DECREE

PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL COMMITTEE

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 05/2011/ND-CP dated January 14, 2011 of the Government on Ethnic Affairs;

At the proposal of the Minister, Head of the Committee for Ethnic Minorities;

The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the National Committee.

Article 1. Position and Functions

The National Ethnic Committee is a ministerial-level agency under the Government, performing state management functions regarding ethnic affairs throughout the country; managing state services within the scope of management of the National Ethnic Committee as prescribed by law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The National Ethnic Committee performs the tasks and powers stipulated in Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific powers:

1. Submit to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, and draft decrees of the Government according to the annual legislative program and plan of the Government, and various resolutions, projects, and programs as assigned by the Government and the Prime Minister.

2. Submit to the Government and the Prime Minister strategic plans, planning, long-term, five-year, and annual plans, and important national projects and works within the scope managed by the National Ethnic Committee.

3. Submit to the Government and the Prime Minister for issuance policies on ethnic groups, special policies, programs, projects, and programs to support economic and social development and poverty reduction in communes, villages, and hamlets with difficult socio-economic conditions in ethnic minority areas and mountainous regions, border communes, safe zones, remote areas, highland areas, and very difficult areas; investment and support policies to stabilize the lives of ethnic minorities; policies and projects to support people in particularly difficult areas; policies and projects to preserve and develop ethnic minority groups with very small populations, and organize the implementation of such policies, programs, projects, and programs after issuance.

4. Submit to the Government and the Prime Minister for issuance policies for respected individuals among ethnic minorities; special policies for cadres and civil servants working in ethnic affairs; coordinate with the Ministry of Home Affairs to build and submit to competent authorities for issuance policies to attract and strengthen cadres, civil servants, and public officials working in ethnic minority areas and mountainous regions.

5. Submitting to the Prime Minister for approval draft decisions, directives, and other documents on ethnic affairs according to the division of labor.

6. Take the lead or coordinate with relevant ministries and agencies to submit to competent authorities for issuance policies on human resource development in ethnic minority areas and mountainous regions; training, capacity building, and utilization policies for ethnic minority cadres, raising ethnic awareness in ethnic minority areas; policies for ethnic minorities to exercise their right to use their languages and scripts, maintain their ethnic identity, and promote their good traditions and cultural practices; investment and development policies for educational institutions to meet material requirements for education and training in ethnic minority areas and mountainous regions.

7. Issue circulars, decisions, and directives within the scope of state management of the National Ethnic Committee; inspect normative legal documents issued by ministries, provincial People's Councils, and centrally governed city People's Councils related to ethnic affairs; be invited by the main reviewing authority to participate in the review of important normative legal document drafts prepared by ministries, ministerial-level agencies, and government agencies directly related to ethnic policies.

8. Direct, guide, inspect, and be responsible for organizing the implementation of normative legal documents, strategies, plans, policies, programs, projects, important national works, decisions, and directives already issued or approved within the scope of state management of the National Ethnic Committee.

9. Take the lead or coordinate with ministries, ministerial-level agencies, government agencies, and political-social organizations to conduct mid-term and final evaluations of the implementation of Party guidelines, State laws related to ethnic affairs, report regularly and urgently to the Government and the Prime Minister as prescribed; review the implementation of ethnic policies in ministries, ministerial-level agencies, government agencies, and localities; propose competent authorities to issue, amend, and supplement ethnic policies to align with actual circumstances and the requirements and tasks of ethnic work of the Party and State.

10. Direct and guide the establishment of exemplary models as outstanding collectives and individuals, and respected persons in ethnic minority areas; award commendations within its authority or propose competent authorities to award commendations to outstanding collectives and individuals with excellent achievements in labor, production, economic and social development, maintaining security and order, and exemplary implementation of Party guidelines and State laws in ethnic minority areas.

11. Direct and guide the organization of provincial and district-level ethnic minority representative congresses; organize exchange activities and experience sharing between ethnic minority representatives, respected individuals among ethnic minorities, and other events related to ethnic affairs to enhance the solidarity among ethnic groups in Vietnam.

12. Direct and guide the implementation and inspection of the organization of provincial and district-level ethnic minority representative congresses; organize exchange activities and experience sharing between ethnic minority representatives, respected individuals among ethnic minorities, and other events related to ethnic affairs to enhance the solidarity among ethnic groups in Vietnam.

