How many groups are eligible for social housing support policies?

What forms of housing development are there?
According to Article 17 of the Law on Housing, forms of housing development include: housing development under projects; housing development by households and individuals. Housing construction projects include: projects for new construction or renovation of individual or clustered housing structures; projects for constructing housing areas with synchronized technical and social infrastructure in rural areas; projects for constructing urban areas or projects using mixed-use land where part of the project area is allocated for housing construction; projects for constructing mixed-use structures for residence and business.
How does the State support social housing?
According to Article 49 of the Law on Housing, those eligible for social housing support policies will receive State support through tax exemptions, preferential credit, and policies prioritizing low-income individuals. At the same time, the State encourages organizations, households, and individuals to participate in developing social housing for rental, lease-purchase, and sale according to market mechanisms.
What obligations do developers of commercial housing projects have?
According to Article 25 of the Law on Housing, developers of commercial housing projects have the following obligations: establishing, reviewing, approving, and implementing projects in accordance with regulations; depositing funds to implement the project; constructing housing and technical and social infrastructure in the project in accordance with detailed planning and the content of the investment decision by competent authorities; allocating land areas that have been invested in technical infrastructure in the project for social housing construction; publicly disclosing information about the project and reporting on the implementation progress and results of the project periodically and upon completion. Developers also have the obligation to hand over housing and related transaction documents to customers, fulfilling all commitments in the sales contract of the project.

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Law stipulates ownership, development, management, and use of housing; transactions concerning housing; state management of housing in Vietnam. For transactions involving the sale, lease, or lease-purchase of commercial housing by businesses and cooperatives engaged in real estate business, they shall be carried out in accordance with the provisions of the Law on Real Estate Business.
Article 2. Applicability
This Law applies to organizations, households, and individuals related to ownership, development, management, use, transactions concerning housing, and state management of housing in Vietnam.
Article 3. Explanation of Terms
In this Law, the following terms shall be understood as follows:
1. Housing is a construction project intended for residential purposes and to serve the daily living needs of households and individuals.
2. Single-family house is a house built on a separate residential land plot legally belonging to organizations, households, or individuals, including villa houses, attached houses, and detached houses.
3. Apartment building is a building with two floors or more, containing multiple units, having common access ways and staircases, comprising both private and common areas, and a shared infrastructure system serving households, individuals, and organizations, including residential buildings constructed solely for residential purposes and mixed-use residential-commercial buildings.
4. Commercial housing is housing developed for sale, lease, or lease-purchase through market mechanisms.
5. Official housing is housing provided for officials entitled to official housing under this Law to rent during their tenure of office or employment.
6. Housing for resettlement is housing allocated to households and individuals eligible for resettlement when the State expropriates residential land or demolishes housing according to the law.
7. Social housing is housing supported by the State for individuals eligible for housing support policies under this Law.
8. Housing development project is a comprehensive proposal related to the use of capital for constructing new housing, technical infrastructure, and social infrastructure to meet residential needs or to renovate and repair existing housing at a specific location.
9. Housing development refers to the investment in constructing new housing, reconstructing housing, or renovating housing to increase its area.
10. Renovation of housing involves upgrading the quality, expanding the area, or adjusting the area structure of existing housing.
11. Maintenance of housing includes regular maintenance and repairs to address damages in order to maintain the quality of housing.
12. Owner of housing refers to organizations, households, or individuals who legally own housing through forms such as investment in construction, purchase, lease-purchase, gift receipt, inheritance, capital contribution, exchange of housing, and other forms prescribed by this Law and relevant laws.
13. Owner of condominium refers to the owner of a condominium unit or other area within a condominium building.
14. Domestic organization includes state agencies, people's armed forces units, public service organizations, political organizations, political-social organizations, occupational-political-social organizations, social organizations, occupational-social organizations, economic organizations, and other organizations as prescribed by civil law (hereinafter referred to collectively as organizations).
15. Private portion in a condominium refers to the interior area of a condominium unit or other area within a condominium building recognized as privately owned by the condominium owner, and the individual equipment within the unit or other area of the condominium owner as prescribed by this Law.
16. Part on common ownership of apartment buildings is the remaining area of the apartment building outside the area belonging to the individual ownership of the apartment building owner and the common equipment for that apartment building as prescribed by this Law.
17. Purchase-rental housing is the act where the purchaser-renter pays in advance 20% of the value of the rental-purchase housing, except in cases where the purchaser-renter has the ability to pay more in advance, they may pay up to 50% of the value of the rental-purchase housing; the remaining amount is calculated as rent to be paid monthly to the lessor-purchaser within a specified period; after the rental-purchase term ends and when all remaining amounts have been paid, the purchaser-renter has the right to ownership of the housing.
18. Ready-made housing is housing that has completed investment construction and put into use.
19. Future-formed housing is housing currently under investment construction and not yet accepted for use.
Article 4. Right to accommodation and right to ownership of housing
Households and individuals have the right to accommodation through investment construction, purchase, lease, purchase-rental, receipt of gifts, inheritance, contribution, exchange, borrowing, residing with permission, managing housing according to authorization and other forms as prescribed by law. Organizations, households, and individuals having legal housing through the forms prescribed in Clause 2 of Article 8 of this Law have the right to ownership of such housing as prescribed by this Law.
Article 5. Protection of the right to ownership of housing
1. The State recognizes and protects the lawful ownership rights over housing of owners as prescribed by this Law.
2. Housing legally owned by organizations, households, and individuals shall not be nationalized. In cases of real necessity for national defense, security; economic and social development for national interest, public interest; or during war, emergency situations, disaster prevention and control, the State decides to compulsorily purchase, requisition, pre-purchase, or relocate housing legally owned by organizations, households, and individuals, then the State shall bear responsibility for compensation, support, and implementation of resettlement policies for housing owners according to the provisions of the law.
Article 6. Prohibited Acts
1. Violating the ownership rights of housing of the State, organizations, households, and individuals.
2. Obstructing the implementation of state management responsibilities regarding housing, the exercise of rights and obligations concerning ownership, use, and transactions of housing by organizations, households, and individuals.
3. Deciding on the investment policy of a project or approving an investment construction project for housing without following the approved urban planning, housing development program, or plan.
4. Constructing housing on land that is not residential land; constructing not in accordance with design standards and area standards for each type of housing as prescribed by the State. Applying incorrect methods of calculating usable area of housing as stipulated in the purchase-sale contract, purchase-rental contract for housing.
5. Illegally occupying housing area; encroaching on space and parts belonging to common ownership or other owners in any form; arbitrarily changing load-bearing structure or altering the design of private ownership parts in apartment buildings.
6. Using areas and equipment belonging to common ownership for personal use; using common areas or areas designated for services in mixed-use apartment buildings for purposes other than those decided in the project's investment policy and approved project content, except in cases where the competent authority permits a change in usage purpose.
7. Misusing funds raised or money paid in advance for housing purchase for housing development.
8. The developer of a housing construction project authorizing or assigning a partner in joint investment, joint venture, joint operation, capital contribution, or another organization or individual to enter into contracts for leasing, purchase-rental, sale, deposit contracts for housing transactions, or land use rights business in the project.
9. Conducting housing sales, transfer of purchase-sale contracts, leasing, purchase-rental, gift-giving, exchange, inheritance, mortgage, capital contribution, lending, residing with permission, or authorizing management of housing in violation of the provisions of this Law.
10. Renovating, expanding, demolishing rented, purchase-rented, borrowed, residing with permission, or authorized managed housing without the owner's consent.
11. Using condominium units for non-residential purposes; using commercial areas in condominiums according to approved projects for the purpose of selling flammable and explosive materials, operating services causing environmental pollution, noise, or other activities affecting the lives of households and individuals in condominiums as prescribed by the Government.
12. Using single-family housing for the purpose of selling flammable and explosive materials, operating services causing environmental pollution, noise, affecting social order, community life without complying with the provisions of the law on business conditions.
13. Reporting or providing inaccurate, untruthful information about housing, or failing to comply with regulations or requirements of the competent state agency; destroying or distorting information in the housing database managed by the competent state agency.
Chapter II
OWNERSHIP OF HOUSING
Article 7. Subjects eligible to own housing in Vietnam
1. Organizations, households, and individuals within the country.
2. Overseas Vietnamese.
3. Organizations and foreign individuals as specified in Clause 1, Article 159 of this Law.
Article 8. Conditions for recognition of ownership rights over housing
1. Organizations, households, and individuals within the country; for overseas Vietnamese, they must be permitted entry into Vietnam; for foreign organizations and individuals, they must meet the conditions stipulated in Article 160 of this Law.
2. Possessing legal housing through the following forms:
a) For organizations, households, and individuals within the country, through forms such as investment construction, purchase, lease-purchase, receipt of gifts, inheritance, contribution of capital, exchange of housing, and other forms prescribed by law;
b) For overseas Vietnamese, through forms such as purchase, lease-purchase of commercial housing from enterprises or cooperatives engaged in real estate business (hereinafter referred to collectively as real estate enterprises); purchase, receipt of gifts, exchange, inheritance of housing from households or individuals; transfer of land use rights in projects for the construction of commercial housing permitted to sell plots for self-construction of housing according to the provisions of law;
c) For foreign organizations and individuals, through the forms prescribed in Clause 2, Article 159 of this Law.
Article 9. Recognition of Ownership Rights over Housing
1. Organizations, households, and individuals who meet the conditions and possess legal housing as stipulated in Article 8 of this Law shall be granted a Certificate of Land Use Right, House Ownership, and Other Property Rights Attached to Land (hereinafter referred to collectively as the Certificate) by the competent state authority for that housing. The housing must already exist to be granted a Certificate.
2. The procedures for issuing Certificates to owners of housing shall be carried out in accordance with the laws on land.
In cases where housing ownership has a term as stipulated in Clause 1, Article 123 of this Law, the buyer of the housing shall be granted a Certificate during the period of housing ownership; when the term of housing ownership expires according to the agreement, the ownership right shall revert to the original owner; the issuance of Certificates to buyers of housing and the handling of Certificates upon expiration of the term of housing ownership shall be carried out in accordance with the regulations of the Government.
3. The competent authority issuing the Certificate must clearly record in the Certificate the type and level of housing as prescribed by this Law and the laws on construction; if it is a condominium unit, the floor area and usable area of the unit must also be recorded; if the housing was constructed under a project, the name of the approved housing construction project must be accurately recorded.
4. For housing constructed under a project for lease-purchase or sale, the developer shall not be issued a Certificate but the Certificate shall be issued to the lessee-purchaser or purchaser of the housing, except in cases where the developer requests a Certificate for housing that has not yet been leased or sold; if the developer constructs housing for lease, a Certificate shall be issued for that housing.
5. Where household or individual housing has two floors or more and each floor has two units or more, and meets the conditions stipulated in Clause 2, Article 46 of this Law, the competent state authority shall issue a Certificate for each unit in that housing.
Article 10. Rights of owners of residential houses and users of residential houses
1. For owners of residential houses who are organizations, households, individuals within the country, and overseas Vietnamese, they have the following rights:
a) The right to inviolability of their legally owned residential houses;
b) To use residential houses for living purposes and other purposes not prohibited by law;
c) To be issued a Certificate of Ownership for their legally owned residential houses according to this Law and the law on land;
d) To sell, transfer contracts of sale, lease, lease-purchase, gift, exchange, inheritance, mortgage, contribute capital, lend, allow residence, authorize management of residential houses; in cases where gifts or inheritances are given to subjects not eligible to own residential houses in Vietnam, these subjects shall only enjoy the value of the residential houses;
đ) To jointly use public utility facilities in the residential area according to this Law and related laws;
In case of being the owner of a condominium, they have the right to jointly own and use the common parts of the condominium and shared infrastructure facilities in the condominium area, except for facilities built for business purposes or must be handed over to the State according to the law or agreed upon in the purchase contract or lease-purchase contract;
e) To maintain, renovate, demolish, and rebuild residential houses according to this Law and construction laws;
g) To be compensated according to the law when the State demolishes, purchases, or requisitions residential houses, or to be paid at market price when the State purchases their legally owned residential houses for national defense, security purposes; economic and social development for national interests, public benefits, or during war, emergency situations, disaster prevention and control;
h) To lodge complaints, file charges, and initiate lawsuits against acts that violate their legitimate ownership rights and other acts that violate laws on residential houses;
2. In cases where the ownership of residential houses has a term as stipulated in Clause 1, Article 123 of this Law, during the ownership period, the owner may exercise the rights prescribed in Clause 1 of this Article, except where the parties have agreed otherwise; when the ownership term ends according to the agreement, the current owner managing and using the house must hand it back to the initial owner;
3. For foreign organizations and individuals who are owners of residential houses, they have the rights as prescribed in Article 161 of this Law;
4. Users of residential houses who are not owners may exercise rights in managing and using residential houses according to agreements with the owners;
Article 11. Obligations of owners of residential houses and users of residential houses
1. For owners of residential houses who are organizations, households, individuals within the country, and overseas Vietnamese, they have the following obligations:
a) To use residential houses for the intended purpose; establish and keep records of files on their residential houses;
b) To implement fire prevention, firefighting, hygiene, environmental protection, and social order and safety according to the law;
c) To fully comply with legal provisions when selling, transferring contracts of sale, lease, lease-purchase, gift, exchange, inheritance, mortgage, contribution of capital, lending, allowing residence, authorizing management of residential houses; for real estate transactions that are joint property of spouses, they must also comply with the provisions of the Marriage and Family Law;
d) To strictly comply with the law and not affect or cause damage to the interests of the State, public interests, or the legitimate rights and interests of other organizations, households, and individuals when maintaining, renovating, demolishing, or rebuilding residential houses; in cases where the ownership of residential houses has a term as stipulated in Clause 1, Article 123 of this Law, renovation and demolition of residential houses must be carried out according to the agreement between the parties;
đ) To pay insurance premiums for residential houses that are required to participate in compulsory fire and explosion insurance according to the law on fire prevention and firefighting and the law on insurance business;
e) To comply with decisions of competent state agencies regarding the handling of violations, resolution of disputes, complaints, and accusations concerning residential houses, compensation, support, resettlement, demolition of residential houses when the State recovers land, clears residential houses, purchases, requisitions, or pre-purchases residential houses;
g) To ensure that relevant parties and authorized persons can carry out inspections, monitoring, maintenance of equipment systems, technical infrastructure systems, and common areas;
h) To fulfill financial obligations to the State when recognized as the owner of residential houses, when conducting transactions, and during the use of residential houses according to the law;
2. For foreign organizations and individuals who are owners of residential houses, in addition to the obligations prescribed in Clause 1 of this Article, they must also fulfill the obligations prescribed in Clause 2 of Article 162 of this Law;
3. Users of residential houses who are not owners must fulfill obligations in managing and using residential houses according to agreements with the owners and the provisions of this Law.
Article 12. Time of Transfer of Ownership of Housing
1. In cases of housing sale that do not fall under the provisions of Clause 3 of this Article and in cases of housing lease-purchase, the time of transfer of ownership of housing shall be from the moment when the buyer or the lease-purchaser has paid the full purchase price or lease-purchase price and has received the handover of the housing, except where the parties have agreed otherwise.
2. In cases of housing contribution, gift, or exchange, the time of transfer of ownership shall be from the moment when the recipient of the contribution, the recipient of the gift, or the recipient of the exchange receives the handover of the housing from the contributor, the donor, or the exchanger.
3. In cases of housing sale between the project developer and the purchaser, the time of transfer of ownership of housing shall be from the moment when the purchaser receives the handover of the housing or from the moment when the purchaser pays the full purchase price to the developer. For commercial housing purchased from real estate businesses, the time of transfer of ownership shall be carried out in accordance with the provisions of the law on real estate business.
4. In cases of inheritance of housing, the time of transfer of ownership of housing shall be carried out in accordance with the provisions of the law on inheritance.
5. The transactions regarding housing specified in Clauses 1, 2, and 3 of this Article must comply with the conditions for housing transactions and the contracts must be effective according to the provisions of this Law.
Chapter III
DEVELOPMENT OF HOUSING
Section 1
GENERAL PROVISIONS ON HOUSING DEVELOPMENT
Article 13. Policy on Housing Development
1. The State has the responsibility to create a housing land fund through approving planning, land use plans, urban planning, special function area planning, rural construction planning.
2. The State promulgates mechanisms and policies on planning, land, finance, credit, scientific research and application of new technologies and building materials to invest in renovating and rebuilding severely damaged apartment buildings that pose a risk of collapse and are unsafe for users, and encourages organizations, households, and individuals to participate in housing development for rental, lease-purchase, and sale according to market mechanisms.
3. The State promulgates mechanisms and policies of tax exemption and reduction, land use fee exemption and reduction, long-term credit with preferential interest rates, other financial incentives, and support from state capital to implement social housing support policies.
4. The State has policies for the research and promulgation of model designs and typical designs for each type of housing suitable for each region, each area, and each ethnic group; encouraging the development of energy-saving housing.
5. Provincial People's Committees (hereinafter referred to collectively as provincial level) and developers of commercial housing projects must allocate land areas for the construction of social housing in accordance with the laws on housing.
Article 14. Requirements for Housing Development
1. To meet the housing needs of different groups and the economic and social conditions of the country, each locality, each region, and each period.
2. To be consistent with the National Housing Development Strategy, construction planning, land use planning, and included in the local housing development program at each stage.
3. To comply with the provisions of the law on housing; construction standards and quality; properly implement fire prevention and explosion protection requirements; ensure architectural design, landscape, hygiene, environment, safety during construction, and the ability to respond to natural disasters and climate change; efficient use of energy and land resources.
4. In urban areas, housing development must be consistent with detailed construction planning and mainly implemented through projects. Housing construction investment projects must meet the requirements stipulated in Clauses 1, 2, and 3 of this Article, ensuring population distribution and urban beautification. For special class, Class 1, and Class 2 cities, housing development should mainly focus on apartment buildings and construction for rental purposes.
