Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Environmental Protection Law dated November 17, 2020;

Pursuant to Decree No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing certain provisions of the Law on Environmental Protection;

At the proposal of the Minister of Natural Resources and Environment;

The Prime Minister issues this Decision on the List of Waste Materials Permitted for Import from Abroad as Raw Materials for Production.

Article 1. Attached to this Decision is the List of Waste Materials Permitted for Import from Abroad as Raw Materials for Production.

Article 2. Organizations and individuals directly importing waste materials as raw materials for production shall only import such waste materials as raw materials for their own facilities according to the designed capacity to produce products and goods.

Article 3. Transitional Provisions

1. Waste paper with HS code 4707 90 00 is permitted to be imported from abroad under environmental component permits (Certificates confirming compliance with environmental protection conditions in the import of waste materials as raw materials for production) issued by competent authorities before the effective date of this Decision may continue to be imported until the expiration date of the environmental component permit.

2. Waste materials and scraps of plastic with HS code 3915 90 00 are permitted to be imported from abroad under environmental component permits or environmental permits issued by competent authorities before the effective date of this Decision may continue to be imported until the expiration date of the environmental component permit or environmental permit corresponding to the HS codes specified in Section 2.3 or Section 2.5 of the List of Waste Materials Permitted for Import from Abroad as Raw Materials for Production attached to this Decision.

3. Types of waste materials permitted to be imported from abroad under environmental component permits or environmental permits issued by competent authorities before the effective date of this Decision, which have different names (but the HS code remains unchanged) compared to this Decision, may continue to be imported until the expiration date of the environmental permit or environmental component permit.

Article 4. Implementation provisions

1. This Decision takes effect from June 1, 2023, and replaces Decision No. 28/2020/QD-TTg dated September 24, 2020.

2. From the effective date of this Decision, the importation of small iron ore slag (iron sand) from the iron or steel industry (HS code 2618 00 00) as raw material for cement production shall be carried out in accordance with the laws governing construction materials.

3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and related organizations and individuals are responsible for implementing this Decision.
