Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Education Law dated June 14, 2005 and the Law Amending and Supplementing Certain Articles of the Education Law dated November 25, 2009;
Pursuant to the Law on Youth dated November 29, 2005;
Pursuant to the Vocational Training Law dated November 29, 2006;
promulgates a Decree stipulating the criteria for stratification, ranking framework, and ranking standards for higher education institutions.
The Prime Minister issues this Decision on the regime and policies for cadres of the Communist Youth Union Ho Chi Minh, the Vietnam Student Association, and the Vietnam Youth Federation (hereinafter referred to collectively as cadres of the Youth Union and Associations) in educational institutions and vocational training centers.
Article 1. Scope of Regulation and Applicability
This Decision stipulates the regime and policies for cadres of the Communist Youth Union Ho Chi Minh, the Vietnam Student Association, and the Vietnam Youth Federation (hereinafter referred to collectively as cadres of the Youth Union and Associations) in educational institutions and vocational training centers, including universities, academies, colleges, vocational colleges, specialized secondary schools, vocational secondary schools, preparatory university programs, high schools, boarding schools for ethnic minorities, and regular education centers under all types of schools within the national education system as defined in the Education Law and the Vocational Training Law.
This Decision does not apply to cadres of the Youth Union and Associations in training and vocational centers belonging to the armed forces.
Article 2. Regime and policies for cadres of the Youth Union and Associations who are lecturers, teachers, and others concurrently performing Youth Union and Association work
1. Regarding time spent on Youth Union and Association work:
a) For universities:
- Secretaries of the Youth Union and Secretaries of the Youth Council are lecturers allocated 70% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers but concurrently hold the positions of Secretary of the Youth Union or Secretary of the Youth Council are allocated 70% of their working time for Youth Union and Association work;
- Deputy Secretaries of the Youth Union, Deputy Secretaries of the Youth Council, and Presidents of the Student Association who are lecturers are allocated 60% of their standard teaching hours for Youth Union and Association work. Deputy Secretaries of the Youth Union and Deputy Secretaries of the Youth Council who are not lecturers are allocated 60% of their working time for Youth Union and Association work;
- Vice-Presidents of the Student Association who are lecturers are allocated 50% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers but concurrently hold the position of Vice-President of the Student Association are allocated 50% of their working time for Youth Union and Association work.
b) For member schools, departments directly under universities; academies, colleges, vocational colleges, specialized secondary schools, vocational secondary schools, and preparatory university programs (hereinafter referred to collectively as school level) with 10,000 students or more:
- Secretaries of the Youth Union or Youth Assistants at the school level who are lecturers or teachers are allocated 70% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Secretary of the Youth Union or Youth Assistant at the school level are allocated 70% of their working time for Youth Union and Association work;
- Deputy Secretaries of the Youth Union, Presidents of the Student Association, and Presidents of the Vietnam Youth Federation at the school level who are lecturers or teachers are allocated 60% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Deputy Secretary of the Youth Union, President of the Student Association, or President of the Vietnam Youth Federation at the school level are allocated 60% of their working time for Youth Union and Association work;
- Vice-Presidents of the Student Association and Vice-Presidents of the Vietnam Youth Federation at the school level who are lecturers or teachers are allocated 50% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Vice-President of the Student Association or Vice-President of the Vietnam Youth Federation at the school level are allocated 50% of their working time for Youth Union and Association work.
c) For school levels with 5,000 to less than 10,000 students:
- Secretaries of the Youth Union or Youth Assistants at the school level who are lecturers or teachers are allocated 60% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Secretary of the Youth Union or Youth Assistant at the school level are allocated 60% of their working time for Youth Union and Association work;
- Deputy Secretaries of the Youth Union, Presidents of the Student Association, and Presidents of the Vietnam Youth Federation at the school level who are lecturers or teachers are allocated 50% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Deputy Secretary of the Youth Union, President of the Student Association, or President of the Vietnam Youth Federation at the school level are allocated 50% of their working time for Youth Union and Association work;
- Vice-Presidents of the Student Association and Vice-Presidents of the Vietnam Youth Federation at the school level who are lecturers or teachers are allocated 40% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Vice-President of the Student Association or Vice-President of the Vietnam Youth Federation at the school level are allocated 40% of their working time for Youth Union and Association work.