5. In rural, mountainous, border, and island areas, housing development must be consistent with rural settlement planning, the new rural construction program, customs and traditions of each ethnic group, and the natural conditions of each region; gradually eliminate shifting cultivation and nomadic lifestyles, ensuring sustainable rural development; encourage housing development through projects and multi-story housing.
Article 15. Housing Development Programs and Plans of Localities
1. Based on the National Housing Development Strategy, the overall socio-economic development plan, land use planning, urban planning, special function area planning, rural construction planning of the locality which have been approved, the Provincial People's Committee shall develop the housing development program of the locality including both urban and rural areas for each five-year and ten-year period or longer to be submitted to the same-level People's Council for approval before being approved according to Article 169 of this Law.
2. Based on the housing development program of the locality that has been approved according to Clause 1 of this Article, the Provincial People's Committee must organize the establishment and approval of annual and five-year housing development plans within its jurisdiction, including commercial housing development plans, social housing development plans, public service housing development plans, housing for resettlement purposes, housing for households and individuals, among which the social housing development plan for rental purposes must be clearly defined.
Article 16. Determination of Land Fund for Housing Development
1. When establishing and approving urban planning, rural construction planning, economic zone planning, industrial park planning, export processing zone planning, high-tech park planning (hereinafter collectively referred to as industrial zones); planning for the construction of higher education institutions, vocational training schools, except scientific research institutes and public boarding schools (hereinafter collectively referred to as educational and training zones), the competent authority approving the planning must clearly define the area of land for housing construction in the planning.
2. In special class cities, class 1, class 2, and class 3 cities, the project investor of commercial housing construction projects must reserve a portion of the residential land area in the project where they have invested in building technical infrastructure for the construction of social housing as prescribed by the Government. For other types of cities, the Provincial People's Committee shall base on the specific conditions of the locality to require the project investors to reserve a portion of the residential land area in the project where they have invested in building technical infrastructure for the construction of social housing.
Article 17. Forms of Housing Development and Housing Construction Investment Projects
1. Forms of housing development include:
a) Housing development through projects;
b) Housing development by households and individuals.
2. Housing construction investment projects as stipulated in this Law include:
a) New construction or renovation of an independent housing facility or a cluster of housing facilities;
b) Housing construction investment projects with synchronized technical and social infrastructure systems in rural areas;
c) Urban development projects or mixed-use land utilization projects that allocate land areas within the projects for housing construction;
d) Construction projects with mixed usage purposes for living and business.
Article 18. Cases of Housing Development and Housing Construction Projects
1. Cases of housing development include:
a) Commercial housing development;
b) Social housing development;
c) Public service housing development;
d) Housing development for resettlement purposes;
e) Housing development by households and individuals.
2. Cases of housing development through projects include:
a) Housing development for rental, lease-purchase, and sale by real estate businesses;
b) Renovation and reconstruction of apartment buildings and old housing areas;
c) Housing development for resettlement purposes;
d) State-owned housing development.
Article 19. Requirements for Housing Construction Investment Projects
1. Housing construction investment projects specified in Clause 2, Article 17 of this Law must be implemented in accordance with the provisions of this Law.
2. A housing construction investment project may only be established, approved, and implemented in areas that have detailed planning schemes which have been approved, comply with the contents of the investment decision made by competent state agencies, and meet the requirements stipulated in Article 14 of this Law.
3. Housing construction investment projects and areas within such projects must be named in Vietnamese; if the investor of a commercial housing construction project wishes to name the project in a foreign language, they must first write the full name in Vietnamese, followed by the foreign language name. The project name and names of areas within the project must be decided by the competent authority, and used throughout the entire process of investment construction and management and use after completion of the investment construction.
4. The investor of a housing construction project must fully implement all contents of the project that have been approved; in cases where the investor requests adjustments to the contents including the project name, implementation schedule, type of housing to be constructed, total floor area, total number of houses, ratio of types of houses, and total investment amount, if it is a project funded by state capital, such adjustments must be decided by the competent authority as prescribed in Article 170 of this Law before commencing construction.
5. The People's Committee of the province shall be responsible for specifically determining the list of housing construction investment projects on its territory, including commercial housing projects, social housing projects, public service housing projects, and housing projects for resettlement purposes, and publicly disclose this information on the provincial People's Committee’s electronic portal according to the following provisions:
a) The number of projects; the total number of houses and total floor area of houses invested in annually within housing construction investment projects on the territory;
b) Basic contents of each housing construction investment project on the territory, including the project name, location of investment construction, scale of the project, detailed planning of the project, implementation schedule, investment objectives, number of houses, total floor area of houses, form of real estate business, and other related contents as prescribed by laws on real estate business;
c) Public disclosure of information about projects as prescribed in points a and b of this clause must be carried out throughout the entire implementation process of the projects.
Article 20. Architectural Principles for Housing
1. The architecture of housing must be compatible with natural conditions, capable of preventing natural disasters, consistent with scientific and technological levels, historical traditions, culture, and in line with the detailed construction planning scheme that has been approved by competent state agencies.
2. In urban areas, architectural design of housing must harmonize renovation with new construction, integrate individual housing structures with the overall urban architectural framework, and comply with urban design and urban architectural planning management regulations.
3. In rural areas, architectural design of housing must harmonize with natural scenery, fit local customs and practices, suit household and individual production and business conditions, and align with ethnic characteristics in each region and locality.
Section 2
DEVELOPMENT OF COMMERCIAL HOUSING THROUGH PROJECTS
Article 21. Conditions for being the project investor in commercial housing construction projects
1. Enterprises and cooperatives established and operating in accordance with Vietnamese laws.
2. Having statutory capital as prescribed by real estate business laws and having a performance bond for each project as prescribed by investment laws.
3. Having the function of conducting real estate business as prescribed by laws.
Article 22. Investment projects for commercial housing construction and selection of project investors
1. Investment projects for commercial housing construction must be established, reviewed, approved, and implemented in accordance with this Law and construction laws.
2. The selection of project investors for commercial housing construction shall be carried out through the following forms:
a) Auctioning land use rights in accordance with land laws;
b) Tendering projects involving land use;
c) Appointing investors as project investors when they meet the conditions stipulated in Article 21 of this Law and have lawful land use rights as stipulated in Clause 1 and Clause 4 of Article 23 of this Law.
3. The selection of project investors for commercial housing construction shall be reported to the provincial People's Committee for decision by the provincial housing management agency; in cases where the project has a large scale or involves multiple provinces or centrally-administered cities as prescribed by the Government, it must be reported to the competent authority for decision in accordance with Clause 2 of Article 170 of this Law before selecting the project investor.
Article 23. Forms of land use for implementing investment projects for commercial housing construction
1. Using the area of residential land under lawful land use rights to construct commercial housing.
2. Being granted land by the State to build rental housing, lease-purchase housing, or housing for sale.
3. Leasing land from the State to build rental housing.
4. Receiving the transfer of residential land use rights in accordance with land laws to construct commercial housing.
Article 24. Types of houses and standards for the area of commercial housing
1. Types of houses and area standards for each type of commercial housing are decided by the project investor but must comply with detailed construction planning, construction standards and norms, architectural design, and the content of the investment project approval decision by the competent state agency.
2. For apartment units, they must be designed and constructed as self-contained apartments with floor areas meeting construction standards and norms.
3. For individual houses, they must be constructed according to detailed construction planning and designs that have been approved in accordance with construction standards and norms.
Article 25. Rights of project investors in commercial housing construction projects
1. Request relevant agencies and organizations to carry out procedures in accordance with the law during the establishment, review, approval, and implementation of the project.
2. Lease, lease-purchase, sell housing; implement capital mobilization, collect rent, lease-purchase payments, and sale proceeds for housing in accordance with this Law, real estate business laws, and the terms of signed contracts.
3. Exercise land user rights and conduct business within the project in accordance with land laws and real estate business laws.
4. Transfer part or all of the project in accordance with real estate business laws.
5. Manage and operate the technical infrastructure system within the project scope in accordance with the project investment policy decision by the competent state agency.
6. Request the competent state agency to issue Certificates of Conformity for housing built in the project in accordance with Article 9 of this Law and land laws.
7. Enjoy preferential policies of the State during the implementation of the project in accordance with the law.
8. Exercise other rights as prescribed by this Law and related laws.
Article 26. Responsibilities of the Investor in Commercial Housing Construction Projects
1. Establishing, reviewing, approving, and implementing projects in accordance with the provisions of this Law and laws on construction.
2. Depositing a guarantee fund to implement the project in accordance with the laws on investment; paying transaction housing deposit as prescribed by the laws on real estate business; ensuring financial capacity to implement the project in accordance with the laws.
3. Constructing houses and technical infrastructure, social infrastructure within the project in accordance with detailed planning, contents of the decision on the project's investment orientation issued by competent state agencies, complying with house design, area standards, and the approved project schedule.
4. Allocating land areas that have been invested in technical infrastructure within the project for constructing social housing in accordance with the laws on housing.
5. Publicizing information stipulated in point b, Clause 5, Article 19 of this Law on their project management board’s website and at their office; reporting on the implementation progress and results of the project periodically and upon completion in accordance with the laws on housing and laws on real estate business.
6. Fully fulfilling all commitments in the business product contracts of the project, delivering houses and related transaction documents to customers; conducting transactions such as buying, renting, leasing, selling houses and operating land use rights in accordance with the laws on real estate business.
7. Within fifty days from the date of handing over the house to the buyer or from the time when the buyer has fully paid according to the agreement, must complete procedures to request the competent state agency to issue the Certificate of Ownership to the buyer or lessee, except in cases where the buyer or lessee voluntarily requests issuance of the Certificate of Ownership. In case of building houses for rental purposes, there is a responsibility to establish and retain housing files in accordance with Articles 76 and 77 of this Law.
8. Providing warranty for houses in accordance with this Law and laws on construction; performing financial obligations to the State as prescribed by the laws.
9. Adhering to decisions that have taken legal effect by competent authorities regarding handling violations of laws in the development of housing, capital mobilization, advance payments from customers, housing transactions, and other activities stipulated in this Article.
10. Compensating in cases causing damage to customers or organizations, individuals, or households participating in housing construction.
Section 3
DEVELOPMENT OF PUBLIC HOUSING
Article 27. Public Housing and Plan for Developing Public Housing
1. The State invests capital from the budget, including central and local budgets, to construct public housing or purchase, lease commercial housing for public housing. Public housing includes central public housing and local public housing.
2. Investment in constructing public housing or purchasing, leasing commercial housing for public housing must be based on the plan for developing public housing as prescribed in Clause 3 of this Article, ensuring safety conditions in work and convenience in living and traveling for public housing users.
3. The plan for developing public housing shall be established and approved as follows:
a) Central agencies are responsible for determining the demand for public housing of their own agencies and submitting it to the Ministry of Construction for review and establishment of the plan for developing central public housing to be submitted to the Prime Minister for approval, except in cases prescribed in point b of this clause;
b) The Ministry of National Defense and the Ministry of Public Security are responsible for determining the demand and establishing the plan for developing public housing for the subjects prescribed in point d, Clause 1, Article 32 of this Law and submit it to the Prime Minister for approval after obtaining the consensus opinion of the Ministry of Construction;
c) Provincial People's Committees establish and approve the plan for developing public housing within the local housing development plan as prescribed in Article 15 of this Law;
d) Agencies responsible for planning as prescribed in points a, b, and c of this clause must clearly determine the demand for public housing including types of housing, quantity, floor area of housing; location for construction and land area for construction or area of commercial housing to be purchased or leased for public housing; sources of capital and annual and five-year investment phases; determining the responsibilities of relevant agencies.
4. The Government shall provide detailed regulations on investment in constructing, purchasing, or leasing commercial housing for public housing, on the objects eligible for public housing rental, and on the management and use of public housing.
Article 28. Housing Construction Projects for Official Residence and Selection of Project Investors
1. Housing construction projects for official residence include new construction investment and purchase of commercial housing, which are established, reviewed, approved, and implemented in accordance with this Law and laws on construction.
2. Housing construction projects for official residence include the following types:
a) Projects decided to be invested in by the Prime Minister upon the proposal of the Ministry of Construction to lease to the objects of central agencies, except in cases provided for in point b of this clause;
b) Projects decided to be invested in by the Ministry of National Defense and the Ministry of Public Security after obtaining the agreement of the Ministry of Construction and being approved by the Prime Minister to lease to the objects specified in point d of Clause 1, Article 32 of this Law;
c) Projects decided to be invested in by the People's Committee of the province upon the proposal of the provincial housing management agency to lease to the objects transferred or rotated to work in the locality.
For the objects transferred or rotated to work in districts, counties, towns under provinces, and equivalent areas (hereinafter referred to collectively as district level), the objects specified in points c, d, e, and g of Clause 1, Article 32 of this Law, the provincial People's Committee decides to invest in the project or delegates the decision to the district-level People's Committee.
3. The selection of investors for housing construction projects for official residence shall be regulated as follows:
a) The Prime Minister decides the selection of investors for projects specified in point a of Clause 2 of this Article upon the proposal of the Ministry of Construction;
b) The Ministers of National Defense and Public Security decide the selection of investors for projects specified in point b of Clause 2 of this Article;
c) The provincial People's Committee decides the selection of investors for projects specified in point c of Clause 2 of this Article upon the proposal of the provincial housing management agency.
Article 29. Land for Building Official Residences
1. The area of land for building official residences is specifically determined in the planning for construction approved by the competent state authority as stipulated in Clause 1, Article 16 of this Law.
2. For official residences of central agencies, the Ministry of Construction takes the lead and coordinates with the provincial People's Committee to determine the area of land for building official residences within their jurisdiction, except in cases provided for in Clause 3 of this Article. The provincial People's Committee is responsible for allocating the area of land for building official residences according to the requirements of the Ministry of Construction.
3. For official residences for the objects specified in point d of Clause 1, Article 32 of this Law, the Ministry of National Defense and the Ministry of Public Security take the lead and coordinate with the provincial People's Committee to determine the area of land for building official residences.
4. For local official residences, the provincial People's Committee is responsible for allocating the area of land for building official residences when establishing and approving the planning as stipulated in Clause 1, Article 16 of this Law.
5. The State does not collect land use fees for the area of land used to build official residences as prescribed in this Article.
Article 30. Purchase or Lease of Commercial Housing for Official Residences
1. In localities where commercial housing is constructed according to projects that comply with the type and standard area prescribed in Article 31 of this Law, the competent authority specified in Clause 2, Article 28 of this Law may decide to purchase or lease such housing for official residences.
2. Purchasing commercial housing for official residences must be established as a project and approved by the competent authority specified in Clause 2, Article 28 of this Law.
3. The price of purchasing commercial housing for official residences is decided by the investor based on market prices and the results of valuation conducted by a qualified valuation unit at the time of purchase.
4. If there is insufficient official housing for leasing, the competent authority specified in Clause 2, Article 28 of this Law decides to lease commercial housing for official residences.
5. The central budget provides funds to purchase or lease commercial housing for official residences for the objects of central agencies, including those of the Ministry of National Defense and the Ministry of Public Security. The local budget provides funds to purchase or lease commercial housing for official residences for the objects of local agencies.
Article 31. Types of Housing and Standards for Public Service Housing Area
1. Public service housing includes single-family houses and apartment units with different area standards suitable for each type of individual eligible to rent public service housing.
2. The standards for the area of public service housing shall be prescribed by the Prime Minister and adjusted appropriately for each period based on the proposal of the Ministry of Construction.
Article 32. Eligible Individuals and Conditions for Renting Public Service Housing
1. Individuals eligible to rent public service housing include:
a) Party and State leaders who are required to reside in public service housing during their tenure;
b) Cadres and civil servants from Party and State agencies, political-social organizations not covered under point a of this clause, who are transferred or rotated to work at central agencies holding positions at the Deputy Minister level or higher; or transferred or rotated to work at localities holding positions at the Chairman of the People's Committee of district level, Director of Departments and equivalent levels or higher;
c) Cadres and civil servants from Party and State agencies, political-social organizations not covered under point b of this clause, who are transferred or rotated to work at remote rural areas, ethnic minority regions, regions with extremely difficult socio-economic conditions, border areas, and islands;
d) Officers and professional military personnel from the People's Armed Forces who are transferred or rotated according to national defense and security requirements, except those individuals required by law to reside in military camps;
đ) Teachers working in rural areas, remote rural areas, ethnic minority regions, regions with extremely difficult socio-economic conditions, border areas, and islands;
e) Doctors and healthcare staff working in rural areas, remote rural areas, ethnic minority regions, regions with extremely difficult socio-economic conditions, border areas, and islands;
g) Scientists assigned to lead important national science and technology tasks as stipulated by the Law on Science and Technology.
2. The conditions for renting public service housing are as follows:
a) For individuals specified in point a of Clause 1 of this Article, they shall be allocated public service housing according to security requirements;
b) For individuals specified in points b, c, d, đ, e, and g of Clause 1 of this Article, they must not own housing or have not purchased, rented, or rented-purchased social housing in the locality where they are transferred to work, or although they own housing in the locality where they are transferred to work, the average housing area per person in their household is lower than the minimum housing area standard prescribed by the Government for each period and different regions.
Article 33. Principles for Determining Rental Prices for Public Service Housing
1. Accurately calculate all necessary costs for managing, operating, maintaining, and leasing public service housing during its use.
2. Do not charge land use fees for constructing public service housing and do not include depreciation costs of investment capital for constructing public service housing or costs of purchasing commercial housing for public service housing.
3. The rental price for public service housing shall be decided by the competent authority as prescribed in Clause 2 of Article 81 of this Law and reviewed and adjusted appropriately for each period.
4. In cases where commercial housing is rented for public service housing purposes, the tenant of public service housing shall pay a rental fee lower than the rental price of commercial housing as prescribed by the Government.
