DECREE

Detailed regulations and guidance for implementing the Ordinance on the State Honorary Title "Heroic Mother Vietnam"

 

Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam"; amended and supplemented by:

Decree No. 83/2025/NĐ-CP dated April 2, 2025 of the Government amending and supplementing certain articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam"; "Heroic Mother Vietnam", shall take effect from April 2, 2025;

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Competition and Rewards dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14, 2005;

On the basis of the Ordinance on the State Honorary Title "Heroic Mother Vietnam" dated August 29, 1994; Ordinance No. 05/2012/UBTVQH13 dated October 20, 2012 amending and supplementing certain articles of the Ordinance on the State Honorary Title "Heroic Mother Vietnam";

On the basis of the Ordinance on Preferential Treatment for Persons with Merit to the Revolution No. 26/2005/PL-UBTVQH11 dated June 29, 2005; Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012 amending and supplementing certain articles of the Ordinance on Preferential Treatment for Persons with Merit to the Revolution;

"Based on the proposal of the Minister of National Defense;"

The Government promulgates this Decree detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam" and the Ordinance amending and supplementing certain articles of the Ordinance on the State Honorary Title "Heroic Mother Vietnam",[1]

Article 1. Scope of Regulation

This Decree details and guides matters concerning the subjects, preferential treatment systems, files, procedures, and formalities for proposing to present or posthumously present the State Honorary Title "Heroic Mother Vietnam".

Article 2. Subjects eligible for presentation or posthumous presentation of the State Honorary Title "Heroic Mother Vietnam"

1. Mothers falling under any of the following circumstances are eligible for presentation or posthumous presentation of the State Honorary Title "Heroic Mother Vietnam":

a) Having two or more children who are martyrs;

b) Only having two children, one of whom is a martyr and the other a war invalid with a reduction in work capacity of 81% or more;

c) Only having one child who is a martyr;

d) Having one child who is a martyr and having a husband or being herself a martyr;

đ) Having one child who is a martyr and being herself a war invalid with a reduction in work capacity of 81% or more.

A child who is a martyr is a person who has been awarded a Certificate of Merit by the Prime Minister, including biological and adopted children as defined by law.

A husband who is a martyr is a person who has been awarded a Certificate of Merit by the Prime Minister and whose wife is the mother in question.

War invalids referred to in points b and đ Clause 1 of this Article are persons who have been issued a War Invalid Certificate by competent authorities, suffering a reduction in work capacity of 81% or more, including both living and deceased individuals.

In cases where a mother's husband or child joined the enemy ranks but the mother complied well with the Party and State policies, received unified approval for presentation or posthumous presentation from all levels of government, and there were no complaints, accusations, petitions, or reflections from the public, or if there were such complaints, accusations, petitions, or reflections but they were concluded by competent authorities to be unfounded, she may still be considered for presentation or posthumous presentation of the State Honorary Title "Heroic Mother Vietnam".[2]

2. Mothers falling under the circumstances specified in Clause 1 of this Article but who betrayed, surrendered to the enemy, committed acts harmful to the revolution, or violated the law and were sentenced to imprisonment by the court, with the judgment or decision of the court still in force (including suspended sentences), shall not be eligible for presentation of the State Honorary Title "Heroic Mother Vietnam".

Article 3. Preferential Treatment Regime

1. A mother who is awarded the State Honorary Title "Heroic Mother Vietnam" shall be presented with a Certificate and Medal "Heroic Mother Vietnam", and shall enjoy preferential treatment as prescribed by laws on commendation and reward and laws on preferential treatment for persons meritorious to the revolution.

2.[3] In cases where a mother is posthumously awarded the State Honorary Title "Heroic Mother Vietnam", the presentation of the Certificate and Medal "Heroic Mother Vietnam" and other benefits shall be carried out in accordance with the provisions of laws on commendation and reward and laws on preferential treatment for persons meritorious to the revolution.

3. The organization of ceremonies for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam" shall be regulated as follows:

a) The Chairman of the People's Committee of the province or centrally governed city shall be responsible for organizing the ceremony for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam";

b) The ceremony for awarding or posthumously awarding shall be solemn, frugal, and have educational significance; the decoration of the ceremony shall include the inscription: Ceremony for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam".

