Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Insurance Business dated December 9, 2000; the Law Amending and Supplementing Certain Provisions of the Law on Insurance Business dated November 24, 2010;

Pursuant to Resolution No. 32/2016/QH14 dated November 23, 2016 of the National Assembly on Continuing to Enhance Capacity and Effectiveness in Implementing the National Target Program for New Rural Development Linked with the Restructuring of the Agriculture Sector;

Pursuant to Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on Agricultural Insurance;

At the proposal of the Minister of Finance and the Minister of Agriculture and Rural Development;

The Prime Minister issues this Decision on Implementing Policies to Support Agricultural Insurance.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decision stipulates the implementation of policies to support agricultural insurance as prescribed in Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on Agricultural Insurance, including: Subjects of organizations and individuals engaged in agricultural production eligible for support; types of crops, livestock, and aquaculture eligible for support; types of risks covered by insurance eligible for support; levels of support; timeframes for providing support; areas eligible for support; levels of support from the central budget to local budgets for implementing agricultural insurance premium subsidies.

Article 2. Applicability

This Decision applies to:

1. Organizations and individuals growing rice, rubber, pepper, cashew, coffee; raising cattle, buffalo, pigs; and farming black tiger shrimp, whiteleg shrimp, and tra catfish fall under the subjects specified in Clause 2, Article 22 of Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on Agricultural Insurance.

2. Non-life insurance companies, branches of foreign non-life insurance companies, and reinsurance companies established and operating in accordance with the Law on Insurance Business and related laws.

3. Other agencies, organizations, and individuals relevant to the implementation of policies to support agricultural insurance.

Chapter II
POLICIES TO SUPPORT AGRICULTURAL INSURANCE

Article 3. Subjects Eligible for Agricultural Insurance Premium Subsidies

1. Crops: Rice, rubber, pepper, cashew, coffee.

2. Livestock: Cattle, buffalo, pigs.

3. Aquaculture: Black tiger shrimp, whiteleg shrimp, tra catfish.

Article 4. Levels of Support for Agricultural Insurance Premiums

1. Individuals engaged in agricultural production classified as poor households or near-poor households according to Decree No. 07/2021/NĐ-CP dated January 27, 2021 of the Government on Multidimensional Poverty Standards for the period 2021-2025 and subsequent amendments and supplements (if any): Maximum support level as prescribed in Clause 1, Article 19 of Decree No. 58/2018/NĐ-CP and subsequent amendments and supplements (if any).

2. Individuals engaged in agricultural production not classified as poor or near-poor households as specified in Clause 1 of this Article: Maximum support level as prescribed in Clause 2, Article 19 of Decree No. 58/2018/NĐ-CP and subsequent amendments and supplements (if any).

3. Organizations engaged in agricultural production: Maximum support level as prescribed in Clause 3, Article 19 of Decree No. 58/2018/NĐ-CP and subsequent amendments and supplements (if any), provided they meet the following requirements:

a) Enterprises established under the Enterprise Law or cooperatives established under the Law on Cooperatives.

b) Have contracts linking them to agricultural products that are eligible for the policy of supporting agricultural insurance, in compliance with Articles 4 and 5 of Decree No. 98/2018/NĐ-CP dated July 5, 2018 of the Government on Policies Encouraging the Development of Cooperatives and Linkages in Agricultural Production and Marketing and subsequent amendments and supplements (if any).

c) Their agricultural products that are eligible for the policy of supporting agricultural insurance must be certified as meeting quality and food safety standards by competent authorities or recognized as high-tech agricultural enterprises under the legal criteria, authority, procedures, and formalities for recognizing high-tech agricultural enterprises.

Article 5. Insured risks supported for agricultural insurance premiums

1. Insured risks supported include rice, rubber, pepper, cashew, and coffee crops

a) Natural disasters affecting rice crops include: Typhoons, tropical depressions, whirlwinds, lightning, heavy rain, floods, flash floods, flooding, landslides caused by floods or water flow, subsidence caused by floods or water flow, rising water levels, saltwater intrusion, heatwaves, droughts, cold damage, hailstorms, frost, earthquakes, tsunamis. Natural disasters must be announced or confirmed by competent state agencies.

Natural disasters affecting rubber, pepper, cashew, and coffee crops include: Typhoons, tropical depressions, whirlwinds, lightning, floods, flash floods, flooding, hailstorms, frost. Natural disasters must be announced or confirmed by competent state agencies.

b) Diseases affecting rice crops include: Dwarf yellow, dwarf twisted leaf, black streaked dwarf, blast, leaf blight, brown spot, brown planthopper, white-backed planthopper, stem borer, small leaf roller, rice ear-cutting caterpillar, rats. Diseases must be announced or confirmed by competent state agencies.

Diseases affecting rubber, pepper, cashew, and coffee crops are not supported.

