REGULATIONS ON FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE DEPARTMENT OF ORGANIZATION AND PERSONNEL
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 16 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government on functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The Department of Organization and Personnel is the advisory body assisting the Minister in performing state management functions over the agricultural and rural development sector concerning organizational structures, staffing, cadres, training and capacity building, commendation and reward, discipline, and policies for cadres, civil servants, and public officials under the Ministry's administrative supervision.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Regarding organizational structures and staffing:
a) Submit to the Minister comprehensive proposals on organizational structures and staffing of the sector and subordinate agencies and units; plan, reorganize the state management system, scientific and technological systems, training and capacity-building systems, public service organizations, and other service-providing entities;
b) Take the lead in drafting and submitting to the Minister proposals on establishing, restructuring, and dissolving Departments, Bureaus, the Inspectorate, the Office, and public service organizations under the Prime Minister's authority; plans for the network of public service organizations and services, criteria for establishment, specific ranking criteria, and self-management mechanisms for public service organizations and services in the agricultural and rural development sectors under the Ministry's administrative supervision;
c) Submit to the Minister decisions on establishing, restructuring, and dissolving self-financing public service organizations and other organizations within the Minister's authority; establishing Rooms under Departments, the Inspectorate, the Office, and organizations directly under Bureaus;
d) Take the lead in reviewing and submitting to the Minister regulations on functions, tasks, powers, and organizational structures of Departments, Bureaus, the Inspectorate, and the Office; provisions on self-management responsibilities of state-owned public service organizations under the Ministry's management;
đ) Aggregate and submit to the Minister proposals on decentralizing state management tasks to local authorities; allocate and decentralize tasks among subordinate agencies and units;
e) Take the lead in drafting and submitting to the Minister circulars or joint circulars guiding the functions, tasks, powers, and organizational structures of specialized agencies in agriculture and rural development at all levels of People's Committees;
g) Submit to the Minister plans for staffing, set staffing standards for state-owned public service organizations in the sector and field according to regulations; decide on annual administrative staffing allocations for agencies and units under the Ministry within the total allocated administrative staffing; approve staffing plans for public service units with established staffing standards; allocate staffing and salary funds annually for public service units without established staffing standards;
h) Submit to the Minister approval of pilot plans for establishing enterprises within public service units under the Ministry. Direct implementation and monitor activities of enterprises within public service units under the Ministry according to regulations;
i) Guide, direct, and inspect the implementation of normative legal documents and the Minister's regulations on functions, tasks, organizational structures, and staffing;
k) Aggregate and submit to the Minister lists of public service organizations currently under the Ministry according to regulations.
2. Regarding cadres, civil servants, and public officials:
a) Submit to the Minister plans for cadre leadership and management development, scientific and technical cadre development, professional cadre development; human resource development plans; rotation plans for cadre leaders and managers according to regulations;
b) Submit to the Minister appointments and dismissals of heads and deputy heads of agencies and units under the Ministry and other positions according to the Ministry's delegated authority;
c) Submit to the Minister issuance and organization of inspections on the implementation of delegated authority and procedures for appointing and dismissing heads and deputy heads of agencies and units under Bureaus and state-owned public service organizations under the Ministry;
d) Submit to the Minister appointments and dismissals of General Directors or Directors of non-equity enterprises under the Ministry's management or authorized by the Prime Minister; propose appointments and dismissals of members of boards of directors of key state-owned enterprises designated by the Prime Minister;
đ) Submit to the Minister regulations on the authority and responsibility of heads of agencies and units under the Ministry;
e) Advise on implementing recruitment, utilization, transfer, rotation, retirement of cadres, civil servants, and public officials under the Ministry's management according to laws;
g) Submit to the Minister issuance and organization of inspections on the implementation of regulations on personnel management abroad according to laws;
h) Guide, monitor, and inspect cadre management, annual performance evaluations of civil servants according to the Ministry's delegated authority and legal regulations. Manage files of cadres, civil servants, and public officials under the Ministry's management; guide subordinate units to implement file management, utilization, storage according to legal regulations;
i) Submit to the Minister issuance and inspection of the implementation of regulations on decentralized cadre management, transfers, examinations, classification, and promotion of civil servants and public officials according to laws;
k) Implement anti-corruption, anti-waste, and anti-bureaucracy measures in the Department according to regulations;
l) Submit to the Minister job classifications for civil servants and public officials in administrative and public service units under the Ministry;
m) Submit to the Minister issuance of specific professional standards for heads of specialized agencies in the agricultural and rural development sectors under provincial and centrally-administered city People's Committees.
