The Minister of Science and Technology issues this Circular to regulate the delegation of authority for issuing, extending, reissuing, amending, supplementing, revoking telecommunications licenses, and requiring cessation of telecommunications service provision activities.

This Circular regulates the delegation of authority for issuing, extending, reissuing, amending, supplementing, revoking telecommunications licenses, and requiring cessation of telecommunications service provision activities as provided for in Clause 4, Article 33 of the Telecommunications Law, except for cases stipulated in Article 4 of Decree No. 133/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and delegation of authority in the field of state management by the Ministry of Science and Technology.

Pursuant to the Law on Telecommunications dated November 24, 2023;

Pursuant to the Government Organization Law on February 18, 2025;

Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 163/2024/NĐ-CP dated December 24, 2024 of the Government detailing certain provisions and implementing mechanisms of the Law on Telecommunications;

Pursuant to Decree No. 133/2025/NĐ-CP dated June 12, 2025 of the Government stipulating decentralization and delegation of authority in the field of state management by the Ministry of Science and Technology;

At the proposal of the Director of the Telecommunications Department;

This Circular applies to agencies, organizations, and individuals related to the issuance, extension, reissuing, amending, supplementing, revoking of telecommunications licenses, and requiring cessation of telecommunications service provision activities.

Article 3. Delegation of Authority for Issuing, Extending, Reissuing, Amending, Supplementing, Revoking Telecommunications Licenses  The Minister of Science and Technology delegates to the Telecommunications Agency the authority to issue, extend, reissue, amend, supplement, and revoke telecommunications licenses as follows:

Article 2. Applicability

1. Telecommunications service provision licenses without network infrastructure, except for cases stipulated in Clause 1, Article 4 of Decree No. 133/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and delegation of authority in the field of state management by the Ministry of Science and Technology.

3. Test network and telecommunications service licenses.

4. Licenses for establishing private telecommunications networks.

Article 4. Delegation of Authority for Requiring Cessation of Telecommunications Service Provision Activities

The Minister of Science and Technology delegates to the Telecommunications Agency the authority to require cessation of telecommunications service provision activities from enterprises that have been issued certificates of registration for telecommunications service provision by the Telecommunications Agency and have submitted notifications of telecommunications service provision.

Article 5. Responsibilities of the Telecommunications Agency

The Telecommunications Agency is responsible before the law and the Minister of Science and Technology for the results of exercising delegated authority; it must periodically report and evaluate the implementation of assigned tasks and shall not further delegate authority as prescribed in this Circular.

1. This Circular takes effect from September 1, 2025.

2. Provisions on delegating authority for issuing, extending, reissuing, amending, supplementing, revoking telecommunications licenses, and requiring cessation of telecommunications service provision activities cease to be effective from the date this Circular takes effect.

1. The Head of the Office, the Director of the Telecommunications Agency, the Heads of agencies and units under the Ministry of Science and Technology, and relevant organizations and individuals are responsible for implementing this Circular.

Article 6. Effectiveness

2. During the implementation process, if there are any difficulties, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Science and Technology (Telecommunications Agency) for guidance or consideration and resolution./.

2. Provisions regarding the delegation to implement the issuance, extension, reissuance, amendment, supplementation, revocation of telecommunications licenses, and the requirement to terminate the provision of telecommunications services shall cease to be effective from the date this Circular takes effect.

Article 7. Implementation Organization

1. The Director of the Office, the Director of the Telecommunications Department, the Heads of agencies and units under the Ministry of Science and Technology, and related organizations and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly reflect these issues to the Ministry of Science and Technology (Telecommunications Department) for guidance or consideration and resolution./.
