At the proposal of the Minister of Construction;
The Government promulgates this Decree detailing certain provisions of the Housing Law on the development and management of social housing [1] .
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree details certain articles, clauses, and points stipulated in the Housing Law number 27/2023/QH15 (hereinafter referred to as the Housing Law) regarding:
1. Clause 2 of Article 83 concerning the requirement that the project investor of a commercial housing development project must allocate a portion of the land area within the project, which has been invested in building infrastructure, for the construction of social housing or arrange a social housing land fund that has been invested in building infrastructure at another location outside the commercial housing development project in that urban area or pay an equivalent value of the land fund that has been invested in building infrastructure to construct social housing.
2. Clause 2 of Article 34 concerning the stages of a social housing development project and housing for the People's Armed Forces.
3. Point a and point b of Clause 4 of Article 84 concerning the selection of the project investor of a social housing development project.
4. Point c, point d, and point đ of Clause 2 of Article 85 and Clause 3 of Article 85 concerning incentives for the project investor of a social housing development project (standard profit rate; commercial service, trade, and commercial housing area; preferential loan interest rates), and the project investor of a commercial housing development project directly investing in social housing within that commercial housing development project.
5. Article 82 concerning types of houses and standards for the area of social housing.
6. Point a and point b of Clause 1, Clause 6, and Clause 8 of Article 78 concerning conditions for enjoying support policies for social housing.
7. Clause 6 of Article 87 concerning the determination of the selling price, purchase price, and rental price of social housing developed without public investment funds or union financial resources.
8. Clause 4 of Article 126 concerning the determination of the price of social housing and housing for the People's Armed Forces under state assets; exemption and reduction of rent for social housing and housing for the People's Armed Forces; management, use, and operation of social housing and housing for the People's Armed Forces under state assets.
9. Clause 9 of Article 88 and point e of Clause 1 of Article 89 concerning payment of land use fees when reselling social housing.
10. Clause 4 of Article 89 concerning procedures and formalities for selling, purchasing on lease, and leasing social housing.
11. Clause 2 of Article 94 concerning environmental safety guarantees, scale, and ratio of land for developing worker dormitories in industrial zones.
12. Clause 4 of Article 100 concerning the leasing and management, use of worker dormitories in industrial zones.
13. Clause 3 of Article 109 concerning procedures and formalities for selling, purchasing on lease, and leasing housing for the People's Armed Forces.
14. Clause 5 of Article 77 concerning support for preferential loans through the Social Policy Bank and credit institutions designated by the State to purchase, lease, build, or renovate and repair housing.
15. Clause 4 of Article 117 concerning preferential loans through the Social Policy Bank and the Vietnam Development Bank for the development of social housing.
16. Clause 2 of Article 125 concerning the review of proposals to sell social housing and housing for the People's Armed Forces under state assets currently being leased.
17. Clause 10 of Article 88 concerning compulsory recovery of social housing.
18. Clause 2 of Article 191 concerning transitional provisions on social housing.
19 [2] General principles for administrative procedures in this Decree:
a) Administrative procedure application files shall be submitted in person, online, or through postal services;
b) Forms, declarations, and file components specified in Clause 1 of Article 13, Clause 5 of Article 19, Article 29, Clause 1 and Clause 2 of Article 30, Clause 2 of Article 35, Article 37, Article 38, Clause 2 of Article 44, point a of Clause 2 of Article 48, Article 63, Article 67, Article 68, and Clause 2 of Article 70 shall be replaced with personal identification codes or specialized codes when national population databases or specialized databases are operational;
c) Results of administrative procedures shall be provided electronically; if individuals or organizations request paper copies, the administrative procedure handling agency shall provide both electronic and paper copies simultaneously. Electronically provided results of administrative procedures have the same legal effect as those provided in paper form.”
Article 2. Applicability
This Decree applies to the following subjects:
1. Organizations, households, individuals belonging to domestic and foreign economic sectors and overseas Vietnamese participating in the development of social housing, worker dormitories in industrial zones, and housing for the People's Armed Forces as prescribed by the Housing Law.
2. Subjects eligible to purchase, lease-purchase, or lease social housing; to lease worker dormitories; to purchase, lease-purchase, or lease housing for the People's Armed Forces as prescribed by the Housing Law.
3. State management agencies and other organizations related to the development and management of social housing, worker dormitories in industrial zones, and housing for the people's armed forces.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. The household entitled to support policies on social housing under this Decree includes the spouse, parents, and children of the person entitled to such support policies as stipulated in Article 77 of the Law on Housing.
2. A social housing project for rental purposes is a social housing project that is developed solely for rental.
3. Social housing investment projects and housing projects for the people's armed forces include housing projects as defined in points a, b, c, đ, and e of Clause 1, Article 30 of the Law on Housing.
4. The low-income individuals specified in Clause 5, Article 76 of the Law on Housing are those with income levels as prescribed in Article 30 of this Decree.
Chapter II. STAGES OF SOCIAL HOUSING INVESTMENT AND CONSTRUCTION PROJECTS, HOUSING FOR THE PEOPLE'S ARMED FORCES
Section 1. PREPARATION STAGE OF SOCIAL HOUSING INVESTMENT AND CONSTRUCTION PROJECTS, HOUSING FOR THE PEOPLE'S ARMED FORCES
Article 4. Investment proposal for housing construction projects when applying for decision or approval of investment orientation
1. The preparation of an investment proposal for social housing construction projects and housing for the people's armed forces when applying for a decision or approval of investment orientation shall be implemented according to the provisions of Article 13 of Decree No. 95/2024/NĐ-CP dated July 24, 2024, detailing certain provisions of the Law on Housing.
2. For social housing construction projects funded by trade union financial resources, the Vietnam General Confederation of Labor shall assign subordinate units or public service units under its jurisdiction to prepare the investment proposal.
Article 5. Planning for construction to implement housing investment projects
1. The planning for construction to implement social housing investment projects and housing for the people's armed forces shall be carried out according to the provisions of Clause 1, point c of Clause 2, and Clause 3 of Article 14 of Decree No. 95/2024/NĐ-CP dated July 24, 2024, detailing certain provisions of the Law on Housing, and the provisions of this Article.
2. Requirements for the level of planning to select the project investor are as follows:
a) In cases where a tender is conducted to select the project investor, the planning requirements shall be applied as stipulated in point d of Clause 1 of Article 21 of this Decree;
b) In cases where the State uses land from commercial housing projects to invest in social housing to be handed over to other organizations for implementation, as provided for in Clause 3 of Article 84 of the Law on Housing, the State shall organize the selection of investors according to the provisions of this Decree if the social housing indicators have been determined in the detailed planning at a scale of 1/500 of the commercial housing project approved by the competent state authority.
If the detailed planning at a scale of 1/500 of the commercial housing project has not yet determined the social housing indicators in the project, the tender to select the investor for the social housing investment project shall be implemented according to the provisions of point a of this clause.
3. In cases where land must be reserved from a commercial housing project that has already been developed with infrastructure systems to build social housing as provided for in Clause 1 of this Article, the land area shall be determined according to the detailed planning at a scale of 1/500 of the commercial housing project approved by the competent authority.
Article 6. Decision, approval, adjustment of investment orientation for housing construction projects
1. The decision, approval, and adjustment of investment orientation for social housing construction projects and housing construction projects for the People's Armed Forces shall be implemented in accordance with the provisions of Clauses 1, 2, 3, 4, and 6 of Article 15 of Decree No. 95/2024/NĐ-CP dated July 24, 2024 of the Government detailing certain provisions of the Law on Housing, and the provisions of this Article.
The decision and adjustment of investment orientation for social housing construction projects funded by trade union financial resources shall be carried out in accordance with the regulations applicable to public investment projects under the laws on public investment.
2. In cases where the State uses land funds from commercial housing construction projects to invest in social housing construction projects to be handed over to other organizations for implementation according to Clause 3 of Article 84 of the Law on Housing, before selecting a new project investor, the competent authority must implement investment orientation approval in accordance with the laws on investment.
3. For housing construction projects that require investment orientation approval under the laws on investment, the leading agency responsible for reviewing the investment orientation must seek the review opinions of the housing management agency at the same level regarding the contents stipulated by the laws on investment and Clauses 4 and 5 of this Article.
For housing construction projects for the People's Armed Forces, the opinions of the Ministry of National Defense and the Ministry of Public Security must be sought regarding the requirements of the project and other relevant contents (if any).
4. The content of the review opinions on social housing and housing for the People's Armed Forces in the application for investment orientation approval includes the contents prescribed in Clause 5 of Article 15 of Decree No. 95/2024/NĐ-CP dated July 24, 2024 of the Government detailing certain provisions of the Law on Housing, and the following contents:
a) A preliminary total investment amount of the project;
b) Type of house and standard floor area of housing;
c) Mechanisms and policies supporting the project investor (if any).
5. The review content on housing in the application for investment orientation approval and simultaneous approval of the project investor for social housing and housing for the People's Armed Forces includes:
a) Compliance with the conditions for being a project investor as prescribed by the laws on housing, laws on investment, laws on land, and related laws (except in cases where the project investor has been selected according to the laws on housing, laws on land, and related laws);
b) The contents prescribed in Clause 4 of this Article.
6. The agencies and individuals with authority are only responsible for the contents assigned to provide review opinions on housing in the application for investment orientation approval as stipulated in Clauses 4 and 5 of this Article; they are not responsible for the contents in documents and papers in the file that have been approved, reviewed, or resolved by other competent agencies or individuals prior to this.
Article 7. Project Investor for Housing Construction Projects
1. For projects using public investment capital and trade union financial resources, the determination of the project investor shall be applied in accordance with Clause 3 of Article 7 of the Construction Law and the laws on public investment.
2. For projects using the capital sources specified in Point b, Clause 1 of Article 113 of the Law on Housing, the determination of the project investor shall be applied in accordance with Clause 2 of Article 7 of the Construction Law.
3. For projects not using the capital sources specified in Clauses 1 and 2 of this Article and not falling within the category of commercial housing construction project investors directly investing in social housing, the selection of the project investor shall be carried out through one of the following methods:
a) Approval of the project investor as prescribed in Point a, Clause 4 of Article 84 of the Law on Housing;
b) Tendering to select the project investor as prescribed in Point b, Clause 4 of Article 84 of the Law on Housing;
c) Approval of the investment orientation simultaneously approving the project investor as prescribed in Point c, Clause 4 of Article 84 of the Law on Housing.
4. The procedures for selecting the project investor as prescribed in Points a and b, Clause 3 of this Article shall be implemented in accordance with Articles 20 and 21 of this Decree.
5. In the case prescribed in Point c, Clause 3 of this Article, the document approving the investment orientation simultaneously approving the project investor under the laws on investment shall be the document determining the project investor.
6. In cases where it is necessary to reserve land funds in commercial housing construction projects for social housing construction as prescribed in Article 17 of this Decree, the investor of the commercial housing construction project shall directly carry out the investment in social housing construction on this land fund.
In cases where the State uses this land fund to hand over to other organizations for implementing social housing construction projects and housing construction projects for the People's Armed Forces as prescribed, the selection of the project investor shall be carried out in accordance with Articles 20 and 21 of this Decree.
7. In cases where multiple investors for social housing and housing for the People's Armed Forces are approved for investment orientation under the laws on investment, these investors may entrust one qualified investor or establish a company or cooperative with the qualifications to be the project investor for housing construction in accordance with the laws on housing. The entrusting of the project investor for social housing and housing for the People's Armed Forces as prescribed in this Clause shall be carried out through a Delegation Agreement, clearly defining the rights and responsibilities of the parties.
Article 8. Allocation of land, leasing of land, change of land use purpose for implementing housing investment projects
1. The allocation of land, leasing of land, and change of land use purpose for implementing social housing investment projects, housing for the people's armed forces, and commercial housing within the scope of social housing investment projects and housing for the people's armed forces (if applicable) shall be carried out in accordance with the laws on land. Compensation, support, and resettlement (if applicable) of the project shall be implemented in accordance with the laws on land.
2. The investor of social housing investment projects and housing for the people's armed forces shall be exempted from land use fees and land lease fees for the entire area of the project; the investor does not need to go through procedures to determine the land price, calculate the land use fee, and land lease fee that are exempted, nor does the investor need to go through procedures to request exemption from land use fees and land lease fees.
In cases where the investor implements the construction of commercial housing within the scope of the project as stipulated in point d, Clause 2, Article 85 of the Law on Housing, the determination of the land price and calculation of the land use fee to be paid must be carried out in accordance with the laws on land.
3. The decision on land allocation and land leasing must clearly state the portion of the land area intended for the construction of commercial housing that requires payment of the land use fee when the investor of the project constructs commercial housing within the scope of the project.
4. In cases where the investor of a social housing investment project has already paid the land use fee when the investor acquires the right to use the land through an agreement to receive the right to use the land for the type of land being used for the social housing investment project, or currently holds the right to use the land for the type of land being used for the social housing investment project in accordance with the Land Law, the provincial People's Committee shall consider and decide on the refund or deduction of the land use fee that the investor has paid to the State in accordance with the laws on land use fees and land lease fees, calculated at the time the State issues the decision allowing the change of land use purpose.
Article 9. Implementation of other related procedures during the preparatory stage of the project
1. After selecting the investor in accordance with Article 7 of this Decree, the investor of the project must carry out related procedures such as agreeing on infrastructure connection, environmental protection commitments if required, implementing fire prevention and firefighting measures in accordance with the laws on fire prevention and firefighting, and carrying out other related procedures in accordance with the laws.
In cases where the project does not yet have a detailed plan approved, the investor shall prepare, submit for review and approval the detailed plan of the project in accordance with the laws on planning and construction.
2. Depending on the nature of the project and specific conditions, the investor may implement different steps or simultaneously carry out the procedures specified in this Article in a manner consistent with the sequence and procedures prescribed by the laws on construction, land, and relevant laws.
Article 10. Preparation, Review, and Approval of Housing Investment Projects
The preparation, review, and approval of social housing investment projects and housing for the people's armed forces shall be implemented in accordance with the provisions of Article 19 of Decree No. 95/2024/NĐ-CP dated July 24, 2024 of the Government detailing certain provisions of the Law on Housing.
Section 2. STAGE OF IMPLEMENTATION OF SOCIAL HOUSING INVESTMENT AND CONSTRUCTION PROJECTS, HOUSING FOR THE PEOPLE'S MILITARY FORCES
Article 11. Preparation, Review and Approval of Construction Design
The preparation, review, and approval of construction design for social housing investment and construction projects, and housing for the people's military forces shall be implemented in accordance with the provisions set forth in Article 20 of Decree No. 95/2024/NĐ-CP dated July 24, 2024, of the Government detailing certain provisions of the Law on Housing.
Article 12. Issuance of Construction Permits
The issuance of construction permits for social housing investment and construction projects, and housing for the people's military forces shall be carried out in accordance with the provisions set forth in Article 21 of Decree No. 95/2024/NĐ-CP dated July 24, 2024, of the Government detailing certain provisions of the Law on Housing.
Article 13. Construction and Business Activities of Sale, Purchase, Lease-Purchase of Future Housing Units
1. After obtaining the Construction Permit, the project investor must notify the commencement of construction to the local construction management authority in accordance with the laws on construction.
After commencing construction, the project investor is responsible for providing information related to the project in accordance with point a, Clause 1, Article 38 of this Decree. For projects implementing housing for the people's military forces in accordance with point a, Clause 1, Article 68 of this Decree.
2. The construction activities of the project must be carried out in accordance with the laws on construction and relevant laws.
3. The business activities of sale, purchase, lease-purchase of future social housing units and housing for the people's military forces within the project shall be conducted in accordance with Article 88 of the Law on Housing. Any business activities of sale, lease of future commercial housing units (if any) within the scope of the project shall be carried out in accordance with the laws on housing and laws on real estate business.
After the housing units and other construction works of the housing investment and construction project meet the conditions for operation as stipulated by the laws on housing and laws on real estate business, the project investor may conduct business operations of housing products and other construction works in accordance with the regulations.
The project investor prepares and submits to the specialized agency of the provincial People's Committee for review the selling price and lease-purchase price of social housing and housing for the people's military forces in accordance with the regulations.
The project investor must fulfill financial obligations regarding land use in accordance with Clause 2, Article 23 of this Decree before putting commercial housing products into business operations (if any).
Article 14. Acceptance of Completed Construction Works
The acceptance of completed construction works of social housing investment and construction projects, and housing for the people's military forces shall be carried out in accordance with the provisions set forth in Article 23 of Decree No. 95/2024/NĐ-CP dated July 24, 2024, of the Government detailing certain provisions of the Law on Housing.
Section 3. STAGE OF COMPLETION OF SOCIAL HOUSING INVESTMENT AND CONSTRUCTION PROJECTS, HOUSING FOR THE PEOPLE'S MILITARY FORCES
Article 15. Stage of Completion of Housing Investment and Construction Projects
The stage of completion of social housing investment and construction projects, and housing for the people's military forces shall be carried out in accordance with the provisions set forth in Article 24 of Decree No. 95/2024/NĐ-CP dated July 24, 2024, of the Government detailing certain provisions of the Law on Housing.
Article 16. Handing Over Housing
The handover of social housing and housing for the people's armed forces shall be carried out in accordance with the provisions of Clause 3 and Clause 4 of Article 37 of the Law on Housing and Article 25 of Decree No. 95/2024/NĐ-CP dated July 24, 2024, issued by the Government detailing certain provisions of the Law on Housing.
Chapter III. ON SOCIAL HOUSING
Section 1. THE ALLOCATION OF LAND AREA FOR SOCIAL HOUSING WITHIN THE SCOPE OF A RESIDENTIAL COMMERCE DEVELOPMENT PROJECT OR ARRANGEMENT AT ANOTHER LOCATION OUTSIDE THE SCOPE OF THE PROJECT OR PAYMENT EQUIVALENT TO THE VALUE OF THE INVESTED LAND FUND FOR THE CONSTRUCTION OF SOCIAL HOUSING INFRASTRUCTURE SYSTEMS
Article 17. Allocation of a portion of land area within a residential commerce development project that has been invested in infrastructure systems for the construction of social housing
1. In special-class cities, class I, class II, and class III cities, the provincial People's Committee where the residential commerce development project is located must decide that the project investor allocate 20% of the total land area (excluding existing residential land and resettlement land) within the scope of the project, which has been invested in infrastructure systems, for the construction of social housing (hereinafter referred to as the social housing land fund), when approving the investment orientation of the project within its authority.
In cases where the residential commerce development project is located in special-class cities, class I, class II, and class III cities and falls under the Prime Minister's authority to approve the investment orientation, the provincial People's Committee where the project is located decides to allocate 20% of the total land area (excluding existing residential land and resettlement land) within the scope of the project, which has been invested in infrastructure systems, for the construction of social housing when the competent agency proposes approval of the investment orientation for the Prime Minister's approval.
