjects in cultural-art schools as stipulated in this Circular shall be carried out in accordance with the provisions of the State Budget Law and related guiding documents.

III. IMPLEMENTATION

1. This Circular shall take effect fifteen days from the date of publication in the Official Gazette. During the implementation process, if there are difficulties or obstacles, relevant agencies and units shall promptly report to the Ministry for coordination and resolution.

2. Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees under the Central Government, and cultural-art schools shall be responsible for implementing the provisions of this Circular.

3. The Ministry of Culture, Sports and Tourism and the Ministry of Finance shall be responsible for coordinating inspections of the implementation of preferential policies for students studying traditional and special arts subjects in cultural-art schools..
