Article 24Regulations on management and traceability of forest products
Circular No. 26/2022/TT-BNNPTNT dated December 30, 2022, issued by the Minister of Agriculture and Rural Development, stipulates regulations on management and traceability of forest products, which took effect from February 15, 2023, and was amended and supplemented by:
Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development, amending and supplementing certain provisions of circulars in the forestry sector.
Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Forestry Law dated November 15, 2017;
At the proposal of the Director General of the Forest Administration;
The Minister of Agriculture and Rural Development issues this Circular to regulate management and traceability of forest products1.
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates on:
1. Procedures and formalities for harvesting common forest plants and common forest animals.
2. Legal forest product files, management, and traceability of forest products.
3. Marking specimens of species listed in the Catalogue of Endangered, Precious, and Rare Forest Plants and Animals; wild flora and fauna species listed in Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), except aquatic species.
Article 2. Applicability
This Circular applies to organizations, individuals, business households, family households, and community residents involved in activities related to the contents prescribed herein. Article 1 of this Circular.
Article 3. Explanation of Terms
1. The local Forest Protection Agency is the District-level Forest Protection Agency or the Provincial-level Forest Protection Agency in areas without a District-level Forest Protection Agency.
2. Roundwood is raw wood, still retaining its original shape after harvesting, not yet cut into pieces or already cut into pieces, peeled wood, pithed wood (only the heartwood remains), with dimensions falling under one of the following cases:2:
a) Wood with a small end diameter from 10 centimeters (cm) to less than 20 cm and a length of 1 meter (m) or more;
b) Wood with a small end diameter of 20 cm or more and a length of 30 cm or more;
c) Planted forest wood, mangrove wood, saltwater forest wood with a small end diameter of 6 cm or more and a length of 1 m or more.
3.3 Sawn timber and carved timber is wood that has been processed into shapes such as planks, sheets, boxes, round logs, polygonal columns, or other shapes, except peeled wood.
4. Non-wood forest plants include: species belonging to the families of bamboo, rattan, palm, coconut, mulberry, and other forest shrubs; herbaceous forest plants; fungi, firewood, derivatives, and other parts of woody plants.
5. The forest product owner is an organization, individual, business household, family household, or community resident legally owning forest products according to the law.
6. The forest owner is an organization, individual, family household, or community resident granted forests or leased forests; allocated or leased land for planting forests; self-restored or developed forests; received transferred, donated, or inherited forests according to the law.
7. Harvesting common forest animals from nature is the activity of removing common forest animal individuals, eggs, larvae from their natural habitats.
8. Finished wood products are products made from wood assembled with all components according to the product's function or disassembled parts of the product, which can be immediately used upon assembly according to the product's function.
9. Common forest plants are those not included in the Catalogue of Endangered, Precious, and Rare Forest Plants and Animals and not listed in the CITES Appendices.
Article 4. Determination of quantity and volume of forest products
1. Method of measuring and calculating the volume of roundwood and sawn timber shaped into cylindrical forms4:
a) Length: Measure the shortest distance between the cross-sections at both ends of the log. If the cross-section at the end of the log is tilted or concave, measure at the position with the shortest length between the two ends of the log. The unit of measurement is meters, taking whole numbers and two decimal places after the units.
b) Diameter: Measure at both ends of the log (excluding bark); measure at two positions with the largest and smallest diameters at each end of the log, then calculate the average value to determine the diameter of each end of the log; the average diameter of the log is calculated by averaging the diameters of the two ends of the log; the unit of measurement is centimeters, taking whole numbers and one decimal place after the units.
c) Volume is determined based on the wood volume:
V = π/4 x (Dtb)2 x l
Where:
V: Volume in cubic meters (m3), taking whole numbers and three decimal places after the units
π: Constant pi (π = 3.14)
DtbD: Average diameter of the log (m)
l: Shortest distance between the two cross-sections (m)
d) The error in calculating the volume of wood in each measurement for each piece of roundwood or cylindrical log is ten percent (±10%).
2. Method of measuring and calculating the volume of sawn timber and carved timber shaped into rectangular planks, sheets, or boxes (cross-sectional and longitudinal cuts are square or rectangular):
a) Length: Measure the shortest distance between the cross-sections at both ends of each plank, sheet, or box of wood. The unit of measurement is meters, taking whole numbers and two decimal places after the units.
b) Width and thickness: Measure the distance between two opposite longitudinal sections of each plank, sheet, or box of wood. In cases where the wood surfaces are skewed or wavy, measure at the positions with the largest and smallest sizes and calculate the average value; the unit of measurement is centimeters, taking whole numbers and one decimal place after the units.
c) Volume is determined based on the wood volume:
V = l x a x b
Where:
V: Volume (m3), taking whole numbers and three decimal places after the units
l: Shortest distance between the two cross-sections (m)
a: Width of the box (m)
b: Thickness of the box (m)
d) The error in calculating the volume of wood in each measurement for each plank, sheet, or box of sawn or carved timber is five percent (±5%).
3. Method of measuring and calculating the volume of sawn timber and carved timber shaped into polygonal column forms:
a) Length: Measure the shortest distance between the cross-sections at both ends of the polygonal column. The unit of measurement is meters, taking whole numbers and two decimal places after the units.
b) Calculate the cross-sectional area: It is the average value of the largest and smallest cross-sectional areas of the polygonal column. The unit of measurement is square meters (m2), taking whole numbers and two decimal places after the units.
c) Volume is determined based on the wood volume:
V = l x S
Where:
V: Volume (m3), taking whole numbers and three decimal places after the units
l: Shortest distance between the two cross-sections (m)
S: Cross-sectional area of the polygonal block (m2)
d) The error in calculating the volume of wood in each measurement for each polygonal column is five percent (±5%).
4. Method of measuring and determining the volume of tree trunks5:
a)6 Height:
For trees with roots, trunks, branches, and leaves intact: measure the total height of the tree from the ground level at the base to the point where the trunk has a diameter of 6 cm at the top.
For trees with roots, trunks, branches, and leaves but the top has been cut off: measure the total height from the ground level at the base to the cutting point at the top.
In the case where the tree still has a trunk, top, branches, and leaves but has been cut at the root: measure the total length from the cutting surface of the root to the position where the diameter of the tree is 6 cm.