4. The organization of funerals when a "Heroic Mother Vietnam" passes away shall be regulated as follows:

a) The Chairman of the People's Committee at the district level shall be responsible for organizing the funeral with representatives from the Party committee, government, political and social organizations; the agency, unit providing care, and the people residing in the locality where the mother lived;

b) The funeral shall be solemn, frugal, and appropriate to local customs and traditions; the decoration of the ceremony shall include the inscription: Funeral of Heroic Mother Vietnam.

5.[4] The budget for organizing the ceremony for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam" shall not exceed one base salary for one case; the funeral of "Heroic Mother Vietnam" shall not exceed two base salaries for one case.

Article 4. Application Documents for Proposing and Examining Awarding or Posthumously Awarding[5]

1. Application documents for proposing and examining awarding or posthumously awarding shall include:

a) An application form for awarding the State Honorary Title "Heroic Mother Vietnam" according to Form No. 01/BMVNAH attached as an appendix to this Decree or an application form for posthumously awarding the State Honorary Title "Heroic Mother Vietnam" according to Form No. 02/BMVNAH attached as an appendix to this Decree;

b) A certified copy of the "State Commendation Certificate", a certified copy of the War Invalid Certificate, depending on the type of awarding or posthumously awarding as stipulated in Clause 1, Article 2 of this Decree;

c) Other related documents (if any).

2. Documents for submitting examination for awarding or posthumously awarding shall include:

a) A report on the proposal for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam" according to Form No. 05/BMVNAH attached as an appendix to this Decree and a list of proposals for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam" according to Form No. 06/BMVNAH attached as an appendix to this Decree;

b) A record of the results of publicizing the proposal for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam" according to Form No. 03/BMVNAH attached as an appendix to this Decree (if applicable); a record of the examination of the proposal for awarding or posthumously awarding the State Honorary Title "Heroic Mother Vietnam" according to Form No. 04/BMVNAH attached as an appendix to this Decree;

c) The documents specified in Clause 1 of this Article.

Article 5. Procedures

1.[6] The mother or the person proposing on behalf of the mother shall prepare one set of application documents for the award or posthumous award of the State Honorary Title "Mother Vietnam Heroine" in accordance with Clause 1 of Article 4 of this Decree and submit it to the People's Committee of the commune where the mother resides or where she has registered her permanent household registration or resided when alive.

2. The Chairman of the People's Committee of the commune shall, within ten working days from the date of receiving complete application documents as prescribed, be responsible for:

a) Organizing meetings to review each case of application for the award or posthumous award of the State Honorary Title "Mother Vietnam Heroine" with representatives from the Party committee, People's Committee, Vietnam Fatherland Front, military, police, and related organizations;

b) [7] Signing the Petition regarding the proposal for the award or posthumous award of the State Honorary Title "Mother Vietnam Heroine" along with the List of Proposals for the Award or Posthumous Award of the State Honorary Title "Mother Vietnam Heroine" and one set of application documents for each case to be submitted to the Chairman of the People's Committee of the district.

c) [8] In cases where the mother had a husband or child who joined the enemy forces, upon receipt of complete documents as prescribed, the People's Committee of the commune shall be responsible for:

Publicly posting the list (information about the mother) and the process of joining the enemy forces by the husband or child of the mother at the village or commune where the mother resides or where she has registered her permanent household registration or resided when alive; the minimum posting period is forty days; announcing on local mass media to solicit public opinions; preparing the Minutes of the Public Posting Results according to Model No. 03/BMVNAH attached to this Decree.

After completing the public posting results, implement the provisions stipulated in point a and b of this clause within ten working days.

3. The Chairman of the People's Committee of the district shall, within fifteen working days from the date of receiving complete application documents as prescribed, be responsible for:

a) Directing the agency assigned to receive the application documents to organize the examination as prescribed;

b) [9] Signing the Petition regarding the proposal for the award or posthumous award of the State Honorary Title "Mother Vietnam Heroine" along with the List of Proposals for the Award or Posthumous Award of the State Honorary Title "Mother Vietnam Heroine" and one set of application documents for each case to be submitted to the Chairman of the People's Committee of the province.