Article 34. Rights and Obligations of Public Service Housing Tenants
1. Public service housing tenants have the following rights:
a) To take over the housing and accompanying equipment according to the agreement in the public service housing lease contract;
b) To use the housing for themselves and family members during their tenure of office or employment;
c) To request the management unit to promptly repair any damage not caused by their fault;
d) To continue signing the public service housing lease contract if they still fall within the eligible category and meet the conditions for leasing public service housing as stipulated in this Law upon expiration of the lease term;
đ) To exercise other housing rights as prescribed by law and as agreed in the public service housing lease contract.
2. Public service housing tenants have the following obligations:
a) To use the housing for residential purposes and to serve personal and family living needs during the lease period;
b) To maintain the housing and accompanying assets; not to arbitrarily renovate, repair, or demolish public service housing; in the case of using apartment units in condominiums, they must also comply with regulations on managing and using communal housing;
c) Not to sublet, lend, or authorize management of public service housing;
d) To pay rent according to the public service housing lease contract signed with the lessor and to settle other service fees as prescribed by the service provider;
đ) To return public service housing to the State when they no longer qualify for housing rental or when they no longer need public service housing or when they commit acts that result in the recovery of housing under this Law within ninety days from the date of receiving notification from the public service housing management agency;
e) To comply with the decision on forced recovery of housing issued by the competent authority in cases of forced recovery of housing;
g) Other housing obligations as prescribed by law and as agreed in the public service housing lease contract.
Section 4
DEVELOPMENT OF HOUSING FOR RELOCATION PURPOSES
Article 35. Principles for Developing Housing for Relocation Purposes
1. In cases where land is reclaimed and houses are demolished for constructing other projects in the central urban areas of special-class cities, class 1 cities, and class 2 cities, the State prepares a housing fund through the use of commercial housing or social housing built under projects to arrange relocation before reclaiming land and demolishing houses, except as provided for in Clause 4 of Article 36 of this Law.
2. In cases where land is reclaimed and houses are demolished for constructing other projects outside the scope specified in Clause 1 of this Article but there is commercial housing or social housing built under projects, the State uses such housing for relocation arrangements; if there is no commercial housing or social housing, the State shall invest in building housing for relocation purposes before reclaiming land and demolishing houses, except as provided for in Clause 4 of Article 36 of this Law.
3. In cases where land is reclaimed and houses are demolished for implementing projects to construct commercial housing and the person whose house is being demolished requests relocation in place, the project investor must prioritize arranging commercial housing within the project to serve relocation purposes.
4. In cases where land is reclaimed and houses are demolished for implementing infrastructure projects for industrial zones and the person whose house is being demolished requests relocation, the project investor must build housing to arrange relocation within the planned area for housing workers in the industrial zone or arrange housing elsewhere for those being relocated.
5. If it is necessary to invest in building housing for relocation purposes, it must be carried out according to a project; in rural areas, the investment project for building housing for relocation purposes must include the allocation of land for production purposes for people who are being relocated.
6. Housing for relocation purposes must have complete technical infrastructure and social infrastructure systems according to detailed construction planning and approved design documents and comply with the provisions of Article 14 of this Law.
Article 36. Forms of Housing Arrangement for Resettlement
1. Purchase commercial housing constructed under a project to lease, lease-purchase, or sell to persons subject to resettlement.
2. Utilize social housing constructed under a project to lease, lease-purchase, or sell to persons subject to resettlement.
3. The State directly invests in constructing housing using state budget capital, national bonds, bonds, official development assistance funds, preferential loans from sponsors, state investment credit funds, or constructs housing through a build-transfer contract on land areas determined for constructing housing to serve resettlement according to approved planning to lease, lease-purchase, or sell to persons subject to resettlement.
4. Households and individuals are paid money to independently choose to purchase, lease, or lease-purchase commercial housing within the area designated for resettlement housing or are granted land by the State to construct housing according to approved planning.
Article 37. Land for Constructing Housing to Serve Resettlement
1. The allocation of land area for constructing housing to serve resettlement must comply with the principles stipulated in Article 35 of this Law and the laws on land.
2. The land area for constructing housing to serve resettlement is specifically defined in the construction planning approved by the competent state authority as provided in Clause 1, Article 16 of this Law.
Article 38. Investment Projects for Constructing Housing to Serve Resettlement and Selection of Project Investors
1. Investment projects for constructing housing to serve resettlement are established, reviewed, approved, and implemented in accordance with this Law and the laws on construction.
2. Investors in projects constructing housing to serve resettlement include specialized project management boards under provincial People's Committees, provincial land development organizations, and real estate businesses; the selection of project investors is carried out in accordance with the provisions of Clauses 3 and 4 of this Article.
3. For projects constructing housing to serve resettlement that utilize capital sources or implement forms prescribed in Clause 3 of Article 36 of this Law, the provincial housing management agency reports to the investment decision-maker to decide on selecting the investor.
4. For projects constructing housing to serve resettlement not falling under the scope prescribed in Clause 3 of Article 36 of this Law, the authority to select investors is regulated as follows:
a) In cases where housing is constructed to serve resettlement for national key projects, the Prime Minister decides on the selection or delegates the Minister of Construction to decide on the selection of investors.
b) In cases where housing is constructed to serve resettlement for projects not falling under the scope prescribed in point a of this clause, the provincial People's Committee decides on the selection of investors.
Article 39. Types of Housing and Standards for Housing Area to Serve Resettlement
1. In urban areas, housing to serve resettlement must meet the following standards:
a) It must be an apartment unit or individual house built in accordance with detailed construction planning and local housing development programs already approved.
b) If it is an apartment unit, it must be designed and constructed in a closed style, meeting construction standards and regulations. When designing housing to serve resettlement, the investor may allocate part of the area for organizing business activities suitable to the actual conditions of each project.
c) If it is an individual house, it must be built according to detailed construction planning and approved design; comply with architectural principles stipulated in Article 20 of this Law and ensure the minimum residential land area limit as prescribed by the laws on land.
2. In rural areas, housing to serve resettlement must be designed and constructed to include living space and auxiliary facilities serving daily life and production connected to the house, comply with architectural principles stipulated in Article 20 of this Law, and ensure the minimum residential land area limit as prescribed by the laws on land.
Article 40. Management of Housing Quality for Resettlement Purposes
1. Housing and construction works within a project shall only be accepted if they meet design requirements and construction standards and regulations. The project investor shall not change the housing area design and auxiliary facilities (if any) to serve resettlement after the competent authority has approved the resettlement plan.
2. Allocation of housing for persons subject to resettlement shall only be carried out after the housing has been accepted in accordance with the laws on construction.
3. The following organizations and individuals shall be responsible for the quality of housing to serve resettlement purposes:
a) Project investors constructing housing to serve resettlement purposes;
b) State agencies authorized to enter into build-transfer contracts to construct housing for resettlement purposes;
c) Project investors constructing commercial housing and social housing to be used for resettlement purposes.
4. Provincial housing management agencies shall be responsible for guiding and inspecting the management of housing quality to serve resettlement purposes within their jurisdiction.
Article 41. Purchase of Commercial Housing and Use of Social Housing for Resettlement Purposes
1. In the case of purchasing commercial housing for resettlement purposes, the unit assigned to arrange resettlement shall sign a sales contract or an order contract to purchase commercial housing with the project investor to allocate to persons subject to resettlement as follows:
a) In the event that the unit assigned to arrange resettlement signs a sales contract for housing with the investor, the person subject to resettlement shall sign a sales, lease, or lease-purchase contract for housing with this unit;
b) In the event that the unit assigned to arrange resettlement signs an order contract to purchase housing from the investor, the person subject to resettlement shall directly sign a sales contract for housing with the investor based on the contents agreed upon in the order contract to purchase housing;
c) The project investor constructing commercial housing shall be responsible for processing procedures to request the competent state agency to issue a Certificate of Ownership for the buyer or lease-purchaser of housing as stipulated in points a and b of this clause, except in cases where the buyer or lease-purchaser of housing voluntarily processes the issuance of the Certificate of Ownership.
2. In the case of using social housing for resettlement purposes, persons eligible for resettlement shall implement leasing, lease-purchasing, or purchasing of social housing in accordance with the provisions of this Law.
3. The Government shall provide detailed regulations on investment in construction, purchasing of commercial housing, or using social housing to serve as housing for resettlement purposes, including types of housing and housing area standards, eligibility criteria and conditions for allocation of housing, procedures and formalities for handing over housing, and management and use of housing for resettlement purposes.
Section 5: DEVELOPMENT OF HOUSING BY HOUSEHOLDS AND INDIVIDUALS IN RURAL AREAS
Article 42. Requirements for Development of Housing by Households and Individuals in Rural Areas
1. It must comply with the rural residential area development planning, connect with the technical infrastructure system of the residential area, and ensure hygiene and environmental requirements.
2. Construction or renovation of existing housing must combine with the preservation and conservation of traditional architectural styles and be consistent with customs, traditions, and production conditions of each region and locality.
3. Households and individuals may only construct housing on legally allocated land plots.
4. In the case of construction within a project, it must comply with the detailed construction planning of the project that has been approved. For areas requiring a Construction Permit and design documents, they must strictly adhere to the contents of the approved Construction Permit and design documents.
5. The provincial People's Committee shall consider and support part or all of the funding from the budget for households and individuals to preserve, maintain, and renovate housing in areas requiring preservation of artistic, cultural, and historical values.
Article 43. Requirements for the development of residential houses by households and individuals in urban areas
1. Must have legitimate land use rights for residential purposes, have existing houses, and be able to renovate or rebuild according to the laws on construction.
2. The construction or renovation of existing houses must comply with detailed construction planning and urban design. For houses that require a Construction Permit, they must be built in accordance with such permit.
3. The construction of houses must ensure connection with the common technical infrastructure system of the area, meet sanitation, environmental, architectural requirements, and not affect adjacent structures.
Article 44. Land for the development of residential houses by households and individuals
1. Legitimate residential land of households and individuals or land leased or borrowed from other organizations, households, or individuals for building houses.
2. Residential land allocated by the State for building houses according to the laws on land.
3. Residential land compensated by the State when land is reclaimed according to the laws on land.
Article 45. Methods for developing residential houses by households and individuals
1. Households and individuals in rural areas shall implement house construction through the following methods:
a) Organizing their own construction or hiring organizations or individuals to construct or receiving support from other organizations or individuals to build houses;
b) Cooperating to help each other build houses.
2. Households and individuals in urban areas shall implement house construction through the following methods:
a) Organizing their own construction or hiring organizations or individuals to construct or receiving support from other organizations or individuals to build houses;
b) Hiring units or individuals with capacity in construction activities to build houses where the laws on construction require such capacity;
c) Cooperating in urban renewal and beautification including houses.
Article 46. Standards and quality of residential houses by households and individuals
1. Houses must be constructed on residential plots meeting the conditions regarding area for house construction according to the laws on land.
2. Households and individuals in urban areas must carry out house construction and renovation according to the laws on construction and bear responsibility for the quality of houses.
In cases where permission is granted to build houses with two floors or more, each floor designed and built with two or more closed apartments, each apartment meeting the minimum floor area standards according to construction regulations and having separate ownership areas and common areas of the apartment building as stipulated by this Law, then the State will recognize ownership rights for each apartment in the house.
3. Single-family houses have a service life determined based on the construction project level and the actual condition of the house.
When houses suffer severe damage, pose a risk of collapse, and fail to ensure safety for users, demolition shall be carried out according to the provisions of Section 4, Chapter VI of this Law.
Article 47. Responsibilities of households and individuals in developing residential houses
1. Must comply strictly with procedures and formalities for house renovation and construction according to the laws on construction.
2. Must implement regulations on maintaining hygiene and environment during the process of house renovation and construction.
3. Must ensure safety for people and property of adjacent households during the construction and renovation of houses; if causing damage, compensation must be provided according to the laws.
4. If households and individuals invest in constructing houses for rental, lease-purchase, or sale, they must also comply with the provisions of Chapter VIII of this Law.
5. Fulfill other responsibilities when renovating or constructing houses according to the laws.
Article 48. Household families and individuals cooperating to help each other build houses and renovate urban areas
1. Household families and individuals may cooperate to help each other build houses or renovate and improve urban areas, including housing, using their financial capabilities, labor, materials, and efforts contributed by members of the cooperative group.
2. Members of the cooperative group must agree on the method of capital contribution, labor, materials, implementation time, rights and obligations of members, and commit to implementing the group's agreement.
Chapter IV
POLICIES ON SOCIAL HOUSING
Section 1
GENERAL PROVISIONS
Article 49. Recipients of social housing support policies
The following subjects, if meeting the conditions stipulated in Article 51 of this Law, shall be entitled to social housing support policies:
1. Persons who have rendered meritorious service to the revolution as prescribed by laws on preferential treatment for persons who have rendered meritorious service to the revolution;
2. Poor and near-poor households in rural areas;
3. Households in rural areas located in regions frequently affected by natural disasters and climate change;
4. Low-income individuals, poor, and near-poor households in urban areas;
5. Workers currently employed at enterprises inside and outside industrial zones;
6. Officers, non-commissioned officers, technical specialists, professional soldiers, and workers in agencies and units under the public security force and the people's armed forces;
7. Civil servants and public officials as prescribed by laws on civil servants and public officials;
8. Subjects who have returned state-provided housing as stipulated in Clause 5, Article 81 of this Law;
9. Students and pupils from academies, universities, colleges, vocational schools, and public boarding schools for ethnic minorities during their study period;
10. Households and individuals whose land has been reclaimed and whose houses have been demolished according to the law but have not yet received compensation in the form of housing or residential land from the State.
Article 50. Forms of Implementation of Social Housing Support Policies
1. Providing support for renting, renting with purchase options, and selling social housing to the subjects specified in Clauses 1, 4, 5, 6, 7, and 10 of Article 49 of this Law; for the subjects specified in Clause 9 of Article 49 of this Law, they can only rent social housing.
2. Supporting through targeted programs on housing for the subjects specified in Clauses 1, 2, and 3 of Article 49 of this Law to construct new or renovate and repair houses for living.
3. Supporting the allocation of residential land with exemptions or reductions in land use fees as prescribed by laws on land or giving houses to the subjects specified in Clauses 1, 2, and 3 of Article 49 of this Law.
4. Supporting preferential loans from the State through the Social Policy Bank or credit organizations designated by the State for the subjects specified in Clauses 1, 4, 5, 6, and 7 of Article 49 of this Law to construct new or renovate and repair houses for living.
Article 51. Conditions for Entitlement to Social Housing Support Policies
1. For cases specified in Clause 1 of Article 50 of this Law, the following conditions regarding housing, residence, and income must be met:
a) Not having owned housing, not having purchased, rented, or rented with purchase options social housing, not having enjoyed housing or land support policies in any form at the place of residence or study, or having owned housing but the average floor area per person in the household is lower than the minimum housing area prescribed by the Government for each period and region;
b) Must have permanent registration in the province or centrally governed city where the social housing is located; in case of no permanent registration, must have temporary registration for at least one year in that province or city, except for the case specified in Clause 9 of Article 49 of this Law;
c) For the subjects specified in Clauses 4, 5, 6, and 7 of Article 49 of this Law, they must belong to the category exempt from regular income tax as prescribed by laws on personal income tax; in case of being poor or near-poor households, they must belong to the category of poor or near-poor as prescribed by the Prime Minister. For the subjects specified in Clauses 1, 8, 9, and 10 of Article 49 of this Law, there is no requirement to meet the income condition stipulated herein.
2. For cases specified in Clauses 2 and 3 of Article 50 of this Law, the conditions must be met as prescribed in the decision approving the corresponding targeted housing program of the competent state agency.
3. For cases specified in Clause 4 of Article 50 of this Law, the following conditions regarding housing and residence must be met:
a) Having residential land but no house or having a house but it is damaged or dilapidated;
b) Having permanent registration in the locality where the residential land and the house to be newly constructed or renovated and repaired are located.
Article 52. Principles for Implementing Social Housing Support Policies
1. The implementation of social housing support policies must ensure the following principles:
a) There must be a combination between the State, community, lineage, and the beneficiaries in implementing the policy;
b) Ensuring transparency and strict oversight by competent state agencies and the community;
c) Ensuring that the beneficiaries meet the prescribed conditions according to this Law;
d) In cases where a beneficiary enjoys multiple different support policies, they shall benefit from the highest level of support policy; in cases where beneficiaries have the same standards and conditions, those who are persons with disabilities or female shall be prioritized for support;
e) In cases where a household has multiple beneficiaries enjoying multiple support policies, only one support policy shall be applied to the entire household.
2. The People's Committee of the province shall be responsible for organizing the implementation and inspecting and auditing the implementation of social housing support policies within its jurisdiction.
Section 2
SOCIAL HOUSING DEVELOPMENT AND MANAGEMENT POLICY
FOR RENT, LEASE PURCHASE, AND SALE
Article 53. Forms of Social Housing Development
1. The State invests in building social housing using state budget funds, national bonds, bonds, official development assistance funds, preferential loans from sponsors, state investment credit funds, or builds under a construction and transfer contract on land areas designated for social housing construction according to regulations for rent, lease purchase.
2. Enterprises and cooperatives invest their own capital in building social housing for rent, lease purchase, sale, or purchasing and renting housing for their employees to lease but with state preferences as stipulated in Clause 1, Article 58 and Article 59 of this Law.
3. Households and individuals invest their own capital in building social housing on their legally owned residential land for rent, lease purchase, and sale but with state preferences as stipulated in Article 58 of this Law.
Article 54. Requirements for Social Housing Construction Projects
1. Meeting the requirements set forth in Article 19 of this Law; in cases where social housing is constructed without being included in the approved housing development program and plan, the People's Committee of the province must seek opinions from the People's Council at the same level before deciding on the investment project for social housing construction.
2. The People's Committee of the province must plan a separate area to establish an investment project for constructing social housing for rent.
3. For social housing construction projects not located in the areas required to establish a separate investment project for social housing construction for rent as stipulated in Clause 2 of this Article, the investor must reserve at least 20% of the social housing area in the project for rent; the investor shall enjoy the preferential mechanism for building rental housing as stipulated in Clause 1, Article 58 of this Law for the 20% social housing area for rent and may sell this housing to tenants according to the regulations on selling social housing after five years of leasing.
