Regarding the amendment and supplementation of certain articles of the regulation on registration, preservation, and utilization of results from implementing scientific and technological tasks issued

Pursuant to Decree No. 159/2004/NĐ-CP dated August 31, 2004 of the Government on scientific and technological information activities;
At the proposal of the Director of the National Scientific and Technological Information Center;
THE MINISTER OF SCIENCE AND TECHNOLOGY ISSUES THE NATIONAL TECHNICAL REGULATION TO AMEND AND SUPPLEMENT CERTAIN PROVISIONS OF THE NATIONAL TECHNICAL REGULATION QCVN 1:2009/BKHCN ON GASOLINE, DIESEL FUEL, AND BIOFUELS PROMULGATED BY DECREE NO. 20/2009/TT-BKHCN DATED SEPTEMBER 30, 2009 OF THE MINISTER OF SCIENCE AND TECHNOLOGY.

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
The Minister of Science and Technology issues this Circular amending and supplementing certain articles of the Regulation on Registration, Preservation, and Utilization of Results from Implementing Scientific and Technological Tasks issued together with Decision No. 03/2007/QĐ-BKHCN dated March 16, 2007 of the Minister of Science and Technology, amended and supplemented by Circular No. 04/2011/TT-BKHCN dated April 20, 2011 of the Minister of Science and Technology as follows:
Article 1. Amending and supplementing certain articles of the Regulation on Registration, Preservation, and Utilization of Results from Implementing Scientific and Technological Tasks issued together with Decision No. 03/2007/QĐ-BKHCN dated March 16, 2007 of the Minister of Science and Technology, amended by Circular No. 04/2011/TT-BKHCN dated April 20, 2011 of the Minister of Science and Technology (hereinafter referred to as the Amended Regulation):
"1. Research topics, projects, programs in the fields of science and technology (including basic research tasks, international cooperation tasks under protocols, experimental production projects) at the national, ministry, provincial, and grassroots levels, using part or all of the state budget funds."
2. Clause 1, Clause 2 of Article 6 shall be amended and supplemented as follows:
"1. The purpose of the national high school examination is to use the examination results for recognizing high school graduation; provide information to evaluate the quality of secondary education; provide data as a basis for university and vocational education admissions."
"1. Within thirty working days from the date when the results of implementing scientific and technological tasks are officially evaluated and accepted, the organization or individual responsible for implementing the scientific and technological tasks must register the results of implementation (with confirmation from the chairman of the evaluation board regarding any necessary revisions, completion, and supplementation according to the requirements of the official evaluation board if revisions are required) at the registration agencies specified in Article 4 of this Regulation.
2. For results of implementing scientific and technological tasks that have registered for protection of intellectual property rights:
a) The results of implementing scientific and technological tasks that have registered for protection of intellectual property rights, upon being officially evaluated and accepted by the scientific and technological task management agency, shall be implemented in accordance with Clause 1 of this Article;
b) The results of implementing scientific and technological tasks that have registered for protection of intellectual property rights after being officially evaluated and accepted, shall be registered at the registration agencies specified in Article 4 of this Regulation within five working days from the date of filing the application for protection of intellectual property rights, but not later than sixty working days from the date of official evaluation and acceptance and with confirmation from the chairman of the evaluation board regarding any necessary revisions, completion, and supplementation according to the requirements of the official evaluation board (if revisions are required)."
3. Clause 2 of Article 14 shall be amended and supplemented as follows:
"2. The registration agencies specified in Clauses 2 and 3 of Article 4 of the Amended Regulation shall be responsible for coordinating with the National Scientific and Technological Information Center to implement the Regulation, and annually submit reports on the situation of registering the results of implementing scientific and technological tasks at their units to the National Scientific and Technological Information Center before December 31."
3. Clause 2, Article 14 shall be amended and supplemented as follows:
"2. The registration agencies specified in Clauses 2 and 3 of Article 4 of the amended Regulation shall cooperate with the National Science and Technology Information Center to implement the Regulation, and annually submit reports on the situation of registering the results of implementing science and technology tasks at their units to the National Science and Technology Information Center before December 31."
Article 2. Replace the appendices in the amended Regulation with the appendices of this Circular as follows:
Appendix I: Technology process description form;
Appendix II: Scientific and technological task implementation result registration form;
Appendix III: Model of the Registration Result Implementation Task Certificate for scientific and technological tasks using state budget funds;
Appendix IV: Model of the Registration Result Implementation Task Certificate for scientific and technological tasks not using state budget funds.
Article 3. Implementation Provisions
This Circular takes effect 45 days from the date of signature./.