2. In cases where the boundaries of a residential commerce development project overlap with the administrative boundaries of multiple units, including at least one class III city or higher, the project investor must allocate 20% of the total land area of the project, which has been invested in infrastructure systems, for the construction of social housing according to the provisions of Clause 1 of this Article.
Article 18. Allocation of the social housing land fund that has been invested in infrastructure systems at another location outside the scope of the residential commerce development project
1. In special-class cities, class I, class II, and class III cities, for projects under the authority to approve the investment orientation, the provincial People's Committee considers and decides on the allocation of the social housing land fund that has been invested in infrastructure systems at another location outside the scope of the residential commerce development project when approving the investment orientation and approving the investor according to the following provisions:
a) Projects that must allocate the social housing land fund as stipulated in Article 17 of this Decree;
b) The investor has a land fund consistent with the land planning and utilization plan and located within the same city as the residential commerce development project, with an area of residential land equivalent in value to the value of the social housing land fund that has been invested in infrastructure systems as stipulated in Article 17 of this Decree or an area of residential land equivalent to the area of residential land that must be allocated for the construction of social housing in the residential commerce development project;
c) The investor has a document proposing the allocation of the land fund specified in point b of this clause to replace the social housing land fund stipulated in Article 17 of this Decree.
2. For residential commerce development projects in special-class cities, class I, class II, and class III cities, under the Prime Minister's authority to approve the investment orientation and approve the investor, the provincial People's Committee where the project is located decides on the allocation of the social housing land fund that has been invested in infrastructure systems at another location outside the scope of the residential commerce development project when the competent agency proposes approval of the investment orientation and approval of the investor for the Prime Minister's consideration and approval if the project meets the provisions of points a, b, and c of Clause 1 of this Article.
3. If the competent authority approves the allocation of the social housing land fund that has been invested in infrastructure systems at another location outside the project scope as stipulated in Clauses 1 and 2 of this Article, the provincial People's Committee is responsible for adjusting the land utilization plan in accordance with the laws on land; approving or reporting to the competent authority for approval of the investment orientation and approval of the investor as the basis for the investor to implement the construction of social housing on the replacement land area stipulated in Clauses 1 and 2 of this Article; investing in infrastructure systems outside the replacement land area stipulated in Clauses 1 and 2 of this Article.
Article 19. Cases of depositing money equivalent to the value of the land fund already invested in constructing technical infrastructure systems for building social housing
1. In special-class cities, class I, class II, and class III cities, the provincial People's Committee, when approving the investment orientation of projects to construct commercial housing, shall approve the investor to implement the project to construct commercial housing according to their authority to examine and decide on not setting aside the land fund that has been invested in constructing technical infrastructure systems within the project as stipulated in Articles 17 and 18 of this Decree, and approve the project investor to deposit money equivalent to the value of the land fund that has been invested in constructing technical infrastructure systems which must be set aside for building social housing.
In cases where projects to construct commercial housing in special-class cities, class I, class II, and class III cities, fall under the Prime Minister’s authority to approve the investment orientation, the provincial People's Committee where the project is located shall decide on not setting aside the area of residential land for building social housing as stipulated in Articles 17 and 18 of this Decree, and approve the project investor to deposit money equivalent to the value of the land fund that has been invested in constructing technical infrastructure systems which must be set aside for building social housing upon receiving the opinion of the leading agency on the examination and approval of the proposal to approve the investment orientation from the competent agency, for the Prime Minister to approve.
2. The amount of money that the project investor must pay, equivalent to the value of the land fund that has been invested in constructing technical infrastructure systems which must be set aside for building social housing, includes:
a) Land use fee for 20% of the residential land area of the project determined according to the laws on land;
b) The amount of money equivalent to the cost of investing in constructing technical infrastructure systems, calculated by multiplying the ratio of 20% of the residential land area over the total land area of the project with the total cost of investing in constructing technical infrastructure systems of the project based on the construction cost index for technical infrastructure announced by the Minister of Construction at the time of calculating the land use fee as stipulated in point a of Clause 2, excluding costs for leveling and filling and sea reclamation costs in cases where the project includes sea reclamation works.
2a. In cases where the project investor delays payment as prescribed in Clause 2 of this Article, they must pay late payment fees (or an amount equivalent to late payment fees) for the amount prescribed in Clause 2 of this Article according to the laws on tax management.
3. The amount of money that the project investor must pay as prescribed in Clause 2 and Clause 2a (if applicable) of this Article must be deposited into the local budget and managed and used according to the laws on state budget and the laws on the National Housing Fund.
4. In cases where the project investor of a project to construct commercial housing has paid money equivalent to the value of the land fund for social housing that has been invested in technical infrastructure systems as prescribed in Clause 2 and Clause 2a (if applicable) of this Article, it is considered that the obligation regarding social housing has been fulfilled.
5. The documents that the project investor of a project to construct commercial housing must submit when depositing money equivalent to the value of the land fund as prescribed in Clause 2 of this Article are as follows:
a) For projects under the provincial People's Committee’s authority to approve the investment orientation, it is the document approving the investment orientation or the document approving the investor according to the laws on investment;
b) For projects under the Prime Minister’s authority to approve the investment orientation, it is the document approving the investment orientation according to the laws on investment; the document of the provincial People's Committee responding to the leading agency on the examination and approval of the proposal to approve the investment orientation for the Prime Minister to decide on approving the investment orientation of the project.
Mục 2. INVESTMENT PROJECT DEVELOPERS FOR SOCIAL HOUSING
Article 20. Selection of Investment Project Developers for Social Housing in Cases Where Only One Investor Is Interested
1. In cases where only one investor meets the requirements of the tender invitation under the laws on bidding, the People's Committee of the province where the project is located shall approve such investor to be the developer of the investment project for social housing when it satisfies the conditions for approval of investors under the laws on investment and the conditions regarding capital ownership and the ability to mobilize capital under the laws on real estate business, land, and other related laws.
2. The procedures for approving investors shall be carried out in accordance with the laws on investment.
3. The document approving investors under the laws on investment is the document determining the developer of the investment project for social housing as stipulated in this Article.
Article 21. Selection of Investment Project Developers for Social Housing Through Bidding
1. Conditions for investment projects for social housing to conduct bidding to select developers include:
a) Meeting the conditions and criteria as prescribed for projects that must organize bidding according to the laws on bidding;
b) Not falling within the cases prescribed in point a and c, Clause 4, Article 84 of the Law on Housing;
c) Having a Decision approving the investment orientation as prescribed by the laws on investment;
d) Possessing a detailed planning scheme at a scale of 1/2000 or 1/500.
2. Organizations participating in bidding to select developers of investment projects for social housing must meet the conditions stipulated in Clause 5, Clause 6, Article 126 of the Land Law No. 31/2024/QH15 dated January 18, 2024, and guiding documents implementing the Land Law, the Bidding Law No. 22/2023/QH15 dated June 23, 2023, and guiding documents implementing the Bidding Law.
3. Announcing the investment project for social housing to select developers through bidding shall be conducted in accordance with the Bidding Law No. 22/2023/QH15 dated June 23, 2023, and guiding documents implementing the Bidding Law.
4. The tender invitation and tender documents for selecting investors to implement investment projects for social housing shall be prepared based on bidding document templates as prescribed by the laws on bidding, but the tender documents must ensure compliance with the evaluation criteria as stipulated in Clause 5 of this Article.
5. The evaluation of tender documents for selecting investors to implement investment projects for social housing shall be conducted in accordance with the laws on bidding.
Tender documents shall be evaluated on a 100-point scale, wherein the total score is the sum of points for evaluation criteria on capacity and experience, points for evaluation criteria on investment business plans, and points for evaluation criteria on investment development effectiveness in industries, sectors, and regions, ensuring a total weight of 100%.
a) Evaluation Criteria on Capacity and Experience:
Financial capacity criteria for implementing the project (selecting investors with a higher proportion of own capital as prescribed by the laws on real estate business): from 5% to 10% of the total points.
Experience criteria for implementing investment construction projects for housing (selecting investors with more experience in implementing housing investment construction projects): from 5% to 10% of the total points.
b) Evaluation Criteria on Investment Business Plans:
Criteria on the suitability of the investment business plan for the project with the local housing development program and plan and the requirements of the tender documents: from 7% to 10% of the total points.
Criteria on the feasibility of the construction technology application solutions proposed by the investor: from 1% to 2% of the total points.
Criteria on infrastructure investment and social infrastructure: from 5% to 7% of the total points; in cases where the project already has infrastructure, all investors will receive maximum points.
Criteria on the project implementation schedule and putting the works into use (selecting investors who propose the shortest implementation time): from 2% to 3% of the total points.
Criteria on resettlement compensation and support plans (if applicable): from 2% to 3% of the total points; in cases where the project pre-funds compensation, support, and resettlement at a minimum rate of 10% of the total investment cost, all investors will receive maximum points.
Criteria on contributions to social welfare for local workers: from 2% to 3% of the total points.
Criteria on environmental protection, energy conservation, land use ratio, and resource utilization in the project area: from 1% to 2% of the total points.
c) Evaluation Criteria on Investment Development Effectiveness in Industries, Sectors, and Regions: Criteria on selling price, purchase price, and rental price (selecting investors who propose lower prices): from 40% to 50% of the total points (in cases where the selling price criterion is determined in the bidding process without conducting a valuation, applicable when there is a detailed planning scheme at a scale of 1/500).
An investor winning the bid to become the developer of the investment project for social housing through bidding shall satisfy the conditions prescribed by the laws on bidding and meet the minimum points of each criterion stipulated in points a, b, and c of this clause, having the highest total points of the criteria and not less than 70% of the total points.
In cases where the total points of the criteria are equal, the investor with higher criteria in the order prescribed in this clause shall be selected, ensuring the principle that if an investor has met the content before, subsequent content will not be considered.
6. The Decision approving the results of the selection of the winning bidder as stipulated in this Article is the document determining the developer of the investment project.
Section 3. INCENTIVES FOR INVESTORS OF SOCIAL HOUSING PROJECTS
Article 22. Prescribed Profit Margin
1. The prescribed profit margin for investors of social housing projects as stipulated in point c, Clause 2, Article 85 of the Law on Housing shall be determined at a maximum of 10% of the total investment cost for constructing the social housing area as specified in this Clause.
2. The total investment cost for constructing the social housing area includes the project's construction investment costs (including: social housing buildings, technical infrastructure works or components, and social infrastructure works (if any) within the project), interest (if any), and reasonable and lawful business expenses allocated to the social housing area, which are determined as follows:
a) The project's construction investment costs are determined according to the legal regulations on managing construction investment costs at the time of submission for review, including: compensation, support, and resettlement costs (if any), construction costs, equipment costs, project management costs, construction investment consulting costs, other costs, and contingency costs;
b) Interest (if any) does not include interest during the construction period that has been included in the project's construction investment costs;
c) Reasonable and lawful business expenses include sales organization costs, enterprise management costs, and directly related project costs allocated to the saleable social housing area and determined in accordance with the submission for review time. The total of these reasonable and lawful costs is equal to 2% of the construction investment costs for the saleable, lease-purchase, and rental social housing area as specified in point a of this Clause; if insufficient, the investor must prepare a budget for this expense item.
3. The construction investment costs for technical infrastructure works or social infrastructure works (common ownership if any) for the entire project and the compensation, support, and resettlement costs as specified in Clause 2 of this Article are evenly distributed among the total residential land and commercial service land areas in the social housing project.
4. The construction investment costs for common-use technical infrastructure works within the project as stipulated in Clause 2 of this Article include: investment costs for traffic systems, energy supply systems, public lighting systems, communication systems, water supply systems, drainage and wastewater treatment systems, solid waste management systems, public sanitation systems, and other technical infrastructure systems within the scope of the social housing project as regulated by the Construction Law.
Article 23. Business Service and Commercial Housing Area
1. Investors of social housing projects are entitled to incentives regarding the business service and commercial housing area as stipulated in point d, Clause 2, Article 85 of the Law on Housing.
2. In cases where investors of social housing projects construct commercial housing on the land area specified in Clause 1 of this Article, they must pay land use fees for the constructed commercial housing area according to the legal regulations on land.
3. The land area for constructing business service and commercial facilities is determined within the total commercial and service land area of the project. The land area for constructing commercial housing is determined within the total residential land area of the project. The specific determination of the land area for constructing business service and commercial facilities and commercial housing is carried out when establishing and approving the detailed planning of the project but in all cases, it shall not exceed 20% of the total residential land area of the project.
4. In cases where the detailed planning scheme of the social housing project approved by the competent state authority does not allocate separate land for constructing business service and commercial facilities within the project area, the investor may reserve a floor area ratio for business services and commerce not exceeding 20% of the total floor area of the housing project, excluding the area designated for serving the common living needs of residents within the project area (community living areas, health stations, kindergartens, and other essential infrastructure facilities serving the lives of building residents) and parking space areas as stipulated by the National Technical Regulations on Apartment Buildings.
In cases where the social housing project consists of multiple buildings, the investor may choose to arrange within each building or combine the entire floor area for business services and commerce from each building into the floor area for business services and commerce of one or several buildings.
5. In cases where investors of social housing projects construct business service and commercial facilities on the land area or reserve floor area of the project for business services and commerce, they are exempt from paying land use fees or land rental fees for such land areas or floor areas, except in cases where the investor transfers or contributes capital in such land areas or floor areas.
Article 24. Incentives for investors in commercial housing projects who directly invest in social housing within such commercial housing projects
1. In cases where investors in commercial housing projects directly invest in social housing in accordance with the provisions of Clause 2, Article 83 of the Law on Housing, the investor shall enjoy the incentives stipulated in Clause 2, Article 85 of the Law on Housing, Article 22 and Article 23 of this Decree.
2. In cases where investors in commercial housing projects directly invest in social housing in accordance with the provisions of Clause 3, Article 83 of the Law on Housing, the investor shall enjoy the incentives stipulated in Clause 2, Article 85 of the Law on Housing, Article 22 and Article 23 of this Decree.
Article 25. Preferential loans for investors in social housing projects not funded by public investment capital or trade union financial resources
The Vietnam Bank for Social Policies, the Vietnam Development Bank, and credit organizations shall provide preferential loans in compliance with the legal regulations on lending activities of the Vietnam Bank for Social Policies, the Vietnam Development Bank, and the current legal regulations on lending activities of credit organizations to customers who are investors in social housing projects not funded by public investment capital or trade union financial resources as stipulated in Clause 2, Article 85 of the Law on Housing, according to the following provisions:
1. Conditions for loan eligibility:
a) Having a social housing development project that has been approved by the competent authority in accordance with the laws on investment;
b) Being selected as the investor in the project in accordance with the laws on land, laws on investment, laws on housing, and related laws;
c) Meeting the conditions for borrowing as stipulated by the laws on lending activities of credit organizations for customers;
d) Applying security measures in lending activities in accordance with the laws and regulations of the Vietnam Bank for Social Policies and credit organizations.
2. Loan amount:
a) For the construction of social housing for sale or lease-purchase: The maximum loan amount is 70% of the total investment cost of the project or funding plan and does not exceed 70% of the value of the collateral securing the loan;
b) For the construction of social housing solely for rental: The maximum loan amount is 80% of the total investment cost of the project or funding plan and does not exceed 80% of the value of the collateral securing the loan.
3. Loan term:
a) For the construction of social housing for sale, the maximum loan term does not exceed 10 years from the date of the first loan disbursement;
b) For the construction of social housing for lease-purchase, the maximum loan term does not exceed 15 years from the date of the first loan disbursement;
c) For the construction of social housing solely for rental, the maximum loan term does not exceed 20 years from the date of the first loan disbursement.
4. Interest rate on loans:
a) For projects constructing social housing for sale or lease-purchase, the preferential interest rate at the Vietnam Bank for Social Policies is 120% of the interest rate for borrowers at the Vietnam Bank for Social Policies to purchase or lease-purchase social housing during each period. The overdue interest rate is 130% of the loan interest rate;
b) For projects constructing social housing solely for rental, the preferential interest rate at the Vietnam Bank for Social Policies is the interest rate for borrowers at the Vietnam Bank for Social Policies to purchase or lease-purchase social housing during each period. The overdue interest rate is 130% of the loan interest rate;
c) The preferential interest rate for loans from credit organizations is agreed upon between the credit organization and the customer.
5. Loan disbursement: The loan funds are disbursed according to the progress of implementation and the request of the investor. The amount of each disbursement is based on the completed volume of work according to the technical stop point.
6. Conditions for borrowing, loan amount, loan term, interest rate on loans, collateral for loans, and other relevant contents for loans at the Vietnam Development Bank are governed by the current legal regulations on state investment credit.
7. In addition to the provisions stipulated in Clauses 1, 2, 3, 4, and 5 of this Article, other relevant contents related to lending activities are implemented by credit organizations in accordance with the current legal regulations on lending activities of credit organizations for customers.
Article 26. Personal Loan Incentives for Building or Renovating Housing for Rental Purposes
Individuals who build or renovate housing for rental purposes to beneficiaries of social housing support policies as stipulated in Clause 4, Article 85 of the Law on Housing shall be entitled to preferential loans under the following provisions:
1. Conditions for obtaining a loan
a) Possess the ability to repay the loan according to commitments with credit institutions providing the loan;
b) Hold a Certificate of Land Use Right and Ownership Certificate of Fixed Assets attached to the land for the construction or renovation project;
c) Have a capital utilization plan and a construction permit when required by law. In cases where there is a time-limited construction permit as prescribed by law, the loan will be considered in accordance with the duration of the existence of the project;
d) Ensure collateral for the loan by the value of residential land use rights and fixed assets attached to the land or other assets as prescribed by law.
2. Loan amount: The maximum loan amount is 70% of the total investment cost of the project or capital utilization plan and does not exceed 70% of the value of the collateral.
3. Loan term: The maximum loan term shall not exceed 20 years from the date of the first disbursement.
4. Interest rate on loans:
a) The preferential loan interest rate at the Social Policy Bank shall be equal to the loan interest rate for borrowers at the Social Policy Bank for purchasing or leasing social housing as prescribed during each period. The overdue interest rate is 130% of the loan interest rate;
b) The preferential loan interest rate of credit organizations shall be agreed upon between the credit organization and the customer.
5. Individuals who build or renovate housing for rental purposes to beneficiaries of social housing support policies as stipulated in Clause 4, Article 85 of the Law on Housing shall be entitled to preferential loans meeting the provisions of Clause 1 of this Article and must establish an investment project. They may not engage in business activities involving social housing products through sale transactions. During implementation, they must report to the provincial housing management agency every three months.
