CIRCULAR

Regulations on the model of investment monitoring and evaluation reports

Pursuant to the Law Amending and Supplementing Certain Provisions of Laws Related to Basic Construction Investment No. 38/2009/QH12;

Pursuant to the Investment Law No. 59/2005/QH11;

Pursuant to the Government Decree No. 113/2009/NĐ-CP dated December 15, 2009 on investment supervision and evaluation;

Pursuant to Decree No. 116/2008/NĐ-CP dated November 14, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment,

Ministry of Planning and Investment stipulates detailed models of investment monitoring and evaluation reports as follows:

Article 1. Scope of regulation and applicable subjects

Article 1. Scope of Regulation: This Circular specifies the models of investment monitoring and evaluation reports as prescribed in the Government Decree No. 113/2009/NĐ-CP dated December 15, 2009 on investment supervision and evaluation.

2. The subjects to which this Circular applies are organizations and individuals involved in preparing investment monitoring and evaluation reports.

Article 2. Model of investment monitoring and evaluation reports

Article 1. The models of investment monitoring and evaluation reports issued together with this Circular include:

a) Model No. 1: Overall investment monitoring and evaluation report for six months and annually;

b) Model No. 2: Monthly implementation status report of investment projects for projects using 30% or more state capital;

c) Model No. 3: Quarterly, six-monthly, and annual investment project implementation monitoring and evaluation report for projects using 30% or more state capital;

d) Model No. 4: Monitoring and evaluation report when adjusting investment projects for projects using 30% or more state capital;

đ) Model No. 5: Final investment project monitoring and evaluation report for projects using 30% or more state capital;

e) Model No. 6: Six-monthly and annual implementation monitoring and evaluation report of investment projects using other sources of capital;

Article 2. In the above models, italicized texts are guiding contents that will be concretized by users based on actual circumstances.

Article 3. Implementation

Article 1. This Circular takes effect from July 17, 2010.

Article 2. During implementation, if there are any difficulties, the relevant ministries, ministerial-level agencies, government agencies, central-level agencies, People's Committees at all levels, and related organizations and individuals are requested to send their opinions to the Ministry of Planning and Investment for timely review and adjustment.
