Circular No. 13/2019/TT-BCT Amending and Supplementing Certain Provisions of Circular No. 20/2014/TT-BCT dated June 25, 2014, issued by the Minister of Industry and Trade on the Implementation of Rules of Origin under the ASEAN-Korea Free Trade Agreement

CIRCULAR

1. Amend and supplement Point d of Clause 2 of Article 24 as follows: amending certain provisions of Circular No. 20/2014/TT-BCTdated June 25, 2014 of Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows: Ministry of Industry and Trade stipulates the implementation of Rules of Origin in the ASEAN-Korea Free Trade Agreement

 Based on Decree No. 98/2017/NĐ-CP dated August 18 August 2017 /NĐ-CP dated March

8/2018, 2018 of the Government detailing the Law on Foreign Trade Management; Implementing the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area signed on February 27, 2009 at the 14th Summit Meeting in Thailand between the member states of the Association of Southeast Asian Nations and Australia and New Zealand; Implementing the First Protocol Amending the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area signed on August 26, 2014 within the framework of the 46th ASEAN Economic Ministers Meeting in Myanmar; về xuất xứ hàng hóa; ||

Implementing the Decision approving the list of goods for conversion under specific product rules in Annex 2 Decree Annex 3 of the Rules of Origin of the Goods Trade Agreement under the Comprehensive Economic Partnership Agreement between the Governments of the Member States of the Association of Southeast Asian Nations and the Government of the Republic of Korea adopted at the 17th ASEAN-Korea Free Trade Agreement Implementation Commission (AKFTA-IC) issues February in Hanoi, Vietnam in Suwon, South Korea;

At the proposal of the Director of the Department of Import-Export;

Circular No. 21/2016/TT-MCT dated September 20, 2016 Circular No. 20/2014/TT-BCT dated June 25, 2014 issued by the Minister of Industry and Trade stipulating the implementation of Rules of Origin in the ASEAN-Korea Free Trade Agreement (hereinafter referred to as Circular No. 20/2014/TT-BCT).

Article 1. Amending and supplementing some articles of Circular No. 20/2014/TT-BCT

1. Clause 2 shall be amended and supplemented as follows:

"The procedures for issuing and checking AK Form A certificates of Vietnam shall be implemented in accordance with the provisions of:1. Decree No. 31/2018/NĐ-CP dated March 8, 2018 of the Government detailing the Law on Foreign Trade Management regarding origin of goods and Circular No. 05/2018/TT-BCT dated April 3, 2018 of the Ministry of Industry and Trade on origin of goods.2. Appendix V attached hereto."

2. Appendix II - Specific Product Rules are amended and supplemented as follows: Repeal Appendix II - Specific Product Rules promulgated together with Circular No. 20/2014/TT-BCT and replace it with the Appendix attached hereto.

Article 2. Implementation clause

1. This Circular takes effect from September 13, 2019.

2. From September 1, 2019 to December 31, 2019, the HS code in cell number 7 on the AK Form A certificate shall be expressed in the following ways:

a) According to the 2017 version of the Harmonized System, simultaneously showing in parentheses the corresponding HS code according to the 2012 version of the Harmonized System; or

b) According to the 2012 version of the Harmonized System.

3. This Circular replaces Circular No. 04/2015/TT-BCT dated March 16, 2015 of the Ministry of Industry and Trade amending and supplementing Specific Product Rules promulgated together with Circular No. 20/2014/TT-BCT./.