d) For school levels with fewer than 5,000 students:
- Secretaries of the Youth Union or Youth Assistants at the school level who are lecturers or teachers are allocated 50% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Secretary of the Youth Union or Youth Assistant at the school level are allocated 50% of their working time for Youth Union and Association work;
- Deputy Secretaries of the Youth Union, Presidents of the Student Association, and Presidents of the Vietnam Youth Federation at the school level who are lecturers or teachers are allocated 40% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Deputy Secretary of the Youth Union, President of the Student Association, or President of the Vietnam Youth Federation at the school level are allocated 40% of their working time for Youth Union and Association work;
- Vice-Presidents of the Student Association and Vice-Presidents of the Vietnam Youth Federation at the school level who are lecturers or teachers are allocated 30% of their standard teaching hours for Youth Union and Association work. Those who are not lecturers or teachers but concurrently hold the positions of Vice-President of the Student Association or Vice-President of the Vietnam Youth Federation at the school level are allocated 30% of their working time for Youth Union and Association work.
đ) For branch Youth Unions at the school level with 1,000 students or more:
The Secretary of the United Youth League is a lecturer or teacher who is allocated 40% of their standard teaching hours for youth league and association work. If the Secretary of the United Youth League is not a lecturer or teacher, they are allocated 40% of their working time for youth league and association work.
e) For general secondary schools, boarding schools for ethnic minorities, and regular education centers:
- The Secretary of the Youth Union or Youth Assistant, Youth Advisor at schools with 28 classes or more is allocated 85% of their standard teaching hours per week for youth league and association work;
- The Secretary of the Youth Union or Youth Assistant, Youth Advisor at schools with less than 28 classes is allocated 70% of their standard teaching hours per week for youth league and association work;
- The Deputy Secretary of the Youth Union at schools with 28 classes or more is allocated 50% of their standard teaching hours per week for youth league and association work;
- The Deputy Secretary of the Youth Union at schools with less than 28 classes is allocated 35% of their standard teaching hours per week for youth league and association work.
The provisions regarding the number of students in points a, b, c, d, and e above only apply to full-time students. In cases where the time exceeds the prescribed limit, Youth League and Association staff who are lecturers or teachers will be entitled to overtime pay; Youth League and Association staff who are not lecturers or teachers will be entitled to additional working hours pay.
2. Regarding allowances:
a) For universities:
- The Secretary of the Youth Union, Secretary of the Executive Committee of the Youth Union shall receive allowances equivalent to those of the Head of Department in universities;
- The Deputy Secretary of the Youth Union, Deputy Secretary of the Executive Committee of the Youth Union, President of the Student Union shall receive allowances equivalent to those of the Deputy Head of Department in universities;
- The Vice President of the Student Union shall receive allowances equivalent to those of the Deputy Head of Department.
b) For member institutions, departments under universities; academies, universities, colleges, vocational colleges, specialized secondary schools, vocational secondary schools, preparatory universities:
- The Secretary of the Youth Union, School-level Youth Assistant shall receive allowances equivalent to those of the Head of Department;
- The Deputy Secretary of the Youth Union, School-level President of the Student Union, President of the Youth Federation shall receive allowances equivalent to those of the Deputy Head of Department;
- The Vice President of the Student Union, Vice President of the Youth Federation, Secretary of the United Youth League (for United Youth Leagues with 1,000 students or more) shall receive allowances equivalent to those of the Deputy Head of Department within the faculty.
c) For general secondary schools, boarding schools for ethnic minorities, and regular education centers:
- The Secretary of the Youth Union, Deputy Secretary of the Youth Union, Youth Assistant, and President of the Youth Federation shall receive allowances equivalent to those of the Head of Professional Group;
- The Vice President of the Youth Federation shall receive allowances equivalent to those of the Deputy Head of Professional Group.
d) In cases where Youth League and Association staff who are lecturers or teachers or not lecturers or teachers hold positions with allowances equivalent to or higher than those of the Head of Department, Deputy Head of Department, Head of Department, Deputy Head of Department, Deputy Head of Department within the faculty, Head of Professional Group, Deputy Head of Professional Group, they shall be entitled to the highest allowance level. Allowances for Youth League and Association staff are paid together with monthly salaries.
Article 3. Regulations and policies for Youth League and Association staff who are students
1. Youth League and Association staff who are students are given priority in adding points to their conduct assessment results according to the regulations on assessing the conduct of students issued by the Ministry of Education and Training; they are given priority in scholarship awards, job recommendations, and additional support for working and studying conditions based on their capabilities and actual circumstances of each school.
2. Annually, Youth League and Association staff who are students who complete their tasks excellently are recognized and rewarded. The budget for organizing recognition and rewarding Youth League and Association staff is included in the annual budget allocated to the Youth League and Association organizations.