In the case where the tree has multiple trunks or branches: measure the length of each section of the trunk or branch that meets the circular wood size requirements specified in this Circular.
The unit of measurement is meters, with whole numbers and two decimal places after the units.
b)7 Diameter: Measure the circumference to determine the diameter at the 1.3-meter mark from the cross-section of the root; for trees with multiple trunks or branches meeting the circular wood size requirements specified in this Circular, measure the circumference of each wooden trunk. The unit of measurement is centimeters, with whole numbers and one decimal place after the units.
c) Volume is determined according to the volume of the wood:
C = (C21.3/4π) x Hvn x f
Where:
V: Wood volume calculated by volume (m3) with whole numbers and three decimal places after the units
C1.3: Circumference at the 1.3-meter mark of the tree (m)
π: Pi constant (π=3.14)
Hvn: Total length of the tree measured from the root to the top (m)
f: Form factor of the tree trunk (for planted forest trees, the value of f is 0.5; for natural forest trees, the value of f is 0.45).
d) The volume calculation error for each measurement of individual trees is ten percent (±10%).
5. In the case of hollow or decayed wood, record the weight of the hollow and decayed parts in the Forest Products Inventory Table.
6.8 For wood not falling under the provisions of Clause 2 Article 3, Clause 3 Article 4 of this Circular; trees whose diameter cannot be determined at the 1.3-meter mark; roots, stumps, wood with complex shapes, non-uniform wood; peeled wood, wood chips, wood that cannot be measured for dimensions should be weighed, with the unit of measurement being kilograms (kg) or calculated in stere; convert 1000 kg to 01 m3 of roundwood or convert 01 stere to 0.7 m3 of roundwood.
7. The unit of measurement for animals is the number of individuals, for animal eggs it is the number of fruits; if the quantity cannot be determined, weigh using kilograms (kg).
8.9 The unit of measurement for non-wood forest plants is kilograms (kg) or stere; forest products belonging to the families of bamboo, rattan, palm, mulberry, and coconut are determined by the number of plants or by weighing, with the unit of measurement being kilograms (kg); parts of wild animals are determined by kilograms (kg).
9. Derivatives of animals and plants are determined by kilograms (kg), meters (m3), liters, or milliliters (ml).
10.10 Number logs, sections, boxes, planks of roundwood, round-shaped peeled wood according to the specifications set out in Point a, Point b Clause 2 Article 3 of this Circular; sawn timber, box-shaped peeled wood with a length of 1 meter or more, width of 20 cm or more, thickness of 5 cm or more; sawn timber, peeled timber shaped into polygonal cylindrical forms; timber listed in Appendix CITES or endangered, precious, rare species group IA, IIA regardless of size.
Article 5. Forest Products Inventory Table
1. Subjects establishing the Forest Products Inventory Table:
a) The owner of forest products or organizations and individuals authorized by the owner of forest products to establish after harvesting;
b) The owner of forest products establishes when selling, transferring ownership rights, transporting, exporting forest products in the same transaction and on the same transport means; when preparing documents to apply for export permits for forest products;
c) The person with authority establishes when preparing documents to handle violations related to forest products;
d) Agencies assigned to handle assets after confiscation establish when auctioning.
2. Establishing the Forest Products Inventory Table:
a) Organizations and individuals specified in Clause 1 of this Article establish the Forest Products Inventory Table corresponding to the Form No. 01, 02, 03, 04 and 05 in the Appendix issued together with this Circular:
Detail for sections, logs of roundwood, round-shaped peeled wood according to the specifications set out in Point a, Point b Clause 2 Article 3 of this Circular; sawn timber, box-shaped peeled wood with a length of 1 meter or more, width of 20 cm or more, thickness of 5 cm or more; sawn timber, peeled timber shaped into polygonal cylindrical forms.
Summarize the total quantity and volume for roundwood not meeting the specifications set out in Point a, Point b Clause 2 Article 3 of this Circular; sawn timber, box-shaped peeled wood with a length less than 1 meter, width less than 20 cm, thickness less than 5 cm; plantation timber.
Detail or summarize the total quantity and volume for each type of non-wood forest products suitable to reality.
At the end of each page of the Forest Products Inventory Table, record the total volume of forest products;
b) Organizations and individuals establishing the Forest Products Inventory Table are responsible under the law for the contents declared and the legal origin of forest products in the Forest Products Inventory Table.
3.11 Forest products must confirm the Forest Products Inventory Table, including:
a) Common wood harvested from natural forests;
b) Forest products after confiscation;
c) Plants listed in the List of Endangered, Precious, Rare Forest Plants; plants listed in Appendix CITES;
d) Wild animals and parts, derivatives, products of wild animals with natural origins, imports, or breeding; critically endangered wild animals listed in Appendix CITES, excluding aquatic species;
đ) Forest products not falling under the cases stipulated in Points a, b, c, and d of this Clause upon request of the owner of forest products.
4.12 Roundwood of enterprises classified as Group I according to the regulations of the Vietnam Timber Legality Assurance System when buying, selling, transferring ownership rights, transporting does not require confirmation of the Forest Products Inventory Table, except when the enterprise requests confirmation according to Point đ Clause 3 of this Article.
5. Finished products produced and processed from crocodile, species belonging to Group IIB in the List of Endangered, Precious, Rare Forest Plants, species listed in Appendices II and III of CITES marked with specimen numbers below five products when buying, selling, transferring ownership rights, transporting do not need to establish the Forest Products Inventory Table.
6. Authority to confirm the Forest Products Inventory Table: Local Forest Protection Agency.
7. Documents:
a) Original Application for Confirmation of the Forest Products Inventory Table according to Form number 06 in the Appendix issued together with this Circular;
b) Original Forest Products Inventory Table established in accordance with Clause 2 of this Article;
c) Copy of the Harvest Plan according to Article 6 or Article 7 of this Circular for cases where confirmation is requested after exploitation;
d) A copy of the import timber product file as prescribed at Article 16 of this Circular for cases where the importer of timber products sells or transfers ownership rights;
đ) A copy of the post-seizure timber product file as prescribed at Article 17 of this Circular for cases where the owner of timber products purchases directly from the agency responsible for handling assets, sells, or transfers ownership rights again;
e) A copy of the List of timber products bought and sold, or ownership rights transferred immediately prior;
g) A copy of the origin file of timber products for cases where confirmation is requested according to the provisions of point đ clause 3 of this Article;
h)|||13 The original Timber Import and Export Register for owners of timber products who are organizations or business households selling timber products according to Form No. 07 The Appendix issued together with this Circular for cases where the timber products are forest plants. The original Breeding Record for the owner of breeding facilities selling wild animals according to the Government's regulations on managing endangered, precious, and rare forest plants and animals, and implementing the Convention on International Trade in Endangered Wild Fauna and Flora.
