THE MINISTER OF INDUSTRY AND TRADE

Pursuant to the Agreement between the Ministry of Industry and Trade of the Socialist Republic of Vietnam and the Ministry of Commerce of the Kingdom of Cambodia signed on November 5, 2007, in Phnom Penh, Cambodia;

Pursuant to Resolution No. 01/2007/QH12 dated July 31, 2007 of the National Assembly of the Socialist Republic of Vietnam, Session I, Term XII, concerning the organizational structure of the Government and the number of Deputy Prime Ministers for Term XII;

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and Ministerial-Level Agencies;

Pursuant to Decree No. 19/2006/NĐ-CP dated February 20, 2006, promulgated by the Government detailing the Law on Commerce regarding the origin of goods;

At the proposal of the Director of the Import-Export Department,

DECISION:

Article 1. Goods listed in Appendix I attached hereto must be harvested, picked, gathered, or produced, processed, manufactured entirely within the territory of the Kingdom of Cambodia after being raised or grown there and must have a Certificate of Origin Form S issued by the Ministry of Commerce of the Kingdom of Cambodia according to the model specified in Appendix II attached hereto.

Article 2. Goods referred to in Article 1 must be transported directly from the Kingdom of Cambodia to Vietnam through the border gates listed in Appendix III of this Decision.

Article 3. The procedures for issuing, implementing, inspecting origin, and related procedures for the Certificate of Origin Form S referred to in Article 1 shall be applied based on appropriate provisions in the Rules of Origin Form D applicable to the ASEAN Free Trade Area (AFTA) Agreement and relevant regulatory legal documents.

Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 5. The Director of the Import-Export Department, Directors, Heads of units concerned under the Ministry of Industry and Trade, relevant agencies, organizations, and individuals are responsible for enforcing this Decision./.