4. Social housing construction projects must be managed and supervised by competent state agencies regarding quality, floor area standards, rental prices, lease purchase prices, sale prices, and the review of eligible tenants for rental, lease purchase, and home purchase.
Article 55. Types of houses and standards for social housing area
1. It shall be apartment buildings or individual houses in accordance with detailed construction planning approved by competent state authorities.
2. In case of individual houses, they must be designed and constructed according to construction standards and social housing area standards.
3. In case of apartment buildings, the apartments must be designed and constructed in a closed style, ensuring construction standards and social housing area standards.
Article 56. Land for constructing social housing
1. When approving urban planning, rural construction planning, industrial zone construction planning, research and training zone construction planning, the People's Committee with authority to approve such planning shall clearly determine the land area for constructing social housing.
2. The land area and information about the region and location designated for developing social housing must be publicly announced on the electronic portal of the provincial People's Committee and the provincial housing management agency.
3. Land for developing social housing includes:
a) Land assigned by the State for renting, selling, or purchasing housing;
b) Land rented by the State for renting housing;
c) The residential land area within commercial housing development projects that the project investor must reserve for social housing construction as stipulated in Clause 2, Article 16 of this Law;
d) Legal residential land of organizations, households, or individuals used for social housing construction.
Article 57. Investors of social housing construction projects
1. For social housing invested with sources or forms specified in Clause 1, Article 53 of this Law, the Ministry of Construction shall report to the authorized investment decision-maker to decide on selecting the investor if it is central government funding, or the provincial housing management agency if it is local government funding.
2. For social housing not invested with sources or forms specified in Clause 1, Article 53 of this Law, the provincial housing management agency shall report to the provincial People's Committee to implement the selection of investors as follows:
a) If the State assigns or rents land for social housing construction, the investor shall be selected through bidding if there are two or more investors registering as investors, or designated if only one investor registers as an investor;
b) If a portion of land must be reserved in commercial housing development projects for social housing construction as stipulated in Clause 2, Article 16 of this Law, the investor of the commercial housing development project shall directly invest in constructing social housing, except when the State uses this land area to assign to another organization for social housing construction;
c) If enterprises or cooperatives have legal land use rights, comply with housing construction planning, meet the conditions to be investors, and have the need to construct social housing, these enterprises or cooperatives shall be assigned as investors of social housing construction projects;
d) If social housing is constructed to accommodate workers in industrial zones, then infrastructure development enterprises in industrial zones, production enterprises in industrial zones, or enterprises with real estate trading functions assigned by the State shall be the investors of the project.
3. Households or individuals who wish to invest in constructing social housing on their own legal residential land shall carry out the investment and construction of social housing.
4. Investors of social housing construction projects as stipulated in Clauses 1, 2, and 3 of this Article shall be responsible for constructing social housing in accordance with the provisions of this Law.
Article 58. Incentives for investors in social housing construction projects
1. Enterprises and cooperatives participating in investment in social housing construction using sources of capital or forms not specified in Clause 1 of Article 53 of this Law for leasing, lease-purchase, or sale shall enjoy the following incentives:
a) Exemption from land use fees and land rental fees for the area of land allocated or leased by the State for investment in social housing construction;
b) Exemption or reduction of value-added tax and corporate income tax according to the provisions of the Tax Law; in the case of constructing social housing for leasing, the reduction of value-added tax and corporate income tax shall be greater than in the case of constructing social housing for lease-purchase or sale;
c) Access to preferential loans from the Social Policy Bank and credit organizations operating in Vietnam; in the case of constructing social housing for leasing, they shall be able to borrow at lower interest rates and for longer periods than in the case of constructing social housing for lease-purchase or sale;
d) Support from the People's Committee of the province for all or part of the investment costs for building technical infrastructure within the scope of the social housing construction project; in the case of constructing social housing for leasing, full support for these costs shall be provided;
e) Other incentives as prescribed by law.
2. Households and individuals who invest their own capital in constructing social housing for leasing, lease-purchase, or sale shall enjoy the incentives stipulated in Clause 1 of this Article when meeting the following requirements:
a) Constructing houses in accordance with the approved urban planning and ensuring connectivity with the infrastructure of the area where the houses are located;
b) Houses complying with construction standards and norms and the standard area for social housing;
c) Setting prices for sale, rent, and lease-purchase of houses within the framework of prices issued by the People's Committee of the province where the houses are located.
Article 59. Incentives for organizations providing accommodation for workers
1. In cases where enterprises or industrial and service cooperatives purchase or rent houses to arrange accommodation for their employees without charging rent or with rent not exceeding the rent for social housing issued by the People's Committee of the province, the cost of purchasing or renting houses shall be considered reasonable expenses in production costs when calculating corporate income tax.
2. In cases where enterprises or industrial and service cooperatives invest in constructing houses to arrange accommodation for their employees without charging rent or with rent not exceeding the rent for social housing issued by the People's Committee of the province, in addition to the incentives stipulated in Clause 1 of Article 58 of this Law, such enterprises shall also be allowed to include construction costs in production costs when calculating corporate income tax.
Article 60. Determination of rental and lease-purchase prices for state-invested social housing
The determination of rental and lease-purchase prices for state-invested social housing using sources of capital or forms specified in Clause 1 of Article 53 of this Law shall be carried out as follows:
1. In the case of leasing houses, the rental price shall cover maintenance costs; recovery of investment costs in house construction over a minimum period of 20 years, starting from the date of signing the lease contract; for student and trainee housing, only management and operation costs and maintenance costs shall be covered, without recovery of investment costs;
2. In the case of lease-purchase of houses, the lease-purchase price shall cover recovery of investment costs in house construction over a minimum period of five years, starting from the date of signing the lease-purchase contract;
3. No land use fees or land rental fees shall be charged for the area of land used for social housing construction;
4. The competent authority prescribed in Clause 2 of Article 81 of this Law shall determine the rental and lease-purchase prices for social housing.
Article 61. Determination of Rental Price, Purchase-Rental Price, and Sale Price for Social Housing Not Financed by the State
1. For social housing constructed without using the capital sources or forms prescribed in Clause 1 of Article 53 of this Law, the rental price, purchase-rental price, and sale price shall be determined as follows:
a) The rental price for social housing shall be determined by the developer based on sufficient maintenance costs for the housing; recovery of investment capital for constructing the housing, interest (if applicable), and fixed profit rate as prescribed by the Government, excluding state benefits stipulated in Clause 1 of Article 58 of this Law.
b) The purchase-rental price for social housing shall be determined according to the provisions of point a of this clause, except for the maintenance fees paid by the purchaser-renter as prescribed in Clause 1 of Article 108 of this Law.
c) The sale price for social housing shall be determined by the project developer based on sufficient costs to recover investment capital for constructing the housing, interest (if applicable), and fixed profit rate as prescribed by the Government, excluding state benefits stipulated in Clause 1 of Article 58 of this Law.
d) Developers of social housing shall be responsible for establishing and reporting to the People's Committee of the province where the social housing is located for appraisal of the rental price, purchase-rental price, and sale price before public announcement.
2. For social housing invested in and constructed by households or individuals, the developer shall independently determine the rental price, purchase-rental price, and sale price in compliance with the provisions of point c of Clause 2 of Article 58 of this Law.
Article 62. Principles for Renting, Purchase-Renting, and Selling Social Housing
1. Renting, purchase-renting, and selling social housing must comply with the provisions of this Law; within the same period, each subject specified in Clause 1 of Article 50 of this Law may only rent or purchase-rent or buy one unit of social housing; for students at public boarding schools for ethnic minorities, they are exempt from paying rent and service charges during their stay.
2. The minimum term of the social housing rental contract is five years; the minimum payment period for the purchase-rental price of social housing is five years, starting from the date of signing the purchase-rental contract.
3. The tenant or purchaser-renter of social housing may not sell, lease again, or lend out the housing during the rental or purchase-rental period; if the tenant or purchaser-renter no longer needs the housing, the contract shall be terminated and the housing returned.
4. The purchaser-renter or buyer of social housing may not resell the housing within a minimum period of five years from the date of full payment of the purchase-rental or purchase price; in case of need to sell the housing within the five-year period, it can only be resold to the management unit of social housing or sold to eligible buyers of social housing if the unit does not purchase it at the maximum sale price equal to the sale price of similar social housing at the same location and time, and no personal income tax is required to be paid.
5. The buyer or purchaser-renter of social housing may resell the housing to interested parties through market mechanisms after five years from the date of full payment of the purchase or purchase-rental price and receipt of the Certificate of Ownership but must pay land use fee as prescribed by the Government and pay personal income tax as prescribed by tax laws; in case of resale to eligible buyers of social housing as prescribed by this Law, it can only be resold at the maximum price equal to the sale price of similar social housing at the same location and time, and no personal income tax is required to be paid.
Households or individuals eligible for resettlement who rent or purchase social housing may resell the housing to interested parties through market mechanisms after full payment of the purchase or purchase-rental price and receipt of the Certificate of Ownership but must pay land use fee to the State as prescribed by the Government and must pay personal income tax as prescribed by tax laws.
6. Any renting, purchase-renting, or selling of social housing that does not comply with the provisions of this Law shall result in the rental, purchase-rental, and sale contracts having no legal effect, and the tenant, purchaser-renter, or buyer must return the housing to the social housing management unit; if they fail to return the housing, the People's Committee of the province where the housing is located shall organize forced recovery of the housing.
The handling of rental and purchase payments shall be carried out in accordance with civil law regulations; the handling of purchase-rental payments for social housing shall be carried out in accordance with the provisions of Article 135 of this Law.
Article 63. Sale, Lease, and Lease-Purchase of Social Housing
1. The project investor for social housing construction may choose to sell, lease-purchase future social housing units or sell existing social housing units.
2. The sale and lease-purchase of future social housing units must comply with the following conditions:
a) Having an investment project dossier for housing construction, technical design of housing approved, and Construction Permit if required by law;
b) Completing the foundation construction of housing according to the construction law and completing the investment in the transportation system, water supply and drainage, electricity for daily use, and public lighting of the housing area to be sold or leased-purchased according to the detailed construction planning, design documents, and project progress approved; the mortgage on the housing must be released unless agreed upon by the buyer, lessee, and mortgagee;
c) Receiving a notification from the provincial housing management agency stating that the housing meets the conditions for sale, except for social housing funded by the State as specified in Clause 1, Article 53 of this Law.
3. The leasing, lease-purchasing, and selling of existing social housing units must comply with the following conditions:
a) The housing area for leasing, lease-purchasing, and selling has completed the investment in technical infrastructure and social facilities according to the detailed construction planning, design documents, and project progress approved; if the investor has mortgaged the housing, it must be released before selling or leasing-purchasing, except when agreed upon by the buyer, lessee, and mortgagee;
b) Receiving a notification from the provincial housing management agency stating that the housing meets the conditions for sale, leasing, and lease-purchasing, except for social housing funded by the State as specified in Clause 1, Article 53 of this Law;
c) The housing meets the conditions stipulated in Point b and Point c, Clause 1, Article 118 of this Law.
4. The project investor for social housing construction shall not enter into a lease contract for future social housing units; if the housing meets the conditions stipulated in Points a and b, Clause 2 of this Article, the investor may only enter into a deposit contract and collect a maximum deposit equivalent to 12 months' rent based on provisional calculations; the lease deposit contract must ensure compliance with the eligible tenants and conditions for leasing social housing as prescribed by this Law. After the housing meets the conditions stipulated in Clause 3 of this Article, the investor may enter into a lease contract with the tenant who has signed the deposit contract.
5. Advance payment by the buyer of social housing as provided in this Article shall be carried out according to the agreement in the sales contract, consistent with the completion rate of the housing construction project and the approved project schedule, but the total advance payment by the buyer shall not exceed 70% of the value of the housing sold prior to delivery to the buyer and shall not exceed 95% of the value of the housing sold prior to issuance of the Certificate of Ownership to the buyer.
6. The Government shall provide detailed regulations on proof of eligibility and conditions for enjoying social housing support policies, investment in construction and purchase of commercial housing for social housing purposes, types and standards of social housing areas, tax reduction and preferential credit for social housing construction for leasing, leasing-purchasing, selling, and managing and using social housing.
Article 64. Management and Use of Social Housing
1. For social housing invested with capital sources or forms prescribed in Clause 1, Article 53 of this Law, the social housing management agency shall decide on selecting the operating unit for the housing; in cases where two or more units register to participate, the selection of the operating unit for the housing shall be carried out according to the principle of bidding.
2. For social housing constructed without using capital sources or forms prescribed in Clause 1, Article 53 of this Law, the management and operation of the housing shall be regulated as follows:
a) For social housing intended for rental, the investor shall organize the management and operation of the housing themselves or hire or entrust a capable unit to manage and operate the housing in accordance with the provisions of this Law;
b) For social housing intended for rent-to-own, during the rent-to-own period, the investor shall manage and operate the housing in accordance with the provisions of point a of this clause; after the tenant has paid the full rent-to-own price to the investor, the management and operation shall be carried out in accordance with the provisions of point c of this clause;
c) For social housing intended for sale, if it is individual housing, the buyer shall manage and operate the housing themselves; in the case of apartment buildings, they must comply with the regulations on managing and operating apartment buildings prescribed in this Law.
3. Activities related to the management and operation of social housing shall enjoy preferential mechanisms like those for public utility services.
4. The unit managing and operating social housing may engage in other businesses within the social housing area that are not prohibited by law to reduce the cost of housing management and operation services.
Section 3
SOCIAL HOUSING POLICY FOR HOUSEHOLDS AND INDIVIDUALS WHO CONSTRUCT OR REPAIR TO LIVE IN
INDIVIDUALS WHO BUILD OR REPAIR TO LIVE IN
Article 65. Support Policy for Households and Individuals Who Construct or Repair Housing to Live In
1. The State supports households and individuals specified in Clauses 1, 2, and 3 of Article 49 of this Law in constructing or repairing housing for living through housing target programs.
2. The support policy for housing for the subjects specified in Clause 1 of this Article shall be implemented as follows:
a) Providing partial funding from the State budget;
b) Supporting preferential credit loans from the Social Policy Bank;
c) Supporting infrastructure construction in areas with housing in rural areas;
d) Supporting the allocation of residential land with exemption or reduction of land use fees in accordance with the laws on land for cases without residential land;
đ) Providing housing gifts for subjects who still lack financial capability to improve their housing despite the support provided under points a and b of this clause;
3. The State supports preferential loans through the Social Policy Bank and credit organizations designated by the State for households and individuals specified in Clauses 1, 4, 5, 6, and 7 of Article 49 of this Law to construct or repair housing for living.
Article 66. Forms of Implementation of the Support Policy for Housing for Households and Individuals Who Construct or Repair Housing to Live In
1. Households and individuals organize the construction or repair of housing themselves.
2. The State organizes the construction or repair of housing for cases involving persons with disabilities or single individuals who lack the ability to construct or repair housing themselves.
Chapter V
FINANCIAL RESOURCES FOR HOUSING DEVELOPMENT
Article 67. Sources of capital for housing development
1. Capital of organizations, households, and individuals.
2. Loans from the Social Policy Bank, credit institutions, and financial organizations operating in Vietnam.
3. Purchase money, lease-purchase money, and advance rent payments for housing in accordance with this Law.
4. Capital contributions through forms such as capital contribution, investment cooperation, business cooperation, joint ventures, and associations made by organizations and individuals.
5. State capital including central and local capital to support housing for social policy beneficiaries through housing programs and by building social housing for lease and lease-purchase.
6. Foreign capital and other lawful sources of capital.
Article 68. Principles for raising capital for housing development
1. The form of raising capital must be appropriate for each type of housing as stipulated by this Law. Cases of raising capital not in accordance with the prescribed form and failing to meet the conditions for each type of housing under the law on housing shall have no legal effect.
2. Organizations and individuals raising capital must meet the conditions for raising capital as stipulated by the law on housing.
3. Ensuring transparency; protecting the rights and legitimate interests of organizations and individuals providing capital for housing development.
4. Organizations and individuals must use raised capital for the intended purpose of housing development and may not use it for other projects or purposes.
5. Capital for housing development and implementation of social housing policies must be managed in accordance with this Law, relevant laws, and agreements between parties.
6. The Government shall provide detailed regulations on raising capital, content, conditions, and forms of raising capital for housing development for each type of housing.
Article 69. Capital for commercial housing development
1. Capital owned by the project investor.
2. Capital raised through forms such as capital contribution, investment cooperation, business cooperation, joint ventures, and associations made by organizations, households, and individuals.
3. Purchase money, lease-purchase money, and rent payments in advance according to purchase, lease, and lease-purchase contracts for future housing.
4. Loans from credit institutions and financial organizations operating in Vietnam.
Article 70. Capital for implementing social housing policies
1. Capital of the project investor or capital raised through forms such as capital contribution, investment cooperation, business cooperation, joint ventures, and associations made by organizations, households, and individuals.
2. Capital of the beneficiaries of social housing support policies.
3. State investment capital as specified in Clause 1, Article 53 of this Law.
4. Direct state support capital for social housing policy beneficiaries; preferential loans provided by the Social Policy Bank and credit institutions designated by the State.
5. Support capital from Funds and other lawful support sources.
Article 71. Capital for civil servant housing development
1. State budget capital including central and local budgets.
2. Other sources of capital as prescribed by law.
Article 72. Capital for housing development for resettlement purposes
1. Capital of the project investor or capital raised through forms such as capital contribution, investment cooperation, business cooperation, joint ventures, and associations made by organizations, households, and individuals.
