Article 24Regarding the examination and recognition of the title of Excellent Lecturer
Pursuant to Decree No. 35/2024/NĐ-CP dated April 2, 2024 of the Government on awarding the titles of "People's Teacher" and "Outstanding Teacher";
Pursuant to Decree No. 27/2015/NĐ-CP dated March 10, 2015 of the Government on the awarding of the titles "People's Teacher" and "Outstanding Teacher";
Pursuant to Decree No. 127/2018/NĐ-CP dated September 21, 2018 of the Government stipulating responsibilities for state management of education;
Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
At the proposal of the Chief of General Staff;
The Minister of National Defense promulgates this Circular on the examination and recognition of the title of Excellent Lecturer and Excellent Teacher within the Ministry of National Defense.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the criteria, standards, files, procedures for examining and recognizing the title of Excellent Lecturer and Excellent Teacher within the Ministry of National Defense, and the responsibilities of relevant agencies, units, organizations, and individuals.
Article 2. Applicability
1. Lecturers, teachers, and educational management staff (hereinafter collectively referred to as educators) directly teaching, nurturing, and managing education at academies, military officer schools, universities; colleges, secondary vocational schools; military region schools, corps schools, Command of Capital City Hanoi, Command of Ho Chi Minh City, sub-officer schools; kindergartens (hereinafter collectively referred to as schools) within the Military.
2. Agencies, units, organizations, and individuals related to the work of examining and recognizing the title of Excellent Lecturer and Excellent Teacher within the Ministry of National Defense.
Article 3. Title of Excellent Lecturer and Excellent Teacher within the Ministry of National Defense
1. The title of Excellent Lecturer and Excellent Teacher within the Ministry of National Defense is granted to recognize, commend, and honor educators who meet the conditions and standards prescribed in this Circular.
2. The title of Excellent Lecturer and Excellent Teacher within the Ministry of National Defense includes:
a) The title of Excellent Lecturer and Excellent Teacher at the grassroots level (at the school level).
b) The title of Excellent Lecturer and Excellent Teacher at the Ministry of National Defense level.
Article 4. Principles for Examining and Recognizing the Title of Excellent Lecturer and Excellent Teacher
1. Based on the standards for Excellent Lecturer and Excellent Teacher prescribed at each level.
a) At the grassroots level: Evaluate teaching performance through competitions and inspections combined with the completion of annual tasks according to the standards for Excellent Lecturer and Excellent Teacher prescribed in this Circular.
b) At the Ministry of National Defense level: Establish a Ministry-level Council to review applications based on the standards for Excellent Lecturer and Excellent Teacher prescribed in this Circular.
2. Ensuring accuracy, fairness, transparency, democracy, objectivity, substance, and honesty.
3. In accordance with the Party's guidelines and State policies, laws, and regulations of the Ministry of National Defense.
4. The results of the examination for the title of Excellent Lecturer and Excellent Teacher at the grassroots level must be reviewed by the same-level Party Committee before being compiled and reported to the competent authority for consideration and decision.
Article 5. Time for Examination, Recognition, and Awarding of the Decision and Certificate for the Title of Excellent Lecturer and Excellent Teacher
1. Examination and recognition of the title: Grassroots level conducts once per academic year, completed before July 31 each year; Ministry of National Defense level conducts every two years, completed before October 31 of the examination year.
2. Organize the awarding of the decision and certificate for the title during the Teachers' Day on November 20; schools award the grassroots level decision and certificate; the Ministry of National Defense awards the Ministry-level decision and certificate.
Article 6. Funding to ensure the tasks of examining, recognizing, and awarding monetary bonuses for the title of Excellent Lecturer and Excellent Teacher
1. The funding shall be sourced from the State budget allocated annually for regular defense expenditure (item Training at academies and schools) in the annual budget plan.
2. The amount of the monetary bonus (calculated based on the current basic salary): For the title at the grassroots level, it is equivalent to 0.3 times one month's salary; for the title at the Ministry of National Defense level, it is equivalent to 1.0 times one month's salary.
