CIRCULAR

DECISION NO. 13-TC/ĐT OF FEBRUARY 2, 1993 OF THE MINISTRY OF FINANCE GUIDING AMENDMENTS AND SUPPLEMENTS TO THE DECISION ON COMPENSATION FOR DAMAGE TO AGRICULTURAL LAND AND FORESTED LAND WHEN TRANSFERRED FOR OTHER USES

Pursuant to Decision No. 186-HĐBT dated May 31, 1990 of the Council of Ministers (now the Government) on compensation for damage to agricultural land and forested land when transferred for other uses, on June 5, 1992, the Ministry of Finance issued Circular No. 18-TC/ĐT guiding the implementation of the aforementioned Decision. After a period of implementation and upon the request of some sectors and localities, the Ministry of Finance guides amendments and supplements to certain points in Circular No. 18-TC/ĐT dated June 5, 1992 as follows:

1. The investment unit must pay compensation for damage to agricultural land and forested land into the State Budget before the land management agency allocates land to organizations and individuals for use. The method of "recorded income, recorded expenditure" shall not be applied to projects funded by the State Budget. When settling accounts for the project, the investor and the supervising investor must settle the compensation payment for damage to land into the value of the project to accurately reflect the value of fixed assets.

Units and enterprises allocated land for use have the obligation to pay compensation for damage to land into the State Budget. Financial agencies and the National Treasury shall allocate the budget revenue from the compensation for damage to land according to the following ratios:

- Central budget: 30%

- Local budget: 70%

3. People's Committees of provinces and centrally-administered cities are responsible for guiding the management and use of the compensation for damage to land (the portion allocated to the local budget) in accordance with Decision No. 186-HĐBT dated May 31, 1992 of the Council of Ministers (now the Government).

This Circular takes effect from the date of issuance.

Any issues arising during implementation should be reported to the Ministry of Finance for consideration and resolution./.