2. Insured risks supported include cattle, buffalo, and pigs

a) Natural disasters include: Typhoons, tropical depressions, whirlwinds, lightning, heavy rain, floods, flash floods, flooding, landslides caused by floods or water flow, subsidence caused by floods or water flow, heatwaves, droughts, cold damage, hailstorms, frost, earthquakes, tsunamis. Natural disasters must be announced or confirmed by competent state agencies.

b) Diseases include: Foot-and-mouth disease, blue ear disease in pigs (porcine reproductive and respiratory syndrome), anthrax, leptospirosis. Diseases must be announced or confirmed by competent state agencies.

3. Insured risks supported include giant shrimp, whiteleg shrimp, and tra fish

a) Natural disasters include: Typhoons, tropical depressions, whirlwinds, lightning, heavy rain, floods, flooding, landslides caused by floods or water flow, subsidence caused by floods or water flow, rising water levels, saltwater intrusion, heatwaves, droughts, hailstorms, earthquakes, tsunamis. Natural disasters must be announced or confirmed by competent state agencies.

b) Diseases: Diseases affecting giant shrimp, whiteleg shrimp, and tra fish are not supported.

Article 6. Areas supported for agricultural insurance premiums

1. For crops:

a) For rice crops, in the provinces: Thai Binh, Nam Dinh, Nghe An, Ha Tinh, Binh Thuan, An Giang, Dong Thap.

b) For rubber crops, in the provinces: Kon Tum, Gia Lai, Dak Lak, Binh Thuan, Binh Phuoc, Tay Ninh, Binh Duong, Dong Nai.

c) For coffee crops, in the provinces: Son La, Kon Tum, Gia Lai, Dak Lak, Dak Nong, Lam Dong, Binh Phuoc.

d) For pepper crops, in the provinces: Gia Lai, Dak Lak, Dak Nong, Binh Phuoc, Dong Nai, Ba Ria-Vung Tau.

đ) For cashew crops, in the provinces: Gia Lai, Dak Lak, Lam Dong, Binh Thuan, Binh Phuoc, Dong Nai.

2. For livestock:

a) For cattle and buffalo, in the provinces and centrally governed cities: Ha Giang, Vinh Phuc, Hanoi, Thanh Hoa, Nghe An, Binh Dinh, Gia Lai, Dak Lak, Lam Dong, Dong Nai, Binh Duong.

b) For pigs, in the provinces and centrally governed cities: Bac Giang, Hanoi, Thai Binh, Nam Dinh, Thanh Hoa, Nghe An, Binh Dinh, Dak Lak, Dong Nai.

3. For giant shrimp, whiteleg shrimp, and tra fish, in the provinces: Ben Tre, Tra Vinh, Soc Trang, Bac Lieu, Ca Mau.

Provincial People's Committees within the areas specified in Clause 1, Clause 2, and Clause 3 of this Article shall organize the selection of areas supported for agricultural insurance premiums according to the provisions of Clause 2, Article 21 of Decree No. 58/2018/NĐ-CP dated April 18, 2018 of the Government on agricultural insurance:

Article 7. Time for Implementing Agricultural Insurance Premium Support

The time for implementing agricultural insurance premium support shall be from the date this Decision takes effect until December 31, 2025.

Article 8. Level of Support from the Central Budget to Local Budgets for Implementing Agricultural Insurance Premium Support

Apply the maximum level of support as prescribed in Decision No. 127/QĐ-TTg dated January 24, 2022, of the Prime Minister on principles of targeted support from the central budget to local budgets to implement social welfare policies issued by the central government during the period 2022-2025.

Provincial People's Committees within the areas specified in Clause 1, Clause 2, and Clause 3 of Article 6 shall be responsible for allocating local budgets to support agricultural insurance premiums in accordance with this Decision.

Chapter III

IMPLEMENTING PROVISIONS

Article 9. Effective Date

1. This Decision takes effect from June 24, 2022, until December 31, 2025.

2. This Decision replaces Decision No. 22/2019/QĐ-TTg dated June 26, 2019, of the Prime Minister on implementing agricultural insurance support policies and Decision No. 03/2021/QĐ-TTg dated January 25, 2021, of the Prime Minister on amending and supplementing certain provisions of Decision No. 22/2019/QĐ-TTg dated June 26, 2019, of the Prime Minister on implementing agricultural insurance support policies.

Article 10. Responsibility for Implementation

1. The Ministry of Finance shall take the lead and coordinate with relevant agencies to summarize, evaluate, and propose the drafting of the Decision for the post-2025 period.

2. The Minister of Finance, the Minister of Agriculture and Rural Development, the Heads of ministerial-level agencies, the Heads of governmental agencies, and the Chairpersons of the People's Committees of provinces and centrally-administered cities are responsible for enforcing this Decision.