13. Promote and mobilize ethnic minority compatriots to implement the Party's guidelines, policies, and state laws, to promote good customs, traditions, and practices of ethnic groups; disseminate, popularize, and educate on laws within the scope of management of the National Ethnic Council; coordinate with relevant ministries and agencies to build and implement projects and programs to strengthen communication work, provide information to grassroots areas of ethnic minorities and mountainous regions, broadcast radio and television channels for ethnic minorities online via the Internet; cooperate in implementing legal aid policies for ethnic minority compatriots.

14. Organize and direct scientific research on strategic, fundamental, and urgent issues concerning ethnic minorities and ethnic policies; study theoretical and practical aspects of ethnic work; apply, transfer science and technology, and protect the environment in ethnic and mountainous regions; activities to implement the application of information technology in ethnic work for the ethnic work system and areas of ethnic minorities and mountainous regions.

15. Monitor, inspect, and compile the situation of ethnic minority regions, the implementation of ethnic work tasks by ministries, ministerial-level agencies, government agencies, and localities; propose and recommend solutions to competent authorities for consideration and resolution of issues related to ethnic work and ethnic minority compatriots.

16. Develop statistical indicators within the scope of state management of ethnic work, a database on ethnic work, and a database on ethnic minorities in Vietnam.

17. Conduct surveys, studies, and compile information on the socio-economic development of ethnic groups, ethnic components, names, customs, and traditions of ethnic minorities, and other issues related to ethnicity.

18. Coordinate with relevant ministries and agencies in planning and submitting to the Government for allocation of resources to reduce poverty and other resources for ethnic minority regions; review or participate in reviewing programs, projects, proposals, and plans for socio-economic development in ethnic minority regions according to the law.

19. International cooperation in fields under the management of the National Ethnic Council according to the law; coordinate with foreign organizations and individuals, international organizations in researching, exchanging experiences on ethnic work, attracting resources to support investment in developing ethnic minority regions, regions with difficult socio-economic conditions, and extremely difficult conditions according to the law; manage, direct, or participate in implementing programs and projects funded and invested by foreign countries and international organizations in ethnic minority regions according to the law.

20. Decide and organize the implementation of administrative reform plans, publicize administrative procedures within the scope of ethnic work; perform other administrative reform tasks according to the law.

21. Inspect and check the implementation of policies and laws in the field of ethnic work; resolve complaints, denunciations, and citizen recommendations; prevent and combat corruption and handle violations of laws in fields under the management of the National Ethnic Council according to the law.

22. Receive, visit, and coordinate with ministries, sectors, and localities to address the wishes of ethnic minority compatriots according to policies, regulations, and laws.

23. Manage public services within the scope of ethnic work; implement public services in the field of State management of the National Ethnic Committee as prescribed by law.

24. Manage organizational structure, civil servant quotas, staff positions, occupational structure, and number of employees in public service units; decide on appointments, reappointments, transfers, rotations, resignations, dismissals, secondments, rewards, punishments, terminations, retirements, and implement salary systems and incentive policies for cadres, civil servants, and staff managed by the National Ethnic Council according to the Party and state laws; issue standards for leadership and management positions in ethnic work agencies under provincial and centrally-administered city people's committees; coordinate with relevant functional agencies in guiding the planning, training, nurturing, utilization, and management of cadres from ethnic minorities in the political system.

25. Prepare annual budget estimates; coordinate with the Ministry of Finance to prepare and consolidate revenue and expenditure budgets by sector and field within the scope of management to submit to the Government; manage, organize the implementation, and settle the state budget; perform other tasks related to the state budget, finance, and assets according to the law.

26. Perform other tasks and powers delegated by the Government and the Prime Minister and as prescribed by law.

In this Article, units specified from Clause 1 to Clause 13 assist the Minister, Chairman of the National Ethnic Council in performing state management functions; units specified from Clause 14 to Clause 18 serve the state management functions of the National Ethnic Council.

The units: Department of Planning and Finance, Department of Ethnic Policies, Localities Department II, Localities Department III have 02 Divisions; Department of Organization and Cadre Affairs has 01 Division; the Office of the National Ethnic Council has 05 Divisions and a representative office in Ho Chi Minh City; the Inspectorate of the National Ethnic Council has 04 Divisions.

Article 4. Effective date

1. This Decree takes effect from March 26, 2017.

2. This Decree replaces Decree No. 84/2012/NĐ-CP dated October 12, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the National Ethnic Council.

Article 5. Responsibilities for Implementation

Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, and Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