4. The Chairman of the People's Committee of the province, within fifteen working days from the date of receiving complete application documents as prescribed, shall be responsible for:

a) Directing the agency assigned to receive the application documents to organize the examination as prescribed;

b) [10] Signing the Petition regarding the proposal for the award or posthumous award of the State Honorary Title "Mother Vietnam Heroine" along with the List of Proposals for the Award or Posthumous Award of the State Honorary Title "Mother Vietnam Heroine" and one set of application documents for each case accompanied by electronic files of the application documents to be submitted to the Prime Minister.

5. The Ministry of Home Affairs, within ten working days from the date of receiving complete application documents as prescribed, shall be responsible for examining the application documents and submitting them to the Prime Minister for recommendation to the President for consideration and decision on the award or posthumous award of the State Honorary Title "Mother Vietnam Heroine".

6. General Provisions:

a)[11] (abolished);

b) In cases where the declarant cannot retain the documents serving as the basis for examination as prescribed in Clause 1 of this Article, they shall submit a letter to the Director of the Department of Labor, Invalids and Social Affairs for confirmation to serve as the basis for preparing the application documents;

c) In cases where the child is a disabled veteran with a labor capacity reduction of 81% or more residing in a veterans' convalescent center or living in another locality, they shall submit a letter to the Director of the Department of Labor, Invalids and Social Affairs managing the veterans for confirmation to serve as the basis for preparing the application documents;

d) In cases where the application documents are incomplete or not in compliance with the regulations, the People's Committee of the level conducting the examination shall return the documents within five working days and notify the reasons in writing. In cases where the documents are unclear, they shall request verification to clarify.

Article 6. Handling of violations

1. Organizations and individuals engaging in falsifying application documents, providing false confirmations, or violating the provisions of this Decree shall be subject to disciplinary action, administrative penalties, or criminal prosecution depending on the nature and severity of the violation as prescribed by law.

2. Cases with conclusions from competent authorities that involve falsification or false declarations shall have their honorary titles revoked, their Certificates and Medals "Mother Vietnam Heroine" confiscated, and the benefits received shall be reclaimed and compensation paid according to the law.

3. The revocation of the State Honorary Title "Mother Vietnam Heroine" shall be carried out in accordance with the laws on commendation and rewards.

Article 7. Implementation Organization

1. The Ministry of Home Affairs is responsible for:

a) [12] Directing and guiding the examination and awarding or posthumous awarding of the State Honorary Title "Mother Vietnam Heroine";

b) Organizing inspections, examinations, handling complaints and reports, and dealing with violations of the laws concerning the State Honorary Title "Mother Vietnam Heroine".

2. The Ministry of Labor, Invalids and Social Affairs shall have the responsibility:

a) Directing the Department of Labor, Invalids and Social Affairs to complete the application documents and examine the awarding or posthumous awarding of the State Honorary Title "Mother Vietnam Heroine" within their authority;

b) Organizing the implementation of the confirmation of martyrs and disabled veterans with a labor capacity reduction of 81% or more as prescribed in Clause 1 of Article 2 of this Decree.

3. The Ministry of National Defense and the Ministry of Public Security shall be responsible for directing military and police agencies to cooperate in the examination and awarding or posthumous awarding of the State Honorary Title "Mother Vietnam Heroine".

4. The Ministry of Finance shall be responsible for allocating state budget funds to implement preferential policies for Mothers Vietnam Heroine.

5. Provincial People's Committees and municipal people's committees directly under the Central Government shall be responsible for:

a) Directing propaganda and dissemination of policies and laws concerning the State Honorary Title "Mother Vietnam Heroine";

b) Implementing preferential policies for Mothers Vietnam Heroine within their scope and authority.

Article 8. Effective Date[13]

1. This Decree takes effect from July 15, 2013.

Preferential policies for Mothers Vietnam Heroine shall be implemented in accordance with Clause 1 of Article 3 of Ordinance No. 05/2012/UBTVQH13 dated October 20, 2012 of the Standing Committee of the National Assembly.