Chapter II
EXCELLENT LECTURER AND TEACHER TITLE AT THE GRASSROOTS LEVEL
Section 1
CRITERIA FOR EXCELLENT LECTURER AND TEACHER TITLE AT THE GRASSROOTS LEVEL
Article 7. General criteria
1. Political quality, ideology, morality
a) Possess firm political resolve, absolutely loyal to the country, people, Party, and State. Master and apply correctly the fundamental viewpoints of Marxism-Leninism and Ho Chi Minh Thought, strictly implement the Party’s guidelines and policies, State laws, military regulations, unit rules, and local regulations where residing.
b) Have good moral character, set a good example, lead a clean and healthy lifestyle, and gain the trust of the school collective, department (discipline), and students.
c) Be rated as having satisfactorily fulfilled duties or better during the academic year; for kindergarten teachers, they must meet the professional standards as specified, achieving a Good rating or higher.
2. Educational qualifications
Meet the educational qualifications currently stipulated for the position held, possess a degree in teaching training or have relevant certificates as prescribed by the State and the Ministry of National Defense.
3. Teaching
a) Achieve the standard teaching hours for the academic year as prescribed by the Ministry of National Defense for educators.
b) Have continuously taught for at least three years before submitting the application for examination and recognition of the title of Excellent Lecturer or Excellent Teacher.
c) Possess high professional expertise, pedagogical skills, and teaching methods. The practical teaching results must achieve an Excellent rating or higher in the school-organized teaching contest of the academic year.
d) The learning outcomes of the student units (classes) taught by the educator in the academic year: At least 90% meet the requirements, with more than 50% achieving Good or Excellent ratings.
4. Research
Achieve the research standard for the academic year as prescribed by the Ministry of National Defense for educators, including meeting the research criteria stipulated in Clause 8 of this Circular.
Article 8. Research criteria
1. For educators at academies, officer schools, and universities: In the academic year under review, they must meet the criteria specified in Point a and one of the criteria specified in Points b, c, or d of this Clause.
a) Lead author of one scientific article published in specialized or interdisciplinary journals, conference proceedings at the school level or higher.
b) Lead or participate in two research projects or initiatives at the grassroots level (school level) or higher that have been accepted and evaluated as Achieved or higher.
c) Lead editor or participate in editing one textbook or reference book used in teaching for the training targets of the school, or lead author of one specialized or reference book used in teaching.
d) Supervise one graduate student or one specialist doctorate or intern doctorate student, or two undergraduate students who successfully defended their graduation thesis, project, or final paper, or one student who won a third prize or higher in national or international competitions, creative youth awards, or participated in the Olympics, or one student who conducted a grassroots-level research project that was evaluated and accepted as Achieved or higher.
2. For educators at colleges, secondary schools, military district schools, corps schools, Command of Hanoi, Command of Ho Chi Minh City, and sub-officer schools: In the academic year under review, they must meet one of the following criteria:
a) Lead or participate in two research projects or initiatives at the grassroots level or higher that have been accepted and evaluated as Achieved or higher.
b) Lead or participate in editing one textbook or teaching material used in teaching for the training targets of the school.
Section 2
3. For educators at kindergartens, in the academic year under review, they must lead one measure to improve education and training quality that has been effectively applied in teaching, childcare, and educational management, and is rated as Good or higher by the Evaluation Board, or win an award in kindergarten teacher excellence contests at the county, general department, or equivalent level.
PROCEDURES FOR APPLICATION, EXAMINATION, AND RECOGNITION OF THE TITLE OF EXCELLENT LECTURER AND TEACHER AT THE GRASSROOTS LEVEL
Article 9. Personal file of teachers
1. Application form according to Model No. 02 in Appendix I issued together with this Circular.
2. Record of achievements according to Model No. 03 in Appendix I issued together with this Circular.
3. Documents as prescribed in Appendix II issued together with this Circular.
4. The teacher's file shall be bound into a volume with A4 size paper, blue cover, without hard binding, arranged according to Model No. 01 in Appendix I issued together with this Circular.