Section 4. TYPES OF HOUSING AND AREA STANDARDS FOR SOCIAL HOUSING
Article 27. Types of Housing and Area Standards for Social Housing Projects
1. In cases where social housing is apartment buildings constructed under projects, the following requirements must be met:
a) Must be designed and built as closed units, complying with national technical standards, and conforming to applicable standards as prescribed by law;
b) The minimum usable area per apartment unit is 25 square meters, and the maximum is 70 square meters; 2 c) The maximum usable area standard for apartment units can be adjusted upwards, but the increase cannot exceed 10% of the maximum usable area of 70 square meters, 2 ;
and ensure that the proportion of apartment units in social housing projects with a usable area exceeding 70 square meters 2 does not exceed 10% of the total number of social housing units in the project. 2 2. In cases where social housing is individual houses constructed under projects, they can only be built in villages belonging to ethnic minority areas and mountainous regions as prescribed by the Prime Minister, and must meet the following requirements:
a) Must be designed and built according to national technical standards and regulations on planning construction;
b) The building density, land use coefficient, and height of individual houses must comply with rural planning or architectural management regulations for rural settlements approved by competent authorities;
c) The plot size standard for social housing individual houses shall not exceed 70 square meters,
and the land use coefficient shall not exceed 2.0 times. 2 , the land utilization coefficient shall not exceed two times.
Article 28. Types of houses and standards for the area of social housing built by individuals for lease
1. In cases where individuals construct multi-story buildings with multiple units, they must ensure the following regulations:
a) In cases where the building has two or more floors and consists of twenty or more units, it must comply with the provisions set forth in Clause 1, Article 57 of the Law on Housing;
b) In cases where the building has two or more floors but consists of fewer than twenty units, it must comply with the provisions set forth in Clause 3, Article 57 of the Law on Housing.
2. In cases where individuals construct single-story row houses for lease, they must ensure the following regulations:
a) They must be constructed as self-contained units (with separate living rooms and bathrooms) according to construction standards;
b) The average usable area per person for living purposes shall not be less than eight square meters 2 (excluding auxiliary areas);
c) They must meet the quality requirements for construction projects at level IV or higher under the laws on construction;
d) The layout of the construction of houses and other construction works within the single-story row house on the land must ensure convenient traffic conditions, environmental hygiene, and conditions for dealing with emergencies (fires, explosions, collapses of structures...).
Section 5. CONDITIONS FOR ENJOYING SUPPORT POLICIES ON SOCIAL HOUSING
Article 29. Conditions regarding housing
1. [3] The case of not having housing owned by oneself is determined when the subject specified in Clause 1, Article 77 of the Law on Housing and their spouse (if any) are identified as not being listed or having no information about housing in the Certificate of Land Use Right, Ownership of Property attached to the land in the province or centrally-run city where the social housing project is located.
Within seven days from the date of receiving the request for confirmation of housing conditions, the authority issuing the Certificate of Land Use Right, Ownership of Property attached to the land, in accordance with the laws on land in the province or centrally-run city where the social housing project is located, shall confirm in accordance with this clause."
2. In cases where the subject specified in Clause 1, Article 77 of the Law on Housing owns housing but the average housing area per person is less than fifteen square meters 2 per person. The average housing area per person stipulated in this clause is determined based on including: the applicant, the spouse (if any), parents (if any), and children (if any) registered as permanent residents in that house.
Within seven days from the date of receiving the application for confirmation of the average housing area per person, the People's Committee of the commune shall carry out the confirmation for the case stipulated in this clause.
Article 30. Income Conditions
1. For the subjects specified in Clauses 5, 6, and 8 of Article 76 of the Law on Housing, the following income conditions must be met:
a) In cases where the applicant is unmarried or recognized as single, the average monthly actual income does not exceed twenty million dong, calculated according to the Wage and Salary Table confirmed by the employer.
In cases where the applicant is unmarried or recognized as single and raising a child under the age of majority, the average monthly actual income does not exceed thirty million dong, calculated according to the Wage and Salary Table confirmed by the employer.
b) In cases where the applicant is married in accordance with the law, the combined average monthly actual income of the applicant and their spouse does not exceed forty million dong, calculated according to the Wage and Salary Table confirmed by the employer.
The period for determining the income condition as provided in points a and b of this clause is twelve consecutive months, starting from the time point when the competent authority implements the confirmation.
Based on the conditions, income levels in each region on the territory, preferential policies on housing for civil servants, public officials, and employees, the number of dependents as prescribed by law, the Provincial People's Committee may decide the adjustment factor for the income level as provided in points a and b of this clause, but not exceeding the ratio between the average income per capita in the locality and the national average income per capita; deciding policies to encourage access to social housing for subjects enjoying support policies on social housing with three (03) or more dependents in the same household.
2. [4] In cases where the subject specified in Clause 5 of Article 76 of the Law on Housing does not have a labor contract, they must meet the income conditions as provided in Clause 1 of this article and be confirmed by the Public Security Office of the commune where they are permanently residing, temporarily residing, or currently residing. Within seven days from the date of receiving the request for confirmation, the Public Security Office of the commune where the citizen is permanently residing, temporarily residing, or currently residing at the time of the citizen's application shall be responsible for confirming the following information: surname, middle name, and given name; date of birth; gender; personal identification number; date of issuance of identity card/residence book; place of permanent residence/temporary residence/current place of residence.
Citizens are responsible for declaring and committing to the average monthly income information. The Public Security Office of the commune shall cooperate with relevant agencies in verifying and post-verifying the average monthly income information of citizens in necessary cases.
The application for confirmation of income conditions as provided in this clause is simultaneously a document proving the subject eligible for support policies on social housing."
3. For the subjects specified in Clauses 2, 3, and 4 of Article 76 of the Law on Housing, they must belong to households classified as poor or near-poor according to the poverty standard of the Government.
4. For the subjects specified in Clause 7 of Article 76 of the Law on Housing, the income conditions shall be applied as provided in Article 67 of this Decree.
Mục 6. RENTAL PRICES, PURCHASE RENTAL PRICES, AND RENTAL PRICES FOR SOCIAL HOUSING
Article 31. DETERMINATION OF RENTAL PRICES AND PURCHASE RENTAL PRICES FOR SOCIAL HOUSING BUILT WITH STATE INVESTMENT FUNDS OR UNION FINANCIAL RESOURCES
1. The rental price for social housing built with state investment funds or union financial resources shall be determined in accordance with the following provisions:
a) The rental price for social housing shall be determined based on covering the costs specified in Clause 1 of Article 86 of the Law on Housing and excluding the benefits stipulated in Clause 1 of Article 85 of the Law on Housing;
b) The method for determining the rental price for social housing shall be calculated according to the following formula:
Where:
G organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. : is the rental price for 01 square meter 2 used for living in 01 month (VND/square meter/month) 2 - Total annual management and operation costs of the official housing area (VND/year).
V đ : is the total construction cost excluding value-added tax to implement the project to build social housing (including costs allocated to the social housing project) as prescribed by laws on construction project management, allocated annually to the usable area of rented housing in accordance with the principle of capital preservation.
d.1. Amount of taxable income in Vietnam: đ (VND): is the total construction cost for the area of social housing as prescribed in Clause 2 of Article 22 of this Decree, based on the final settlement value of the investment capital approved by the competent state authority; if the final settlement has not been approved, it shall be determined based on the construction cost of the project approved by the competent state authority or the actual bidding result (if any).
r (%/year): is the interest rate for preserving the investment capital (per year) decided by the investor.
n: is the number of years for recovering the investment capital of the project decided by the investor but at least 20 years.
B organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. : is the average annual maintenance cost allocated to the usable area of rented housing as prescribed by laws on quality management, construction, and maintenance of construction projects.
Provincial People's Committees set specific prices organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. : is the usable area of rented housing.
K: is the floor adjustment factor for the rental price of the apartment determined according to the weighted average principle and ensuring that the weighted average of the housing areas of each floor of a building equals 1.
VAT: value-added tax as prescribed by laws on taxation.
Number 12: is the number of months within one year.
c) The determination of the rental price shall be carried out for the entire project or for each phase of the investment (if any), in accordance with the investment policy of the project.
2. The purchase rental price for social housing built with state investment funds shall be implemented in accordance with the following provisions:
a) The purchase rental price for social housing shall be determined based on covering the costs specified in Clause 2 of Article 86 of the Law on Housing and excluding the benefits stipulated in Clause 1 of Article 85 of the Law on Housing;
b) The method for determining the purchase rental price for social housing shall be calculated according to the following formula:

G organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. : is the purchase rental price for 01 square meter 2 used for living in 01 month (VND/square meter/month) 2 - Total annual management and operation costs of the official housing area (VND/year).
V đ : is the total construction cost excluding value-added tax to implement the construction of the social housing project (including costs allocated to the social housing project) as prescribed by laws on construction project management, allocated annually to the usable area of rented housing in accordance with the principle of capital preservation. When determining Vđ, the initial payment costs agreed upon in the Contract must be deducted.
d.1. Amount of taxable income in Vietnam: đ (VND): is the total construction cost for the area of social housing as prescribed in Clause 2 of Article 22 of this Decree, based on the final settlement value of the investment capital approved by the competent state authority; if the final settlement has not been approved, it shall be determined based on the construction cost of the project approved by the competent state authority or the actual bidding result (if any).
r (%/year): is the interest rate for preserving the investment capital (per year) decided by the investor.
n: is the number of years for recovering the investment capital of the project decided by the investor but at least 05 years.
Provincial People's Committees set specific prices tm : is the usable area of rented housing.
K: is the floor adjustment factor for the purchase rental price of the apartment determined according to the weighted average principle and ensuring that the weighted average of the housing areas of each floor of a building equals 1.
VAT: value-added tax as prescribed by laws on taxation.
Number 12: is the number of months within one year.
c) The determination of the purchase rental price shall be carried out for the entire project or for each phase of the investment (if any), in accordance with the investment policy of the project.
3. Based on the provisions of Clauses 1 and 2 of this Article, the housing management agency shall be responsible for organizing and submitting the rental prices and purchase rental prices for social housing under state assets to the competent authority for approval and application to the housing currently being managed.
4. For projects funded by union financial resources, the project investor shall develop a pricing plan for submission to the Vietnam General Confederation of Labor for issuance.
Article 32. Determining the Sale Price of Social Housing Units Constructed Without Public Investment Funds or Financial Resources from Trade Unions
1. The sale price of social housing units shall be determined based on sufficient costs as stipulated in point a, Clause 1, Article 87 of the Law on Housing, without including any benefits or maintenance fees as stipulated in point b, Clause 1, Article 87 of the Law on Housing.
The determination of the sale price shall be carried out for the entire project or for each phase of investment (if applicable), in accordance with the investment policy of the project.
2. The method for determining the sale price of social housing units shall be calculated according to the following formula:

The application and procedures for requesting confirmation are Form 1 - HĐ/HTQT and the provisions in Section D.III of Circular No. 133/2004/TT-BTC, supplemented with the following specific information: B (DONG/M 2 ): is the sale price of 01 square meter 2 of a completed social housing unit (or house) at position i.
d.1. Amount of taxable income in Vietnam: đ (VND): is the total construction cost (including VAT) for the area of social housing units as prescribed in Clause 2, Article 22 of this Decree, determined based on the final settlement value of the investment capital; if the final settlement has not been approved, it shall be determined based on the approved construction cost or the actual bidding result (if available).
L (VND): is the standard profit margin determined by multiplying the standard rate with T đ .
Provincial People's Committees set specific prices B (m 2 ): is the total usable area of apartments (or houses) for sale in the housing project or in the project, including the area of apartments or houses retained by the investor for non-sale purposes.
Ki: is the adjustment factor for the sale price of the area at position i, based on the weighted average principle and ensuring that the weighted average of the housing area of a building block equals 1.
3. The procedures for appraising the sale price of social housing units constructed without public investment funds or financial resources from trade unions shall be implemented in accordance with Article 35 of this Decree.
Article 33. Determining the Rent-to-Purchase Price of Social Housing Units Constructed Without Public Investment Funds or Financial Resources from Trade Unions
1. The rent-to-purchase price of social housing units shall be implemented in accordance with Clause 2, Article 87 of the Law on Housing, without including any benefits or maintenance fees as stipulated in point b, Clause 1, Article 87 of the Law on Housing.
The determination of the rent-to-purchase price shall be carried out for the entire project or for each phase of investment (if applicable), in accordance with the investment policy of the project.
2. The method for determining the rent-to-purchase price of social housing units shall be calculated according to the following formula:

The application and procedures for requesting confirmation are Form 1 - HĐ/HTQT and the provisions in Section D.III of Circular No. 133/2004/TT-BTC, supplemented with the following specific information: TM (DONG/M 2 /month): is the rent-to-purchase price of 01 square meter 2 of a completed social housing apartment (or house) at position i for one month. The rent-to-purchase price does not include condominium maintenance fees.
Ai: is the ratio between the remaining value of the social housing apartment (or house) at position i (after deducting the initial payment) compared to the original value of the rented apartment or house i (A < 1) as stipulated in the Rent-to-Purchase Contract.
V đ (VND/year): is the total annualized construction cost of social housing units in the project allocated for the area of social housing units for rent-to-purchase, distributed annually based on the principle of capital preservation, calculated according to the following formula:
d.1. Amount of taxable income in Vietnam: đ (VND): is the total construction cost (including VAT) for the area of social housing units as prescribed in Clause 2, Article 22 of this Decree, determined based on the final settlement value of the investment capital; if the final settlement has not been approved, it shall be determined based on the approved construction cost or the actual bidding result (if available).
r (%/year): is the interest rate for preserving the investment capital (calculated annually) decided by the authorized investment decision-maker.
n: is the rental period agreed upon between the lessor and lessee but must be at least five years.
L (VND/year): is the standard profit margin calculated annually and determined by multiplying the standard rate with T đ .
Si TM (m 2 ): is the usable area of a social housing apartment (or house) for rent-to-purchase at position i in the housing project or in the project.
Ki: is the adjustment factor for the rent-to-purchase price of the area at position i, based on the weighted average principle and ensuring that the weighted average of the housing area of a building block equals 1.
3. The procedures for appraising the rent-to-purchase price of social housing units constructed without public investment funds or financial resources from trade unions shall be implemented in accordance with Article 35 of this Decree.
Article 34. Determination of rental prices for social housing funded without public investment capital or trade union financial resources
1. The method for determining rental prices for social housing funded without public investment capital or trade union financial resources shall be applied according to the method for determining rental prices for social housing funded with public investment capital as stipulated in Clause 1, Article 31 of this Decree. The rental price for social housing includes maintenance costs and fixed profit margins as prescribed and does not include state benefits.
2. The provincial housing management agency is responsible for organizing and submitting a framework for rental prices of social housing to the provincial People's Committee for issuance. During the process of establishing the framework for rental prices of social housing at the provincial level, the provincial housing management agency may hire consulting units to establish and determine the framework for rental prices of social housing.
3. For social housing built or renovated by individuals for tenants eligible for social housing support policies, the individual must independently determine the rental price ensuring it is consistent with the framework set by the provincial People's Committee where the social housing is located.
Before signing a social housing rental contract with customers, the individual must submit the rental price list to the commune People's Committee where the social housing is located for monitoring.
Article 35. Procedures and formalities for appraising sale prices and lease-purchase prices for social housing funded without public investment capital or trade union financial resources
1. The project investor directly submits one set of documents (certified copies) to the specialized agency of the provincial People's Committee where the project is located or submits the documents online through the provincial public service portal where the project is located to request an appraisal of the sale price and lease-purchase price of the social housing they have invested in, as stipulated in Clause 2 of this Article.
2. The documents submitted by the investor for price appraisal include:
a) An application for price appraisal according to the model attached as Appendix I of this Decree;
b) Legal documents of the project (including: Investment approval; Land allocation decision or Land Use Right Certificate or other proof of land use rights; Detailed planning approval at a scale of 1/500; Construction permit and other related documents).
In cases where national databases or specialized databases on land, investment, and construction activities have been operational, these can replace the information code sent along with the application form under point a of this clause.
c) The investor's plan for determining the sale price and lease-purchase price of social housing.
3. The specialized agency of the provincial People's Committee where the project is located shall conduct the appraisal of the sale price and lease-purchase price of social housing proposed by the investor according to the following regulations:
a) The specialized agency of the provincial People's Committee where the project is located shall organize the appraisal and bear responsibility before the provincial People's Committee for the results and time limit of the appraisal.
If the investor has completed the construction of social housing and has undergone auditing or settlement of project costs as prescribed, the specialized agency of the provincial People's Committee where the project is located may base its appraisal on the audit report or approved settlement decision.
b) Within thirty days from the date of receiving valid documents requesting an appraisal from the investor, the specialized agency of the provincial People's Committee where the project is located shall organize the appraisal and issue a notification of the appraisal results to the investor, clearly stating the agreed contents and those requiring revision (if any).
Based on the notification of the appraisal results, the investor shall publish the sale price and lease-purchase price of the project on the principle that it cannot exceed the appraised price.
c) If beyond the time limit specified in point b of this clause, the specialized agency of the provincial People's Committee where the project is located does not issue a notification of the appraisal results, the investor has the right to publish the price according to the proposed pricing scheme or the price requested in the bidding documents and sign purchase-sale or lease-purchase contracts with customers, but before signing the contract, the investor must send the published sale price and lease-purchase price to the local Construction Department for monitoring.
d) Within sixty days from the date exceeding the time limit specified in point b of this clause, the specialized agency of the provincial People's Committee where the project is located must complete the appraisal of the sale price and lease-purchase price of social housing and issue a notification of the appraisal results to the investor.
When the notification of the appraisal results shows a higher price than the price already signed in the contract by the investor, the investor shall not collect additional amounts; if lower, the investor must sign a new contract or amend the supplementary contract and refund the difference to the buyer or lease-purchaser of the housing.
đ) The specialized agency of the provincial People's Committee is responsible for publicly announcing the appraised price on the Housing Management Agency's website (within fifteen days from the date of the appraisal result); the project investor must publicly announce the appraised price, sale price, and lease-purchase price of social housing at the project site and on the investor's or project's website (if available).
e) After the social housing construction project is completed and put into use, the investor conducts an audit and approves the settlement of project costs as prescribed and submits one set of documents (certified copies) to the specialized agency of the provincial People's Committee where the project is located for verification of the sale price and lease-purchase price of social housing.
If the sale price and lease-purchase price of social housing based on the audit results or approved settlement are higher than the price already signed in the contract by the investor, the investor shall not collect additional amounts; if lower, the investor must sign a new contract or amend the supplementary contract and refund the difference to the buyer or lease-purchaser of the housing.
4. If the investor uses the winning bid price, there is no need to re-appraise the sale price and lease-purchase price of social housing as stipulated in this Article.