8. Procedure for implementation:
a) The owner of timber products or organizations, individuals authorized by the owner of timber products submit directly or through postal services or electronic environment one set of files corresponding to each type of timber products requesting confirmation as prescribed in clause 7 of this Article to the local Forest Protection Agency. In cases where the owner of timber products creates a Quick Response (QR) code containing the timber product file in the List of timber products, they are not required to submit the files prescribed in points c, d, đ, e, and g of clause 7 of this Article. In cases where files are submitted through the electronic environment, they shall be implemented according to the provisions of Decree No. 45/2020/ND-CP dated April 8, 2020, of the Government on implementing administrative procedures in the electronic environment (hereinafter referred to as Decree No. 45/2020/ND-CP).
b) Time limit for responding to the validity of the file components:
For direct submission of files: The local Forest Protection Agency checks the file components and immediately responds to the validity of the file components for the owner of timber products or organizations, individuals authorized by the owner of timber products.
For submission of files through postal services or the electronic environment: Within one working day from the date of receipt of the files, the local Forest Protection Agency examines the validity of the file components; if the files are invalid according to the regulations, it will notify in writing and specify the reasons;
c) Within two working days from the date of receipt of valid files, the local Forest Protection Agency confirms the List of timber products; confirms the existence of timber products in the Timber Import and Export Register for cases prescribed in point h clause 7 of this Article. If verification of the origin of timber products is necessary, within one working day from the date of receipt of valid files, the local Forest Protection Agency notifies the owner of timber products about the verification; within three working days from the notification date, the local Forest Protection Agency conducts verification, prepares the Verification Report according Form No. 08 at the Appendix issued together with this Circular and completes the confirmation of the List of timber products; confirms the existence of timber products in the Timber Import and Export Register; in cases with many complex contents, verification and confirmation are completed within no more than seven days. If confirmation is not made, it will respond in writing and specify the reasons;
d)14 After confirming the List of timber products and confirming the existence of timber products, the local Forest Protection Agency returns the original List of timber products, Timber Import and Export Register, and Breeding Record confirmed to the owner of timber products or organizations, individuals authorized by the owner of timber products.
9. The local Forest Protection Agency bears responsibility under the law when confirming the List of timber products; establishes and updates the confirmation into the register of confirmed Lists of timber products according Form No. 09 at the Appendix issued together with this Circular; retains copies of the confirmed List of timber products and timber product files as prescribed in clause 7 of this Article.
Chapter II. PROCEDURE AND PROCEDURES FOR EXPLOITING COMMON FOREST PLANTS AND COMMON WILD ANIMALS
Section 1. APPROVAL OF FOREST HARVESTING PLANS
Article 6. Approval of harvesting plans for common forest plants15
1. Cases for approval of harvesting plans:
a) Harvesting to utilize wood from common forest plant species in natural forests;
b) Harvesting to collect residual wood from common forest plant species in natural forests;
c) Harvesting non-wood products from common forest plant species in natural special-purpose forests;
d) Collecting samples of common forest plants for scientific and technological research from special-purpose forests;
đ) Main harvesting, harvesting to utilize, and harvesting to collect residual wood from common forest plant species in production forests that are planted forests owned by the State as the representative owner;
e) Main harvesting, harvesting to utilize, and harvesting to collect residual wood from common forest plant species in protective forests that are planted forests;
g) Harvesting to utilize and harvesting to collect residual wood from common forest plant species in planted special-purpose forests, except for cases where harvesting is carried out to implement tasks of approved scientific and technological research programs and topics;
2. Authorities with approval power:
a) The competent ministry or sector approves harvesting plans to utilize, to collect residual, and to collect samples for cases specified in points a, b, c, d, and g of Clause 1 of this Article on areas managed by subordinate units;
b) The authority approving the forest planting capital approves harvesting plans for the case specified in point đ of Clause 1 of this Article;
c) The People's Committee at the district level approves harvesting plans for the case specified in point e of Clause 1 of this Article where individuals, households, or community groups self-fund or participate in state-supported projects and policies; harvesting to utilize and harvesting to collect residual wood from natural production forests managed by individuals, households, or community groups;
d) The Department of Agriculture and Rural Development approves harvesting plans for cases not covered by points a, b, and c of this clause;
3. Documents:
a) Original Application for Approval of Forest Harvesting Plan according to Form No. 10 Appendix issued together with this Circular;
b) Original Forest Harvesting Plan according to Form No. 11 Appendix issued together with this Circular;
c) A copy of the decision to change the purpose of using the forest to another purpose approved by the competent authority, or a copy of the decision to approve the forest-related project or documentation proving the implementation of forest management measures or scientific research programs and topics approved by the competent authority for cases specified in points a, d, đ, e, and g of Clause 1 of this Article;
4. Procedure for implementation:
a) The forest owner or organization or individual authorized by the forest owner, or organization or individual assigned to utilize the forest area managed by the People's Committee at the commune level, shall submit directly or through postal services or electronic environment one set of documents as stipulated in Clause 3 of this Article to the authority with approval power as stipulated in Clause 2 of this Article. In the case of submitting documents through the electronic environment, it shall be implemented in accordance with Decree No. 45/2020/NĐ-CP;
b) Time limit for responding to the validity of the file components:
In the case of direct submission: the authority with approval power shall check the components of the documents and immediately inform the organization or individual submitting the documents about the validity of the components;
In the case of submission through postal services or electronic environment: within 01 working day from the date of receipt of the documents, the approving authority shall examine the validity of the components of the documents; if the documents are invalid, notify in writing and specify the reasons;
c) Within 10 days from the date of receipt of valid documents, the authority approving the forest product harvesting plan shall provide the result to the forest owner or organization or individual authorized by the forest owner; if not approved, notify in writing and specify the reasons.