2. State investment capital as specified in Clause 3, Article 36 of this Law.
3. Capital from the Land Development Fund.
4. Capital from compensation and resettlement support when land clearance is carried out in accordance with the law.
5. Capital raised from other lawful sources.
Article 73. Capital for developing residential housing for households and individuals
1. Capital of households and individuals.
2. Cooperative capital between households and individuals; support capital from clans and communities.
3. Borrowed capital from credit organizations and financial institutions operating in Vietnam.
4. State support capital for cases entitled to social housing support policies as stipulated in Article 65 of this Law.
5. Support capital from other lawful sources.
Article 74. Preferential loans through the Social Policy Bank for developing social housing
1. The State supports preferential loans with low interest rates and long-term repayment periods through the allocation of funds from the State budget to the Social Policy Bank to implement programs and projects on housing and social housing construction.
2. The Social Policy Bank shall be allowed to mobilize savings deposits from domestic households and individuals who have the need to purchase or lease social housing, to lend these individuals at preferential interest rates and long-term repayment periods after a certain period of depositing savings.
3. The Social Policy Bank must establish a separate account to manage and utilize the source of capital according to the purposes specified in Clause 1 and Clause 2 of this Article.
4. The Ministry of Construction and the Ministry of Labor, Invalids and Social Affairs shall be responsible for participating in managing the source of capital and the utilization of the capital as specified in Clause 1 and Clause 2 of this Article.
5. The Government shall provide detailed regulations on this matter.
Chapter VI
MANAGEMENT AND USE OF HOUSING
Section 1
GENERAL PROVISIONS ON MANAGEMENT AND USE OF HOUSING
Article 75. Contents of management and use of housing
1. Establishing, storing, and managing housing records.
2. Housing insurance.
3. Management and use of housing with artistic, cultural, and historical value.
4. Management and use of state-owned housing.
5. Warranty, maintenance, renovation, and demolition of housing.
Article 76. Establishment of housing records
1. The owner of the housing or the person currently using the housing if the owner has not been identified, or the organization entrusted with managing state-owned housing shall be responsible for establishing and storing housing records in accordance with Clause 2 of this Article and Article 77 of this Law.
2. Housing records are defined as follows:
a) For housing established before July 1, 2006, in urban and rural areas, there must be proof of lawful establishment of the housing or a declaration of information about the housing in accordance with the laws on housing;
b) For housing established from July 1, 2006, in urban areas, the housing record includes proof of lawful establishment of the housing; documentation identifying the consulting unit, construction unit, design drawings, floor plans, completion documents in accordance with the laws on construction (if applicable);
c) For housing established from July 1, 2006, in rural areas, the housing record includes proof of lawful establishment of the housing and design drawings, floor plans (if applicable);
d) In the case of housing constructed under a project, the housing record includes the investment project documents for housing construction and completion documents in accordance with the laws.
Article 77. Storage and management of housing records
1. Organizations and individuals storing housing records are defined as follows:
a) The owner of the housing or the person currently using the housing if the owner has not been identified, or the organization entrusted with managing state-owned housing shall be responsible for storing housing records;
b) The housing management agency at the district level shall be responsible for storing housing records of domestic households and individuals, overseas Vietnamese residing in Vietnam within its jurisdiction;
c) The housing management agency at the provincial level shall be responsible for storing housing records of domestic organizations, foreign organizations, foreign individuals, and housing construction investment projects within its jurisdiction.
2. The competent authority when processing the issuance of the Certificate of Ownership must provide information about housing as stipulated in Clause 2 of Article 76 of this Law to the housing management agency at the same level to establish housing records.
The People's Committee of the province shall be responsible for specifying the coordination in providing housing information between the competent authority processing the issuance of the Certificate of Ownership and the local housing management agency to ensure consistency in housing and land information recorded in the housing records.
Article 78. Housing Insurance
1. The State encourages owners to purchase housing insurance. For housing included in the list of facilities with fire and explosion risks as stipulated by laws on fire prevention and fighting, the owner must purchase mandatory fire and explosion insurance.
2. The form, contribution level, and duration of housing insurance shall be implemented in accordance with the provisions of laws on insurance business and laws on fire prevention and fighting.
Article 79. Management and Use of Housing with Artistic, Cultural, and Historical Value
1. Housing with artistic, cultural, and historical value includes old villas regardless of ownership form and is determined as follows:
a) Housing ranked by competent state authorities as national or provincial-level cultural and historical relics;
b) Housing not covered under point a of this clause but included in the list approved by the provincial People's Committee based on the proposal of the competent authority as stipulated in Clause 2 of this Article.
2. The provincial People's Committee shall establish a council comprising representatives from provincial-level architectural, construction, and cultural agencies, professional associations, and related scientists to determine criteria and lists of housing projects with artistic, cultural, and historical value within their jurisdiction for approval.
3. The management and use of housing specified in Clause 1 of this Article must comply with the provisions of this Law and laws on cultural heritage; in cases where the housing belongs to the State, it must also comply with the provisions of Section 2 of this Chapter.
4. The budget of the State shall provide funds for the management, conservation, maintenance, and renovation of housing specified in point a of Clause 1 of this Article and housing belonging to the State.
For housing specified in point b of Clause 1 of this Article, except for housing belonging to the State, depending on specific conditions of the locality, the provincial People's Committee shall decide to support partially or fully the funding for the owner to manage, conserve, maintain, and renovate such housing.
Section 2
MANAGEMENT AND USE OF STATE-OWNED HOUSING
Article 80. Types of State-Owned Housing
1. Official housing constructed or purchased by the State using state budget funds or established as State-owned property according to the provisions of the law.
2. Housing for resettlement constructed by the State using funds or forms prescribed in Clause 3 of Article 36 of this Law.
3. Social housing constructed by the State using funds or forms prescribed in Clause 1 of Article 53 of this Law.
4. Old housing constructed using state budget funds or having origins from state budget funds or established as State-owned property and currently leased to households or individuals according to the law on housing.
Article 81. Management and Use of State-Owned Housing
1. State-owned housing must be used for its intended purpose effectively, avoiding waste; the sale, lease, lease-purchase, recovery of housing, and management and use of State-owned housing must be carried out in accordance with the provisions of this Law.
2. The following agencies represent the owner and are responsible for managing State-owned housing:
a) The Ministry of Construction manages official housing and social housing funded by central government funds; the Ministry of Defense and the Ministry of Public Security manage housing funded by the Ministry of Defense and the Ministry of Public Security;
b) The provincial People's Committee manages housing funded by local funds and housing assigned to manage within their jurisdiction.
3. The management and operation of State-owned housing shall be conducted by enterprises or cooperatives with functions to manage and operate housing and enjoy preferential mechanisms like public services. The selection of units to manage and operate State-owned housing shall be decided by the competent agency as stipulated in Clause 2 of this Article.
4. For official housing, it can only be rented; for social housing, it can be built for rental or lease-purchase purposes; if there is no longer a need for use or relocation to another location without demolition or requiring reconstruction of other social housing, the Ministry of Construction shall be responsible for reviewing and reporting to the Prime Minister to decide on the conversion of usage function and implement rental or sale management according to the provisions of this Law.
5. Tenants of official housing who no longer meet the conditions for renting housing or have moved elsewhere or violated regulations on management and use of housing subject to recovery shall return the official housing to the State.
If the person returning official housing does not fall under the category of having housing recovered due to violations listed in points a, e, and h of Clause 1 of Article 84 of this Law and has no housing at the place of residence after returning the official housing, the agency or organization directly managing and using that person shall be responsible for coordinating with the provincial People's Committee where they reside to resolve rental, lease-purchase, purchase of social housing, or allocation of land for them to build housing based on specific circumstances.
6. The Government shall specify detailed regulations on leasing, lease-purchase, selling housing, exemption and reduction of rent, and management and use of State-owned housing.
Article 82. Subjects and Conditions for Leasing, Purchasing on Lease, and Buying State-Owned Housing
1. The subjects eligible for leasing, purchasing on lease, and buying state-owned housing are defined as follows:
a) The subjects specified in Clause 1, Article 32 and Clause 9, Article 49 of this Law shall only be eligible for leasing housing;
b) The subjects specified in Clauses 1, 4, 5, 6, 7, 8, and 10, Article 49 of this Law shall be considered for leasing or purchasing on lease social housing;
c) The subjects specified in Clause 10, Article 49 of this Law, if not yet leased, purchased on lease, or bought social housing, shall be resolved to lease, purchase on lease, or buy housing for resettlement purposes;
d) The subjects actually using old housing as stipulated in Clause 4, Article 80 of this Law shall be resolved to lease or buy such housing.
2. The conditions for leasing, purchasing on lease, and buying state-owned housing are defined as follows:
a) The subjects eligible for leasing official housing must meet the conditions stipulated in Clause 2, Article 32 of this Law;
b) The subjects eligible for leasing or purchasing on lease social housing must meet the conditions stipulated in Clause 1, Article 51 of this Law; if they are the subjects specified in Clause 10, Article 49 of this Law, they must also belong to those who have not been allocated housing or land for resettlement;
c) The subjects eligible for leasing, purchasing on lease, or buying housing for resettlement purposes must belong to those whose land has been reclaimed or houses demolished according to the decision of competent state agencies and who have not yet leased, purchased on lease, or bought social housing;
d) The subjects eligible for leasing or buying old housing must actually be using such housing and have a need to lease or buy it.
Article 83. Leasing, Purchasing on Lease, and Selling State-Owned Housing
1. Leasing, purchasing on lease, and selling state-owned housing must ensure transparency; in addition to complying with the provisions of Articles 82, 84, and the regulations on transactions of buying and selling, leasing, and purchasing on lease housing in Chapter VIII of this Law, the following provisions must also be implemented:
a) In the case of leasing official housing, the provisions of Article 33 of this Law must be implemented;
b) In the case of leasing, purchasing on lease, or selling housing for resettlement purposes, the provisions of Articles 35 and 41 of this Law must be implemented;
c) In the case of leasing, purchasing on lease, or selling social housing, the provisions of Articles 62 and 63 of this Law must be implemented;
d) In the case of leasing or selling old housing, such housing must not have disputes over usage rights and must be eligible for leasing or selling according to the laws on housing.
2. Contracts for leasing, purchasing on lease, and selling housing must include contents as prescribed in Article 121 of this Law. The signing of contracts is regulated as follows:
a) In the case of buying and selling social housing or old housing, the contract is signed between the buyer or purchaser and the housing management agency;
b) In the case of leasing, purchasing on lease, or selling housing for resettlement purposes, the contract is signed between the person being resettled and the unit responsible for resettlement allocation;
c) In the case of leasing housing including old housing, official housing, or social housing, the contract is signed between the lessee and the housing management agency or the unit responsible for managing and operating such housing.
Article 84. Recovery of State-Owned Housing
1. The recovery of state-owned housing shall be carried out in any of the following cases:
a) Leasing, selling, or purchasing on lease housing beyond authority, to ineligible subjects, or without meeting the conditions stipulated in this Law;
b) Upon expiration of the lease term according to the contract, the lessee no longer needs to lease or both parties agree to terminate the lease or purchase on lease contract;
c) The lessee returns the leased or purchased on lease housing;
d) The lessee no longer meets the conditions for leasing housing according to this Law;
đ) The lessee dies or is declared missing by the Court and there is no one living together; in the case of leasing official housing, when the person leasing official housing dies or is declared missing by the Court;
e) The lessee or purchaser does not pay rent for three months or more without a valid reason;
g) The leased or purchased on lease housing falls within the category that must be demolished for renovation and reconstruction according to the decision of competent state agencies;
h) The lessee or purchaser uses the housing for purposes other than those agreed upon in the lease contract, or arbitrarily transfers, sells, rents, lends, alters, excavates, extends, renovates, or demolishes the leased or purchased on lease housing.
2. Those currently leasing or purchasing on lease housing subject to recovery as stipulated in Clause 1 of this Article must return the housing to the unit responsible for managing the housing; if they fail to return the housing, the agency representing the owner of the housing will decide to forcibly recover the housing; the Provincial People's Committee is responsible for organizing the forcible recovery of the housing within thirty days from the date of issuance of the decision to forcibly recover the housing.
Section 3
WARRANTY, MAINTENANCE, AND RENOVATION OF HOUSING
Article 85. Warranty for Housing
1. Organizations and individuals constructing housing must provide warranty for housing in accordance with the provisions of the Construction Law; organizations and individuals supplying housing equipment must provide warranty for such equipment within the period specified by the manufacturer.
In cases where housing is invested in for sale or lease purchase, the seller or lessor must be responsible for providing warranty for housing in accordance with Clause 2 and Clause 3 of this Article. The seller or lessor has the right to request organizations and individuals constructing housing and supplying equipment to fulfill their warranty responsibilities as prescribed by law.
2. Housing shall be under warranty from the completion of construction and acceptance for use, with the following warranty periods:
a) For apartment buildings, at least 60 months;
b) For individual houses, at least 24 months.
3. The contents of the warranty for housing include repairs and rectification of damages to frames, columns, beams, floors, walls, ceilings, roofs, terraces, staircases, cladding, tiling, plastering, fuel supply systems, electricity supply systems for daily use and lighting, water tanks and daily water supply systems, septic tanks and wastewater drainage systems, household waste, rectification of tilting, subsidence, cracking, collapse of housing, and other contents agreed upon in the housing purchase or lease-purchase contract. For other equipment attached to housing, the seller or lessor must carry out warranty repairs and replacements according to the manufacturer's specified period.
Article 86. Maintenance of Housing
1. The owner of housing is responsible for maintaining the housing; if the owner cannot be identified, the person managing and using the housing is responsible for its maintenance.
2. Maintenance of housing must be carried out in accordance with this Law and the Construction Law; for housing as stipulated in Clause 1 of Article 79 of this Law, it must also comply with the laws on architecture, planning, and the preservation, restoration, and management of historical and cultural relics.
3. The owner and the entity performing maintenance of housing must ensure safety for people and property and maintain hygiene and environmental standards during the maintenance process; in cases where the housing is state-owned, they must also comply with the provisions of Article 90 of this Law.
Article 87. Renovation of Housing
1. The owner of housing may renovate housing owned by them; a person who is not the owner can only renovate housing if the owner consents.
2. Renovation of housing must be carried out in accordance with this Law and the Construction Law; if the law requires the establishment of a project for housing renovation, it must be implemented according to the approved project. For state-owned housing, the renovation must also comply with the provisions of Article 90 of this Law.
3. For housing as stipulated in Clause 1 of Article 79 of this Law, renovation must also comply with the laws on planning, architecture, and cultural heritage management; if the law requires prior approval from competent authorities before renovation, the owner and the housing management agency must implement according to the approval document issued by the competent authority.
4. For old villas listed in Clause 1 of Article 79 of this Law, the following regulations must also be adhered to:
a) The original condition of the villa must not be altered;
b) Demolition is not allowed unless there is serious damage posing a risk of collapse, as concluded by the provincial housing management agency; if demolition is necessary for reconstruction, it must follow the original architectural design, use the correct materials, density of construction, number of floors, and height of the old villa;
c) Additional structures that increase area or extend beyond the exterior space of the villa are not permitted.
Article 88. Rights and Obligations of the Owner of Housing in Maintenance and Renovation of Housing
1. The owner of housing has the following rights in maintenance and renovation of housing:
a) To carry out maintenance and renovation themselves or to hire organizations or individuals to perform such tasks; if laws stipulate that maintenance and renovation must be carried out by units or individuals with construction practice capability, they must hire units or individuals with such capability;
b) To request competent state agencies to issue Construction Permits when required by law, thereby facilitating maintenance and renovation of housing upon meeting the conditions prescribed by construction laws;
c) To exercise other rights as prescribed by law.
2. The owner of housing has the following obligations in maintenance and renovation of housing:
a) To comply with laws on maintenance and renovation of housing; to create conditions for other owners of housing to carry out maintenance and renovation of their housing;
b) To compensate others in case of damage caused;
c) To fulfill other obligations as prescribed by law.
Article 89. Maintenance and Renovation of Housing Under Lease
1. The lessor has the right to renovate the housing with the consent of the lessee, except in cases of emergency or force majeure; the lessee is responsible for allowing the lessor to carry out maintenance and renovation of the housing.
2. The lessor may adjust the rent reasonably after completion of renovation if the remaining lease period is one-third or less of the lease contract term; if the lessee disagrees with the rent adjustment, they have the right to unilaterally terminate the contract and claim compensation according to the law.
3. In cases where the lessee must move to another place for maintenance or renovation of the housing, both parties shall agree on temporary accommodation and rental fees during the maintenance and renovation period; if the lessee arranges their own accommodation and has prepaid the rental fees for the entire maintenance or renovation period, the lessor must refund this amount to the lessee. The maintenance or renovation period does not count towards the lease term. The lessee may continue leasing the housing after the completion of maintenance and renovation.
4. The lessee has the right to request the lessor to maintain the housing, except when the housing is damaged by the lessee; if the lessor fails to maintain the housing, the lessee may maintain it but must notify the lessor in writing at least 15 days in advance. The notification must clearly state the extent of maintenance and the implementation costs. The lessor must pay the maintenance costs to the lessee or gradually deduct them from the rent.
Article 90. Maintenance and Renovation of State-Owned Housing
1. Maintenance and renovation of housing must be approved by competent state agencies and carried out in accordance with this Law and construction laws.
2. In cases of renovation of leased housing, it shall be implemented in accordance with Article 89 of this Law; if there is written consent from the housing management agency allowing the lessee to fund the renovation, the renovated part of the housing remains state-owned, and the organization entrusted with managing the housing is responsible for reimbursing the lessee or gradually deducting the costs from the rental fees.
Article 91. Maintenance and Renovation of Common Housing
1. Owners of common housing have the right and responsibility to maintain and renovate common housing corresponding to their share of ownership; in cases where it is not possible to determine each owner's share of ownership, the maintenance and renovation responsibilities shall be equally divided among the owners. The maintenance and renovation of common housing must be agreed upon by all owners.
2. The costs for maintaining and renovating the common portion shall be allocated according to each owner’s share of ownership, except in cases where the owners have agreed otherwise. For apartment buildings with multiple owners, the contribution of funds for maintaining the common portion shall be carried out in accordance with Article 108 of this Law.