Article 10. Examination and recommendation process at department and faculty level
1. Department/faculty level
a) Teachers base on the criteria stipulated in this Circular voluntarily prepare three sets of files and submit them to the department/faculty for examination and recognition of the titles of Excellent Lecturer and Excellent Teacher.
b) The head of the department/faculty organizes a meeting of all teachers in the department/faculty to examine whether the teachers meet the prescribed criteria.
c) A secret ballot is conducted to obtain trust votes. Teachers who receive 90% or more trust votes compared to the total number of teachers in the department/faculty will be reported to the faculty; the file includes: Nomination list according to Model No. 05 in Appendix I issued together with this Circular, along with the teacher's file as prescribed in Article 9 of this Circular.
d) For educational management staff, the examination and recommendation process shall be carried out as prescribed in points a and b of this Clause.
2. Faculty level
a) The faculty head organizes a meeting of all teachers in the faculty to examine and recommend the titles of Excellent Lecturer and Excellent Teacher at the institutional level.
b) A secret ballot is conducted (for kindergartens, opinions from all teachers in the kindergarten are sought). Teachers who receive 90% or more trust votes compared to the total number of teachers in the faculty will be recommended to the institutional council; the file includes: Documents prescribed in point b of Clause 1 of this Article; Minutes of the examination and recommendation meeting according to Model No. 06; Minutes of the examination and recommendation vote counting according to Model No. 07; Voting ballots according to Model No. 08; List of teachers recognized the title according to Model No. 09 in Appendix I issued together with this Circular.
Article 11. Examination and recommendation process at institutional level
1. Institutional Council
a) The Director or Principal of the school decides to establish the Institutional Council with a membership of 11 to 17 people. The Council consists of: Chairman, Vice Chairmen, Secretary Members, and Members; among which, the Director or Principal or Political Commissar, Deputy Director, or Deputy Principal serves as the Chairman of the Council, the Deputy Chairmen of the Council are Deputy Directors, Deputy Principals, or Deputy Political Commissars; the Members of the Council include: Heads of training units as Secretary Members and Heads of other units, heads of specialized departments. The Institutional Council of kindergartens is established by the kindergarten management level.
b) Teachers registering and submitting files for examination and recognition of the titles of Excellent Lecturer and Excellent Teacher do not participate in the Council.
c) The Council operates based on democratic, transparent principles, and secret ballot voting. Meetings of the Council must have at least two-thirds of members present. Absent members must be approved by the Chairman of the Council and their ballots must be sent to the Council for consideration at the session to ensure full participation.
d) The Council may use the seal of the authority that decides to establish the Council.
e) The Training Unit is the permanent body of the Council.
2. The Chairman of the Council decides to establish a Secretariat to assist the Council.
3. Reviewing files
a) The permanent body of the Council compiles recommendations from departments and hands over files to the Secretariat for review.
b) The Secretariat reviews the accuracy and validity of the files and the criteria of teachers as prescribed, reports to the Chairman of the Council the results of reviewing teachers who meet and do not meet the criteria for examination and recognition of the titles of Excellent Lecturer and Excellent Teacher, and proposes the Chairman of the Council to publicly announce and post on the school's website the results of the Secretariat's review, no later than 10 days before organizing the Council meeting.
c) The Secretariat compiles and unifies the list of teachers who meet and do not meet the criteria for examination and recognition of the titles of Excellent Lecturer and Excellent Teacher, reports to the Chairman of the Council; sends files and documents to Council members and prepares for the Council meeting.
4. Holding the Council meeting and completing files
a) The Council examines and discusses the criteria of teachers participating in the examination and recognition of Excellent Lecturer and Excellent Teacher; the Council examines suggestions from organizations and individuals (if any), votes to approve the list of those who meet and do not meet the criteria.
b) A secret ballot is conducted to obtain trust votes for teachers proposed for recognition of the titles of Excellent Lecturer and Excellent Teacher at the institutional level. Teachers who receive two-thirds or more trust votes compared to the total number of Council members will be included in the list of those proposed for recognition of the titles of Excellent Lecturer and Excellent Teacher at the institutional level.
c) The Secretariat completes the report and recommends the authorized person to issue a decision recognizing the titles according to Clause 5 of this Article.