Article 7. Approval of the Plan for Exploitation of Common Wild Animals from Nature
1. The competent authority to approve: The local Forest Protection Agency.
2. Documents:
a) Original Application for Approval of the Plan for Exploitation of Common Wild Animals from Nature in accordance with Form No. 10 in the Appendix issued together with this Circular;
b) Original Plan for Exploitation of Common Wild Animals from Nature in accordance with Form No. 12 attached as Appendix issued together with this Circular.
3. Procedures for implementation:
a) Organizations, individuals, households, and community groups exploiting common wild animals from nature shall submit directly or through postal services or electronic environment one set of documents as prescribed in Clause 2 of this Article to the local Forest Protection Agency. In case of submission through the electronic environment, it shall be carried out in accordance with Decree No. 45/2020/NĐ-CP;
b) Time limit for responding to the validity of the file components:
In case of direct submission: The local Forest Protection Agency shall check the components of the dossier and immediately inform the organizations, individuals, households, and community groups about the validity of the dossier components.
In case of submission through postal services or electronic environment: Within 01 working day from the date of receipt of the dossier, the local Forest Protection Agency shall examine the validity of the dossier components; in case the dossier does not meet the requirements, notify in writing and specify the reasons;
c) Within 10 days from the date of receipt of the valid dossier, the local Forest Protection Agency shall approve the Plan for Exploitation and deliver the result to the organizations, individuals, households, and community groups; in case of non-approval, notify in writing and specify the reasons.
Section 2. PROCEDURE FOR EXPLOITATION OF COMMON WILD PLANTS AND ANIMALS FROM FORESTS16
Article 8. Exploitation of Timber from Common Wild Plant Species from Natural Forests
1. Documents:
a) Exploitation within the scope of land clearance: A copy of the decision on changing the purpose of forest use to another purpose; a copy of the approved Plan for Exploitation of Timber from Common Wild Plant Species from Natural Forests;
b) Exploitation during the implementation of forest composition adjustment, forest nurturing, and other forest management measures: A copy of the decision approving the forest management project or a copy of the documentation proving the implementation of forest management measures; a copy of the approved Plan for Exploitation of Timber from Common Wild Plant Species from Natural Forests.
2.17 Procedure for Implementation: Before organizing exploitation, the forest owner or the organization or individual authorized by the forest owner or the organization or individual assigned to exploit timber when changing the purpose of forest use to another purpose for the area managed by the People's Committee of the commune shall submit one set of documents as prescribed in Clause 1 of this Article to the local Forest Protection Agency for supervision during the implementation process and within 05 working days from the completion of exploitation, submit the original Inventory of Forest Products to the local Forest Protection Agency for confirmation in accordance with Article 5 of this Circular.
Article 9. Exploitation of Timber from Common Wild Plant Species from Natural Forests
1. Documents: A copy of the approved Plan for Exploitation of Timber from Common Wild Plant Species from Natural Forests.
2.18 Procedure for Implementation: Before organizing exploitation, the forest owner or the organization or individual authorized by the forest owner shall submit one set of documents as prescribed in Clause 1 of this Article to the local Forest Protection Agency for supervision during the implementation process and within 05 working days from the completion of exploitation, submit the original Inventory of Forest Products to the local Forest Protection Agency for confirmation in accordance with Article 5 of this Circular.
Article 10. Primary exploitation, utilization exploitation, and residual exploitation of non-timber forest products from common forest plant species in natural forests.19
1. Documents:
a) A copy of the approved exploitation plan for the exploitation of non-timber forest products and derivatives of common forest plant species in natural forests classified as special-use forests.
b) A copy of the exploitation plan established by organizations, households, individuals, or community residents for the exploitation of non-timber forest products and derivatives of common forest plant species in natural forests classified as protective forests or production forests. Form No. 11 The form of which is attached to this Circular.
2.20 Procedure: Prior to organizing exploitation, the forest owner or the organization or individual authorized by the forest owner shall submit one set of documents as stipulated in Clause 1 of this Article to the local Forest Protection Agency for supervision during implementation, and within five working days from the completion of exploitation, submit a copy of the inventory list to the local Forest Protection Agency for monitoring and consolidation.
Article 11. Primary exploitation, utilization exploitation, and residual exploitation of common forest plants from production forests that are planted forests owned by the State; exploitation of common forest plants from protective forests that are planted forests; exploitation of common forest plants from special-use forests that are planted forests.21
1. Documents:
a) A copy of the approved exploitation plan for timber exploitation or a copy of the exploitation plan established by the forest owner or the organization or individual authorized by the forest owner according to Form No. 11 the form attached to this Circular for the exploitation of non-timber forest products, parts, or derivatives from forest plants.
b) A copy of the decision on changing the purpose of forest land use for utilization exploitation of timber on areas where the purpose of forest land use has been changed or a copy of the decision approving the forest production project or a copy of the documentation proving the implementation of forest management measures for utilization exploitation during the process of adjusting forest composition, nurturing forests, and applying other forest management measures.
2. Procedure: Prior to organizing exploitation, the forest owner or the organization or individual authorized by the forest owner or the organization or individual assigned to utilize exploitation when changing the purpose of forest land use for state-owned planted forests managed by the People's Committee of the commune, shall submit one set of documents as stipulated in Clause 1 of this Article to the local Forest Protection Agency for supervision during implementation, and within five working days from the completion of exploitation, submit a copy of the inventory list to the local Forest Protection Agency for monitoring and consolidation.
Article 12. Exploitation of common forest plants from production forests that are planted forests, garden wood, and scattered trees invested by organizations, individuals, households, or communities, or under state-supported projects and policies.22
1. Documents: the original information sheet on forest product exploitation established by the forest product owner or the organization or individual authorized by the forest product owner according to Model Number 13 the form attached to this Circular.
2. Procedure: Prior to organizing exploitation, the forest owner or the organization or individual authorized by the forest owner or the organization, individual, household, or community with garden wood or scattered trees shall submit one set of documents as stipulated in Clause 1 of this Article to the local Forest Protection Agency for supervision during implementation, and within five working days from the completion of exploitation, submit a copy of the inventory list to the local Forest Protection Agency for monitoring and consolidation.