Section 4
DEMOLITION OF HOUSING
Article 92. Circumstances Requiring Demolition of Housing
1. Housing that is severely damaged, at risk of collapse, and does not ensure safety for users, as concluded by the provincial housing management agency or in emergency situations for disaster prevention.
2. Housing as specified in Clause 2 of Article 110 of this Law.
3. Housing that must be demolished for land recovery pursuant to a decision of a competent state agency.
4. Housing constructed in prohibited construction areas or on non-residential land as per approved planning.
5. Housing that must be demolished according to construction laws.
Article 93. Responsibility for Demolishing Housing
1. The owner of the housing or the person currently managing or using the housing has the responsibility to demolish the housing; if the housing must be demolished to construct new housing or other projects, then the project investor has the responsibility to demolish the housing.
2. The owner of the housing may carry out the demolition themselves if they have the necessary capacity as stipulated by construction laws, or they can hire organizations or individuals with construction capacity to perform the demolition.
3. In cases where apartment buildings are demolished for renovation and reconstruction, additional provisions under Section 2 of Chapter VII of this Law must also be followed.
4. The People's Committee of communes, wards, towns (hereinafter referred to as the People's Committee of the commune level) has the responsibility to monitor and urge the demolition of housing within their jurisdiction.
Article 94. Requirements for Demolishing Housing
1. People and property must be moved out of the demolition area.
2. Warning signs and isolation measures must be implemented around the demolition site.
3. Safety for people, property, surrounding structures, technical infrastructure not subject to demolition, and environmental hygiene must be ensured in accordance with the law.
4. Demolition of housing within residential areas is prohibited between 12:00 PM and 1:00 PM and from 10:00 PM to 5:00 AM, except in emergencies.
Article 95. Forced Demolition of Housing
1. If housing must be demolished as provided in Article 92 of this Law, but the owner of the housing, the project investor, or the person currently managing or using the housing does not voluntarily carry out the demolition, the competent state agency as specified in Clause 2 of this Article shall issue a decision for forced demolition of the housing.
2. The authority to issue decisions for forced demolition of housing is as follows:
a) The Chairman of the People's Committee of the district issues a decision for forced demolition in cases of demolishing housing for land recovery as specified in Clause 3 of Article 92 of this Law, and individual housing as specified in Clauses 1, 4, and 5 of Article 92 of this Law;
b) The Chairman of the People's Committee of the province issues a decision for forced demolition in cases of demolishing apartment buildings as specified in Clauses 1, 2, 4, and 5 of Article 92 of this Law.
3. The People's Committee of the district is responsible for organizing the forced demolition of housing in accordance with the decision for forced demolition of housing as specified in Clause 2 of this Article.
4. The costs for forced demolition of housing are as follows:
a) The owner of the housing or the person currently managing or using the housing or the project investor must bear the costs for forced demolition and related demolition expenses;
b) If the owner of the housing, the person currently managing or using the housing, or the project investor does not pay, the competent state agency will issue a decision for forced execution to secure the funds for demolition through asset seizure.
Article 96. Place of Residence of the Owner when Housing is Demolished
1. The owner of housing must arrange their own place of residence when the housing is demolished.
2. In cases where housing is demolished due to land reclamation, the owner's place of residence shall be resolved according to the policy on resettlement housing when the State reclaims land as stipulated in this Law and the laws on land.
3. In cases where apartment buildings are demolished for renovation and construction of new apartment buildings, the owner's place of residence with demolished apartment buildings shall be resolved in accordance with Article 116 of this Law.
Article 97. Demolition of Rented Housing
1. The lessor of housing must notify the lessee in writing about the demolition at least 90 days before implementation, except in urgent cases or demolition pursuant to administrative decisions of competent state agencies.
2. In cases where demolition is for reconstruction of housing while the lease term still remains, the lessor has the responsibility to arrange alternative accommodation for the lessee during the demolition and reconstruction period, except if the lessee agrees to arrange their own accommodation. After completion of the housing reconstruction, the lessee may continue renting until the end of the lease contract, unless the lessee does not wish to continue renting that housing; in the case where the lessee arranges their own accommodation, they are not required to pay rent during the demolition and reconstruction period, and such period is not counted towards the lease term.
Chapter VII
MANAGEMENT, USE OF APARTMENT BUILDINGS
Section 1
MANAGEMENT, USE AND MAINTENANCE OF APARTMENT BUILDINGS
Article 98. Classification of Apartment Buildings
1. Apartment buildings are classified into different categories to determine the value of apartment buildings when managing or conducting transactions on the market.
2. The Minister of Construction shall prescribe the classification and recognition of apartment building classifications.
Article 99. Service Life of Apartment Buildings
1. The service life of apartment buildings is determined based on the construction project level and the quality inspection conclusion of the provincial housing management agency in accordance with Clause 2 of this Article. The provincial People's Committee allocates funds to carry out the quality inspection of housing.
2. When apartment buildings reach the end of their service life as prescribed by the construction law or suffer serious damage, posing a risk of collapse and failing to ensure safety for users, the provincial housing management agency must organize a quality inspection of the apartment building project to handle it according to the following provisions:
a) In cases where apartment buildings still ensure quality and safety for users, the owners may continue using them for the duration recorded in the inspection conclusion, except as provided in Clauses 2 and 3 of Article 110 of this Law;
b) In cases where apartment buildings suffer serious damage, pose a risk of collapse, and fail to ensure safety for users, the provincial housing management agency must issue a quality inspection conclusion and report to the provincial People's Committee to notify the owners in writing; the content of the notification must be publicly announced on the provincial People's Committee's website and the housing management agency's website, as well as through local mass media.
The owners of apartment buildings have the responsibility to demolish and renovate or construct new apartment buildings or hand over to the competent authority for demolition and construction of other projects as prescribed in Clause 3 of this Article.
3. Handling of apartment buildings and land use rights of apartment buildings as prescribed in Point b Clause 2 of this Article shall be regulated as follows:
a) In cases where the land with apartment buildings is still suitable for residential construction planning, the owners may renovate and construct new apartment buildings in accordance with Section 2 of this Chapter;
b) In cases where the land with apartment buildings is no longer suitable for residential construction planning, the owners of apartment buildings must hand over the apartment buildings to the competent authority for demolition and construction of other projects according to approved planning;
c) In cases where the owners of apartment buildings do not comply with demolition or do not hand over the housing, the Chairman of the provincial People's Committee decides to forcibly demolish or forcibly relocate to hand over the housing;
d) Arrangement of accommodation for owners whose apartment buildings are demolished is carried out in accordance with Article 116 of this Law.
In cases where demolition is for reconstruction of apartment buildings, the owners retain the right to use the land with those apartment buildings; in cases where demolition is for construction of other projects, handling of the land use rights of these apartment buildings is carried out in accordance with the laws on land.
Article 100. Private Ownership and Common Ownership Parts of Apartment Buildings
1. The private ownership parts within apartment buildings include:
a) The interior area of the apartment including balconies and verandas attached to the apartment;
b) Other areas within the apartment building recognized as private ownership for the owner of the apartment building;
c) Technical equipment systems exclusively used and attached to the apartment or other areas belonging to private ownership.
2. The common ownership parts of apartment buildings include:
a) The remaining area of the apartment building outside the privately owned areas specified in Clause 1 of this Article; community houses of the apartment building;
b) Space and load-bearing structure systems, shared technical equipment within the apartment building including frames, columns, load-bearing walls, encircling walls of the building, partition walls between apartments, floors, roofs, terraces, corridors, staircases, elevators, escape routes, garbage chutes, technical cabinets, power supply systems, water supply systems, gas supply systems, communication, broadcasting, television systems, drainage systems, septic tanks, lightning rods, fire-fighting systems, and other parts not included in the privately owned areas of the apartment building owners;
c) External technical infrastructure systems connected to the apartment building, except those used for public purposes or must be handed over to the State or managed by the investor according to the approved project content;
d) Public facilities within the apartment building area but not constructed for business purposes or must be handed over to the State according to the approved investment construction project content including communal courtyards, flower gardens, parks, and other facilities determined in the content of the approved residential construction investment project.
Article 101. Parking Spaces and Determination of Apartment Usage Area and Other Areas in Apartment Buildings
1. Parking spaces serving apartment building owners and users including cars, two-wheeled motor vehicles, three-wheeled motor vehicles, bicycles, and disabled person's vehicles must be constructed according to construction standards and designs that have been approved and must be used for their intended purpose. The determination of ownership and usage rights for parking spaces is regulated as follows:
a) For bicycle parking spaces, disabled person's vehicle parking spaces, two-wheeled motor vehicle parking spaces, and three-wheeled motor vehicle parking spaces for apartment building owners and users, these belong to the common ownership and usage of apartment building owners;
b) For car parking spaces allocated for apartment building owners, the buyer or lessee of the apartment or other areas within the apartment building decides to purchase or lease; if they do not purchase or lease, the car parking space belongs to the management of the developer, and the developer cannot include the cost of constructing this parking space in the sale price or lease price. The allocation of car parking spaces in the apartment building area must prioritize apartment building owners before allocating public parking spaces.
2. The usage area of an apartment or other areas within the apartment building belonging to the private ownership of the apartment building owner is calculated based on the clear dimensions including the internal wall area of rooms within the apartment, balcony area, and veranda area (if any), excluding the external wall area of the building, partition wall area between apartments, floor area with columns, and technical cabinet area inside the apartment. When calculating the balcony area, the entire floor area is considered; if the balcony has a shared wall area, it is measured from the inner edge of the shared wall.
Article 102. Building Owners' Meeting
1. The Building Owners' Meeting is a meeting of building owners and users if the building owner does not attend.
2. The Building Owners' Meeting shall be convened to decide on matters prescribed in Clause 3 or Clause 4 of this Article when conditions are met according to the Management and Usage Regulations for Buildings issued by the Minister of Construction.
3. For buildings with multiple owners, the Building Owners' Meeting shall convene to decide on the following issues:
a) Nomination, election, and removal of members of the Building Management Board; approval, supplementation, and amendment of the Building Management and Usage Internal Rules;
b) Approval, supplementation, and amendment of the Operating Regulations of the Building Management Board; determination of responsibility allowances for Board members and other reasonable expenses serving the Board's activities;
c) Approval of the management service fee rate for operating the building as stipulated in Article 106 of this Law and the use of maintenance funds for common property of the building;
d) Selection of a management and operation unit for the building in cases where the developer lacks the function or capacity to manage and operate the building, or has such functions and capacities but does not participate in management and operation, or participates but fails to meet requirements agreed upon in the service provision contract signed with the Building Management Board;
đ) Approval of reports on management and operation activities, maintenance activities of common property of the building;
e) Decision on other matters related to the management and usage of the building.
4. Đối với nhà chung cư có một chủ sở hữu thì Hội nghị nhà chung cư được tổ chức họp để quyết định các vấn đề quy định tại các điểm a, b và e khoản 3 Điều này.
5. Mọi quyết định của Hội nghị nhà chung cư về các vấn đề quy định tại khoản 3 Điều này được thông qua theo nguyên tắc đa số bằng hình thức biểu quyết hoặc bỏ phiếu, được lập thành biên bản có chữ ký của các thành viên chủ trì cuộc họp và thư ký cuộc họp Hội nghị nhà chung cư.
Điều 103. Ban quản trị nhà chung cư
1. Đối với nhà chung cư có một chủ sở hữu hoặc nhà chung cư có nhiều chủ sở hữu nhưng có dưới 20 căn hộ thì chủ sở hữu, người sử dụng nhà chung cư thống nhất quyết định việc thành lập Ban quản trị nhà chung cư hoặc không thành lập Ban quản trị nhà chung cư; trường hợp thành lập Ban quản trị nhà chung cư được thực hiện như sau:
a) Đối với nhà chung cư có một chủ sở hữu, thành phần Ban quản trị bao gồm đại diện chủ sở hữu và người sử dụng nhà chung cư;
b) Đối với nhà chung cư có nhiều chủ sở hữu, thành phần Ban quản trị nhà chung cư thực hiện theo quy định tại khoản 2 Điều này.
2. Đối với nhà chung cư có nhiều chủ sở hữu mà có từ 20 căn hộ trở lên phải thành lập Ban quản trị nhà chung cư. Thành phần Ban quản trị nhà chung cư gồm đại diện các chủ sở hữu nhà chung cư, đại diện chủ đầu tư (nếu có); trường hợp người sử dụng nhà chung cư tham gia Hội nghị nhà chung cư thì thành phần Ban quản trị nhà chung cư có thể gồm cả người sử dụng.
3. Ban quản trị nhà chung cư có một chủ sở hữu được tổ chức theo mô hình tự quản. Ban quản trị nhà chung cư có nhiều chủ sở hữu được tổ chức và hoạt động theo mô hình Hội đồng quản trị của công ty cổ phần hoặc mô hình Ban chủ nhiệm của hợp tác xã, có tư cách pháp nhân, có con dấu và thực hiện các quyền, trách nhiệm quy định tại khoản 1 Điều 104 của Luật này.
Khi bầu, bãi miễn thành viên Ban quản trị nhà chung cư, các chủ sở hữu, người sử dụng nhà chung cư không phải thành lập công ty cổ phần hoặc thành lập hợp tác xã; việc bầu, bãi miễn thành viên Ban quản trị được thực hiện thông qua Hội nghị nhà chung cư theo Quy chế quản lý, sử dụng nhà chung cư do Bộ trưởng Bộ Xây dựng ban hành.
Điều 104. Quyền và trách nhiệm của Ban quản trị nhà chung cư
1. Đối với nhà chung cư có nhiều chủ sở hữu thì Ban quản trị nhà chung cư có quyền và trách nhiệm sau đây:
a) Đôn đốc, nhắc nhở các chủ sở hữu, người sử dụng nhà chung cư trong việc thực hiện nội quy, quy chế quản lý, sử dụng nhà chung cư;
b) Quản lý, sử dụng kinh phí bảo trì phần sở hữu chung của nhà chung cư theo quy định của Luật này và quyết định của Hội nghị nhà chung cư; báo cáo Hội nghị nhà chung cư việc thu, chi khoản kinh phí này;
c) Đề nghị Hội nghị nhà chung cư thông qua mức giá dịch vụ quản lý vận hành nhà chung cư;
d) Ký hợp đồng cung cấp dịch vụ quản lý vận hành nhà chung cư với chủ đầu tư hoặc đơn vị có chức năng, năng lực quản lý vận hành nhà chung cư sau khi đã được Hội nghị nhà chung cư lựa chọn theo quy định tại điểm d khoản 3 Điều 102 của Luật này.
Trường hợp nhà chung cư không yêu cầu phải có đơn vị quản lý vận hành theo quy định tại điểm b khoản 1 Điều 105 của Luật này và được Hội nghị nhà chung cư giao cho Ban quản trị thực hiện quản lý vận hành thì Ban quản trị nhà chung cư thực hiện việc thu, chi kinh phí quản lý vận hành theo quyết định của Hội nghị nhà chung cư;
đ) Ký kết hợp đồng với đơn vị có năng lực bảo trì nhà ở theo quy định của pháp luật về xây dựng để bảo trì phần sở hữu chung của nhà chung cư và giám sát hoạt động bảo trì. Việc bảo trì phần sở hữu chung có thể do đơn vị đang quản lý vận hành nhà chung cư hoặc đơn vị khác có năng lực bảo trì theo quy định của pháp luật về xây dựng thực hiện;
e) Thu thập, tổng hợp ý kiến, kiến nghị của người sử dụng nhà chung cư về việc quản lý, sử dụng và cung cấp các dịch vụ nhà chung cư để phối hợp với cơ quan chức năng, tổ chức, cá nhân có liên quan xem xét, giải quyết;
g) Phối hợp với chính quyền địa phương, tổ dân phố trong việc xây dựng nếp sống văn minh, giữ gìn trật tự, an toàn xã hội trong nhà chung cư;
h) Thực hiện đúng quy chế hoạt động của Ban quản trị nhà chung cư đã được Hội nghị nhà chung cư thông qua, không được tự bãi miễn hoặc bổ sung thành viên Ban quản trị nhà chung cư;
i) Được hưởng thù lao trách nhiệm và các chi phí hợp lý khác theo quyết định của Hội nghị nhà chung cư;
k) Chịu trách nhiệm trước pháp luật, trước chủ sở hữu, người sử dụng nhà chung cư khi thực hiện quyền và trách nhiệm không đúng với quy định tại khoản này;
l) Thực hiện các công việc khác do Hội nghị nhà chung cư giao mà không trái với quy định pháp luật.
2. Đối với nhà chung cư có một chủ sở hữu thì Ban quản trị nhà chung cư thực hiện quyền và trách nhiệm quy định tại các điểm a, e, g, h, i, k và l khoản 1 Điều này.
Điều 105. Quản lý vận hành nhà chung cư
1. Việc quản lý vận hành nhà chung cư được quy định như sau:
a) Đối với nhà chung cư có thang máy thì do đơn vị có chức năng, năng lực quản lý vận hành nhà chung cư thực hiện;
b) Đối với nhà chung cư không có thang máy thì Hội nghị nhà chung cư họp quyết định tự quản lý vận hành hoặc thuê đơn vị có chức năng, năng lực quản lý vận hành nhà chung cư thực hiện.
2. Đơn vị quản lý vận hành nhà chung cư phải có đủ điều kiện về chức năng và năng lực theo quy định sau đây:
a) Được thành lập, hoạt động theo quy định của Luật doanh nghiệp hoặc Luật hợp tác xã và có chức năng quản lý vận hành nhà chung cư;
b) Phải có các bộ phận chuyên môn nghiệp vụ về quản lý vận hành nhà chung cư bao gồm bộ phận kỹ thuật, dịch vụ, bảo vệ an ninh, vệ sinh, môi trường;
c) Có đội ngũ cán bộ, nhân viên đáp ứng yêu cầu về quản lý vận hành nhà ở bao gồm lĩnh vực xây dựng, kỹ thuật điện, nước, phòng cháy, chữa cháy, vận hành trang thiết bị gắn với nhà chung cư và có giấy chứng nhận đã được đào tạo, bồi dưỡng kiến thức chuyên môn nghiệp vụ về quản lý vận hành nhà chung cư theo quy định của Bộ trưởng Bộ Xây dựng.