5. Authority to decide on recognition of the titles of Excellent Lecturer and Excellent Teacher at the institutional level
a) For schools under the Ministry of National Defense: Based on the recommendation of the institutional council, the Director or Principal signs the decision recognizing and issuing certificates for the titles of Excellent Lecturer and Excellent Teacher at the institutional level.
b) For schools not under the Ministry of National Defense: Based on the recommendation of the institutional council, the Director or Principal reports in writing to the Head of the school management level to sign the decision recognizing and issuing certificates for the titles of Excellent Lecturer and Excellent Teacher at the institutional level.
c) For kindergartens, the school management level signs the decision and issues certificates for the title of Excellent Teacher at the institutional level.
6. Certificate for the titles of Excellent Lecturer and Excellent Teacher at the institutional level according to Model No. 10 in Appendix I issued together with this Circular.
Chapter III
EXCELLENT LECTURER AND EXCELLENT TEACHER TITLES AT THE MINISTRY OF NATIONAL DEFENSE LEVEL
Section 1
CRITERIA FOR EXCELLENT LECTURER AND EXCELLENT TEACHER TITLES AT THE MINISTRY OF NATIONAL DEFENSE LEVEL
Article 12. General Standards
1. Political quality, ideology, morality
a) Possess firm political resolve, absolutely loyal to the country, people, Party, and State. Master and apply correctly the fundamental viewpoints of Marxism-Leninism and Ho Chi Minh Thought, strictly implement the Party’s guidelines and policies, State laws, military regulations, unit rules, and local regulations where residing.
b) Have good moral character, set a good example, lead a clean and healthy lifestyle, and gain the trust of the school collective, department (discipline), and students.
c) The years of study must be evaluated to rank officers as having satisfactorily fulfilled their duties or better; for kindergarten teachers, the years of study must meet the professional standards at the Good level or higher.
2. Have three consecutive years, or four non-consecutive years achieving the title of Excellent Lecturer, Excellent Teacher at the base level, including a year adjacent to or coinciding with the year applying for the title of Excellent Lecturer, Excellent Teacher at the Ministry of National Defense level; specifically for kindergarten teachers, have one year achieving the title of Excellent Teacher at the national level organized by the Political Bureau or achieving the title of Excellent Teacher at the provincial or municipal level or higher. The subsequent review does not count achievements from the previous recognized review.
3. Meet the research criteria stipulated in Article 13 of this Circular.
Article 13. Research Standards
1. For educators at academies, officer schools, universities, by the year of application, must meet the following criteria:
a) Lead author of three scientific articles published in specialized, interdisciplinary journals, conference proceedings at the school level or higher.
b) Lead one research project or two scientific initiatives at the base level (approved by the Chief of the General Staff, the Chief of the Political Bureau, the Chief of the bureau, or the head of the management unit) or participate in two research projects at the ministry level or higher that have been accepted and rated as Achieved or higher.
c) Lead editor of two or participate in editing three textbooks, teaching materials, or lead author of two reference books, monographs used in teaching for the training targets of the school.
2. For educators at colleges, secondary schools; military schools of military regions, corps, Command of Hanoi Capital, Command of Ho Chi Minh City, sub-officer schools, by the year of application, must meet the following criteria:
a) Lead author of two articles published in specialized journals, research conference proceedings at the base level.
b) Lead two or participate in three research projects, scientific initiatives at the base level or participate in two research projects, scientific initiatives at the base level (approved by the Chief of the General Staff, the Chief of the Political Bureau, the Chief of the bureau, or the head of the management unit) that have been accepted and rated as Achieved or higher.
c) Lead editor of one or participate in editing two textbooks, teaching materials used in teaching for the training targets of the school.