Article 13. Collection of samples of common forest plants in special-use forests for scientific and technological research.
1. Documents:
a) A copy of the scientific research program or topic approved by the competent authority.
b) A copy of the sample collection plan approved by the competent authority.
2.23 Procedure: Prior to organizing sample collection, the organization or individual implementing the scientific research program or topic or the person authorized by the organization or individual implementing the scientific research program or topic shall submit one set of documents as stipulated in Clause 1 of this Article to the local Forest Protection Agency for supervision during implementation, and within five working days from the completion of sample collection, the organization or individual implementing the scientific research program or topic or the authorized person shall submit a copy of the collected sample inventory list to the local Forest Protection Agency for monitoring and consolidation.
Article 14. Exploitation of common wild animals, parts, derivatives of common wild animals from nature
1. Documents: A copy of the approved Plan for exploitation of common wild animals from nature as prescribed in Article 7 of this Circular.
2. Within five working days from the completion of exploitation, the forest product owner or the organization or individual authorized by the forest product owner shall submit one set of documents as prescribed in Clause 1 of this Article and the original Forest Product Inventory to the local Forest Protection Agency for confirmation as prescribed in Article 5 of this Circular.
Chapter III. FOREST PRODUCT DOCUMENTS
Section 1. SOURCE DOCUMENTS FOR FOREST PRODUCTS
Article 15. Source documents for forest products after exploitation
1. Timber harvested from natural forests: The original Forest Product Inventory with the confirmation of the local Forest Protection Agency.
2. Timber harvested from state-owned planted forests; protective planted forests funded by organizations, individuals, households, or community groups:
a) The original Forest Product Inventory prepared by the forest product owner; a copy of the approved exploitation plan by the competent authority;
b) The original Forest Product Inventory with the confirmation of the local Forest Protection Agency in cases where the forest product owner requests confirmation as prescribed in Point d, Clause 3, Article 5 of this Circular.
3. Timber harvested from production forests which are planted forests, trees with names identical to those of natural forest timber, scattered trees, garden trees funded by organizations, individuals, households, or community groups: The original Forest Product Inventory prepared by the forest product owner or the original Forest Product Inventory with the confirmation of the local Forest Protection Agency in cases where the forest product owner requests confirmation as prescribed in Point d, Clause 3, Article 5 of this Circular.
4. Non-timber forest products harvested from natural forests, planted forests:
a) For non-timber forest products listed in the List of Endangered, Precious, and Rare Wild Plants and Animals; non-timber forest products listed in Appendix CITES: The original Forest Product Inventory with the confirmation of the local Forest Protection Agency;
b) For non-timber forest products not covered by the provisions of point a of this Clause: The original Forest Product Inventory prepared by the forest product owner or the original Forest Product Inventory with the confirmation of the local Forest Protection Agency in cases where the forest product owner requests confirmation as prescribed in Point d, Clause 3, Article 5 of this Circular.
5. Wild animals: The original Forest Product Inventory with the confirmation of the local Forest Protection Agency.
Article 16. Source documents for imported forest products
1. Imported timber: Implemented according to Article 7 of Decree No. 102/2020/NĐ-CP dated September 1, 2020 of the Government on the Vietnam Legal Timber Assurance System.
2. Imported non-timber forest products:
a) For species listed in Appendix CITES: Customs declaration as prescribed by law; the original or copy or electronic version of the CITES import permit;
b) For species not listed in Appendix CITES: Customs declaration as prescribed by law; the original Forest Product Inventory prepared by the forest product owner or packing list/log list prepared by the organization or individual as prescribed by the exporting country.
3. After clearance, the Customs Office returns the documents to the forest product owner for retention as prescribed.
Article 17. Source documents for forest products after confiscation24
1. In cases where the agency responsible for handling confiscated assets is the Forest Protection Agency: The original Forest Product Inventory prepared by the Forest Protection Agency responsible for handling the assets.
2. In cases where the agency responsible for handling confiscated assets is not the Forest Protection Agency: The original Forest Product Inventory prepared by the agency responsible for handling the assets with the confirmation of the local Forest Protection Agency.
Section 2. DOCUMENTS FOR FOREST PRODUCTS WHEN PURCHASING, SELLING, TRANSFERRING OWNERSHIP RIGHTS, DOMESTIC TRANSPORTATION AND EXPORT
Article 18. Documents for forest products when purchasing, selling, transferring ownership rights, domestic transportation
1. For forest products that must be confirmed with a Forest Product Inventory List according to points a, b, c, and d Clause 3 Article 5 of this Circular a) The original Forest Product Inventory List confirmed by the Local Forest Protection Agency;:
b) A copy of the purchase and sale, ownership transfer documents immediately preceding it or a QR code containing the documents specified herein on the Forest Product Inventory List.
2. For forest products that are not finished wood products and do not fall under the cases stipulated in
a) The original Forest Product Inventory List established by the forest product owner selling or transferring ownership rights or the original Forest Product Inventory List confirmed by the Local Forest Protection Agency for the forest products specified in a) The original Forest Product Inventory List confirmed by the Local Forest Protection Agency;:
3. For post-harvest forest products transported by the forest product owner to warehouses or storage areas in the same trip and using the same means of transport: Implement according to the provisions at Point d, Clause 3, Article 5 of this Circular;
2. For forest products that are not finished wood products and do not fall under the cases stipulated in
4. For imported forest products transported from the border gate to the warehouse of the importing organization or individual: Implement according to the provisions at Article 15 of this Circular.
5. For forest products purchased directly from the Auction Council, then transported to the warehouse of the purchasing organization or individual: Implement according to the provisions at Article 16 of this Circular.
6. For finished wood products: The original Forest Product Inventory List established by the forest product owner or the original Forest Product Inventory List confirmed by the Local Forest Protection Agency for the cases specified in Article 17 of this Circular.
Article 19. Documents for forest products when exporting Point d, Clause 3, Article 5 of this Circular.