3. Đơn vị quản lý vận hành nhà chung cư thực hiện việc quản lý vận hành hệ thống kỹ thuật, trang thiết bị, cung cấp các dịch vụ cho nhà chung cư, bảo trì nhà chung cư nếu có năng lực thực hiện bảo trì và thực hiện các công việc khác liên quan đến việc quản lý vận hành nhà chung cư.
4. Đơn vị quản lý vận hành nhà chung cư được thu kinh phí quản lý vận hành của các chủ sở hữu, người sử dụng nhà chung cư theo mức giá quy định tại khoản 3 và khoản 4 Điều 106 của Luật này; đối với nhà chung cư thuộc sở hữu nhà nước thì giá dịch vụ quản lý vận hành được thực hiện theo quy định tại điểm a khoản 5 Điều 106 của Luật này.
5. Đơn vị quản lý vận hành nhà chung cư được quản lý, vận hành nhiều nhà chung cư tại một hoặc nhiều địa bàn khác nhau.
Điều 106. Giá dịch vụ quản lý vận hành nhà chung cư
1. Việc xác định giá dịch vụ quản lý vận hành nhà chung cư phải công khai, minh bạch và căn cứ vào nội dung các công việc cần quản lý vận hành, dịch vụ sử dụng đối với từng loại nhà chung cư.
2. Giá dịch vụ quản lý vận hành nhà chung cư không bao gồm kinh phí bảo trì phần sở hữu chung, chi phí trông giữ xe, chi phí sử dụng nhiên liệu, năng lượng, nước sinh hoạt, dịch vụ truyền hình, thông tin liên lạc và các chi phí dịch vụ khác phục vụ cho việc sử dụng riêng của chủ sở hữu, người sử dụng nhà chung cư.
3. Đối với nhà chung cư có nhiều chủ sở hữu thì giá dịch vụ quản lý vận hành nhà chung cư được quy định như sau:
a) Trường hợp chưa tổ chức được Hội nghị nhà chung cư lần đầu thì giá dịch vụ quản lý vận hành nhà chung cư thực hiện theo thỏa thuận trong hợp đồng mua bán, thuê mua nhà ở;
b) Trường hợp đã tổ chức được Hội nghị nhà chung cư thì giá dịch vụ quản lý vận hành nhà chung cư do Hội nghị nhà chung cư quyết định.
4. Đối với nhà chung cư có một chủ sở hữu thì giá dịch vụ quản lý nhà chung cư được thực hiện theo thỏa thuận giữa chủ sở hữu và người sử dụng nhà chung cư; trường hợp nhà chung cư thuộc sở hữu nhà nước thì giá dịch vụ quản lý nhà chung cư được thực hiện theo quy định tại khoản 5 Điều này.
5. Ủy ban nhân dân cấp tỉnh có trách nhiệm ban hành khung giá dịch vụ quản lý vận hành nhà chung cư để áp dụng cho các trường hợp sau đây:
a) Thu kinh phí quản lý vận hành nhà chung cư thuộc sở hữu nhà nước trên địa bàn;
b) Làm cơ sở để các bên thỏa thuận trong hợp đồng mua bán, hợp đồng thuê mua nhà ở hoặc trong trường hợp có tranh chấp về giá dịch vụ giữa đơn vị quản lý vận hành nhà chung cư với chủ sở hữu, người sử dụng nhà chung cư; trường hợp không thỏa thuận được giá dịch vụ quản lý vận hành nhà chung cư thì áp dụng mức giá trong khung giá dịch vụ do Ủy ban nhân dân cấp tỉnh ban hành.
Điều 107. Bảo trì nhà chung cư
1. Bảo trì nhà chung cư bao gồm bảo trì phần sở hữu riêng và bảo trì phần sở hữu chung. Chủ sở hữu nhà chung cư có trách nhiệm bảo trì phần sở hữu riêng và đóng góp kinh phí để thực hiện bảo trì phần sở hữu chung của nhà chung cư.
2. Việc đóng góp kinh phí bảo trì phần sở hữu chung của nhà chung cư có nhiều chủ sở hữu được thực hiện theo quy định tại Điều 108 của Luật này; việc sử dụng kinh phí bảo trì phần sở hữu chung có nhiều chủ sở hữu được thực hiện theo quy định tại Điều 109 của Luật này.
3. Nội dung bảo trì, quy trình bảo trì và việc quản lý hồ sơ bảo trì nhà chung cư được thực hiện theo quy định của pháp luật về xây dựng.
Điều 108. Kinh phí bảo trì phần sở hữu chung của nhà chung cư có nhiều chủ sở hữu
1. Kinh phí bảo trì phần sở hữu chung của nhà chung cư có nhiều chủ sở hữu được quy định như sau:
a) Đối với căn hộ, phần diện tích khác trong nhà chung cư mà chủ đầu tư bán, cho thuê mua thì chủ đầu tư phải đóng 2% giá trị căn hộ hoặc diện tích khác bán, cho thuê mua; khoản tiền này được tính vào tiền bán, tiền thuê mua nhà mà người mua, thuê mua phải đóng khi nhận bàn giao và được quy định rõ trong hợp đồng mua bán, hợp đồng thuê mua;
b) Đối với căn hộ, phần diện tích khác trong nhà chung cư mà chủ đầu tư giữ lại không bán, không cho thuê mua hoặc chưa bán, chưa cho thuê mua tính đến thời điểm bàn giao đưa nhà chung cư vào sử dụng, trừ phần diện tích thuộc sở hữu chung thì chủ đầu tư phải đóng 2% giá trị căn hộ, phần diện tích giữ lại; phần giá trị này được tính theo giá bán căn hộ có giá cao nhất của nhà chung cư đó.
2. Trường hợp kinh phí bảo trì quy định tại khoản 1 Điều này không đủ để thực hiện bảo trì phần sở hữu chung của nhà chung cư thì các chủ sở hữu nhà chung cư có trách nhiệm đóng góp thêm kinh phí tương ứng với phần diện tích thuộc sở hữu riêng của từng chủ sở hữu.
3. Trường hợp chủ đầu tư ký hợp đồng mua bán, thuê mua căn hộ hoặc diện tích khác trong nhà chung cư trước ngày 01 tháng 7 năm 2006 mà chưa thu kinh phí bảo trì phần sở hữu chung thì các chủ sở hữu nhà chung cư họp Hội nghị nhà chung cư để thống nhất mức đóng góp kinh phí này; mức đóng góp kinh phí có thể được nộp hằng tháng vào tài khoản tiền gửi tại tổ chức tín dụng đang hoạt động tại Việt Nam do Ban quản trị nhà chung cư lập hoặc được đóng khi phát sinh công việc cần bảo trì.
4. Trường hợp chủ đầu tư ký hợp đồng mua bán, thuê mua căn hộ hoặc diện tích khác trong nhà chung cư sau ngày 01 tháng 7 năm 2006 mà trong hợp đồng mua bán, thuê mua nhà ở không có thỏa thuận về kinh phí bảo trì thì chủ đầu tư phải đóng khoản tiền này; trường hợp trong hợp đồng mua bán, thuê mua nhà ở mà giá mua, giá thuê mua chưa tính kinh phí bảo trì thì chủ sở hữu thực hiện đóng khoản kinh phí bảo trì phần sở hữu chung theo quy định tại khoản 3 Điều này.
5. Trường hợp nhà chung cư có mục đích sử dụng hỗn hợp để ở và kinh doanh mà phân chia được riêng biệt các khu chức năng khác nhau trong cùng một tòa nhà bao gồm khu chức năng căn hộ, khu chức năng kinh doanh, dịch vụ và mỗi khu chức năng này có phần sở hữu chung được tách biệt với phần sở hữu chung của cả tòa nhà, được quản lý, vận hành độc lập thì chủ đầu tư và người mua, thuê mua căn hộ hoặc diện tích khác trong nhà chung cư thỏa thuận trong hợp đồng mua bán, thuê mua việc phân chia tỷ lệ kinh phí bảo trì phần sở hữu chung thành nhiều phần để quản lý, sử dụng theo quy định tại khoản 4 Điều 109 của Luật này.
Điều 109. Quản lý, sử dụng kinh phí bảo trì phần sở hữu chung của nhà chung cư có nhiều chủ sở hữu
1. Đối với kinh phí bảo trì quy định tại khoản 1 Điều 108 của Luật này thì trong thời hạn 07 ngày, kể từ ngày thu kinh phí của người mua, thuê mua căn hộ hoặc diện tích khác trong nhà chung cư, chủ đầu tư có trách nhiệm gửi vào tài khoản tiền gửi tiết kiệm mở tại tổ chức tín dụng đang hoạt động tại Việt Nam để quản lý kinh phí này và thông báo cho cơ quan quản lý nhà ở cấp tỉnh nơi có nhà chung cư biết.
Trong thời hạn 07 ngày, kể từ ngày Ban quản trị nhà chung cư được thành lập, chủ đầu tư phải chuyển giao kinh phí bảo trì bao gồm cả lãi suất tiền gửi cho Ban quản trị để thực hiện quản lý, sử dụng theo quy định của Luật này và có thông báo cho cơ quan quản lý nhà ở cấp tỉnh biết; trường hợp chủ đầu tư không bàn giao kinh phí này thì Ban quản trị nhà chung cư có quyền yêu cầu Ủy ban nhân dân cấp tỉnh nơi có nhà chung cư thực hiện cưỡng chế buộc chủ đầu tư phải thực hiện bàn giao theo quy định của Chính phủ.
2. Kinh phí bảo trì quy định tại Điều 108 của Luật này chỉ được sử dụng để bảo trì các phần sở hữu chung của nhà chung cư, không được sử dụng cho việc quản lý vận hành nhà chung cư và các mục đích khác; trường hợp nhà chung cư phải phá dỡ mà kinh phí bảo trì chưa sử dụng hết thì được sử dụng để hỗ trợ tái định cư hoặc đưa vào quỹ bảo trì phần sở hữu chung của nhà chung cư mới sau khi được xây dựng lại.
3. Ban quản trị nhà chung cư có trách nhiệm quản lý, sử dụng kinh phí bảo trì đúng mục đích, đúng hạng mục cần bảo trì theo kế hoạch bảo trì đã được Hội nghị nhà chung cư thông qua hằng năm. Việc sử dụng kinh phí bảo trì phần sở hữu chung phải có hóa đơn tài chính, có thanh toán, quyết toán theo quy định của pháp luật về tài chính và phải báo cáo Hội nghị nhà chung cư.
Thành viên Ban quản trị nhà chung cư có quyết định sử dụng kinh phí không đúng quy định tại khoản 2 Điều này và khoản này thì bị xử lý theo quy định của pháp luật và phải bồi thường thiệt hại.
4. Việc quản lý, sử dụng phần kinh phí bảo trì quy định tại khoản 5 Điều 108 của Luật này được quy định như sau:
a) Đối với phần kinh phí để bảo trì phần sở hữu chung của cả tòa nhà và phần sở hữu chung của khu căn hộ thì được chuyển vào tài khoản do Ban quản trị nhà chung cư lập để quản lý, sử dụng theo quy định tại Điều này;
b) Đối với phần kinh phí để bảo trì phần sở hữu chung của khu kinh doanh, dịch vụ thì chủ sở hữu khu kinh doanh, dịch vụ được tự quản lý, sử dụng để bảo trì phần sở hữu chung của khu chức năng này.
Mục 2
PHÁ DỠ NHÀ CHUNG CƯ ĐỂ CẢI TẠO,
XÂY DỰNG LẠI NHÀ CHUNG CƯ
Điều 110. Các trường hợp phá dỡ nhà chung cư để cải tạo, xây dựng lại nhà chung cư
1. Nhà chung cư thuộc diện phải phá dỡ để cải tạo, xây dựng lại nhà chung cư theo quy định tại điểm b khoản 2 Điều 99 của Luật này.
2. Nhà chung cư bị hư hỏng mà chưa thuộc diện bị phá dỡ nhưng nằm trong khu vực phải thực hiện cải tạo, xây dựng đồng bộ với khu nhà ở thuộc diện bị phá dỡ theo quy định tại khoản 1 Điều này theo quy hoạch xây dựng được phê duyệt.
3. Nhà chung cư không thuộc diện quy định tại khoản 1 và khoản 2 Điều này nhưng được tất cả các chủ sở hữu thống nhất phá dỡ để xây dựng lại nhà chung cư mới thông qua Hội nghị nhà chung cư.
Điều 111. Lập kế hoạch cải tạo, xây dựng lại nhà chung cư
1. Ủy ban nhân dân cấp tỉnh nơi có nhà chung cư có trách nhiệm tổ chức rà soát, thống kê các loại nhà chung cư trên địa bàn; lập và phê duyệt kế hoạch cải tạo, xây dựng lại các nhà chung cư thuộc diện quy định tại khoản 1 và khoản 2 Điều 110 của Luật này.
2. Kế hoạch cải tạo, xây dựng lại nhà chung cư có thể được lập và phê duyệt riêng hoặc được xác định trong kế hoạch phát triển nhà ở của địa phương và phải được công bố công khai trên phương tiện thông tin đại chúng của địa phương, trên Cổng thông tin điện tử của Ủy ban nhân dân cấp tỉnh, cơ quan quản lý nhà ở cấp tỉnh và thông báo đến khu dân cư, Ủy ban nhân dân cấp xã nơi có nhà chung cư.
Điều 112. Yêu cầu đối với việc phá dỡ nhà chung cư để cải tạo, xây dựng lại nhà chung cư
1. Việc phá dỡ để cải tạo, xây dựng lại nhà chung cư phải thuộc trường hợp quy định tại Điều 110 của Luật này, phù hợp với quy hoạch xây dựng và chương trình, kế hoạch phát triển nhà ở của địa phương đã được phê duyệt.
2. Trước khi thực hiện phá dỡ để cải tạo, xây dựng lại nhà chung cư thì chủ đầu tư phải tổ chức lập phương án tái định cư để báo cáo Ủy ban nhân dân cấp tỉnh nơi có nhà chung cư phê duyệt. Phương án tái định cư phải được thông báo đến khu dân cư nơi có nhà chung cư bị phá dỡ, được công bố công khai trên các phương tiện thông tin đại chúng của địa phương, trên Cổng thông tin điện tử của Ủy ban nhân dân và cơ quan quản lý nhà ở cấp tỉnh.
3. Việc cải tạo, xây dựng lại nhà chung cư phải được thực hiện theo dự án; khi phá dỡ để cải tạo, xây dựng lại nhà chung cư phải kết hợp cải tạo lại khu nhà ở trong khu vực của dự án theo quy hoạch xây dựng được phê duyệt.
4. Trường hợp cải tạo, xây dựng lại nhà chung cư thuộc sở hữu nhà nước thì phải được cơ quan có thẩm quyền phê duyệt và phải tuân thủ quy định về cải tạo, xây dựng lại nhà ở thuộc sở hữu nhà nước.
Điều 113. Các hình thức cải tạo, xây dựng lại nhà chung cư
1. Doanh nghiệp kinh doanh bất động sản đầu tư vốn hoặc góp vốn cùng các chủ sở hữu có nhà chung cư quy định tại Điều 110 của Luật này để cải tạo, xây dựng lại nhà chung cư, trừ trường hợp chủ sở hữu nhà chung cư quy định tại khoản 1 và khoản 2 Điều 110 của Luật này không chấp hành việc phá dỡ.
2. Nhà nước thực hiện cưỡng chế phá dỡ và trực tiếp đầu tư cải tạo, xây dựng lại nhà chung cư bằng nguồn vốn hoặc hình thức quy định tại khoản 3 Điều 36 của Luật này đối với trường hợp quy định tại khoản 1 và khoản 2 Điều 110 của Luật này mà chủ sở hữu nhà chung cư không chấp hành việc phá dỡ.
Điều 114. Chủ đầu tư dự án cải tạo, xây dựng lại nhà chung cư
1. Việc lựa chọn chủ đầu tư dự án cải tạo, xây dựng lại nhà chung cư được thực hiện như sau:
a) Trường hợp Nhà nước đầu tư bằng nguồn vốn quy định tại khoản 3 Điều 36 của Luật này để cải tạo, xây dựng lại nhà chung cư thì cơ quan quản lý nhà ở cấp tỉnh báo cáo người có thẩm quyền quyết định đầu tư quyết định lựa chọn chủ đầu tư;
b) Trường hợp Nhà nước đầu tư cải tạo, xây dựng lại nhà chung cư theo hình thức xây dựng - chuyển giao quy định tại khoản 3 Điều 36 của Luật này thì cơ quan quản lý nhà ở cấp tỉnh báo cáo Ủy ban nhân dân cấp tỉnh quyết định lựa chọn chủ đầu tư theo hình thức đấu thầu nếu có từ hai nhà đầu tư trở lên đăng ký làm chủ đầu tư hoặc chỉ định thầu nếu chỉ có một nhà đầu tư đăng ký làm chủ đầu tư;
c) Trường hợp doanh nghiệp kinh doanh bất động sản tham gia góp vốn đầu tư cải tạo, xây dựng lại nhà chung cư thì chủ sở hữu nhà chung cư và doanh nghiệp thỏa thuận về đơn vị làm chủ đầu tư và đề nghị cơ quan quản lý nhà ở cấp tỉnh báo cáo Ủy ban nhân dân cấp tỉnh chấp thuận.
2. Việc lựa chọn chủ đầu tư dự án cải tạo, xây dựng lại nhà chung cư chỉ được thực hiện sau khi có kế hoạch cải tạo, xây dựng lại nhà chung cư được Ủy ban nhân dân cấp tỉnh phê duyệt.
3. Trường hợp cải tạo, xây dựng lại nhà chung cư quy định tại điểm b và điểm c khoản 1 Điều này thì chủ đầu tư phải có đủ điều kiện theo quy định tại Điều 21 của Luật này.