3. Youth League and Association staff who are students are supported with monthly activity fees or per academic year. Based on specific conditions, the school stipulates the level of support for activity fees for each position of Youth League and Association staff.
Article 4. Other systems and policies
1. League and Association cadres shall be provided with time conditions and travel expenses reimbursed when participating in League and Association activities convened by higher levels in accordance with current laws; they shall be given opportunities to enhance their professional qualifications through study; they shall be prioritized for dormitory accommodation; and they shall enjoy social welfare benefits equivalent to those of managers at the same level.
2. League and Association cadres who have worked continuously for three years or more and have performed excellently in their duties shall be given priority consideration for recruitment when taking civil service examinations, competitive examinations, or selection for public servants.
3. Secretaries and Deputy Secretaries of the League from grassroots level upwards, if meeting the criteria, may be included in the planning for leadership positions within educational institutions. For key League and Association cadres who have completed their tasks, upon reaching the retirement age for League and Association work, the institution shall be responsible for transferring them to equivalent positions suitable for their expertise, providing conditions for development. For full-time League and Association cadres upon reaching the retirement age for such work, the institution shall be responsible for arranging appropriate jobs.
4. The systems and policies for other positions of League and Association cadres shall be stipulated in the internal expenditure regulations of the educational institution but shall not exceed the standard set for key League and Association cadres as specified in this Decision.
5. The institution shall be responsible for arranging offices and facilities suitable to ensure effective operation of the League and Association organizations.
Article 5. On the number of full-time cadres
1. Universities with five affiliated schools or departments shall allocate at least three full-time cadres for League and Association work. University directors shall decide on the number of full-time cadres for League and Association work based on proposals from the League and Association organizations and specific conditions when the number of affiliated schools or departments changes.
2. The number of full-time cadres for League and Association work in affiliated schools or departments of universities, academies, colleges, vocational colleges, specialized secondary schools, vocational secondary schools, and preparatory universities:
- If there are 10,000 students or more, at least three full-time cadres shall be allocated for League and Association work;
- If there are between 5,000 and less than 10,000 students, at least two full-time cadres shall be allocated for League and Association work;
- If there are fewer than 5,000 students, at least one full-time cadre shall be allocated for League and Association work.
3. Secondary schools and boarding schools for ethnic minorities shall allocate at least one full-time cadre for League and Association work. Education centers with twenty-eight classes or more shall allocate at least one full-time cadre for League and Association work.
Article 6. Responsibilities of League and Association organizations
1. League and Association organizations in educational institutions and vocational training institutions mentioned in this Decision shall operate according to their own Charter and relevant laws; they play an important role and cannot be separated from educational and training work; they are responsible for contributing to the implementation of educational goals as stipulated in the Education Law and the Vocational Training Law.
2. League and Association organizations shall send key cadres as representatives to participate in committees and councils related to the rights and legitimate interests of young lecturers, teachers, staff, students, and pupils; young staff and lecturers have the responsibility to participate in League and Association work and youth movements.
3. The operating funds of League and Association organizations shall be stipulated in the internal expenditure regulations of educational and vocational training institutions. League and Association organizations are responsible for preparing annual budgets for operating funds which shall be approved by the director (or principal).
In addition to annual allocations, when assigned urgent tasks by the Party Committee, higher-level League and Association organizations, and the institution, League and Association organizations may prepare budgets for organizing and implementing these tasks and obtain approval in accordance with regulations.
Article 7. Effective Date of Implementation
1. This Decision shall take effect from March 26, 2013.
2. This Decision replaces Decision No. 61/2005/QĐ-TTg dated March 24, 2005 of the Government on the system and policies for Communist Youth Union cadres of Ho Chi Minh Communist Youth Union, Vietnam Student Association, Vietnam Youth Federation in universities, colleges, specialized secondary schools, vocational training institutions, and high schools.
Article 8. Implementation organization
1. The funds to implement the systems and policies stipulated in this Decision shall be allocated within the regular operating budget of educational institutions and vocational training institutions.
2. The Ministry of Education and Training shall take the lead and coordinate with relevant ministries, sectors, the National Committee on Youth Affairs, the Central Committee of the Ho Chi Minh Communist Youth Union, People's Committees of provinces and centrally governed cities to direct and inspect the implementation of this Decision.
3. It is requested that political-social organizations direct subordinate educational institutions and vocational training institutions to implement this Decision and organize inspections of its implementation.
4. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, related organizations and individuals are responsible for implementing this Decision./.