3. For educators at kindergarten schools, by the year of application, must meet the following criteria: Lead two measures to improve the quality of childcare, nutrition, education for children, educational management work, effectively applied in kindergarten education institutions, rated as Good or higher by the examination board at the district level, bureau level, or equivalent.
Section 2
PROCEDURES FOR REVIEWING AND AWARDED THE TITLE OF EXCELLENT LECTURER, EXCELLENT TEACHER AT THE MINISTRY OF NATIONAL DEFENSE LEVEL
Article 14. Documents for examination, proposal, and recognition at the Ministry of National Defense level
1. The documents include:
a) The teacher's application file in accordance with Article 9 of this Circular.
b) Documents according to Model Nos. 04, 05, 06, 07, 08, 09 attached as Appendix I to this Circular.
Article 15. Procedures for examination, proposal, and recognition at the Ministry of National Defense level
1. Council at the Ministry of National Defense level
- Chairperson: Comrade Chief of General Staff, Deputy Minister of National Defense.
- Vice-Chairpersons: One Comrade Deputy Chief of General Staff serving as the Permanent Vice-Chairperson; one Comrade Deputy Director of the Political General Department.
- Standing Members: Director of the School Administration Department.
- Member兼任书记长:学校管理局副局长一名。
- Members: 一名军事科学局局长;一名军力局局长;一名干部局局长;一名宣传局局长;军队妇女局局长;一些学校的校长或院长。
b) The Council operates on the principles of democracy, transparency, and secret ballot. Meetings of the Council must have at least two-thirds of its members present. Absent members must obtain permission from the Chairperson and submit their ballots to the Council for consideration during the session to ensure full participation.
c) Teachers who register and submit applications for examination and recognition of the titles of Excellent Instructor or Excellent Teacher do not participate in the Council.
d) The Council may use seals in accordance with the provisions of the law and regulations of the Ministry of National Defense.
2. The Chairperson of the Council decides to establish the Secretariat to assist the Council.
3. Reviewing files
a) The permanent office of the Council compiles the application files proposed by the grassroots councils and hands them over to the Secretariat for review.
b) The Secretariat reviews the accuracy and validity of the files and the teachers' standards as prescribed, reports to the Chairperson the results of the review regarding teachers meeting and not meeting the standards for examination and recognition of the titles of Excellent Instructor and Excellent Teacher, and proposes that the Chairperson seek opinions from relevant functional agencies and the schools with candidates applying for examination about the Secretariat's review results.
c) The Secretariat consolidates and unifies the list of teachers meeting and not meeting the standards for examination and recognition of the titles of Excellent Instructor and Excellent Teacher, reports to the Chairperson, sends the files and materials to the Council members, and prepares for the Council session at the Ministry of National Defense level.
4. Holding the Council Session
a) The Council examines and discusses the standards of the teachers proposed for examination and recognition of the titles of Excellent Instructor and Excellent Teacher; the Council considers the recommendations of organizations and individuals (if any), votes to approve the list of those meeting and not meeting the standards.
b) A confidence vote is conducted through a secret ballot for teachers proposed for recognition of the titles of Excellent Instructor and Excellent Teacher at the Ministry of National Defense level. Teachers receiving two-thirds or more of the confidence votes compared to the total number of Council members will be included in the list proposed for examination and recognition of the titles of Excellent Instructor and Excellent Teacher at the Ministry of National Defense level.
c) The Secretariat completes the files, and the permanent office reports to the Chairperson to sign the document proposing the Minister of National Defense to decide on the recognition of the titles of Excellent Instructor and Excellent Teacher at the Ministry of National Defense level.
5. Certificate of the title of Excellent Instructor and Excellent Teacher at the Ministry of National Defense level according to Model No. 11 attached as Appendix I to this Circular.
