Pursuant to Decree No. 73/2013/NĐ-CP dated July 15, 2013 of the Government adjusting pensions, social insurance benefits, and monthly allowances for retired village cadresJune 2024;(hereinafter referred to as Decree No. 73/2013/NĐ-CP)June 2024;The Minister of Labor, Invalids, and Social Affairs issues this Circular guiding the adjustment of pensions, social insurance benefits, and monthly allowances pursuant to Decree No. 73/2013/NĐ-CP of the Government dated July 15, 2013.

The Minister of Labor - Invalids and Social Affairs issues this Circular guiding the adjustment of pensions, social insurance benefits, and monthly allowances for the subjects specified in Clauses 1, 2, 3, and Clause 8 of Article 1 of Decree No. 44/2019/NĐ-CP dated May 20, 2019 of the Government

pursuant to the Government's Decree No. 73/2013/NĐ-CP dated July 15, 2013June 2024;pursuant to Decree No. 73/201of the Government,

Article 1. Scope of application

1. Civil servants, employees, workers, officials, and laborers (including those with voluntary social insurance participation periods, those who have retired and received monthly allowances from the social insurance fund of the farmers of Nghe An Province transferred according to Decision No. 41/2009/QĐ-TTg dated March 16, 2009 of the Prime Minister); military personnel, public security officers, and civil servants enjoying pensions before July 1, 2013.

2. Village, ward, and town cadres as prescribed in Decree No. 92/2009/NĐ-CP dated October 22, 2009, Decree No. 121/2003/NĐ-CP dated October 21, 2003, and Decree No. 09/1998/NĐ-CP dated January 23, 1998 of the Government, enjoying pensions and monthly allowances before July 1, 2013.

3. Persons currently receiving monthly disability allowances; persons currently receiving monthly allowances under Decision No. 91/2000/QĐ-TTg dated August 4, 2000, Decision No. 613/QĐ-TTg dated May 6, 2010 of the Prime Minister, and rubber plantation workers receiving monthly allowances before July 1, 2013.

As of July 1, 2019, the level of pensions, social insurance benefits, and monthly allowances of the subjects specified in Article 1 of this Circular shall be increased by 7.19% compared to the level of pensions, social insurance benefits, and monthly allowances in June 2019. Specifically:

The levels of pensions, social insurance allowances, and monthly allowances for the subjects specified in Article 1 of this Circular shall be adjusted as follows:

Example 1: Mr. A has a pension rate of 3,660,400 VND/month in June 2013. His pension rate from July 2013 will be adjusted as follows:

3,660,400 VND/month x 1.096 = 4,011,798 VND/month

Example 2: Mr. B, a retired village cadre receiving monthly allowances under Decree No. 09/1998/NĐ-CP, has a monthly allowance rate of 1,362,200 VND/month in June 2013. His monthly allowance rate from July 2013 will be adjusted as follows:

1,362,200 VND/month x 1.096 = 1,492,971 VND/month

Example 3: Mr. C, a person who retired and receives monthly disability allowances, has a monthly allowance rate of 1,479,200 VND/month in June 2013. His monthly disability allowance rate from July 2013 will be adjusted as follows:

1,479,200 VND/month x 1.096 = 1,621,203 VND/month

Article 3. Implementation Organization

1. Provincial People's Committees shall be responsible for directing the Department of Labor, Invalids, and Social Affairs and relevant agencies to inspect and urge the implementation of the provisions of this Circular.

2. The Vietnam Social Security shall be responsible for implementing the adjustment of pensions, social insurance benefits, and monthly allowances as stipulated in Decree No. 73/2013/NĐ-CP and guided in this Circular; prepare and submit a report according to the model attached to this Circular to the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance by November 1, 2013.

3. For persons currently receiving monthly allowances for work-related accidents and occupational diseases before July 1, 2013, the monthly allowance rate for work-related accidents and occupational diseases from July 1, 2013 will be increased by 9.52%. In cases where individuals suffer work-related accidents or occupational diseases and are discharged from hospital or have a medical assessment conclusion (for non-inpatient cases) between May 1, 2012 and June 30, 2013 without having their benefits resolved, the monthly allowance rate for work-related accidents and occupational diseases will still be calculated based on the national minimum wage of 1,050,000 VND/month; from July 1, 2013, the monthly allowance rate for work-related accidents and occupational diseases will be increased by 9.52%.

4. For individuals suffering work-related accidents or occupational diseases and currently receiving service allowances, or those currently receiving monthly survivor benefits before July 1, 2013, the monthly allowance rate from July 1, 2013 will be calculated based on the basic salary of 1,150,000 VND/month. In cases where individuals died between May 1, 2012 and June 30, 2013 and their survivors have not yet had their survivor benefits resolved, the monthly survivor benefit rate will still be calculated based on the national minimum wage of 1,050,000 VND/month; from July 1, 2013, the monthly survivor benefit rate will be calculated based on the basic salary of 1,150,000 VND/month.

5. For individuals currently receiving sick leave or maternity allowances before July 1, 2013, who are subject to state-prescribed salary systems and continue to be entitled to such allowances from July 1, 2013 onwards, the remaining allowance rates will be calculated based on the basic salary of 1,150,000 VND/month.

6. Military personnel and public security officers who have transferred to civilian jobs and then retired or stopped working due to health reasons, and have been receiving transfer allowances as stipulated in Article 3 of Decision No. 812/TTg dated December 12, 1995 of

8. The national minimum wage serving as the basis for calculating contributions and entitlements to social insurance benefits according to the Law on Social Insurance from July 1, 2013 will be calculated based on the basic salary set by the Government.

Article 4. Effective date

This Circular takes effect from October 4, 2013; the provisions of this Circular shall be implemented from July 1, 2013. Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids, and Social Affairs for study and resolution.