2. Decree No. 176-CP dated October 20, 1994 of the Government on the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroine" and other conflicting legal provisions shall cease to be effective from the date this Decree takes effect.

Article 9. Responsibility for implementation

Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial and municipal People's Committees directly under the Central Government are responsible for implementing this Decree./.

Implementing Ordinance No. 05/2012/UBTVQH13 dated October 20, 2012 of the Standing Committee of the National Assembly on amending and supplementing some articles of the Ordinance on the national honor title "Mother Heroine of Vietnam", Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the national honor title "Mother Heroine of Vietnam", and Decree No. 83/2025/NĐ-CP dated April 2, 2025 of the Government amending and supplementing some articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government.

[1] Decree No. 83/2025/NĐ-CP amending and supplementing some articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam", based on the following grounds:

Pursuant to the Government Organization Law on February 18, 2025;

Based on the Residence Law dated November 13, 2020;

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to the Law on Identity Cards dated November 27, 2023;

Based on the Ordinance on the State Honorary Title "Heroic Mother Vietnam" dated August 29, 1994; the Ordinance amending and supplementing some articles of the Ordinance on the State Honorary Title "Heroic Mother Vietnam" dated October 20, 2012;

Based on the Ordinance on Preferential Treatment for Persons with Merit in the Revolution dated December 9, 2020;

"Based on the proposal of the Minister of National Defense;"

The Government issues the Decree amending and supplementing some articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam".

[2] This section is amended and supplemented according to the provisions of Clause 1 Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing some articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam", which takes effect from April 2, 2025.

[3] This clause is amended and supplemented according to the provisions of Point a Clause 2 Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing some articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam", which takes effect from April 2, 2025.

[4] This clause is amended and supplemented according to the provisions of Point b Clause 2 Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing some articles of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Heroic Mother Vietnam", which takes effect from April 2, 2025.

[5] This provision is amended and supplemented pursuant to Clause 3, Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[6] This clause is amended and supplemented pursuant to Point a, Clause 4, Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[7] This point is amended and supplemented pursuant to Point b, Clause 4, Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[8] This point is added pursuant to Point c, Clause 4, Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[9] This point is amended and supplemented pursuant to Point d, Clause 4, Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[10] This point is amended and supplemented pursuant to Point đ, Clause 4, Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[11] This point is repealed pursuant to Clause 3, Article 2 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[12] This point is amended and supplemented pursuant to Clause 5, Article 1 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025.

[13] Article 3, Article 4, and Article 5 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic", which takes effect from April 2, 2025, provide as follows:

"Article 3. Transitional Provisions

In cases where the application dossier for awarding or posthumously awarding the State Honorary Title "Mother Vietnam Heroic" has been received by the People's Committee at the commune level before this Decree takes effect, it shall be implemented according to the provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government.

Article 4. Effective date

This Decree takes effect from the date of issuance.

Article 5. Responsibilities for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-run cities are responsible for implementing this Decree."/

(1) This annex is amended and supplemented pursuant to Article 2 of Decree No. 83/2025/NĐ-CP amending and supplementing certain provisions of Decree No. 56/2013/NĐ-CP dated May 22, 2013 of the Government detailing and guiding the implementation of the Ordinance on the State Honorary Title "Mother Vietnam Heroic". Model No. 01a/BMAH, Model No. 01b/BMAH, Model No. 03/BMAH, and Model No. 04/BMAH of the annex promulgated together with Decree No. 56/2013/NĐ-CP are replaced by Model No. 01/BMVNAH, Model No. 02/BMVNAH, Model No. 04/BMVNAH, and Model No. 06/BMVNAH of the annex promulgated together with Decree No. 83/2025/NĐ-CP as stipulated in Clause 2 of Article 2; Model No. 03/BMVNAH and Model No. 05/BMVNAH of the annex promulgated together with Decree No. 83/2025/NĐ-CP are added as stipulated in Clause 1 of Article 2; Model No. 02/BMAH of the annex promulgated together with Decree No. 56/2013/NĐ-CP is repealed as stipulated in Clause 3 of Article 2.