1. For roundwood, sawn timber, wood products, the documents include one of the following:
a) The original Forest Product Inventory List or the original Forest Product Inventory List confirmed by the Local Forest Protection Agency for the forest products specified in
Clause 3 Article 5 of this Circular b) The original or copy or electronic version of the CITES Export Permit for wood and wood products listed in the Catalogue of Endangered, Precious, and Rare Wild Plants and Animals; wild animals and plants listed in the CITES Appendices.;
2. For non-wood forest products, the documents include one of the following:
a) The original or copy or electronic version of the CITES permit for specimens listed in the Catalogue of Endangered, Precious, and Rare Wild Plants and Animals; wild animals and plants listed in the CITES Appendices;
b) The original Forest Product Inventory List confirmed by the Local Forest Protection Agency for common wild animals;
c) The original Forest Product Inventory List for non-wood forest plants belonging to common species.
3. After customs clearance, the Customs Authority returns the documents to the forest product owner for retention according to regulations.
Section 3. DOCUMENTS FOR FOREST PRODUCTS AT PROCESSING, BUSINESS, STORAGE, BREEDING, AND PLANTING OF WILD PLANTS AND ANIMALS
Article 20. Documents for forest products at processing, business, storage of wood, wild plants, wild animals, and species listed in the CITES Appendices
1. The original origin documents for post-harvest forest products, imported forest products, bred forest products, or post-seizure processed forest products for the case where the facility owner directly harvests, imports, or purchases post-seizure processed forest products.
2. The original Forest Product Inventory List and a copy of the forest product documents transferring ownership rights from organizations or individuals immediately preceding it.
3. A copy of the export or ownership transfer documents for forest products to organizations or individuals.
4. A record book tracking the import and export of forest products for organizations or households engaged in business according to
the annex attached to this Circular. The forest product owner is responsible for updating information in the record book when importing or exporting forest products. Form No. 07 5. For species listed in the Catalogue of Endangered, Precious, and Rare Wild Plants and Animals; species listed in the CITES Appendices: Record books as prescribed by the Government for managing endangered, precious, and rare wild plants and animals and implementing the Convention on International Trade in Endangered Species of Wild Fauna and Flora.
6. The forest product owner is responsible for retaining corresponding documents for each stage of the forest product supply chain, including: Origin documents for post-harvest forest products, transportation, processing, production, purchase and sale, ownership transfer, importation, and post-seizure processed forest products as stipulated in this Circular.
6. The forestry product owner shall be responsible for retaining forestry product records corresponding to each stage of the forestry product supply chain, including: Forestry product origin records after harvesting, transportation, processing, production, purchase and sale, transfer of ownership rights, imported forestry products, and post-seizure processed forestry products as prescribed in this Circular.
Article 21. Forest product files at breeding and cultivation facilities
1. Forest product files at breeding facilities for wild animal species; animals listed in CITES Appendices:
a) The facility code issued by the competent state agency for breeding facilities of critically endangered, precious, and rare wild animals; critically endangered wild animals listed in CITES Appendices;
b) Original forest product files of the origin of animals harvested domestically, imported, or bred by the facility owner who is also an organization or individual directly harvesting, importing, or breeding; a copy or electronic version of the original forest product files of the origin of animals harvested, imported, or bred by the facility owner who is not directly involved in harvesting, importing, or breeding;
c) Original forest product files when receiving ownership transfer from adjacent organizations or individuals;
d) A copy of forest product files when publishing or transferring ownership to organizations or individuals;
đ) Various registers as prescribed by the Government on the management of critically endangered wild plants and animals, and the implementation of the Convention on International Trade in Endangered Wild Fauna and Flora.
2. Forest product files at cultivation facilities for critically endangered, precious, and rare wild plants; plants listed in CITES Appendices:
a) The facility code issued by the competent state agency;
b) Original forest product files of the origin of plants harvested domestically, imported, or artificially cultivated by the facility owner who is also an organization or individual directly harvesting, importing, or artificially cultivating; a copy or electronic version of the original forest product files of the origin of plants harvested, imported, or artificially cultivated by the facility owner who is not directly involved in harvesting, importing, or artificially cultivating;
c) Original forest product files when receiving ownership transfer from other organizations or individuals previously;
d) A copy of forest product files when publishing or transferring ownership to other organizations or individuals;
đ) Various registers as prescribed by the Government on the management of critically endangered wild plants and animals, and the implementation of the Convention on International Trade in Endangered Wild Fauna and Flora.
Chapter IV. MARKING OF SPECIMENS
Article 22. Objects to be marked
1. Finished products produced or processed from crocodiles, species belonging to Group IIB according to the List of Critically Endangered, Precious, and Rare Wild Plants and Animals, species listed in CITES Appendices II and III when purchasing, selling, transferring ownership, or transporting.
2. Specimens of species listed in CITES Appendices that require marking as specified by CITES shall be implemented in accordance with CITES regulations.
Article 23. Forms, methods, and responsibilities for marking specimens
1. Marking specimens may be carried out using labels such as stamps, codes, barcodes, QR codes, or other materials (hereinafter referred to collectively as marking labels) containing all the information prescribed in Article 24 of this Circular for management and traceability of origin.
2. The specimen owner decides on the material, size, and form of the marking label, suitable for the nature and type of the specimen and ensuring compliance with legal provisions regarding product labeling.
3. Each product is marked with one marking label. The marking label must be directly attached to the product or packaging, storage items, ensuring it can be easily identified by the naked eye or reading devices and preventing counterfeiting.
4. Marking labels directly attached to specimens must ensure that when the label is peeled off, it will tear, become damaged, and cannot be reused. In cases where specimens are contained in the same packaging or storage item, the forest product label must be affixed in positions where peeling the packaging or storage item will cause the marking label to tear, become damaged, and cannot be reused.
5. The specimen owner must mark the specimen before transporting, purchasing, selling, or transferring ownership of the specimen.
6. After completing the marking of the specimen, within one working day, the forest product owner must record all marking information in the specimen marking tracking logbook in paper or electronic format as Model No. 14 set forth in the Appendix attached to this Circular and bear responsibility for the accuracy of the information on the marking label; submit the Specimen Marking Notification as Model Number 15 set forth in the Appendix attached to this Circular to the local Forest Protection Authority for monitoring and management.