Article 36. Exemption and Reduction of Rent for Social Housing Belonging to State Property
1. The exemption and reduction of rent for social housing belonging to state property shall be implemented based on the following principles:
a) The person exempted or reduced from rent must be named in the Housing Lease Contract (including the representative named in the Contract and other members named in the lease contract).
b) The exemption or reduction of rent will only be considered once for each tenant.
c) In cases where a person qualifies for multiple rent exemption or reduction benefits, they shall only enjoy the highest level of benefit.
d) If there are two or more people in a household who qualify for rent reduction, then the household may be exempted from rent.
2. The subjects eligible for rent exemption or reduction for social housing belonging to state property include:
a) Persons with meritorious service to the revolution and relatives of martyrs who are entitled to support for improving their housing according to the Regulations on Preferential Treatment for Persons with Meritorious Service to the Revolution.
b) Poor and near-poor households as defined by the poverty and near-poverty standards set forth in the law.
c) Social welfare beneficiaries receiving monthly social allowances as stipulated by law who are entitled to housing support policies.
3. Levels of Exemption and Reduction of Rent
a) Subjects specified in point a, Clause 2 of this Article shall have their rent reduced according to the ratio prescribed in the guiding documents implementing the Regulations on Preferential Treatment for Persons with Meritorious Service to the Revolution.
b) Subjects specified in points b and c, Clause 2 of this Article shall have their rent reduced by 60%; specifically, for poor and near-poor households, this reduction applies to the entire household (not individually to each member of the household).
Section 7. PROCEDURES FOR THE SALE AND LEASE OF SOCIAL HOUSING
Article 37. Procedures and Formalities for Leasing and Selling Social Housing Built by the State Using Public Investment Funds and Trade Union Financial Resources
1. The procedures and formalities for leasing social housing built by the State using public investment funds shall be carried out as follows:
a) Individuals wishing to lease social housing built by the State using public investment funds shall submit one set of application documents directly to the provincial housing management agency or the housing operation management unit according to local classification. The application package includes Form No. 01 attached at Appendix II of this Decree, proof of eligibility as directed by the Minister of Construction, the Minister of Defense, and the Minister of Public Security, and proof of eligibility for rent exemption or reduction (if applicable).
For individuals specified in Clause 5 of Article 76 of the Law on Housing, if they do not have a labor contract, they must provide confirmation of their status from the People's Committee of the commune according to the model provided by the Minister of Construction. For individuals specified in Clause 10 of Article 76 of the Law on Housing, they must provide confirmation of their status from the People's Committee of the district where land was expropriated and demolished, according to the model provided by the Minister of Construction.
b) The agency receiving the application has the responsibility to check and classify the applications; if the application does not contain all required documents, it must immediately notify the applicant to supplement the documents. If the housing operation management unit receives the application, after checking and classifying the applications, the unit must report a list of qualified tenants along with valid applications to the housing management agency for review and verification.
c) Based on the list of qualified tenants along with valid applications, the housing management agency shall organize the creation of a list of tenants for social housing and submit a report with the list to the representative owner for approval.
If the total number of valid applications equals or is less than the total number of social housing units available for lease, the list of tenants is the list of qualified applicants.
If the total number of valid applications exceeds the total number of social housing units available for lease, the selection process for tenants shall be conducted through a lottery (either in-person or online) organized by the provincial housing management agency or the housing operation management unit according to local classification. If the housing operation management unit conducts the lottery, the provincial housing management agency shall supervise the process. The lottery must have a record of results.
If the project has priority subjects as specified in point d, Clause 1 of Article 79 of the Law on Housing, they can lease social housing without participating in the lottery up to a certain ratio. The number of social housing units allocated to these priority subjects (without going through the lottery) is determined by the ratio between the total number of applications from the five priority groups over the total number of applications multiplied by the total number of social housing units available for lease. The list of priority subjects is arranged in order of submission time. Social housing units allocated to priority subjects are arranged according to the priority list until exhausted, and remaining subjects continue to participate in the lottery.
d) Based on the report from the housing management agency, the representative owner of the housing shall examine and issue a decision approving the list of tenants for social housing and send it to the housing operation management unit to sign the lease contract with the tenants.
đ) The processing time for leasing social housing shall not exceed thirty days, starting from the day the unit receives complete valid applications.
e) Depending on local conditions, the provincial People's Committee may specify preferential treatment for tenants of social housing built by the State using public investment funds within its jurisdiction.
2. The procedures and formalities for leasing social housing constructed using trade union financial resources shall be carried out as follows:
a) Workers and employees who are entitled to social housing support policies and have the need to rent social housing built by the Vietnam General Confederation of Labor using public financial resources shall submit one set of application documents directly to the organization entrusted with managing and operating the social housing of the Vietnam General Confederation of Labor or the Provincial Federation of Labor at their localities. The application package includes Form No. 01 for registering to rent social housing attached as Appendix II of this Decree, and documents proving the eligibility according to the regulations;
b) The agency receiving the application documents is responsible for checking and classifying them; if the documents do not contain all required papers, they must immediately notify the applicant to supplement the missing documents. In cases where the Provincial Federation of Labor at the locality receives the application documents, after checking and classifying them, the unit will compile a list of eligible tenants along with valid applications and send it to the organization entrusted with managing and operating the social housing of the Vietnam General Confederation of Labor for examination and verification.
If the total number of valid applications equals or is less than the total number of social housing units available for lease, the list of tenants is the list of qualified applicants.
If the total number of valid applications exceeds the total number of available social housing units for rent, the selection process will be conducted through a direct lottery organized by the housing management authority of the Vietnam General Confederation of Labor. The lottery must be recorded in a minutes of the results. In cases where there are priority beneficiaries under Article 79, Point d, Clause 1 of the Housing Law and trade union members, they may lease social housing without participating in the lottery.
c) Based on the list of eligible tenants along with valid applications, the organization entrusted with managing and operating the social housing of the Vietnam General Confederation of Labor will review and sign rental contracts with the tenants.
d) The processing time for renting social housing does not exceed ten days from the date when the organization entrusted with managing and operating the social housing of the Vietnam General Confederation of Labor receives complete valid applications.
3. The procedures for leasing and purchasing social housing constructed by the State with public investment funds shall be implemented as follows:
a) Individuals who wish to lease and purchase social housing shall submit one set of application documents directly to the Construction Department of the locality or the unit managing and operating the housing according to the local classification. The application package includes Form No. 01 for registering to lease and purchase social housing attached as Appendix II of this Decree, and documents proving the eligibility and conditions for enjoying social housing support policies according to the regulations.
For individuals specified in Clause 5 of Article 76 of the Law on Housing, if they do not have a labor contract, they must provide confirmation of their status from the People's Committee of the commune according to the model provided by the Minister of Construction. For individuals specified in Clause 10 of Article 76 of the Law on Housing, they must provide confirmation of their status from the People's Committee of the district where land was expropriated and demolished, according to the model provided by the Minister of Construction.
b) The procedures for leasing and purchasing shall be carried out in accordance with Points b, c, d, and đ of Clause 1 of this Article.
Article 38. Procedures for selling, leasing and purchasing social housing constructed under projects and not using public investment funds or trade union financial resources [5]
1. The procedures for selling social housing shall be carried out as follows: a) Within thirty days from the start of construction of the project, the project investor has the responsibility to provide information related to the project to be publicly announced on the website of the Construction Department, People's Committee of the commune at the location of the project; published at least once in the local government newspaper and announced on the website of the project investor (if any) or the real estate trading floor of the project investor (if any) so that citizens can prepare registration forms to buy social housing and monitor the implementation.
Publicly disclosed information includes: Project name; project investor; project construction site; contact address, address for submitting registration forms; project progress; project scale; number of apartments/houses (including: Number of apartments/houses for sale; apartment size; estimated selling price for each type of apartment/house; expected time to start accepting registration forms and other relevant contents).
In cases where the housing and real estate market information system and database have been connected and utilized, information about the construction of social housing projects shall be publicly disclosed on this system in accordance with laws on construction and management of housing and real estate market information systems and databases;
b) Before the start of accepting registration forms to purchase social housing, the investor shall disclose information about the start and end dates for accepting registration forms, the number of apartments/houses for sale, apartment sizes, and the selling price of social housing on the housing and real estate market information system and database, and send it to the Construction Department of the locality where the project is located for public disclosure on the Construction Department's website.
Disclosure of information must be completed at least thirty days before the start of accepting registration forms;
c) Based on the publicly disclosed information about the social housing project, households and individuals with the need to purchase social housing shall submit application forms to the project investor. Each household or individual wishing to purchase social housing cannot simultaneously register to purchase social housing in multiple projects at the same time.
The subjects specified in Clause 10, Article 76 of the Housing Law must have confirmation of their status from the People's Committee of the commune where land was expropriated and demolished, following the model provided by the Minister of Construction. Within seven days from the date of receipt of the request for confirmation, the People's Committee of the commune shall issue the confirmation. Submission of the application form can be done through direct submission, online submission, postal service, or submission to the agency, unit, or enterprise where the individual works for consolidation and forwarding to the project investor.
The period for submission and acceptance of application forms is determined by the investor but must be at least thirty days from the start of accepting application forms; d) The application form for purchasing social housing includes: Form No. 01 for registering to purchase social housing as stipulated in Appendix II of this Decree; documents proving the eligibility and conditions for enjoying social housing support policies.
Documents proving the eligibility and conditions for enjoying social housing support policies are valid for twelve months from the date of confirmation. Applicants for purchasing social housing must commit to not having previously enjoyed housing support policies and bear responsibility for ensuring their eligibility and conditions for enjoying social housing support policies at the time of signing the sales contract.
d) Within ten days from the deadline for submitting application files, the project investor shall be responsible for compiling the List of registrations to purchase social housing, including personal information of applicants and members of their households declared in the Application Form for purchasing social housing; send it to the Construction Department of the local authority where the project is located for checking whether the applicants have already benefited from or not yet benefited from housing support policies as prescribed by laws on housing. The Construction Department shall be responsible for replying in writing within ten days from the date of receipt of the registration list.
The project investor shall be responsible for reviewing, evaluating, consolidating the opinions of the Construction Department, and comparing them with the provisions of laws on housing to determine whether the application files meet the conditions to benefit from social housing support policies.
The project investor shall be responsible for establishing and publicly disclosing the List of application files meeting the conditions as prescribed and the List of application files not meeting the conditions at the location where the project is carried out, on the investor's electronic information website (if available), and at the investor's real estate trading floor (if available).
Within thirty days from the deadline for submitting application files, the project investor shall be responsible for publicly disclosing the List of application files meeting the conditions to purchase social housing. For application files not meeting the conditions, they shall be returned with clear reasons stated within fifteen days from the date of public disclosure of the List.
e) In case the total number of application files registered and meeting the conditions in the list under point d of this clause equals or is less than the total number of apartments/houses planned for sale, the buying and selling shall be carried out through agreements between the project investor and customers.
g) In case the total number of application files registered and meeting the conditions in the list under point d of this clause exceeds the total number of apartments/houses planned for sale, the project investor shall organize a lottery to select those who will purchase social housing.
The form of the lottery shall be decided by the project investor but must be supervised by representatives of the local Construction Department, the People's Committee of the commune-level administrative unit, and the Public Security Police Station of the commune-level administrative unit where the project is located, confirming in the record of the lottery results.
h) In case the project has priority groups as prescribed in point d of Article 79 of the Law on Housing, they shall be given priority to purchase social housing without having to participate in the lottery, with the number of apartments/houses being equal to the total number of application files meeting the conditions of these priority groups divided by the total number of application files meeting the conditions in the list prescribed in this clause multiplied by the total number of apartments/houses of social housing planned for sale.
Priority for female individuals shall apply in cases where the applicant registering is a single woman or must be the head of a household based on residence data.
Priority groups prescribed in point d of Article 79 of the Law on Housing shall be allocated apartments/houses in the following order: persons with meritorious service to the revolution, relatives of martyrs, persons with disabilities, persons resettled through the purchase of social housing, women. In case the number of individuals in one priority group exceeds the remaining number of priority apartments/houses, a lottery shall be conducted among that group, and the remaining individuals shall continue to participate in the lottery together with non-priority individuals.
i) After the housing meets the conditions for sale as prescribed by laws on real estate business, the project investor shall implement the signing of the Purchase and Sale Contract for social housing with customers; simultaneously updating transaction information, subjects who have purchased social housing according to the provisions of laws on housing, construction management, and information systems, databases on housing and the real estate market.
The project investor shall be responsible for publicly announcing the List of customers who have signed the Purchase and Sale Contract for social housing (including all members of their households) at the investor's office, at the location where the project is carried out, and at the investor's real estate trading floor (if available) or on the investor's electronic information website on social housing (if available).
2. The procedures for leasing and purchasing social housing shall be implemented according to the provisions of Clause 1 of this Article.
3. The procedures for leasing social housing shall be implemented according to the provisions of Clause 1 of this Article and there is no need to submit documents proving housing conditions and income. In case the leased social housing belongs to state property, the lessee shall submit documents proving eligibility for exemption or reduction of rent for social housing (if applicable).
Article 39. Procedures for selling social housing within a five-year period
1. [6] In cases where social housing is resold to the project's developer, the resale shall be carried out in accordance with Clause d, Paragraph 1 of Article 89 of the Law on Housing and regulations on real estate business and land laws.
2. In cases where social housing is resold to other eligible buyers, the following provisions shall apply:
a) The person purchasing the social housing must have certificates confirming their eligibility and conditions as guided by the Minister of Construction, the Minister of National Defense, and the Minister of Public Security, and submit the application to the People's Committee of the locality where the project is located to verify the correct eligibility and conditions as stipulated in Clause d, Paragraph 1 of Article 38 of this Decree;
b) The person reselling the property must complete the procedures to terminate the Contract with the project's developer (if applicable). The resale shall be carried out in accordance with Clause d, Paragraph 1 of Article 89 of the Law on Housing and regulations on real estate business and land laws.
3. [7] If the party reselling the social housing as stipulated in Paragraphs 1 and 2 of this Article has not completed the procedures to terminate the purchase-sale contract with the developer, they must first carry out the contract termination procedures in accordance with civil law before reselling the social housing.
Article 40. Procedures for selling social housing after a five-year period
The procedures for selling social housing after a five-year period as stipulated in Clause e, Paragraph 1 of Article 89 of the Law on Housing shall be implemented as follows:
1. The seller must hold a Certificate of Land Use Right and Ownership of Fixed Assets on the Land.
2. The resale shall be carried out in accordance with regulations on real estate business and land laws.
Article 41. Payment of land use fee by the project's developer when reselling social housing after ten years of rental
The payment of the land use fee by the project's developer when reselling social housing after ten years of rental as stipulated in Paragraph 9 of Article 88 of the Law on Housing shall be carried out in accordance with land laws.
Article 42. Payment of land use fee when reselling social housing after a five-year period
When reselling social housing that is individual housing after a five-year period as stipulated in Clause e, Paragraph 1 of Article 89 of the Law on Housing, in addition to the amounts required by law, the seller must pay 50% of the land use fee as prescribed by land laws. The time for calculating the land use fee is the date of submitting a valid application to recognize the right to use the land according to land laws.
Article 43. Procedures for renting social housing built by individuals
The procedures for renting social housing built by individuals who invest in building social housing shall be as follows:
1. Individuals investing in building social housing are responsible for reporting to the People's Committee of the commune where the housing is being constructed (in writing) about the construction location; progress; scale, number of units, including: Number of units for rent; start date of renting, so that the People's Committee of the commune can publicly announce the information at the commune office for local authorities and residents to know and follow up and supervise.
2. Based on the information about social housing in the area that has been announced according to regulations, those who wish to lease social housing submit a certificate confirming their eligibility for social housing support policies as guided by the Minister of Construction, the Minister of National Defense, and the Minister of Public Security to the individual investor in social housing.
3. After collecting all registration files from eligible applicants, the individual investor in social housing signs a Rental Agreement with the tenant. At the same time, they are responsible for sending the People's Committee of the commune a list of social housing tenants to serve management and inspection work (post-inspection).
Article 44. Updating Information on Subjects Eligible to Purchase, Lease-Purchase, or Rent Social Housing
1. Within fifteen days from the date of receipt of the List of subjects who have signed Contracts for purchasing, lease-purchasing, or renting social housing as stipulated in point g, Clause 1, Article 38 of this Decree, the Construction Department of the locality where the project is located shall be responsible for checking and updating the List of subjects eligible to purchase, lease-purchase, or rent social housing onto the Construction Department's Electronic Information Website according to the contents prescribed in Clause 2 of this Article.
2. The contents of the information to be updated:
a) Full name;
b) Citizen identification number/personal identification number;
c) Permanent residence address/temporary residence address;
d) Members of the household (if the subject is a household);
đ) Name of the investment project for constructing social housing.
3. In cases where a subject with a need to purchase, lease-purchase, or rent social housing has been signed a Contract by the project investor but falls under the circumstances leading to termination of the Contract, the project investor shall be responsible for reporting to the Construction Department to update the List of subjects eligible to purchase, lease-purchase, or rent social housing on the Construction Department's Electronic Information Website and the Ministry of Construction's Electronic Information Portal.
4. In cases where there is no database of information on subjects eligible to purchase, lease-purchase, or rent social housing on the Ministry of Construction's Electronic Information Portal, the Construction Department shall publish the List on its own Electronic Information Website, and simultaneously send it to the Ministry of Construction (in hard copy and electronic file) according to the contents prescribed in Clause 2 of this Article.
Article 45. Rights, Obligations, and Responsibilities of the Seller, Lessor, and Buyer, Lessee of Social Housing
The rights, obligations, and responsibilities of the seller, lessor, and buyer, lessee of social housing shall be implemented in accordance with civil law, housing law, and clearly recorded in the Sales Contract, Lease-Purchase Contract, or Rental Contract for social housing, including the following contents:
1. For the seller, lessor, and renter of social housing:
a) Must strictly comply with all terms agreed upon in the signed Sales Contract, Lease-Purchase Contract, or Rental Contract;
b) Has the right to terminate the Sales Contract, Lease-Purchase Contract, or Rental Contract for social housing according to the agreement in the signed Contract;
c) Organize the establishment of a Management Board and draft the Internal Regulations for managing and using apartment buildings according to the guidelines of the Minister of Construction for social housing that is apartment buildings;
d) In cases of renting social housing, the lessor has the right to reclaim the rented housing when terminating the Rental Contract, but must notify the lessee at least one month in advance and return the deposit and prepaid rent (if any) according to the agreement in the Rental Contract;
đ) Collect service fees related to the management and use of social housing according to the agreement in the signed Contract and the Management Regulations for Apartment Buildings in cases where social housing is an apartment building;
e) Must comply with decisions of competent authorities regarding the handling of violations and resolving complaints and disputes related to the sale, lease-purchase, or rental of social housing;
g) Perform other rights and obligations as prescribed by law.