Chapter IV
RESPONSIBILITIES OF ORGANIZATIONS, UNITS, AND INDIVIDUALS
Article 16. General Staff Department
1. To take the lead, advise, and assist the Central Military Commission and the Minister of National Defense in leading and directing the work of examination and recognition of the titles of Excellent Instructor and Excellent Teacher in conjunction with the plan for developing the teaching staff in the military.
a) To advise and assist the Heads of the Ministry of National Defense and the General Staff Headquarters in guiding and directing the training and development of the teaching staff and educational management personnel in military schools.
b) To perform the function of the permanent office of the Council at the Ministry of National Defense level, with the responsibility of guiding and inspecting military schools in implementing the examination and proposal for recognition of the titles of Excellent Instructor and Excellent Teacher within the Ministry of National Defense.
c) To take the lead and coordinate with relevant agencies and units to prepare materials for the Council to convene meetings for examination and recognition of the titles of Excellent Instructor and Excellent Teacher at the Ministry of National Defense level.
đ) To take the lead and coordinate with relevant agencies and units to organize the ceremony for presenting the Decision and Certificate of the titles of Excellent Instructor and Excellent Teacher at the Ministry of National Defense level.
3. Direct the Military Personnel Bureau to review the moral character of teachers proposed for examination and recognition of the titles of Excellent Instructor and Excellent Teacher under the jurisdiction of the military personnel bureau.
Article 17. The Political General Department
1. To advise and assist the Central Military Commission and the Minister of National Defense in the work of examination and recognition of the titles of Excellent Instructor and Excellent Teacher in conjunction with the plan for developing the teaching staff and educational management personnel in the military.
2. Direct the Cadre Bureau
Review the moral character of teachers being considered for recognition of the title of Excellent Lecturer or Excellent Teacher at the Ministry of National Defense level under the management of personnel agencies.
To promote the construction of teacher teams and the competition movement in military schools. Coordinate with the School Administration Department and schools, agencies, and units to implement award activities in accordance with regulations.
4. Direct the Women's Military Department
To review the expertise of teachers being considered for recognition of the title of Excellent Teacher at the Ministry of National Defense level in military kindergartens.
Article 18. Military Schools
1. Develop resolutions and plans for training and improving the teaching staff and educational managers to meet established standards. Continuously pay attention to, care for, organize training, improvement, and discipline of teachers to enhance their capabilities and qualifications in all aspects; encourage and create conditions for teachers to strive for titles such as Excellent Lecturer and Excellent Teacher at various levels, contributing to improving the quality of education, training, and scientific research.
2. Annually organize lectures and teaching competitions for excellent lecturers and teachers within the school, ensuring strictness, seriousness, accuracy, transparency, democracy, and fairness.
3. Be responsible for the accuracy of the application files submitted to the higher-level Council.
Article 19. Responsibilities, Rights, and Obligations of Excellent Lecturers and Teachers
1. Bear legal responsibility for the accuracy and honesty of information declared in the application file for recognition of the title of Excellent Lecturer or Excellent Teacher.
2. Receive certificates of Excellent Lecturer or Excellent Teacher along with monetary rewards; be considered for awards according to regulations; receive attention and support in teaching, scientific research, and further education to improve comprehensive qualities; enjoy other benefits as stipulated by the State and the Ministry of National Defense.
3. Continue to study, train, and improve in all aspects, fully utilizing the role of Excellent Lecturer or Excellent Teacher to effectively perform teaching and scientific research tasks, striving for higher titles; continuously perfect knowledge and pedagogical talent, serving as exemplary models for students and colleagues.
Chapter V
IMPLEMENTING PROVISIONS
Article 20. Effective Date
This Circular takes effect from March 15, 2022.
2. Decision No. 130/2005/QĐ-BQP dated September 1, 2005, of the Minister of National Defense on criteria, procedures for examination and recognition of the title of Excellent Lecturer and Excellent Teacher in the Military shall cease to be effective from the date this Circular takes effect.
Article 21. Responsibility for Implementation
The Chief of General Staff, heads of agencies, units, and related individuals are responsible for implementing this Circular./.