Article 24. Information and Registration of Mark Labels
1. Information on mark labels:
a) Name of specimen;
b) Species name: Common name and scientific name. In cases where specimens are produced from multiple species of animals and plants, the common name and scientific name of each species must be fully recorded;
c) Name and address of organizations or individuals selling, transferring ownership rights of specimens and the name and address of organizations or individuals purchasing, receiving transferred ownership rights of specimens;
d) Quantity of specimens: The quantity of specimens expressed in units of measurement or counted according to the characteristics of each type of specimen;
đ) Serial number of the label, including: the serial number of the mark label, abbreviation of province name, administrative unit code of district level, abbreviation of specimen owner's name, abbreviation of two digits of the year the code was issued. Among them:
The serial number of the mark label: Recorded in Arabic numerals, in ascending order starting from number 01 until the end of the year.
Abbreviation of province name in the Appendix issued together with the Government Decree on management of endangered, precious, rare forest plants and animals and enforcement of the Convention on International Trade in Endangered Species of Wild Fauna and Flora.
Abbreviation of specimen owner's name: Determined by the specimen owner and reported to the Provincial Forest Protection Agency. If the specimen owner changes their name, they choose a new abbreviation and report it to the Provincial Forest Protection Agency for knowledge and management.
Administrative unit code of district level is the corresponding code for each district, town, city directly under the province, encoded with three digits according to Decision No. 124/2004/QĐ-TTg dated July 8, 2004 of the Prime Minister on issuing the List of Categories and Codes of Administrative Units in Vietnam.
2. Organizations or individuals marking specimens send notification along with specimen mark label samples to the Provincial Forest Protection Agency for consolidation and monitoring.
Chapter V. INSPECTION AND TRACEABILITY OF FOREST PRODUCTS
Article 25. Inspection Objectives and Forms
1. Inspection targets: Organizations, individuals, households engaged in business, families, community residents involved in harvesting, transporting, processing, producing, buying, selling, transferring ownership rights of forest products, exporting, importing, storing forest products, raising wild animals, planting endangered, precious, rare forest plants and marking specimens.
2. Forms of Inspection:
a) Planned inspection;
b) Spot inspection.
Article 26. Content of Inspection
1. For harvesting forest products: Inspect compliance with laws on harvesting forest products according to the Forest Management Regulations and provisions in Chapter II of this Circular and actual harvested forest products at the site.
2. For imported and exported forest products: Inspect forest product documentation as stipulated in Article 16 and Article 19 of this Circular and actual forest products at the border gate.
3. For transporting forest products: Inspect compliance with regulations on forest product documentation during transportation as stipulated in Article 18 of this Circular and forest products on transport vehicles.
4. For processing, trading, storing wood and forest products establishments: Inspect compliance with regulations on forest product documentation as stipulated in Article 20 of this Circular and existing forest products at the establishment.
5. For establishments raising wild animals listed in CITES Appendices; establishments growing endangered, precious, rare forest plant species or plants listed in CITES Appendices: Inspect compliance with regulations on forest product documentation as stipulated in Article 21 of this Circular and animals, plants currently being raised or grown at the establishment.
6. For storage places of forest products: Inspect forest product documentation as stipulated in this Circular and existing forest products.
Article 27. Principles of Inspection
1. The inspection activities of the Forest Protection Agency shall be carried out by the Inspection Team or Inspection Group (hereinafter referred to as the Inspection Team) when there is an inspection decision made by the person with authority as stipulated in Article 30 of this Circular, except for sudden inspections as provided for in Clause 1, Article 29 of this Circular.
2. Inspection activities of forest rangers must ensure promptness, objectivity, accuracy, compliance with their duties and powers, and adherence to legal regulations.
3. Inspection activities must be conducted in accordance with the procedures prescribed in Article 31 of this Circular and must establish an Inspection Record as prescribed in Model Number 16 send a text message Model Number 17 attached as Appendix issued together with this Circular.
Article 28. Planned Inspections
1. Annual Inspection Plan:
a) Before November 30 each year, the Head of the Forest Protection Agency as stipulated in Article 30 of this Circular has the responsibility to develop the next year's inspection plan and submit it for direct superior approval;
b) In cases where there are directives from higher-level agencies or new management contents arise outside the annual inspection plan, adjust the inspection plan and submit it for approval by the competent authority;
c) Based on the approved inspection plan, the Forest Protection Agency shall notify relevant agencies, organizations, and individuals before December 31 each year or after adjusting and approving the inspection plan.
2. Special Topic Inspection Plan: Based on the situation of forest product management in the area that requires inspection and handling, the Head of the Forest Protection Agency shall proactively develop a special topic inspection plan.
Article 29. Sudden Inspections
1. Basis for sudden inspections:
a) Information from mass media;
b) Information from complaints, denunciations, or reports from organizations or individuals;
c) Information from requests to handle violations from organizations or individuals;
d) Information from discoveries or immediate detection of violations by forest rangers managing the area or forest rangers assigned to monitor and detect violations;
đ) Directives from the Head of the competent state management agency;
e) When signs of violation of laws are discovered.
2. Forest rangers collecting or receiving information about law violations or signs of law violations must immediately report to the Head of the Forest Protection Agency for information processing.
3. Based on the information specified in Clause 1 of this Article, the Head of the Forest Protection Agency is responsible for processing information, directing inspections, and bearing responsibility for decisions made; directing the establishment of a record to track information and organizing management according to confidential document management regulations.
Article 30. Authority to Issue Inspection Decisions by Forest Rangers
1. The Director of the Forest Protection Department, the Director of the Regional Forest Protection Sub-department, the Director of the Provincial Forest Protection Sub-department, the Commander of the Special Task Force Forest Ranger Team, the Commander of the Mobile and Firefighting Forest Ranger Team, and the Head of the Forest Ranger Station issue inspection decisions according to their assigned functions and tasks.
2. The persons with authority as stipulated in Clause 1 of this Article may delegate their subordinates to issue inspection decisions in accordance with the law.
Article 31. Inspection Procedures
1.25 Announce and hand over the inspection decision to the inspected entity or its representative; notify the members of the Inspection Team and witnesses (if any). In cases of sudden inspections without an inspection decision, the representative of the inspection team must introduce the participants and the reasons for the inspection.
2. Require the inspected entity or its representative to comply with the inspection decision of the authorized person and work with the Inspection Team. If these people are not present at the inspection location, the Inspection Team shall invite representatives of the People's Committee of the commune or the police station where the inspection takes place, and witnesses to announce the inspection decision and conduct the inspection as prescribed.