2. For the buyer, lease-purchaser, and renter of social housing:
a) Has the right to terminate the Sales Contract, Lease-Purchase Contract, or Rental Contract for social housing according to the agreement in the signed Contract;
b) Must comply with all terms agreed upon in the signed Sales Contract, Lease-Purchase Contract, or Rental Contract for social housing and the Management Regulations for Apartment Buildings in cases where social housing is an apartment building;
c) The buyer, lease-purchaser, and renter must comply with decisions of competent authorities regarding the handling of violations and resolving complaints and disputes related to the sale, lease-purchase, or rental of social housing and perform other rights and obligations as prescribed by law;
d) For social housing intended for rental, the lessee is responsible for returning the house to the lessor according to the agreement in the signed Rental Contract; if the lessee unilaterally terminates the Rental Contract before the term, they must notify the lessor at least one month in advance; if the lessee has prepaid rent for the entire rental period according to the Contract, they will receive back the prepaid rent for the remaining rental period and the deposit (if any), except in cases of unilateral termination of the Contract due to a breach by one party leading to the forfeiture of the deposit according to the Civil Code; the lessee has the right to purchase the rented housing if the owner implements the sale of housing according to this Decree and relevant housing laws; may not擅自进行维修、改造租赁房屋,不得将租赁房屋用于其他用途,不得转租或出借给他人;未经出租人同意,不得转让租赁合同或将租赁房屋与他人交换;
đ) If the Rental Contract expires and the lessee still qualifies as a subject eligible to rent social housing and meets the conditions, both parties may agree to sign a new Rental Contract for social housing; three months before the expiration of the Rental Contract, if the lessee still has a need to rent housing and does not violate the circumstances leading to the termination of the Rental Contract as stipulated in the signed Rental Contract, they have the right to sign a new Rental Contract for social housing or extend the Rental Contract for social housing;
e) The lessee of social housing is responsible for prepaying a deposit to the lessor according to the agreement between both parties, but not exceeding three months, and not less than one month's rent to ensure the fulfillment of the lessee's obligations.
The lessor and lessee of social housing may agree on a higher deposit amount than the amount prescribed in this clause, but not exceeding fifty percent of the value of the rented housing. In cases where the lessee pays the deposit as prescribed in this clause, they may receive a reduction in rent or be exempted from paying rent for a certain period agreed upon by both parties.
In cases where the subjects are those specified in Clause 1, Clause 4, and Clause 11 of Article 76 of the Law on Housing, they are not required to pay a deposit when renting social housing.
Mục 8. SUPPORT FOR LOANING OF PREFERENTIAL CAPITAL FROM THE STATE TO PURCHASE OR LEASE PURCHASE SOCIAL HOUSING; CONSTRUCTION OR RECONSTRUCTION AND REPAIR OF HOUSING TO IMPLEMENT SOCIAL HOUSING POLICIES
Article 46. Principles for Implementing Preferential Loan Policies
1. In cases where an individual beneficiary is entitled to multiple preferential loan policies supporting housing, only the highest level of support policy shall be applied.
2. In cases where a household has multiple beneficiaries entitled to multiple preferential loan policies, only one loan policy shall be applied for the entire household.
3. The Social Policy Bank or credit organizations designated by the State shall implement preferential loans to support social housing and housing for the people's armed forces in accordance with the laws on housing, credit laws, and related laws.
4. The Social Policy Bank may mobilize savings deposits from domestic households and individuals who have the need to purchase or lease purchase social housing and housing for the people's armed forces to lend to these beneficiaries according to the provisions of Clause 1, Article 48 and Clause 1, Article 71 of this Decree after a certain period of deposit as agreed upon with the Social Policy Bank.
Article 47. Preferential Loans for Construction or Reconstruction and Repair of Housing under National Target Programs or Public Investment Programs on Housing
1. Beneficiaries specified in Clause 1, Clause 2, and Clause 3 of Article 76 of the Law on Housing shall be eligible for preferential loans to support housing for construction or reconstruction and repair of housing in accordance with specific regulations of each national target program or public investment program on housing decided by competent state agencies.
2. Loan conditions, loan amounts, terms, interest rates, debt management policies, collateral, and debt extension shall be implemented in accordance with specific regulations stipulated in the Decision approving the national target program or public investment program on housing by competent state agencies.
Article 48. Preferential Loans for Purchase or Lease Purchase of Social Housing; Construction or Reconstruction and Repair of Housing at the Social Policy Bank
1. Beneficiaries specified in Clause 1, Clause 4, Clause 5, Clause 6, Clause 7, and Clause 8 of Article 76 of the Law on Housing to obtain preferential loans for purchasing or leasing social housing must meet the following conditions:
a) Having income sources and the ability to repay debts as committed to the Social Policy Bank;
b) Having a loan application for purchasing or leasing social housing;
c) Having a Contract for Purchasing or Leasing Social Housing with the developer in accordance with this Decree and the laws on housing;
d) Ensuring collateral for the loan by assets formed from the loaned capital in accordance with the law. The Social Policy Bank, the developer, and the borrower must clearly define the management and disposal methods of the collateral in a tripartite contract.
2. Beneficiaries specified in Clause 1, Clause 2, Clause 3, Clause 4, Clause 5, Clause 6, Clause 7, and Clause 8 of Article 76 of the Law on Housing to obtain preferential loans for constructing or reconstructing and repairing housing must meet the following conditions:
a) Having sufficient documentation proving their status and conditions as prescribed in Articles 76 and 110 of the Law on Housing.
The People's Committee of the commune confirms the conditions as prescribed in Point a, Clause 4, Article 110 of the Law on Housing; the form of documents shall follow the guidance of the Minister of Construction.
a1) [8] Within seven days from the date of receiving confirmation about the conditions as prescribed in Point a, Clause 4, Article 110 of the Law on Housing, the People's Committee of the commune shall confirm in accordance with this provision.
b) Having the ability to repay debts as committed to the lending credit organization;
c) Having a loan application for constructing or reconstructing and repairing housing;
d) Having a Certificate of Land Use Right and Ownership of Fixed Assets on Land for the housing project to be constructed or reconstructed and repaired;
đ) Having a calculation plan for costs and a construction permit as required by the laws on construction. In cases where there is a time-limited construction permit as prescribed by law, the loan will be considered in accordance with the duration of existence of the project;
e) Ensuring collateral for the loan by the value of land use rights and fixed assets on land or other assets as prescribed by law.
3. Loan amount:
a) In cases of purchasing or leasing social housing, the maximum loan amount shall be 80% of the value of the Purchase or Lease Contract for Housing;
b) In cases of new construction or reconstruction and repair of housing, the maximum loan amount shall be 70% of the budget estimate or funding usage plan, not exceeding one billion dong, based on the investment cost per unit and construction price of housing approved by the competent authority, and not exceeding 70% of the value of the collateral.
4. The loan interest rate is 5.4% per year. The overdue interest rate is 130% of the loan interest rate. If it is necessary to change the loan interest rate, the Social Policy Bank shall take the lead, coordinate with the Ministry of Construction and relevant agencies to submit to the Prime Minister for consideration and decision.
5. Loan term: The loan term shall be agreed upon between the bank and the customer in accordance with the customer's repayment capacity and shall not exceed twenty-five years from the date of the first disbursement of the loan.
6. Beneficiaries specified in Clause 2 and Clause 3 of Article 76 of the Law on Housing who purchase or lease social housing as stipulated in Clause 1 of Article 77 of the Law on Housing shall be eligible for preferential loans as provided in Clause 1, Clause 3, Clause 4, and Clause 5 of this Article.
Article 49. Borrowing preferential capital to purchase, lease-purchase social housing; construct or renovate, repair housing at credit institutions designated by the State
1. The borrowing subjects for preferential capital to purchase, lease-purchase social housing; construct or renovate, repair housing at credit institutions designated by the State shall be defined in Clause 1, Clause 4, Clause 5, Clause 6, Clause 7, and Clause 8 of Article 76 and Point a, Clause 3, Article 78 of the Law on Housing.
Article 50. State capital sources for preferential lending
2. Credit institutions designated by the State shall implement lending to the subjects specified in Clause 1 of this Article according to specific provisions in documents approved by the Government and the Prime Minister.
Section 9. SOURCES OF CAPITAL AND MANAGEMENT AND USE OF CAPITAL FOR PREFERENTIAL LOANS TO IMPLEMENT SOCIAL HOUSING POLICIES
Article 50. State capital sources for preferential lending
1. Capital for preferential lending through the Vietnam Bank for Social Policies:
a) The State budget allocates 100% of the capital, subsidizes interest rate differences and management fees in the medium-term investment plan and annually to the Vietnam Bank for Social Policies as prescribed to lend to the subjects specified in Article 25, Article 26, Clause 1, Article 47, and Clause 3, Article 71 of this Decree;
b) The State budget allocates 50% of the capital in the medium-term investment plan and annually, the Vietnam Bank for Social Policies mobilizes 50% of the capital; the State budget subsidizes interest rate differences and management fees for the Vietnam Bank for Social Policies as prescribed to lend to the subjects specified in Clause 5, Article 77 of the Law on Housing;
c) Entrusted capital from the local housing development fund (if any), annual support from the local budget, capital from issuing bonds, housing treasury bills, and other lawful sources as prescribed by law decided by the People's Councils at provincial level (for provincial budgets) and district level (for district budgets) to implement social housing objectives and plans at the local level.
2. Capital for social housing loans through the Vietnam Development Bank:
a) Capital for lending from issuing government-guaranteed bonds and other lawful sources as prescribed by law to provide social housing loans as stipulated in Clause 6, Article 25 of this Decree. The State does not subsidize interest rate differences and management fees.
b) Capital from the State budget to provide social housing loans under programs of the Government and the Prime Minister during each period. The State subsidizes interest rate differences and management fees.
3. Preferential capital from the State budget:
Based on the provincial housing development program in each period approved by the competent authority, the Provincial People's Committee builds the medium-term and annual investment plan as the basis for the State budget to allocate capital to provinces and centrally-administered cities to subsidize interest rates for investors constructing social housing, worker dormitories in industrial zones, housing for the people's armed forces, and individuals borrowing capital to construct or renovate, repair housing for rental purposes as prescribed in this Decree at credit institutions. The subsidized interest rate level is decided by the Prime Minister upon the proposal of the Ministry of Finance for each period.
4. Capital for preferential lending from credit institutions:
a) Credit institutions designated by the State lend according to credit programs decided by the Government and the Prime Minister during each period;
b) The Government uses official development assistance (ODA) loan capital and preferential foreign loans to refinance credit institutions designated to lend for social housing as prescribed in this Decree;
c) Government bonds, local government bonds.
Article 51. Management and Utilization of Preferential Loan Capital
1. The management of capital sources and the utilization of loan capital for social housing support shall be carried out by the Social Policy Bank or credit organizations designated by the State.
2. The classification of debts and the handling of risky debts at the Social Policy Bank shall be implemented in accordance with the regulations on debt classification and handling of risky debts at the Social Policy Bank.
Section 10. MANAGEMENT, UTILIZATION, AND OPERATION OF SOCIAL HOUSING AS STATE ASSETS
Article 52. Management, Utilization, and Operation of Social Housing as State Assets
1. The management, utilization, and operation of social housing as state assets shall be conducted in accordance with the laws governing the management and utilization of housing as state assets, including:
a) Housing management agencies and their responsibilities;
b) Housing management units and their responsibilities;
c) Management of income from leasing, lease-purchase, and sale of housing;
d) Management, utilization, and operation of housing as state assets;
đ) Procedures and processes for recovery and forced recovery of housing as state assets.
2. In cases where investment in building social housing is necessary, the representative of the owner of state asset housing may prepare a proposal to sell rented social housing in accordance with the provisions of Article 53 of this Decree.
The procedures for preparing, reviewing, and approving proposals to sell rented state asset social housing shall be carried out in accordance with the provisions of Article 54 of this Decree.
3. The procedures for selling state asset social housing after the proposal has been approved shall be implemented in accordance with the provisions of Clause 3, Article 37 of this Decree.
Article 53. Basic Content of Proposals to Sell Rented State Asset Social Housing
Proposals to sell rented state asset social housing include the following basic contents:
1. Address and quantity of housing.
2. Reasons for sale.
3. Pricing plan ensuring accuracy, completeness, preservation of investment capital, and prevention of state asset loss.
4. Target groups and conditions for purchasing housing.
5. Procedures and processes for sale.
6. Payment methods; implementation period; estimated revenue.
7. Plan for utilizing proceeds for reinvestment in constructing other social housing.
Article 54. Procedures and Processes for Preparing and Approving Proposals to Sell Rented State Asset Social Housing
The procedures and processes for preparing and approving proposals to sell rented state asset social housing, as stipulated in Clause 2, Article 125 of the Law on Housing, shall be carried out as follows:
1. The agency representing the owner must prepare a proposal to sell housing with the basic contents as prescribed in Article 53 of this Decree.
2. The agency representing the owner must submit a dossier including the proposal and supporting documents to the Ministry of Construction for review and report to the Prime Minister for consideration and approval.
3. If the Prime Minister approves, the agency representing the owner must approve the proposal and implement it according to its contents and the Prime Minister's approval document.
4. Proceeds from the sale of housing must be used for reinvestment in constructing social housing; the agency representing the owner must report to the Ministry of Construction on the use of these funds, and the Ministry of Construction is responsible for inspecting the use of funds and reporting to the Prime Minister.
5. For state asset social housing managed by the Ministry of Construction that requires functional conversion or sale as provided in this Article, a report and dossier must be prepared in accordance with Clause 1 of this Article and submitted to the Prime Minister for consideration and decision.
Section 11. FORCIBLE RECOVERY OF SOCIAL HOUSING NOT CONSTITUTING PUBLIC PROPERTY
Article 55. Procedures and Formalities for Implementing Forcible Recovery of Social Housing
1. The forcible recovery of social housing shall be carried out after the Decision on Recovery of Social Housing issued by the Provincial People's Committee becomes effective thirty days later and prior to that, the competent state agency has attempted to persuade and negotiate with the person whose housing is to be recovered without success.
The Decision on Forcible Recovery of Social Housing shall be issued by the Provincial People's Committee and sent to the person subject to forcible recovery, and simultaneously posted publicly at the Construction Department, the office of the District People's Committee, and the common living area of the residential community where the housing is located.
2. Within ten days from the issuance of the Decision on Forcible Recovery of Social Housing, the Chairman of the Provincial People's Committee or delegated to the District People's Committee shall decide to establish the Forcible Recovery of Social Housing Board, including: the Chairman or Vice-Chairman of the Provincial or District People's Committee as head; representatives from inspection, construction, judicial, natural resources and environment agencies; the project investor; representatives from the Management Board and other members decided by the Chairman of the Provincial or District People's Committee.
3. The Forcible Recovery of Social Housing Board shall attempt to persuade and negotiate with the person subject to forcible recovery within ten days; if the person complies with the Forcible Recovery Decision, the Board shall record the compliance in a written statement. The handover of social housing shall be completed no later than thirty days from the date of the written statement.
If the person subject to forcible recovery does not comply with the Forcible Recovery Decision, the Board shall organize the forcible recovery.
4. The Forcible Recovery of Social Housing Board has the authority to compel the person subject to forcible recovery and related persons to vacate the forcibly recovered housing and remove their property from it; if they fail to do so, the Board shall be responsible for removing the person subject to forcible recovery and related persons along with their property from the housing.
5. The Forcible Recovery of Social Housing Board shall invite a representative of the Vietnam Fatherland Front Committee at the district level to participate in supervising the forcible recovery of social housing.
Article 56. Responsibilities of Organizations and Individuals in Implementing Decisions on Forcible Recovery of Social Housing
1. The Provincial or District People's Committee shall be responsible for organizing the implementation of forcible recovery, handling complaints related to forcible recovery according to the law on complaints; ensuring necessary conditions and means for forcible recovery; allocating funds for the forcible recovery of social housing.
2. The Forcible Recovery of Social Housing Board shall be responsible for drafting the plan and budget estimate for forcible recovery activities to be submitted to the Provincial or District People's Committee for approval; transferring social housing to the project investor or relevant agency for allocation to eligible individuals with needs.
3. The police force shall be responsible for maintaining order and safety during the execution of the decision on forcible recovery.
4. The District People's Committee where the social housing is located shall be responsible for coordinating with relevant agencies and units to implement the delivery of the Decision on Forcible Recovery of Social Housing to the person subject to forcible recovery, posting the decision publicly; participating in the forcible recovery; coordinating with the Forcible Recovery of Social Housing Board to seal and move the property of the person subject to forcible recovery.
5. Other relevant agencies, organizations, and individuals shall be responsible for cooperating with the Forcible Recovery of Social Housing Board to carry out the forcible recovery when requested by the Board.
Chapter IV. ON WORKER HOUSING IN INDUSTRIAL ZONES
Article 57. Stages of investment and construction for workers' accommodation projects within industrial zones
1. Investment preparation phase:
a) The proposal; Decision, approval of the investment orientation; planning of workers' accommodation shall be carried out concurrently with the infrastructure investment project of the industrial zone in accordance with laws on industrial zone management and economic zones, investment laws, and other relevant laws;
b) The selection of the investor for the workers' accommodation project within the industrial zone shall be conducted in accordance with the laws on housing. In cases where the business operating the industrial zone's infrastructure directly invests in workers' accommodation, the business operating the industrial zone's infrastructure shall be the investor of the workers' accommodation project. In cases where enterprises, cooperatives, or cooperative unions producing within the industrial zone lease land or sublease land to invest in constructing workers' accommodation within the industrial zone, the enterprise, cooperative, or cooperative union producing within the industrial zone shall be the investor of the workers' accommodation project;
c) The allocation of land, leasing of land, and change of land use purpose shall be carried out in accordance with the laws on land;
d) Procedures for establishing, reviewing, and approving the project shall be implemented in accordance with the laws on construction.
2. The implementation stage of the project includes surveying, designing, reviewing, and approving the construction design, issuing construction permits, construction work, operation of the construction works, and completion acceptance of the construction works in accordance with the laws on construction.
3. The final stage of the project includes handing over, settling the construction contract, and other related procedures in accordance with the laws on construction, laws on housing, and other relevant laws.
Article 58. Scale and Proportion of Land for Developing Workers' Accommodation in Industrial Zones
1. During the process of planning the construction of industrial zones, the People's Committee of the province has the responsibility to allocate at least 20% of the commercial and service land fund of the industrial zone for workers' accommodation, except in cases where the provincial land use plan, housing development program, and plan have already allocated sufficient land to meet the housing needs of workers in that industrial zone.
