CIRCULAR

On planning frequency channels for fixed and terrestrial mobile services in the band (30 - 30 000) MHz

WHEREAS, the Law on Radio Frequency Spectrum dated November 23, 2009;

Pursuant to Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications, amended by Decree No. 50/2011/NĐ-CP dated June 24, 2011 of the Government;

Pursuant to Decision No. 125/2009/QĐ-TTg dated October 23, 2009 of the Prime Minister approving the National Radio Frequency Spectrum Plan;

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE RADIO FREQUENCY MANAGEMENT AGENCY;

The Minister of Information and Communications issues this Circular on Planning Frequency Channels for Fixed and Terrestrial Mobile Services in the Band (30-30 000) MHz,

Article 1. Scope of Regulation and Applicability

Article 1. This Circular plans frequency channels for fixed and terrestrial mobile services in the band (30-30 000) MHz (excluding cellular mobile communication systems with separate planning) along with conditions for using frequency channels including:

a) Planning frequency channels for fixed and terrestrial mobile services in the band (30-1000) MHz as set out in Appendix 1;

b) Planning frequency channels for fixed and terrestrial mobile services in the band (1000-30 000) MHz as set out in Appendix 2.

Article 2. This Circular applies to the following entities:

a) Organizations and individuals producing, importing, and trading for use in Vietnam radio equipment belonging to fixed and terrestrial mobile services in the band (30-30 000) MHz;

b) Organizations and individuals using frequencies and radio equipment belonging to fixed and terrestrial mobile services in the band (30-30 000) MHz in Vietnam.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. is a band of radio frequencies defined by the width and center frequency of the channel or other characteristic parameters. Mobile Ground Service

2. is a radio communication service between fixed radio stations and mobile ground radio stations, or between mobile ground radio stations. Fixed Service

3. is a radio communication service between predetermined fixed points. Single-frequency transmission

4. is a mode of operation where two radio stations can transmit in one or two directions, but not simultaneously in both directions and only use one frequency channel. Dual-frequency transmission

5. is a mode of operation where transmissions between two radio stations use two frequency channels. Simplex is a mode of operation where transmission is carried out sequentially in each direction on one communication channel.

6. Simplex is a mode of operation where transmission takes place sequentially in each direction over a single channel.

7. is a mode of operation where transmission is carried out simultaneously in both directions on one communication channel. Half-duplex

8. is a mode of operation where simplex is applied at one end of the channel and duplex at the other end. VHF/UHF system

9. Microwave System Point-to-point communication (applicable to VHF/UHF)

10. Point-to-point Communication (applicable to microwave) Point-to-multipoint communication (applicable to VHF/UHF)

11. Point-to-multipoint Communication (applicable to microwave) Channelization

12. is the arrangement of channels within the same frequency band. Primary channelization

13. is channelization determined by basic parameters including the center frequency, the distance between adjacent channels, and the frequency separation. Secondary channelization

14. is additional channelization inserted between primary channels, with the center frequencies of secondary channels offset by half the distance between adjacent primary channels from the center frequencies of primary channels. involves adding additional channels between the main channels, the central frequencies of the additional channels being offset by half the distance between the central frequencies of adjacent main channels.

15. Minimum Transmission Distance (applicable to microwave) là khoảng cách truyền dẫn nhỏ nhất mà một tuyến vi ba được khuyến nghị sử dụng trong phân kênh tương ứng.

Article 3. Objectives of the Plan

1. To establish an order in the use of frequency channels, unify standards for radio communication systems, limit harmful interference among devices, systems, and networks, and keep pace with the rapid development of modern radio communication technology worldwide.

2. To guide producers, importers, traders, and users in the production, importation, and investment in equipment, assisting regulatory authorities in organizing and managing the spectrum effectively and reasonably.

3. To develop radio communication networks towards modernization, synchronization, and long-term stability, in line with international trends, meeting information needs for economic, social, defense, and security development.

Article 4. Principles of the Plan

1. To comply with the national radio frequency spectrum plan approved by the Prime Minister and currently in effect.

2. Based on the channel allocation recommendations of the International Telecommunication Union (ITU) and regional telecommunications organizations.

3. To take into account the current characteristics of frequency spectrum usage in Vietnam, ensuring the transition from the existing situation to the new plan with minimal cost.

4. To ensure rational, effective, economical, and purposeful management, exploitation, and use of radio frequencies.

5. To meet the demand for frequency channels in the coming years and the potential for introducing new technologies.

6. To be flexible in assigning frequencies.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

Article 1. The Radio Frequency Management Department shall be responsible for disseminating and guiding the implementation of this Circular; coordinating with relevant agencies of ministries and sectors to disseminate, guide, and inspect the implementation of this Circular.

Article 2. Radio communication systems belonging to fixed and terrestrial mobile services in the band (30-30000) MHz that have been permitted to operate but are no longer compliant with this Circular must develop a conversion plan within a maximum period of seven years from the date this Circular comes into effect, or cease operations if they cause harmful interference to systems operating according to the plan. Systems specified in Points 3.7 and 3.8.2 of Appendix 2 issued together with this Circular shall implement the conversion regulations as stipulated in those points.

Article 6. Implementation Provisions

Article 1. This Circular takes effect from August 15, 2013 and replaces Circular No. 27/2009/TT-BTTTT dated August 3, 2009 of the Minister of Information and Communications on the Planning of Radio Frequency Channels of Vietnam for Fixed and Terrestrial Mobile Services in the Band (30-30000) MHz.

Article 2. The Head of the Office, the Director of the Radio Frequency Management Department, the Heads of agencies and units under the Ministry of Information and Communications, and domestic and foreign organizations and individuals in Vietnam using, producing, importing, and trading radio equipment for use in Vietnam are responsible for implementing this Circular./.