3. Regarding labor policies and salaries:
a) Submit to the Minister policies and systems for cadres, civil servants, public officials, and workers in the agricultural and rural development sector;
b) Lead the coordination and consolidation to submit to the Minister for issuance of professional standards for civil servants' ranks within the sector and field under the Ministry's assigned management; consolidate and submit to the Minister for issuance of professional standards for officials' ranks within the sector and field under the Ministry's assigned management as prescribed;
c) Submit to the Minister for salary increase, allowances, and resolution of policies for cadres and civil servants under the Ministry's management; guide and inspect agencies and units under the Ministry in implementing policies for cadres, civil servants, officials, and workers in the agriculture and rural development sector according to delegated management and legal provisions;
d) Submit to the Minister for grading, salary increment, and resolution of policies for cadres in the Ministry's leadership positions, civil servants under the management of the Politburo, Secretariat, and Ministry of Home Affairs;
đ) Submit to the Minister for implementation of preferential policies for those who have contributed to the revolution for cadres, civil servants, officials, and workers in the agriculture and rural development sector;
e) Resolve or participate in resolving termination benefits, social insurance, and funeral benefits according to the regulations of the Ministry;
4. Regarding training and capacity building:
a) Submit to the Minister for strategic planning, master plans, and plans for human resource development in the sector;
b) Submit to the Minister for training programs and plans for cadre, civil servant, and professional staff training in the sector;
c) Submit to the Minister for approval of annual training quotas for training institutions under the Ministry;
d) Guide and inspect training institutions on the implementation of training and capacity building regulations within the Ministry's authority according to legal provisions;
5. Regarding commendation, rewards, and disciplinary actions:
a) Advise the Minister on commendation work and propose reward forms for cadres, civil servants, officials, workers, and agencies with achievements in developing the sector;
b) Guide and inspect the implementation of commendation policy regulations;
c) Manage and distribute commendation and reward items of the sector according to delegated authority; organize and present rewards according to legal provisions. Complete procedures for replacing damaged or lost reward items and confirm reward forms;
d) Submit to the Minister for issuance of specific measures to strengthen administrative discipline and discipline for agencies, units, and cadres, civil servants, and officials under the Ministry's management;
đ) Advise on organizing the implementation of rewards and disciplinary actions for cadres, civil servants, and officials under the Ministry's management and agencies according to legal provisions;
6. Consolidate and report on organizational and cadre work according to regulations;
7. Submit to the Minister for approval of the list of state secrets of the sector, implement internal political security protection; manage the use of seals of agencies and units under the Ministry according to legal provisions;
8. Organize inspections and supervision of organizational and cadre work according to regulations;
9. Regarding management of associations and non-governmental organizations in the sector:
a) Submit to the Minister for recognition of the steering committee for establishing associations and non-governmental organizations and opinions on permission for establishment, merger, division, dissolution of associations and non-governmental organizations operating in the sector and field under the Ministry's administrative management;
b) Serve as the focal point for monitoring, consolidating, and reporting on the activities of associations and non-governmental organizations in the sector and field under the Ministry's administrative management;
10. Implement administrative reform according to the Ministry's program and plan and the Minister's assignment;
11. Participate in review boards for programs, projects, basic surveys, planning projects, investment development projects in agriculture, forestry, salt industry, fisheries, irrigation, and rural development according to the Department's functions and tasks and the Minister's assignment;
12. Act as permanent members of the following councils: salary council; commendation and reward council; disciplinary council; civil service recruitment council; council for recommending national honors such as teacher, doctor, and scientific titles; act as permanent member of the Women's Progress Council in agriculture and rural development;
13. Perform other tasks assigned by the Minister;
Article 3. Organizational Structure
1. Leadership of the Department:
The Department is led by the Director and Deputy Directors appointed and relieved from duty by the Minister of Agriculture and Rural Development according to regulations;
The Director manages the Department's operations, is responsible to the Minister of Agriculture and Rural Development and the law for the Department's activities;
Deputy Directors assist the Director in overseeing certain aspects of work according to the Director's assignment and are responsible to the Director and the law for assigned tasks;
2. Professional Departments:
a) Personnel and Establishment Department;
b) Cadre Management Department;
c) Training Management Department;
d) Policy and Salary Department;
đ) Commendation, Reward, and Discipline Department;
e) Consolidation Department;
Heads and Deputy Heads of departments listed in Clause 2 of this Article are appointed by the Minister of Agriculture and Rural Development according to regulations;
The Director of the Department of Organization and Cadre Management specifies the functions and responsibilities of each department according to the Ministry's delegation; directs the development, approval, and implementation of the Department's operational regulations; assigns civil servants suitable to their positions, standards, job descriptions, and assigned tasks;
Article 4. Effective date
This Decision takes effect fifteen days after its publication in the Official Gazette. Decree No. 86/2003/QĐ-BNN dated September 4, 2003, issued by the Minister of Agriculture and Rural Development regarding the functions, powers, and organizational structure of the Department of Organization and Cadre Management and previous contradictory regulations are abolished;
Article 5. Responsibilities for Implementation
The Director of the Department of Organization and Cadre Management, the Head of the Ministry's Office, Department Directors, Bureau Chiefs, the Chief Inspector of the Ministry, and heads of related agencies and units are responsible for enforcing this Decision./;