2. In cases where an industrial zone has been established but does not yet have or does not adequately provide accommodation for workers in the industrial zone and still has commercial and service land areas ensuring environmental safety as stipulated in Article 59 of this Decree, the business operating the industrial zone's infrastructure may study and report to the People's Committee of the province to adjust part of the commercial and service land area for workers' accommodation.
Article 59. Ensuring Environmental Safety
Workers' accommodation within industrial zones must ensure environmental safety according to the following regulations:
1. The environmental safety distance of workers' accommodation must comply with environmental laws, construction laws ensuring safety for the project, and must be determined concurrently when assessing the environmental impact of the industrial zone.
2. There must be separate pathways and gates from the industrial production pathways, the distance between the gate and the separate pathway must ensure fire prevention and firefighting safety in accordance with the law.
3. A separate fence must be arranged to isolate the workers' accommodation area from the industrial production area.
4. A green buffer zone must be arranged around the workers' accommodation area with a width of ≥ 10 meters.
5. It must ensure the environmental safety distance from pollution sources in the industrial zone, which include production workshops, material storage warehouses, finished product warehouses, hazardous waste warehouses, and auxiliary facilities generating non-domestic waste.
Article 60. Rental of Worker Dormitories in Industrial Zones
1. In cases where worker dormitories in industrial zones are invested in and constructed by infrastructure business enterprises, the following regulations shall be implemented:
a) The infrastructure business enterprise that invests in and constructs the worker dormitory or the management and operation unit of the worker dormitory authorized to manage it shall be responsible for renting the dormitory to the correct target group, which are workers in the industrial zone.
b) Workers who wish to rent a worker dormitory must submit an application form according to Model No. 02 in Appendix II of this Decree, with confirmation from the production enterprise within the industrial zone.
c) In cases where the number of applications for renting worker dormitories exceeds the total number of worker dormitories, the review and selection of tenants shall be conducted through a lottery organized by the investor, with participation from representatives of the industrial zone management board and supervision by the trade union organization. The lottery must have a record of results.
d) Renting a worker dormitory must be formalized in a Lease Contract with the management and operation unit of the worker dormitory.
đ) Workers renting a worker dormitory must pay the rent fully and may not sublet or transfer the Lease Contract; if violated, the contract will be terminated or they will be subject to legal penalties.
2. In cases where worker dormitories in industrial zones are invested in and constructed by production enterprises within the industrial zone, workers wishing to rent must submit an application form according to Model No. 02 in Appendix II of this Decree and follow the provisions at points a, b, and d of Clause 1 of this Article.
Article 61. Management and Use of Worker Dormitories in Industrial Zones
1. The investor may organize the management and operation of worker dormitories themselves or entrust a capable unit to manage and operate them.
2. Worker dormitories must be rented to the correct target group.
3. Unauthorized changes in the purpose of use are prohibited.
4. Maintenance of the facilities must comply with legal regulations on construction.
5. The management and operation unit of the worker dormitory must establish usage rules for the dormitory, publicly announce them so that renting workers and related units and individuals are aware and can implement them.
6. The management and operation unit of the worker dormitory has the right to operate other services within the worker dormitory area without being restricted by law to reduce the cost of managing and operating housing.
7. The management and operation of worker dormitories shall enjoy preferential mechanisms similar to those for public utility services.
Chapter V. HOUSING FOR THE PEOPLE'S ARMED FORCES
Section 1. HOUSING FOR THE PEOPLE'S ARMED FORCES INVESTED AND BUILT WITH PUBLIC INVESTMENT FUNDS
Article 62. Determination of Rental Prices and Purchase-Rental Prices for Housing for the People's Armed Forces Invested and Built with Public Investment Funds
The determination of rental prices and purchase-rental prices for housing for the people's armed forces invested and built with public investment funds shall be carried out in accordance with Article 31 of this Decree.
Article 63. Procedures and Formalities for Renting and Purchase-Renting Housing for the People's Armed Forces Invested and Built with Public Investment Funds
1. The procedures and formalities for renting housing for the people's armed forces invested and built with public investment funds shall be carried out as follows:
a) Individuals who wish to rent housing for the people's armed forces shall submit one set of documents directly to the housing management agency assigned by the Ministry of National Defense or the Ministry of Public Security (hereinafter referred to as the housing management agency of the Ministry of National Defense or the Ministry of Public Security) or the management and operation unit assigned by the Ministry of National Defense or the Ministry of Public Security to manage and operate housing. The documents include an application form for renting housing for the people's armed forces according to Model No. 03 in Appendix II of this Decree, proof of eligibility for renting housing for the people's armed forces, and proof of eligibility for exemption or reduction in housing rental fees for the people's armed forces (if applicable).
b) The housing management agency of the Ministry of National Defense or the Ministry of Public Security shall be responsible for reviewing and categorizing the documents; if the documents do not contain all required papers, the agency must immediately inform the applicant to supplement the missing documents. If the management and operation unit receives the documents, after reviewing and categorizing them, the unit must report a list of eligible tenants along with valid documents to the housing management agency of the Ministry of National Defense or the Ministry of Public Security for examination and verification.
c) The housing management agency of the Ministry of National Defense or the Ministry of Public Security shall compile a preliminary list of tenants to be sent to the Construction Department of the local authority for verification and exclusion of individuals who are already renting social housing or housing for the people's armed forces.
d) Within twenty days from the date of receiving the list, if the Construction Department does not provide feedback, the housing management agency of the Ministry of National Defense or the Ministry of Public Security shall organize the compilation of a list of tenants for housing for the people's armed forces and submit a report with the list to the representative of the property owner for decision-making, except in cases where the representative of the property owner delegates implementation according to Clause 3 of Article 15 of the Law on Housing.
đ) The representative of the property owner or the housing management agency delegated according to Clause 3 of Article 15 of the Law on Housing shall examine and issue a decision approving the list of tenants for housing and send it to the management and operation unit to sign a Lease Contract with the tenant.
In cases where the total number of valid applications for renting equals or is less than the total number of housing units for the people's armed forces available for rent, the list of tenants is the list of eligible applicants.
In cases where the total number of valid applications for renting exceeds the total number of housing units for the people's armed forces available for rent, the review and selection of tenants shall be conducted according to the decision of the representative of the property owner.
e) The time limit for processing the rental of housing for the people's armed forces shall not exceed thirty days from the date the management and operation unit receives a complete set of valid documents.
2. The procedures and formalities for purchase-renting housing for the people's armed forces invested and built with public investment funds shall be carried out as follows:
a) A person who wishes to lease-purchase housing for the People's Armed Forces shall submit one set of application documents directly to the housing management agency of the Ministry of National Defense, the Ministry of Public Security, or the housing management and operation unit assigned by the Ministry of National Defense or the Ministry of Public Security to manage and operate housing. The application package includes Form No. 03 attached as Appendix II of this Decree and relevant documents proving the eligibility and conditions for leasing-purchasing housing for the People's Armed Forces as stipulated by laws on housing;
b) The housing management agencies of the Ministry of National Defense and the Ministry of Public Security are responsible for reviewing and classifying the applications; if the application lacks the required documents, they must immediately notify the applicant to supplement the missing documents. In cases where the housing management and operation unit receives the application, after reviewing and classifying the application, such unit must report a list of eligible persons for leasing-purchasing housing along with valid application documents to the housing management agency of the Ministry of National Defense or the Ministry of Public Security for examination and verification;
c) The housing management agency assigned by the Ministry of National Defense or the Ministry of Public Security to manage housing is responsible for compiling a proposed list of persons leasing-purchasing housing to be sent to the Construction Department of the local authority to organize and coordinate with relevant agencies to conduct inspections aimed at excluding individuals who do not meet the housing conditions specified in point a, Clause 1, Article 78 of the Law on Housing.
d) Việc lập Danh sách dự kiến thuê mua, quyết định phê duyệt Danh sách thuê mua và thời gian giải quyết việc cho thuê mua thực hiện theo quy định tại điểm d, điểm đ và điểm e khoản 1 Điều này.
Mục 2. QUẢN LÝ, SỬ DỤNG, VẬN HÀNH NHÀ Ở CHO LỰC LƯỢNG VŨ TRANG NHÂN DÂN THUỘC TÀI SẢN CÔNG
Điều 64. Quản lý, sử dụng, vận hành nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công
Việc quản lý, sử dụng, vận hành nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công thực hiện theo quy định tại khoản 1 Điều 52 của Nghị định này.
Điều 65. Việc miễn, giảm tiền thuê nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công
1. Việc miễn, giảm tiền thuê nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công thực hiện theo nguyên tắc quy định tại khoản 1 Điều 36 của Nghị định này.
2. Đối tượng quy định tại khoản 7 Điều 76 của Luật Nhà ở nếu thuộc một trong các trường hợp sau thì được miễn, giảm tiền thuê nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công:
a) Có tỷ lệ tổn thương cơ thể từ 31% trở lên khi làm nhiệm vụ cấp bách, nguy hiểm;
b) Trong hộ gia đình có thành viên thuộc đối tượng là người có công với cách mạng hoặc người khuyết tật.
3. Đối tượng quy định tại khoản 2 Điều này được giảm 50% tiền thuê nhà ở phải nộp.
Điều 66. Bán nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công đang cho thuê
1. Trường hợp cần đầu tư xây dựng nhà ở cho lực lượng vũ trang nhân dân, đại diện chủ sở hữu nhà ở thuộc tài sản công có thể lập Đề án bán nhà ở cho lực lượng vũ trang nhân dân đang cho thuê với nội dung quy định tại Điều 53 của Nghị định này.
2. Trình tự, thủ tục lập, thẩm định, phê duyệt Đề án bán nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công đang cho thuê thực hiện theo quy định tại các khoản 1, 2, 3 và 4 Điều 54 của Nghị định này.
3. Trình tự, thủ tục bán nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công sau khi Đề án được phê duyệt thực hiện theo quy định tại khoản 2 Điều 63 của Nghị định này.
Mục 3. NHÀ Ở CHO LỰC LƯỢNG VŨ TRANG NHÂN DÂN ĐƯỢC ĐẦU TƯ XÂY DỰNG KHÔNG BẰNG VỐN ĐẦU TƯ CÔNG
Điều 67. Điều kiện về thu nhập để được mua, thuê mua nhà ở cho lực lượng vũ trang nhân dân
1. Trường hợp người đứng đơn là người độc thân thì có thu nhập hàng tháng thực nhận không quá tổng thu nhập của sỹ quan có cấp bậc hàm Đại tá (gồm lương cơ bản và phụ cấp theo quy định) được cơ quan, đơn vị nơi công tác, quản lý xác nhận.
2. Trường hợp người đứng đơn đã kết hôn theo quy định của pháp luật:
a) Người đứng đơn và vợ (chồng) của người đó đều thuộc đối tượng quy định tại khoản 7 Điều 76 của Luật Nhà ở thì có tổng thu nhập hàng tháng thực nhận không quá 2,0 lần tổng thu nhập của sỹ quan có cấp bậc hàm Đại tá (gồm lương cơ bản và phụ cấp theo quy định) được cơ quan, đơn vị nơi công tác, quản lý xác nhận;
b) Vợ (chồng) của người đứng đơn không thuộc đối tượng quy định tại khoản 7 Điều 76 của Luật Nhà ở thì có tổng thu nhập hàng tháng thực nhận không quá 1,5 lần tổng thu nhập của sỹ quan có cấp bậc hàm Đại tá (gồm lương cơ bản và phụ cấp theo quy định) được cơ quan, đơn vị, doanh nghiệp nơi đối tượng làm việc xác nhận.
Trường hợp vợ (chồng) của người đứng đơn thuộc đối tượng quy định tại khoản 5 Điều 76 của Luật Nhà ở trong trường hợp không có Hợp đồng lao động thì thực hiện việc xác nhận điều kiện về thu nhập theo quy định tại khoản 2 Điều 30 của Nghị định này.
3. Thời gian xác nhận điều kiện về thu nhập trong 01 năm liền kề, tính từ thời điểm nộp hồ sơ mua, thuê mua nhà ở cho lực lượng vũ trang nhân dân.
Điều 68. Trình tự, thủ tục bán, cho thuê mua, cho thuê nhà ở cho lực lượng vũ trang nhân dân được đầu tư xây dựng không bằng vốn đầu tư công [9]
1. Trình tự, thủ tục bán nhà ở cho lực lượng vũ trang nhân dân thực hiện như sau:
a) Sau thời gian 30 ngày kể từ ngày khởi công, chủ đầu tư dự án đầu tư xây dựng nhà ở cho lực lượng vũ trang nhân dân có trách nhiệm cung cấp các thông tin liên quan đến dự án (tên dự án; chủ đầu tư dự án; địa điểm xây dựng dự án; địa chỉ liên lạc; tiến độ thực hiện dự án; quy mô dự án; số lượng căn hộ (trong đó bao gồm: tổng số căn hộ của dự án; diện tích căn hộ; giá bán (tạm tính) đối với từng loại căn hộ; thời gian bắt đầu và kết thúc nhận đơn đăng ký và các nội dung khác có liên quan) đến cơ quan chuyên môn về nhà ở của Bộ Quốc phòng, Bộ Công an.
Trường hợp hệ thống thông tin, cơ sở dữ liệu về nhà ở và thị trường bất động sản đã được kết nối, khai thác thì thực hiện công khai thông tin về dự án đầu tư xây dựng nhà ở cho lực lượng vũ trang nhân dân trên hệ thống này theo quy định của pháp luật về xây dựng và quản lý hệ thống thông tin, cơ sở dữ liệu về nhà ở và thị trường bất động sản;
b) Trước thời điểm bắt đầu tiếp nhận hồ sơ đăng ký mua nhà ở cho lực lượng vũ trang nhân dân thì chủ đầu tư phải gửi thông tin về thời điểm bắt đầu tiếp nhận, kết thúc tiếp nhận hồ sơ đăng ký mua, số căn hộ/căn nhà để bán, diện tích căn hộ, giá bán nhà ở cho lực lượng vũ trang nhân dân trên hệ thống thông tin về nhà ở và thị trường bất động sản và được gửi đến cơ quan chuyên môn về nhà ở trực thuộc Bộ Quốc phòng, Bộ Công an.
Thời gian nộp, tiếp nhận hồ sơ do chủ đầu tư quyết định nhưng tối thiểu là 30 ngày kể từ ngày bắt đầu tiếp nhận hồ sơ;
c) Bộ Quốc phòng, Bộ Công an có trách nhiệm giao cơ quan chuyên môn về nhà ở trực thuộc hoặc đơn vị trực thuộc cấp tỉnh tại địa phương nơi có dự án gửi thông tin dự án tới các đơn vị thuộc lực lượng vũ trang nhân dân trên địa bàn để thông báo cho đối tượng được hưởng chính sách hỗ trợ về nhà ở cho lực lượng vũ trang nhân dân đăng ký.
Cá nhân có nhu cầu đăng ký mua nhà ở cho lực lượng vũ trang nhân dân nộp đơn đăng ký mua nhà ở cho lực lượng vũ trang nhân dân theo Mẫu số 03 tại Phụ lục II của Nghị định này và các giấy tờ chứng minh đối tượng, điều kiện được mua nhà ở cho lực lượng vũ trang nhân dân về đơn vị nơi cá nhân đang công tác để tổng hợp, gửi cơ quan chuyên môn trực thuộc Bộ Quốc phòng, Bộ Công an;
d) Căn cứ số lượng đăng ký của các đơn vị, Bộ Quốc phòng, Bộ Công an tổ chức phân bổ số lượng căn hộ tại dự án cho các đơn vị trực thuộc đóng quân trên địa bàn cấp tỉnh nơi có dự án theo tỷ lệ hồ sơ đăng ký và các điều kiện đặc thù của lực lượng vũ trang. Việc phân bổ có thể thực hiện theo một hoặc nhiều đợt, bảo đảm phù hợp với số lượng căn hộ, hồ sơ đăng ký và tình hình triển khai thực tế của dự án.
Căn cứ số lượng căn hộ được phân bổ, các đơn vị trực thuộc Bộ Quốc phòng, Bộ Công an tổ chức xét duyệt, lập Danh sách các đối tượng thuộc phạm vi quản lý dự kiến mua nhà ở cho lực lượng vũ trang nhân dân kèm theo hồ sơ chứng minh đối tượng và điều kiện được hưởng chính sách hỗ trợ về nhà ở xã hội theo quy định để gửi về cơ quan chuyên môn về nhà ở trực thuộc Bộ Quốc phòng, Bộ Công an.
Người đăng ký mua nhà ở cho lực lượng vũ trang nhân dân phải cam kết chưa được hưởng chính sách hỗ trợ về nhà ở, chưa được mua nhà ở cho lực lượng vũ trang nhân dân và chịu trách nhiệm về việc bảo đảm đối tượng, điều kiện được hưởng chính sách hỗ trợ về nhà ở cho lực lượng vũ trang nhân dân tại thời điểm ký hợp đồng mua bán;
đ) Cơ quan chuyên môn về nhà ở trực thuộc Bộ Quốc phòng, Bộ Công an có trách nhiệm tổng hợp Danh sách dự kiến mua nhà ở cho lực lượng vũ trang nhân dân, trong đó thể hiện thông tin cá nhân của người đăng ký và các thành viên trong hộ gia đình được khai tại Đơn đăng ký mua nhà ở cho lực lượng vũ trang nhân dân; gửi Sở Xây dựng địa phương nơi có dự án để kiểm tra người đăng ký mua nhà ở cho lực lượng vũ trang nhân dân đã được hưởng hoặc chưa được hưởng chính sách hỗ trợ về nhà ở theo quy định của pháp luật về nhà ở. Sở Xây dựng có trách nhiệm trả lời bằng văn bản trong thời hạn 10 ngày kể từ ngày nhận được Danh sách;
e) Cơ quan chuyên môn về nhà ở trực thuộc Bộ Quốc phòng, Bộ Công an có trách nhiệm rà soát, đánh giá, tổng hợp ý kiến của Sở Xây dựng và đối chiếu với các quy định của pháp luật về nhà ở để xác định hồ sơ đáp ứng điều kiện được hưởng chính sách hỗ trợ về nhà ở cho lực lượng vũ trang nhân dân, tổng hợp Danh sách đủ điều kiện mua nhà ở cho lực lượng vũ trang nhân dân, trình lãnh đạo Bộ Quốc phòng, Bộ Công an phê duyệt Danh sách và thông báo cho chủ đầu tư dự án, đối tượng được mua nhà ở tại dự án.
Đối với hồ sơ không đáp ứng đủ điều kiện thì gửi trả lại và nêu rõ lý do trong thời hạn 15 ngày kể từ ngày phê duyệt Danh sách.