3. Conduct the inspection strictly according to the content of the announced inspection decision. If new content arises during the inspection that exceeds the authority, the Inspection Team must immediately report to the person who issued the inspection decision for timely handling.
4. Inspection of forest product transportation: The Inspection Team can only stop vehicles in transit to inspect forest products if they have grounds as prescribed in Clause 1, Article 29 of this Circular. Stop signals may use one type or combine sirens, forest ranger flags, and flashlights.
5. Inspection of imported, exported, and transiting forest products at border gates: The Forest Protection Agency shall cooperate with the customs authorities at the border gate to organize the inspection of forest products as prescribed in this Circular.
6. The inspected entity must comply with the inspection requirements of the Inspection Team; immediately present the forest product files as prescribed in this Circular and other related documents as required by law.
Chapter VI. IMPLEMENTATION26
Article 32. Responsibility for Implementation
1.27 Forest Protection Agency:
a) Organize propaganda, dissemination, and implementation of this Circular nationwide;
b) Guide, inspect, and supervise the implementation of laws on forest product management and traceability throughout the country as prescribed in this Circular;
c) Develop pilot models for the application of information technology in forest product management and traceability;
d) Summarize and report on the implementation of regulations on forest product management and traceability throughout the country as prescribed in this Circular.
2.28 The Forestry Department:
a) Guide and inspect the implementation of logging procedures and formalities as prescribed in this Circular nationwide;
b) Develop pilot models for issuing and managing plantation codes for forest raw materials to serve traceability of forest products linked to sustainable forest management and certification.
c) Develop pilot models for the application of information technology in forest product management and traceability;
d) Summarize and report on the implementation of regulations on forest product management and traceability throughout the country as prescribed in this Circular.
3. Regional Forest Protection Sub-department:
a) Organize the inspection of forest product origins as prescribed in this Circular under the direction of the Forest Protection Department in the assigned area;
b) Summarize and report on the implementation of this Circular in the assigned area when requested by the competent authority.
4. Department of Agriculture and Rural Development: Organize the implementation and guidance of this Circular in the province.
5. Provincial Forest Protection Agency:
a) Summarize and retain information on logging situations; import and export of forest products in the province; organize inspections, supervision, and traceability of forest products as prescribed in this Circular;
b) Manage forest product files as prescribed in this Circular;
c) Report on the management, inspection, and tracing of the origin of forest products; animal breeding facilities and plant cultivation sites within the jurisdiction as stipulated in this Circular.
6. The local Forest Protection Authority:
a) Aggregate and retain information on the situation of exploitation; import and export of forest products within its jurisdiction; organize inspections, verifications, supervision, and tracing of the origin of forest products as prescribed in this Circular;
b) Manage forest product files as prescribed in this Circular;
c) Retain files submitted by forest owners and forest product holders according to Chapters II and III of this Circular; manage the Record of Confirmation of the Forest Product Inventory List as provided for herein; Form No. 09 in the Appendix issued together with this Circular;
d) Aggregate reports pursuant to Model Number 18 attached hereto regarding the situation of import and export of forest products within the jurisdiction and submit them to the provincial Forest Protection Authority no later than ten days from the date of receipt of the report of organizations, households, and businesses as stipulated in point c, Clause 8, Article 6 of this Circular.
7. Forest Owners:
a) Retain complete files on the origin of forest products as prescribed in this Circular;
b) Implement pre- and post-exploitation reporting as prescribed in this Circular.
8. Organizations, individuals, business households, family households, and community residents:
a) Retain complete forest product files as prescribed in this Circular;
b) Be responsible for the accuracy and compliance with inspection and tracing regulations of competent authorities;
c) For organizations and business households: Maintain a record of import and export of forest products as provided for Form No. 07 attached hereto; update promptly and fully the situation of import and export of forest products and present when requested for inspection by competent authorities; report the situation of import and export of forest products to the local Forest Protection Authority as provided for Model Number 18 attached hereto semi-annually before July 15 and annually before January 15. The period for finalizing data for the six-month report runs from January 1 to June 30; the period for finalizing data for the annual report runs from January 1 to December 31 of the reporting year.
Article 33. Effective Date
1. This Circular takes effect from February 15, 2023.
2. Circular No. 27/2018/TT-BNNPTNT dated November 16, 2018, issued by the Minister of Agriculture and Rural Development concerning the management and tracing of the origin of forest products shall cease to be effective from the date this Circular comes into force.
3. Transitional Provisions
a) In cases where forest product holders store legally sourced timber harvested from natural forests, timber after confiscation processing, timber listed in the Catalogue of Endangered, Precious, and Rare Forest Plants and Animals, and timber listed in Appendix CITES prior to the effective date of this Circular, when buying, transferring ownership rights, or transporting such timber, they must confirm the forest product inventory list as prescribed at Article 5 of this Circular. Forest product holders must tally legally sourced timber harvested from natural forests, timber after confiscation processing, and timber listed in Appendix CITES stored at their premises, prepare the Forest Product Inventory List as provided for Form No. 01 attached hereto, and submit it to the local Forest Protection Authority for confirmation, management, and completion by September 30, 2023.
b) In cases where forest product harvesting files have been approved before the effective date of this Circular but have not yet been exploited or are currently being exploited, they shall continue to implement the provisions of Circular No. 27/2018/TT-BNNPTNT dated November 16, 2018, issued by the Minister of Agriculture and Rural Development concerning the management and tracing of the origin of forest products. Post-harvest forest product files shall be implemented according to this Circular.
4. In cases where normative legal documents cited in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replaced documents shall apply.
5. During implementation, if there are any difficulties, agencies, organizations, and individuals should reflect them to the Ministry of Agriculture and Rural Development for consideration and resolution./.

26 Article 14 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development amending and supplementing certain provisions of several Circulars in the forestry sector, which shall take effect from February 1, 2024, provides as follows:
"Article 14. Implementation Provisions
1. This Circular takes effect from February 1, 2024.
2. During the implementation of this Circular, if there are difficulties or obstacles, agencies, organizations, and individuals shall promptly report them to the Ministry of Agriculture and Rural Development for guidance and research on amendments and supplements."
27 This provision is amended and supplemented pursuant to Clause 13, Article 2 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development amending and supplementing certain provisions of several Circulars in the forestry sector, which shall take effect from February 1, 2024.