Trường hợp người có nhu cầu mua nhà ở cho lực lượng vũ trang nhân dân đáp ứng đúng đối tượng, đủ điều kiện theo quy định và đã được phê duyệt trong Danh sách, nhưng không còn nhu cầu mua nhà ở thì báo cáo đơn vị đang công tác để gửi về Bộ Quốc phòng, Bộ Công an đưa ra khỏi Danh sách;
g) Sau khi nhà ở đủ điều kiện được bán theo quy định của pháp luật về kinh doanh bất động sản, chủ đầu tư thực hiện ký kết Hợp đồng mua bán nhà ở cho lực lượng vũ trang nhân dân với khách hàng; đồng thời cập nhật thông tin về giao dịch, đối tượng đã mua nhà ở cho lực lượng vũ trang nhân dân theo quy định của pháp luật nhà ở, pháp luật về xây dựng và quản lý hệ thống thông tin, cơ sở dữ liệu về nhà ở và thị trường bất động sản.
Chủ đầu tư dự án có trách nhiệm công bố công khai Danh sách các khách hàng đã ký hợp đồng mua bán nhà ở cho lực lượng vũ trang nhân dân (bao gồm cả các thành viên trong hộ gia đình) tại trụ sở làm việc của chủ đầu tư, tại địa điểm thực hiện dự án và tại Sàn giao dịch bất động sản (nếu có) hoặc trang thông tin điện tử về nhà ở cho lực lượng vũ trang nhân dân của chủ đầu tư (nếu có) và gửi về cơ quan chuyên môn về nhà ở trực thuộc Bộ Quốc phòng, Bộ Công an để lưu trữ và phục vụ cho công tác quản lý, kiểm tra.
2. Trình tự, thủ tục cho thuê mua nhà ở cho lực lượng vũ trang nhân dân được thực hiện theo quy định tại khoản 1 Điều này. 19 3. Trình tự, thủ tục cho thuê nhà ở cho lực lượng vũ trang nhân dân được thực hiện theo quy định tại khoản 1 Điều này và không phải nộp các giấy tờ chứng minh điều kiện về nhà ở và thu nhập. Trường hợp thuê nhà ở cho lực lượng vũ trang nhân dân thuộc tài sản công thì người thuê nộp các giấy tờ chứng minh thuộc đối tượng được miễn, giảm tiền thuê nhà ở cho lực lượng vũ trang nhân dân (nếu có).
Điều 69. Trình tự, thủ tục bán lại nhà ở cho lực lượng vũ trang nhân dân
1. Trình tự, thủ tục bán lại nhà ở cho lực lượng vũ trang nhân dân trong thời hạn 05 năm thực hiện như sau:
a) Trường hợp bán lại nhà ở cho lực lượng vũ trang nhân dân cho chủ đầu tư dự án thực hiện theo quy định tại khoản 1 Điều 39 của Nghị định này;
b) Trường hợp bán lại nhà ở cho lực lượng vũ trang nhân dân cho đối tượng khác thuộc diện được mua, thuê mua nhà ở cho lực lượng vũ trang nhân dân, thì người mua lại nhà ở cho lực lượng vũ trang nhân dân phải có đơn và các giấy tờ xác nhận về đối tượng và điều kiện được mua nhà ở cho lực lượng vũ trang nhân dân và nộp hồ sơ về cơ quan quản lý nhà ở của Bộ Quốc phòng, Bộ Công an và Sở Xây dựng địa phương nơi có dự án để xác định đúng đối tượng, điều kiện theo quy định tại điểm c và điểm d khoản 1 Điều 68 của Nghị định này. Người bán lại phải làm thủ tục thanh lý Hợp đồng với chủ đầu tư dự án (nếu có).
Việc bán lại thực hiện theo quy định tại khoản 1 Điều 109 của Luật Nhà ở và quy định của pháp luật về kinh doanh bất động sản, pháp luật về đất đai.
2. Trình tự, thủ tục bán lại nhà ở cho lực lượng vũ trang nhân dân sau thời hạn 05 năm thực hiện theo quy định tại Điều 40 của Nghị định này.
Điều 70. Việc cập nhật thông tin các đối tượng được mua, thuê mua, thuê nhà ở cho lực lượng vũ trang nhân dân
1. Sau 15 ngày kể từ khi nhận được Danh sách các đối tượng đã ký Hợp đồng mua, thuê mua, thuê nhà ở cho lực lượng vũ trang nhân dân theo quy định tại điểm e khoản 1 Điều 68 của Nghị định này, Sở Xây dựng địa phương nơi có dự án nhà ở cho lực lượng vũ trang nhân dân có trách nhiệm cập nhật Danh sách các đối tượng được mua, thuê mua, thuê nhà ở cho lực lượng vũ trang nhân dân lên Trang thông tin điện tử theo các nội dung quy định tại khoản 2 Điều này.
2. Các thông tin cập nhật như sau:
a) Họ và tên;
b) Căn cước công dân/số định danh cá nhân;
c) Địa chỉ thường trú;
d) Những người có tên trong hộ gia đình (nếu đối tượng là hộ gia đình);
đ) Tên dự án đầu tư xây dựng nhà ở cho lượng vũ trang nhân dân.
3. Trường hợp người có nhu cầu mua, thuê mua, thuê nhà ở cho lực lượng vũ trang nhân dân đã được chủ đầu tư dự án ký Hợp đồng nhưng thuộc trường hợp chấm dứt Hợp đồng thì chủ đầu tư dự án đó có trách nhiệm báo cáo cơ quan quản lý nhà ở của Bộ Quốc phòng, Bộ Công an và Sở Xây dựng địa phương nơi có dự án nhà ở cho lực lượng vũ trang nhân dân để cập nhật lại Danh sách đối tượng được mua, thuê mua, thuê nhà ở cho lực lượng vũ trang nhân dân.
Điều 71. Vay vốn ưu đãi để mua, thuê mua nhà ở cho lực lượng vũ trang nhân dân và xây dựng nhà ở cho lực lượng vũ trang nhân dân
1. Việc vay vốn ưu đãi để mua, thuê mua nhà ở cho lực lượng vũ trang nhân dân tại Ngân hàng Chính sách xã hội thực hiện theo quy định tại các khoản 1, 3, 4 và 5 Điều 48 của Nghị định này.
2. Việc vay vốn ưu đãi để mua, thuê mua nhà ở cho lực lượng vũ trang nhân dân tại tổ chức tín dụng do Nhà nước chỉ định thực hiện theo quy định tại Điều 49 của Nghị định này.
3. Việc vay vốn ưu đãi của chủ đầu tư dự án đầu tư xây dựng nhà ở cho lực lượng vũ trang nhân dân không bằng vốn đầu tư công thực hiện theo quy định tại Điều 25 của Nghị định này.
Chương VI. TỔ CHỨC THỰC HIỆN
Điều 72. Trách nhiệm của Bộ Xây dựng
1. Thực hiện các nhiệm vụ được giao theo quy định của Luật Nhà ở và Nghị định này.
2. Ban hành theo thẩm quyền quy chế quản lý vận hành nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân loại hình nhà chung cư.
3. Chủ trì, phối hợp với các bộ, ngành, Ủy ban nhân dân cấp tỉnh hướng dẫn việc xây dựng hệ thống cơ sở dữ liệu về nhà ở xã hội, cập nhật trên Cổng thông tin điện tử của Bộ Xây dựng; hướng dẫn, kiểm tra, thanh tra theo thẩm quyền về công tác phát triển và quản lý nhà ở xã hội; tổng hợp, đánh giá tình hình triển khai thực hiện Nghị định này; đề xuất sửa đổi, bổ sung cho phù hợp tình hình thực tế trình Chính phủ xem xét, quyết định.
4. Thực hiện các nhiệm vụ, quyền hạn khác theo quy định của pháp luật.
Điều 73. Trách nhiệm của các bộ, ngành có liên quan
1. Trách nhiệm của Bộ Quốc phòng và Bộ Công an:
a) Chủ trì ban hành, hướng dẫn về mẫu giấy tờ chứng minh đối tượng được hưởng chính sách hỗ trợ về nhà ở cho lực lượng vũ trang nhân dân, chính sách hỗ trợ về nhà ở xã hội thuộc phạm vi quản lý;
b) Chủ trì, phối hợp với Ủy ban nhân dân cấp tỉnh trong việc tổ chức việc xác định nhu cầu nhà ở đối với đối tượng lực lượng vũ trang nhân dân thuộc thẩm quyền quản lý, làm cơ sở tổng hợp nhu cầu này trong kế hoạch phát triển nhà ở của địa phương;
c) Chủ trì ban hành, hướng dẫn yêu cầu đối với dự án đầu tư xây dựng nhà ở cho lực lượng vũ trang nhân dân thuộc phạm vi quản lý, đảm bảo phù hợp với quy định của Luật Nhà ở và Nghị định này;
d) Phối hợp với các bộ, ngành báo cáo cấp có thẩm quyền để xử lý những khó khăn, vướng mắc trong quá trình triển khai thực hiện các dự án đầu tư xây dựng nhà ở cho lực lượng vũ trang nhân dân thuộc phạm vi quản lý;
đ) Tổ chức thanh tra, kiểm tra, giám sát và xử lý các vi phạm liên quan đến việc bán, cho thuê mua, cho thuê nhà ở cho lực lượng vũ trang nhân dân thuộc phạm vi quản lý;
e) Chịu trách nhiệm về việc phê duyệt Danh sách đối tượng đăng ký mua, thuê mua, thuê nhà ở cho lực lượng vũ trang nhân dân gửi chủ đầu tư dự án nhà ở cho lực lượng vũ trang nhân dân đảm bảo đúng đối tượng và đủ điều kiện theo quy định của pháp luật về nhà ở.
2. Bộ Tài chính
Phối hợp với Bộ Kế hoạch và Đầu tư và các bộ, ngành liên quan thực hiện việc bố trí vốn từ ngân sách trung ương theo kế hoạch hàng năm thông qua Ngân hàng Chính sách xã hội, Ngân hàng Phát triển Việt Nam, các tỉnh, thành phố trực thuộc Trung ương để triển khai chính sách hỗ trợ cho vay ưu đãi theo quy định của Nghị định này.
3. Bộ Tài nguyên và Môi trường
Chủ trì hướng dẫn các địa phương trong việc lập quy hoạch, kế hoạch sử dụng đất, bố trí quỹ đất để triển khai thực hiện các dự án xây dựng nhà ở xã hội, dự án xây dựng nhà ở cho lực lượng vũ trang nhân dân.
4. Ngân hàng Nhà nước Việt Nam
Căn cứ các Chương trình tín dụng do Chính phủ, Thủ tướng Chính phủ quyết định trong từng thời kỳ, chỉ định một số tổ chức tín dụng triển khai cho vay hỗ trợ nhà ở xã hội, nhà lưu trú công nhân trong khu công nghiệp, nhà ở cho lực lượng vũ trang nhân dân.
5. Ngân hàng Chính sách xã hội, Ngân hàng Phát triển Việt Nam:
a) Quản lý và sử dụng nguồn vốn, thực hiện cho vay đúng đối tượng theo quy định của Nghị định này;
b) Phối hợp với các bộ, ngành báo cáo cấp có thẩm quyền để xử lý những khó khăn, vướng mắc trong quá trình thực hiện cho vay hỗ trợ nhà ở xã hội.
6. Các bộ, ngành có liên quan có trách nhiệm nghiên cứu ban hành theo thẩm quyền hoặc trình cơ quan có thẩm quyền ban hành sửa đổi, bổ sung các cơ chế, chính sách liên quan đến việc phát triển và quản lý nhà ở xã hội quy định tại Nghị định này.
Điều 74. Trách nhiệm của Tổng Liên đoàn Lao động Việt Nam
1. Quản lý và sử dụng nguồn tài chính công đoàn để thực hiện chính sách phát triển và quản lý nhà ở xã hội cho thuê theo quy định của Luật Nhà ở và Nghị định này.
2. Chủ trì ban hành, hướng dẫn về giá cho thuê nhà ở xã hội tại các dự án đầu tư xây dựng nhà ở xã hội thuộc phạm vi quản lý.
3. Phối hợp với các bộ, ngành báo cáo cấp có thẩm quyền để xử lý những khó khăn, vướng mắc trong quá trình triển khai thực hiện các dự án đầu tư xây dựng nhà ở xã hội thuộc phạm vi quản lý.
4. Tổ chức kiểm tra, giám sát và kiến nghị xử lý các vi phạm liên quan đến việc cho thuê nhà ở xã hội tại các dự án đầu tư xây dựng nhà ở xã hội thuộc phạm vi quản lý.
Điều 75. Trách nhiệm của Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương
1. Tổ chức, chỉ đạo việc điều tra, khảo sát, tổng hợp nhu cầu để xây dựng, điều chỉnh chương trình, kế hoạch, chỉ tiêu đầu tư xây dựng nhà ở xã hội hàng năm, trung hạn và dài hạn trên địa bàn; chỉ đạo và giao nhiệm vụ cho các doanh nghiệp tại địa phương, phối hợp với Bộ Xây dựng, Bộ Quốc phòng, Bộ Công an để chỉ đạo giao nhiệm vụ cho các doanh nghiệp nhà nước giữ quyền chi phối trực thuộc các bộ này để phát triển nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân theo quy định của Nghị định này.
2. Rà soát, điều chỉnh, bổ sung quỹ đất dành để phát triển nhà ở xã hội (bao gồm quỹ đất để phát triển nhà ở cho lực lượng vũ trang nhân dân) trong quy hoạch phân khu, quy hoạch chi tiết.
3. Thu hồi quỹ đất 20% dành để xây dựng nhà ở xã hội trong các dự án đầu tư xây dựng nhà ở thương mại, khu đô thị theo quy định của Luật Nhà ở số 65/2014/QH13 đối với các trường hợp chủ đầu tư không đưa quỹ đất này vào sử dụng hoặc chậm tiến độ sử dụng đất so với tiến độ ghi trong dự án đầu tư thuộc trường hợp thu hồi đất theo quy định của pháp luật về đất đai để giao cho các chủ đầu tư có nhu cầu đầu tư xây dựng nhà ở xã hội. Việc thu hồi quỹ đất này thực hiện theo quy định của pháp luật về đất đai.
4. Thu hồi quỹ đất 20% theo quy định của pháp luật về đất đai trong trường hợp chủ đầu tư dự án đầu tư xây dựng nhà ở thương mại phải dành quỹ đất để đầu tư xây dựng nhà ở xã hội theo quy định tại Điều 17 của Nghị định này nhưng không triển khai đầu tư xây dựng hoặc chậm triển khai đầu tư xây dựng so với tiến độ ghi trong dự án đầu tư.
5. Tổ chức chỉ đạo thực hiện việc lập, thẩm định, quyết định chủ trương đầu tư hoặc phê duyệt dự án đầu tư xây dựng nhà ở xã hội đầu tư bằng vốn đầu tư công theo thẩm quyền; thẩm định, chấp thuận chủ trương đầu tư dự án đầu tư xây dựng nhà ở xã hội không bằng vốn đầu tư công theo thẩm quyền.
6. Quy định cụ thể và công bố công khai các tiêu chuẩn, đối tượng và điều kiện được mua, thuê, thuê mua nhà ở xã hội trên phạm vi địa bàn phù hợp với điều kiện của từng địa phương.
7. Tổ chức quản lý và theo dõi chặt chẽ việc bán, thuê, thuê mua nhà ở xã hội.
8. Chỉ đạo cơ quan chức năng tham khảo phương pháp xác định giá cho thuê theo quy định tại Điều 34 của Nghị định này và mặt bằng giá thị trường tại địa phương để xây dựng, ban hành khung giá cho thuê nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân được đầu tư xây dựng theo dự án, nhà lưu trú công nhân trong khu công nghiệp đảm bảo phù hợp với điều kiện thực tế của địa phương; ban hành khung giá thuê nhà ở do các cá nhân đầu tư xây dựng hoặc cải tạo, sửa chữa nhà ở để các đối tượng được hưởng chính sách hỗ trợ về nhà ở xã hội thuê trên phạm vi địa bàn theo quy định của Nghị định này.
9. Chỉ đạo cơ quan chức năng thuộc thẩm quyền thực hiện việc thẩm định giá bán, giá thuê mua nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân trên phạm vi địa bàn. Tổ chức quản lý và theo dõi chặt chẽ việc bán, cho thuê mua, cho thuê.
10. Ban hành giá dịch vụ quản lý vận hành nhà ở tại các dự án đầu tư xây dựng nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân để áp dụng thống nhất trên địa bàn.
11. Phối hợp với Bộ Quốc phòng, Bộ Công an trong việc xác định, tổng hợp nhu cầu nhà ở cho lực lượng vũ trang nhân dân trên phạm vi địa bàn trong quá trình xây dựng kế hoạch phát triển nhà ở của địa phương; bố trí quỹ đất trong quỹ đất phát triển nhà ở xã hội của địa phương để phát triển nhà ở cho lực lượng vũ trang nhân dân.
12. Triển khai thực hiện các cơ chế chính sách về phát triển và quản lý nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, nhà lưu trú công nhân trong khu công nghiệp; ban hành các quy định cụ thể về cơ chế khuyến khích, ưu đãi thêm của địa phương, để kêu gọi các thành phần kinh tế tham gia đầu tư xây dựng nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, nhà lưu trú công nhân trong khu công nghiệp trên phạm vi địa bàn; hỗ trợ chủ đầu tư dự án đầu tư xây dựng nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, nhà lưu trú công nhân trong khu công nghiệp trong việc thực hiện đấu nối hệ thống hạ tầng kỹ thuật trong dự án với hệ thống hạ tầng chung của khu vực.
13. Yêu cầu các chủ đầu tư dự án xây dựng nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, nhà lưu trú công nhân trong khu công nghiệp trên phạm vi địa bàn báo cáo về tình hình triển khai thực hiện dự án cho cơ quan quản lý nhà nước về nhà ở tại địa phương theo định kỳ; tổ chức giao ban, sơ kết đánh giá tình hình, kết quả thực hiện phát triển nhà ở xã hội của địa phương theo định kỳ hàng năm hoặc theo yêu cầu đột xuất, báo cáo Bộ Xây dựng để tổng hợp, báo cáo Thủ tướng Chính phủ.
14. Chỉ đạo Sở Xây dựng, Sở Tài nguyên và Môi trường, chính quyền cấp huyện, cấp xã và các cơ quan chức năng khác thực hiện thẩm định, xác nhận đối tượng, điều kiện về nhà ở, điều kiện về thu nhập, điều kiện được vay vốn ưu đãi theo quy định tại Nghị định này; phối hợp chặt chẽ với Ngân hàng Chính sách xã hội, tổ chức tín dụng trong quá trình xử lý nợ bị rủi ro và tài sản bảo đảm để thu hồi vốn vay.
15. Tổ chức chủ trì hoặc phối hợp với các bộ, ngành cơ quan có liên quan trong việc thanh tra, kiểm tra, giám sát và xử lý các vi phạm liên quan đến việc đầu tư xây dựng, bán, cho thuê, cho thuê mua nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, nhà lưu trú công nhân trong khu công nghiệp trên phạm vi địa bàn.
16. Phối hợp với các bộ, ngành có liên quan tổng hợp, báo cáo cấp có thẩm quyền kế hoạch đầu tư công trung hạn và hàng năm và bố trí nguồn vốn ngân sách nhà nước để cấp bù lãi suất cho các chủ đầu tư xây dựng nhà ở xã hội vay vốn ưu đãi tại các tổ chức tín dụng theo quy định tại khoản 3 Điều 50 của Nghị định này; hướng dẫn cấp bù lãi suất cho đối tượng vay vốn ưu đãi tại các tổ chức tín dụng theo quy định tại khoản 3 Điều 50 của Nghị định này.
Điều 76. Trách nhiệm của các doanh nghiệp có cơ sở sản xuất trong khu công nghiệp
1. Đối với các doanh nghiệp đã và đang sản xuất tại khu công nghiệp, căn cứ nhu cầu thực tế về nhà lưu trú công nhân trong khu công nghiệp và quỹ đất thương mại dịch vụ của khu công nghiệp để xây dựng kế hoạch giải quyết nhà lưu trú công nhân, dành nguồn tài chính để hỗ trợ đầu tư phát triển nhà lưu trú công nhân cho công nhân của đơn vị mình thuê trong thời gian làm việc.
2. Đối với các doanh nghiệp thành lập mới hoặc mở rộng sản xuất có trách nhiệm bảo đảm nhà ở xã hội cho hộ gia đình, cá nhân làm việc tại đơn vị mình.
Chương VII. ĐIỀU KHOẢN THI HÀNH [10]
Điều 77. Điều khoản thi hành và trách nhiệm thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 8 năm 2024.
2. Các quy định về phát triển và quản lý nhà ở xã hội sau đây hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành:
a) Nghị định số 100/2015/NĐ-CP ngày 20 tháng 10 năm 2015 của Chính phủ về phát triển và quản lý nhà ở xã hội;
b) Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 100/2015/NĐ-CP ngày 20 tháng 10 năm 2015 của Chính phủ về phát triển và quản lý nhà ở xã hội;
c) Điều 6 và khoản 4 Điều 16 Nghị định số 35/2023/NĐ-CP ngày 20 tháng 6 năm 2023 của Chính phủ sửa đổi, bổ sung một số Nghị định thuộc lĩnh vực quản lý nhà nước của Bộ Xây dựng;
d) Điều 7 Nghị định số 104/2022/NĐ-CP ngày 21 tháng 12 năm 2022 của Chính phủ sửa đổi, bổ sung một số điều của các Nghị định liên quan đến việc xuất trình sổ hộ khẩu, sổ tạm trú giấy khi thực hiện thủ tục hành chính, cung cấp dịch vụ công.
3. Trong giai đoạn đến năm 2030, Ngân hàng Chính sách xã hội chưa thực hiện cho vay đối với chủ đầu tư dự án nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, cá nhân xây dựng hoặc cải tạo, sửa chữa nhà ở để cho thuê theo quy định tại Điều 25, Điều 26 và khoản 3 Điều 71 của Nghị định này.
Sau năm 2030, căn cứ chức năng nhiệm vụ được cấp có thẩm quyền giao, Ngân hàng Chính sách xã hội chủ trì, phối hợp với Bộ Xây dựng và các bộ, ngành có liên quan xây dựng Đề án cho vay đối với chủ đầu tư dự án nhà ở xã hội, nhà ở cho lực lượng vũ trang nhân dân, cá nhân xây dựng hoặc cải tạo, sửa chữa nhà ở để cho thuê theo quy định tại Điều 25, Điều 26 và khoản 3 Điều 71 của Nghị định này trình Chính phủ xem xét, phê duyệt trước khi triển khai thực hiện.
4. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương và các cơ quan, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này.
Điều 78. Quy định chuyển tiếp
1. Đối với dự án đầu tư xây dựng nhà ở xã hội thực hiện theo hình thức xây dựng - chuyển giao (BT) thực hiện theo quy định của Nghị định số 100/2015/NĐ-CP ngày 20 tháng 10 năm 2015 của Chính phủ thì việc xử lý chuyển tiếp được thực hiện theo quy định của pháp luật về đầu tư theo phương thức đối tác công - tư.
2. Đối với các dự án đầu tư xây dựng nhà ở thương mại, khu đô thị đã có quyết định hoặc chấp thuận chủ trương đầu tư tại thời điểm Nghị định số 100/2015/NĐ-CP ngày 20 tháng 10 năm 2015 của Chính phủ, Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ, Nghị định số 35/2023/NĐ-CP ngày 20 tháng 6 năm 2023 của Chính phủ thì chủ đầu tư tiếp tục thực hiện nghĩa vụ nhà ở xã hội theo quy định của các Nghị định nêu trên. Trường hợp điều chỉnh tiến độ thực hiện dự án thì thực hiện theo quy định của pháp luật về đầu tư.
3. Trường hợp dự án đầu tư xây dựng nhà ở xã hội đã được cơ quan có thẩm quyền quyết định hoặc chấp thuận chủ trương đầu tư; chấp thuận đầu tư dự án; quyết định phê duyệt dự án trước ngày Luật Nhà ở số 27/2023/QH15 ngày 27 tháng 11 năm 2023 có hiệu lực thi hành thì chủ đầu tư dự án tiếp tục được hưởng cơ chế ưu đãi theo nội dung văn bản đã được quyết định, chấp thuận, phê duyệt, trừ trường hợp Luật Nhà ở số 27/2023/QH15 và Nghị định này quy định ưu đãi đầu tư mới, ưu đãi đầu tư cao hơn thì chủ đầu tư được hưởng ưu đãi đầu tư theo quy định của Luật Nhà ở số 27/2023/QH15 và Nghị định này cho thời gian hưởng ưu đãi còn lại của dự án đầu tư.
4. Đối với trường hợp dự án đầu tư xây dựng nhà ở thương mại có quy mô dưới 10 ha, chủ đầu tư dự án đã được chấp thuận thực hiện nghĩa vụ nhà ở xã hội theo hình thức nộp bằng tiền trước ngày Nghị định này có hiệu lực thi hành nhưng đến thời điểm Nghị định này có hiệu lực thi hành mà chưa tính, chưa nộp số tiền chủ đầu tư phải nộp tương đương giá trị quỹ đất ở đã đầu tư xây dựng hệ thống hạ tầng kỹ thuật phải dành để xây dựng nhà ở xã hội thì thực hiện tính, thu, nộp theo quy định tại Nghị định này; trường hợp đã tính tiền nhưng chưa nộp tiền thì phải nộp số tiền đã tính và số tiền chậm nộp theo quy định tại khoản 2a Điều 19 của Nghị định này.
Trường hợp dự án đầu tư xây dựng nhà ở thương mại có quy mô dưới 10 ha, chủ đầu tư dự án đã được chấp thuận thực hiện nghĩa vụ nhà ở xã hội theo hình thức nộp bằng tiền trước ngày Nghị định này có hiệu lực thi hành đã tính, đã nộp tiền sử dụng đất, tiền thuê đất theo quy định của pháp luật về đất đai trước ngày Nghị định này có hiệu lực thi hành thì không phải nộp số tiền theo quy định tại điểm b khoản 2 Điều 19 của Nghị định này
5. Đối với dự án phát triển nhà ở thương mại, dự án đầu tư phát triển đô thị đã lựa chọn chủ đầu tư trước thời điểm Nghị định này có hiệu lực thi hành, nhưng chưa bố trí quỹ đất dành để xây dựng nhà ở xã hội theo quy định của pháp luật về nhà ở tại thời điểm dự án được quyết định chủ trương đầu tư, chấp thuận chủ trương đầu tư, chấp thuận đầu tư, phê duyệt dự án mà sau thời điểm Nghị định này có hiệu lực thi hành, dự án đó bị thu hồi theo quy định của pháp luật để giao cho chủ đầu tư khác thì chủ đầu tư dự án đó có trách nhiệm tổ chức lập, điều chỉnh quy hoạch để bố trí bổ sung quỹ đất ở trong dự án để xây dựng nhà ở xã hội theo quy định tại Điều 17 của Nghị định này.
6. Trường hợp dự án đầu tư xây dựng nhà ở xã hội được ưu đãi theo quy định tại điểm b, điểm c khoản 1 Điều 9 của Nghị định số 100/2015/NĐ- CP ngày 20 tháng 10 năm 2015 của Chính phủ (được sửa đổi, bổ sung tương ứng tại điểm a khoản 8 Điều 1 Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ, khoản 2 và khoản 5 Điều 6 Nghị định số 35/2023/NĐ-CP ngày 20 tháng 6 năm 2023 của Chính phủ) thì khi chuyển nhượng công trình kinh doanh thương mại, nhà ở thương mại trong phần diện tích được ưu đãi này không phải nộp số tiền sử dụng đất đã được miễn, giảm cho Nhà nước.
7. Trường hợp dự án đầu tư xây dựng nhà ở xã hội đã được cơ quan có thẩm quyền quyết định hoặc chấp thuận chủ trương đầu tư; chấp thuận đầu tư dự án; quyết định phê duyệt dự án và đã được cơ quan nhà nước có thẩm quyền quyết định miễn, giảm tiền sử dụng đất, tiền thuê đất nộp tiền một lần cho cả thời gian thuê trước ngày Luật Nhà ở số 27/2023/QH15 ngày 27 tháng 11 năm 2023 có hiệu lực thi hành thì không xác định lại mức ưu đãi đã được hưởng và tiền sử dụng đất, tiền thuê đất đã được xác định đúng chính sách pháp luật.
8. Chủ đầu tư dự án đầu tư xây dựng nhà ở xã hội không sử dụng nguồn vốn hoặc hình thức quy định tại khoản 1 Điều 53 của Luật Nhà ở số 65/2014/QH13 đã được sửa đổi, bổ sung tại điểm b khoản 6 Điều 99 của Luật Đầu tư theo phương thức đối tác công tư (PPP) số 64/2020/QH14 để cho thuê, cho thuê mua, bán thì được miễn tiền sử dụng đất, tiền thuê đất theo quy định tại điểm a khoản 2 Điều 85 của Luật Nhà ở số 27/2023/QH15 ngày 27 tháng 11 năm 2023.
Ủy ban nhân dân cấp tỉnh xem xét, quyết định việc hoàn trả lại hoặc khấu trừ vào nghĩa vụ tài chính của chủ đầu tư dự án phải nộp cho Nhà nước, kể cả chi phí bồi thường, giải phóng mặt bằng (nếu có) đối với trường hợp chủ đầu tư đã nộp tiền sử dụng đất khi được Nhà nước giao đất hoặc đã nhận chuyển nhượng quyền sử dụng đất từ tổ chức, hộ gia đình, cá nhân khác mà diện tích đất đó được sử dụng để xây dựng nhà ở xã hội hoặc chủ đầu tư dự án đã nộp tiền sử dụng đất đối với quỹ đất 20% theo quy định tại Điều 5 của Nghị định số 100/2015/NĐ-CP ngày 20 tháng 10 năm 2015 của Chính phủ (được sửa đổi, bổ sung tại khoản 4 Điều 1 Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ).
9. Trường hợp dự án đầu tư xây dựng nhà ở xã hội đang trong giai đoạn lựa chọn chủ đầu tư dự án đầu tư xây dựng nhà ở xã hội theo quy định của Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ mà chưa ban hành văn bản lựa chọn chủ đầu tư theo quy định của Nghị định số 49/2021/NĐ-CP trước ngày Nghị định này có hiệu lực thi hành thì tiếp tục áp dụng theo quy định của Nghị định số 49/2021/NĐ-CP.
10. Đối với trường hợp bán nhà ở xã hội phải nộp tiền sử dụng đất theo quy định của Nghị định số 100/2015/NĐ-CP ngày 20 tháng 10 năm 2015 của Chính phủ (được sửa đổi, bổ sung tại Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ) trước ngày Nghị định này có hiệu lực thi hành mà đến ngày Nghị định này có hiệu lực thi hành vẫn chưa nộp tiền sử dụng đất thì tiếp tục nộp tiền theo quy định của Nghị định số 49/2021/NĐ-CP.
11. Việc đăng ký hồ sơ, xét duyệt hồ sơ, thẩm định giá, ký Hợp đồng, mua bán, cho thuê mua, cho thuê, bán lại nhà ở xã hội đang thực hiện theo quy định của Nghị định số 100/2015/NĐ-CP ngày 20 tháng 10 năm 2015 của Chính phủ (được sửa đổi, bổ sung tại Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ) trước ngày Nghị định này có hiệu lực thi hành mà đến ngày Nghị định này có hiệu lực thi hành chưa thực hiện xong thì tiếp tục áp dụng theo quy định của Nghị định số 49/2021/NĐ-CP.

Trường hợp đang cho thuê nhà ở xã hội theo quy định tại khoản 2 Điều 26 Nghị định số 100/2015/NĐ-CP thì chủ đầu tư được ưu tiên bán nhà ở cho người đang thuê nếu người thuê nhà ở có nhu cầu mua trước thời hạn 10 năm và đảm bảo đúng đối tượng, điều kiện theo quy định của Nghị định này hoặc bán lại nhà ở này cho Quỹ nhà ở quốc gia.
Giá bán nhà ở xã hội đang cho thuê gồm: giá bán đã được thẩm định, xác định tại thời điểm xác định, thẩm định giá thuê, cộng với lãi vay bình quân hằng năm của các ngân hàng thương mại cổ phần nhà nước tương ứng với thời gian thuê và trừ đi phần giá trị khấu hao nhà ở. Giá trị khấu hao nhà ở được xác định bằng giá bán nhà ở đã được cơ quan nhà nước có thẩm quyền thẩm định nhân với thời gian đã thuê chia cho số năm thu hồi vốn đầu tư đã tính toán để cho thuê
13. Đối với dự án đang trong quá trình thực hiện chấp thuận chủ trương đầu tư trước thời điểm Nghị định này có hiệu lực mà quy hoạch chi tiết của dự án chưa phù hợp quy hoạch chung và quy hoạch phân khu thì sự phù hợp với quy hoạch được thẩm định theo quy hoạch chung, quy hoạch phân khu và chỉ tiêu về hệ số sử dụng đất hoặc mật độ xây dựng theo quy định của Luật Nhà ở số 65/2014/QH13 và các văn bản hướng dẫn thi hành.
14. Đối với các khoản vay đã ký Hợp đồng tín dụng với Ngân hàng Chính sách xã hội để mua, thuê mua nhà ở xã hội, xây dựng mới hoặc cải tạo, sửa chữa nhà để ở theo quy định tại Điều 16 Nghị định số 100/2015/NĐ- CP ngày 20 tháng 10 năm 2015 của Chính phủ (được sửa đổi, bổ sung tại Nghị định số 49/2021/NĐ-CP ngày 01 tháng 4 năm 2021 của Chính phủ) trước ngày Nghị định này có hiệu lực thi hành thì áp dụng mức lãi suất theo quy định tại khoản 4 Điều 48 của Nghị định này cho dư nợ gốc thực tế, dư nợ gốc bị quá hạn (nếu có)./.

[1] Nghị định số 54/2026/NĐ-CP ngày 09/02/2026 của Chính phủ sửa đổi, bổ sung một số điều của các Nghị định trong lĩnh vực nhà ở, kinh doanh bất động sản, có căn cứ ban hành như sau:
“Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;
Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;
Căn cứ Luật Tổ chức chính quyền địa phương số 72/2025/QH15;
Căn cứ Luật Nhà ở số 27/2023/QH15;
Căn cứ Luật Kinh doanh bất động sản số 29/2023/QH15;
Căn cứ Luật số 43/2024/QH15 sửa đổi, bổ sung một số điều của Luật Đất đai số 31/2024/QH15, Luật Nhà ở số 27/2023/QH15, Luật Kinh doanh bất động sản số 29/2023/QH15 và Luật Các tổ chức tín dụng số 32/2024/QH15;
Theo đề nghị của Bộ trưởng Bộ Xây dựng; Chính phủ ban hành Nghị định sửa đổi, bổ sung một số điều của các Nghị định trong lĩnh vực nhà ở, kinh doanh bất động sản”
[2] Khoản này được bổ sung theo quy định tại Điều 31 Nghị định số 54/2026/NĐ-CP, có hiệu lực thi hành kể từ ngày 09/02/2026.

[10] Điều 41 Nghị định số 54/2026/NĐ-CP, có hiệu lực thi hành kể từ ngày 09/02/2026 quy định như sau:
“Điều 41. Điều khoản thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 09 tháng 02 năm 2026.

4. Cơ quan có thẩm quyền giải quyết thủ tục hành chính quy định tại Nghị định số 95/2024/NĐ-CP, Nghị định số 96/2024/NĐ-CP, Nghị định số 98/2024/NĐ-CP, Nghị định số 100/2024/NĐ-CP và Nghị định này có trách nhiệm cập nhật văn bản giải quyết thủ tục hành chính lên hệ thống thông tin về nhà ở và thị trường bất động sản theo quy định của pháp luật về kinh doanh bất động sản”
Điều 42 Nghị định số 54/2026/NĐ-CP có hiệu lực thi hành kể từ ngày 09/02/2026 quy định như sau:
“Điều 42. Quy định chuyển tiếp
1. Đối với các hồ sơ đã nộp trước ngày Nghị định này có hiệu lực thi hành mà chưa ban hành kết quả giải quyết, cơ quan tiếp nhận hồ sơ không được yêu cầu nộp thêm giấy tờ (bản giấy) đối với thành phần hồ sơ đã được quy định tại Nghị định này, trừ trường hợp cơ sở dữ liệu đối với nội dung đó chưa được khai thác, vận hành.

4. Trường hợp chủ đầu tư đã thực hiện tiếp nhận hồ sơ đăng ký mua, thuê mua theo quy định của Nghị định số 100/2024/NĐ-CP thì tiếp tục thực hiện theo trình tự, thủ tục của Nghị định số 100/2024/NĐ-CP. Trường hợp chưa tiếp nhận hồ sơ đăng ký thì thực hiện theo quy định của Nghị định này.
5. Các giấy tờ chứng minh đối tượng, điều kiện được hưởng chính sách hỗ trợ về nhà ở xã hội đã được cơ quan có thẩm quyền xác nhận theo quy định trước ngày Nghị định này có hiệu lực thi hành thì tiếp tục được sử dụng và có giá trị trong thời hạn 12 tháng, kể từ ngày được xác nhận”