Điều 115. Phương án bố trí tái định cư khi phá dỡ nhà chung cư
1. Trường hợp nhà chung cư có một chủ sở hữu mà đang cho thuê thì việc bố trí chỗ ở cho người đang thuê được thực hiện theo thỏa thuận giữa chủ sở hữu và người thuê nhà.
2. Trường hợp nhà chung cư có nhiều chủ sở hữu mà có sự tham gia đầu tư của doanh nghiệp kinh doanh bất động sản thì chủ sở hữu nhà chung cư và doanh nghiệp này thỏa thuận phương án bố trí tái định cư theo nguyên tắc quy định tại Điều 116 của Luật này để báo cáo Ủy ban nhân dân cấp tỉnh nơi có nhà chung cư phê duyệt.
Các chủ sở hữu nhà chung cư phải tổ chức cuộc họp Hội nghị nhà chung cư để thống nhất phương án bố trí tái định cư trước khi báo cáo Ủy ban nhân dân cấp tỉnh nơi có nhà chung cư phê duyệt.
3. Trường hợp nhà chung cư thuộc diện quy định tại khoản 1 và khoản 2 Điều 110 của Luật này mà chủ sở hữu không chấp hành việc phá dỡ thì Ủy ban nhân dân cấp tỉnh nơi có nhà ở thực hiện cưỡng chế phá dỡ và tổ chức lập, phê duyệt phương án bố trí tái định cư theo nguyên tắc quy định tại Điều 116 của Luật này.
Điều 116. Bố trí nhà ở tái định cư
1. Việc bố trí tái định cư cho các chủ sở hữu có nhà chung cư thuộc diện phá dỡ để cải tạo, xây dựng lại nhà chung cư được thực hiện như sau:
a) Trường hợp chủ sở hữu không có nhu cầu tái định cư tại chỗ thì tùy theo điều kiện cụ thể của địa phương mà được bố trí nhà ở, đất ở tái định cư theo quy định tại Điều 36 của Luật này;
b) Trường hợp chủ sở hữu có nhu cầu tái định cư tại chỗ thì được bố trí nhà ở mới có diện tích tối thiểu bằng hoặc lớn hơn diện tích nhà ở cũ.
Trường hợp Nhà nước đầu tư cải tạo, xây dựng lại nhà chung cư mà có chênh lệch về giá trị giữa nhà ở cũ và nhà ở mới thì việc thanh toán giá trị chênh lệch được thực hiện theo phương án bố trí tái định cư đã được phê duyệt; nếu doanh nghiệp kinh doanh bất động sản và chủ sở hữu thỏa thuận đầu tư cải tạo, xây dựng lại nhà chung cư thì việc thanh toán giá trị chênh lệch được thực hiện theo thỏa thuận giữa các bên;
c) Việc bố trí tái định cư bằng nhà ở được thực hiện thông qua hợp đồng cho thuê, cho thuê mua, mua bán nhà ở ký giữa người được bố trí tái định cư với đơn vị được giao bố trí tái định cư nếu do Nhà nước đầu tư; ký với chủ đầu tư dự án nếu do doanh nghiệp kinh doanh bất động sản đầu tư xây dựng;
d) Ngoài việc được bố trí tái định cư theo quy định tại khoản này, người được bố trí tái định cư còn được xem xét hỗ trợ theo quy định của pháp luật về bồi thường, hỗ trợ, tái định cư.
2. Việc bố trí tái định cư cho các chủ sở hữu có nhà chung cư phải phá dỡ để xây dựng công trình khác được thực hiện theo quy định tại Điều 36 của Luật này.
3. Trường hợp Nhà nước đầu tư cải tạo, xây dựng lại nhà chung cư thì chủ đầu tư dự án phải lo chỗ ở tạm thời hoặc thanh toán tiền để người được tái định cư tự lo chỗ ở trong thời gian cải tạo, xây dựng lại; trường hợp doanh nghiệp kinh doanh bất động sản và chủ sở hữu thỏa thuận đầu tư cải tạo, xây dựng lại nhà chung cư thì các bên thỏa thuận về chỗ ở tạm thời của chủ sở hữu trong thời gian cải tạo, xây dựng lại.
4. Chính phủ quy định chi tiết việc phá dỡ nhà chung cư để cải tạo, xây dựng lại nhà chung cư và việc bố trí nhà ở cho người được tái định cư.
Chương VIII
GIAO DỊCH VỀ NHÀ Ở
Mục 1
QUY ĐỊNH CHUNG VỀ CÁC GIAO DỊCH VỀ NHÀ Ở
Điều 117. Các hình thức giao dịch về nhà ở
Giao dịch về nhà ở bao gồm các hình thức mua bán, cho thuê, cho thuê mua nhà ở, chuyển nhượng hợp đồng mua bán nhà ở thương mại, tặng cho, đổi, thừa kế, thế chấp, góp vốn, cho mượn, cho ở nhờ và ủy quyền quản lý nhà ở.
Điều 118. Điều kiện của nhà ở tham gia giao dịch
1. Giao dịch về mua bán, cho thuê mua, tặng cho, đổi, thế chấp, góp vốn bằng nhà ở thì nhà ở phải có đủ điều kiện sau đây:
a) Có Giấy chứng nhận theo quy định của pháp luật, trừ trường hợp quy định tại khoản 2 Điều này;
b) Không thuộc diện đang có tranh chấp, khiếu nại, khiếu kiện về quyền sở hữu; đang trong thời hạn sở hữu nhà ở đối với trường hợp sở hữu nhà ở có thời hạn;
c) Không bị kê biên để thi hành án hoặc không bị kê biên để chấp hành quyết định hành chính đã có hiệu lực pháp luật của cơ quan nhà nước có thẩm quyền;
d) Không thuộc diện đã có quyết định thu hồi đất, có thông báo giải tỏa, phá dỡ nhà ở của cơ quan có thẩm quyền.
Các điều kiện quy định tại điểm b và điểm c khoản này không áp dụng đối với trường hợp mua bán, thuê mua nhà ở hình thành trong tương lai.
2. Giao dịch về nhà ở sau đây thì nhà ở không bắt buộc phải có Giấy chứng nhận:
a) Mua bán, thế chấp nhà ở hình thành trong tương lai;
b) Tổ chức thực hiện tặng cho nhà tình nghĩa, nhà tình thương;
c) Mua bán, thuê mua nhà ở thuộc sở hữu nhà nước; mua bán, thuê mua nhà ở xã hội, nhà ở để phục vụ tái định cư không thuộc sở hữu nhà nước; bán nhà ở quy định tại khoản 4 Điều 62 của Luật này;
d) Cho thuê, cho mượn, cho ở nhờ, ủy quyền quản lý nhà ở;
đ) Nhận thừa kế nhà ở;
e) Chuyển nhượng hợp đồng mua bán nhà ở thương mại được xây dựng trong dự án đầu tư xây dựng nhà ở bao gồm cả trường hợp đã nhận bàn giao nhà ở từ chủ đầu tư nhưng chưa nộp hồ sơ đề nghị cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận đối với nhà ở đó.
Các giấy tờ chứng minh điều kiện nhà ở tham gia giao dịch quy định tại khoản này thực hiện theo quy định của Chính phủ.
3. Trường hợp nhà ở cho thuê thì ngoài các điều kiện quy định tại các điểm b, c và d khoản 1 Điều này, nhà ở còn phải bảo đảm chất lượng, an toàn cho bên thuê nhà ở, có đầy đủ hệ thống điện, cấp, thoát nước, bảo đảm vệ sinh môi trường.
Điều 119. Điều kiện của các bên tham gia giao dịch về nhà ở
1. Bên bán, cho thuê, cho thuê mua nhà ở, chuyển nhượng hợp đồng mua bán nhà ở thương mại, tặng cho, đổi, để thừa kế, thế chấp, góp vốn, cho mượn, cho ở nhờ, ủy quyền quản lý nhà ở phải có điều kiện sau đây:
a) Là chủ sở hữu nhà ở hoặc người được chủ sở hữu cho phép, ủy quyền để thực hiện giao dịch về nhà ở theo quy định của Luật này và pháp luật về dân sự; trường hợp chuyển nhượng hợp đồng mua bán nhà ở thương mại thì phải là người đã mua nhà ở của chủ đầu tư hoặc người đã nhận chuyển nhượng hợp đồng mua bán nhà ở;
b) Nếu là cá nhân thì phải có đầy đủ năng lực hành vi dân sự để thực hiện giao dịch về nhà ở theo quy định của pháp luật dân sự; nếu là tổ chức thì phải có tư cách pháp nhân, trừ trường hợp tổ chức tặng cho nhà tình nghĩa, nhà tình thương.
2. Bên mua, thuê, thuê mua nhà ở, bên nhận chuyển nhượng hợp đồng mua bán nhà ở thương mại, nhận đổi, nhận tặng cho, nhận thừa kế, nhận góp vốn, nhận thế chấp, mượn, ở nhờ, được ủy quyền quản lý nhà ở là cá nhân thì phải có điều kiện sau đây:
a) Nếu là cá nhân trong nước thì phải có đủ năng lực hành vi dân sự để thực hiện các giao dịch về nhà ở theo quy định của pháp luật dân sự và không bắt buộc phải có đăng ký thường trú tại nơi có nhà ở được giao dịch;
b) Nếu là cá nhân nước ngoài, người Việt Nam định cư ở nước ngoài thì phải có đủ năng lực hành vi dân sự để thực hiện giao dịch về nhà ở theo quy định của pháp luật Việt Nam, phải thuộc đối tượng được sở hữu nhà ở tại Việt Nam theo quy định của Luật này và không bắt buộc phải có đăng ký tạm trú hoặc đăng ký thường trú tại nơi có nhà ở được giao dịch.
3. Bên mua, thuê, thuê mua nhà ở, bên nhận chuyển nhượng hợp đồng mua bán nhà ở thương mại, nhận đổi, nhận tặng cho, nhận thừa kế, nhận thế chấp, nhận góp vốn, được ủy quyền quản lý nhà ở là tổ chức thì phải có tư cách pháp nhân và không phụ thuộc vào nơi đăng ký kinh doanh, nơi thành lập; trường hợp là tổ chức nước ngoài thì phải thuộc đối tượng được sở hữu nhà ở tại Việt Nam theo quy định của Luật này; nếu tổ chức được ủy quyền quản lý nhà ở thì phải có chức năng kinh doanh dịch vụ bất động sản và đang hoạt động tại Việt Nam theo quy định của pháp luật về kinh doanh bất động sản.
Điều 120. Trình tự, thủ tục thực hiện giao dịch về nhà ở
1. Các bên tham gia giao dịch nhà ở thỏa thuận lập hợp đồng mua bán, cho thuê, thuê mua, tặng cho, đổi, thế chấp, góp vốn, cho mượn, cho ở nhờ, ủy quyền quản lý nhà ở hoặc văn bản chuyển nhượng hợp đồng mua bán nhà ở thương mại (sau đây gọi chung là hợp đồng về nhà ở) có các nội dung quy định tại Điều 121 của Luật này; trường hợp tổ chức tặng cho nhà tình nghĩa, nhà tình thương thì chỉ cần lập văn bản tặng cho.
2. Các bên thỏa thuận để một bên thực hiện nộp hồ sơ đề nghị cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận đối với nhà ở đó; trường hợp mua, thuê mua nhà ở của chủ đầu tư dự án thì chủ đầu tư có trách nhiệm làm thủ tục để cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận cho bên mua, bên thuê mua, trừ trường hợp bên mua, bên thuê mua tự nguyện làm thủ tục đề nghị cấp Giấy chứng nhận.
3. Cơ quan nhà nước có thẩm quyền khi thực hiện cấp Giấy chứng nhận cho bên mua, bên thuê mua, bên nhận tặng cho, nhận đổi, nhận góp vốn, nhận thừa kế nhà ở cùng với nhận chuyển quyền sử dụng đất ở hợp pháp có nhà ở đó thì đồng thời công nhận quyền sở hữu nhà ở và quyền sử dụng đất ở cho bên nhận quyền sở hữu nhà ở.
Điều 121. Hợp đồng về nhà ở
Hợp đồng về nhà ở do các bên thỏa thuận và phải được lập thành văn bản bao gồm các nội dung sau đây:
1. Họ và tên của cá nhân, tên của tổ chức và địa chỉ của các bên;
2. Mô tả đặc điểm của nhà ở giao dịch và đặc điểm của thửa đất ở gắn với nhà ở đó. Đối với hợp đồng mua bán, hợp đồng thuê mua căn hộ chung cư thì các bên phải ghi rõ phần sở hữu chung, sử dụng chung; diện tích sử dụng thuộc quyền sở hữu riêng; diện tích sàn xây dựng căn hộ; mục đích sử dụng của phần sở hữu chung, sử dụng chung trong nhà chung cư theo đúng mục đích thiết kế đã được phê duyệt ban đầu;
3. Giá trị góp vốn, giá giao dịch nhà ở nếu hợp đồng có thỏa thuận về giá; trường hợp mua bán, cho thuê, cho thuê mua nhà ở mà Nhà nước có quy định về giá thì các bên phải thực hiện theo quy định đó;
4. Thời hạn và phương thức thanh toán tiền nếu là trường hợp mua bán, cho thuê, cho thuê mua, chuyển nhượng hợp đồng mua bán nhà ở;
5. Thời gian giao nhận nhà ở; thời gian bảo hành nhà ở nếu là mua, thuê mua nhà ở được đầu tư xây dựng mới; thời hạn cho thuê, cho thuê mua, thế chấp, cho mượn, cho ở nhờ, ủy quyền quản lý nhà ở; thời hạn góp vốn;
6. Quyền và nghĩa vụ của các bên;
7. Cam kết của các bên;
8. Các thỏa thuận khác;
9. Thời điểm có hiệu lực của hợp đồng;
10. Ngày, tháng, năm ký kết hợp đồng;
11. Chữ ký và ghi rõ họ, tên của các bên, nếu là tổ chức thì phải đóng dấu (nếu có) và ghi rõ chức vụ của người ký.
Điều 122. Công chứng, chứng thực hợp đồng và thời điểm có hiệu lực của hợp đồng về nhà ở
1. Trường hợp mua bán, tặng cho, đổi, góp vốn, thế chấp nhà ở, chuyển nhượng hợp đồng mua bán nhà ở thương mại thì phải thực hiện công chứng, chứng thực hợp đồng, trừ trường hợp quy định tại khoản 2 Điều này.
Đối với các giao dịch quy định tại khoản này thì thời điểm có hiệu lực của hợp đồng là thời điểm công chứng, chứng thực hợp đồng.
2. Đối với trường hợp tổ chức tặng cho nhà tình nghĩa, nhà tình thương; mua bán, cho thuê mua nhà ở thuộc sở hữu nhà nước; mua bán, cho thuê mua nhà ở xã hội, nhà ở phục vụ tái định cư; góp vốn bằng nhà ở mà có một bên là tổ chức; cho thuê, cho mượn, cho ở nhờ, ủy quyền quản lý nhà ở thì không bắt buộc phải công chứng, chứng thực hợp đồng, trừ trường hợp các bên có nhu cầu.
Đối với các giao dịch quy định tại khoản này thì thời điểm có hiệu lực của hợp đồng là do các bên thỏa thuận; trường hợp các bên không có thỏa thuận thì thời điểm có hiệu lực của hợp đồng là thời điểm ký kết hợp đồng.
3. Văn bản thừa kế nhà ở được công chứng hoặc chứng thực theo quy định của pháp luật về dân sự.
4. Việc công chứng hợp đồng về nhà ở được thực hiện tại tổ chức hành nghề công chứng; việc chứng thực hợp đồng về nhà ở được thực hiện tại Ủy ban nhân dân cấp xã nơi có nhà ở.
Mục 2
MUA BÁN NHÀ Ở, CHUYỂN NHƯỢNG
HỢP ĐỒNG MUA BÁN NHÀ Ở
Điều 123. Giao dịch mua bán nhà ở, chuyển nhượng hợp đồng mua bán nhà ở thương mại
1. Việc mua bán nhà ở phải được lập thành hợp đồng có các nội dung quy định tại Điều 121 của Luật này. Các bên có thể thỏa thuận về việc bên bán thực hiện bán nhà ở, chuyển nhượng quyền sử dụng đất ở gắn với nhà ở đó trong một thời hạn nhất định cho bên mua theo quy định của Chính phủ.
2. Trường hợp bên mua nhà ở thương mại của chủ đầu tư nếu thuộc diện chưa nộp hồ sơ đề nghị cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận đối với nhà ở đó và có nhu cầu thì được chuyển nhượng hợp đồng mua bán nhà ở; bên nhận chuyển nhượng hợp đồng có trách nhiệm thực hiện đầy đủ nghĩa vụ theo hợp đồng mua bán nhà ở đã ký với chủ đầu tư.
Trình tự, thủ tục chuyển nhượng, nội dung và mẫu văn bản chuyển nhượng hợp đồng mua bán nhà ở được thực hiện theo quy định của Bộ trưởng Bộ Xây dựng; bên chuyển nhượng hợp đồng phải nộp thuế, lệ phí theo quy định của pháp luật về thuế, lệ phí.
Điều 124. Giá mua bán nhà ở, giá chuyển nhượng hợp đồng mua bán nhà ở thương mại
Giá mua bán nhà ở, giá chuyển nhượng hợp đồng mua bán nhà ở do các bên thỏa thuận và được ghi rõ trong hợp đồng mua bán nhà ở, văn bản chuyển nhượng hợp đồng mua bán nhà ở; trường hợp Nhà nước có quy định về giá mua bán nhà ở thì các bên phải thực hiện theo quy định đó.
Điều 125. Mua bán nhà ở trả chậm, trả dần
1. Việc mua bán nhà ở trả chậm, trả dần do các bên thỏa thuận và được ghi rõ trong hợp đồng mua bán nhà ở; trong thời gian trả chậm, trả dần, bên mua nhà ở được quyền sử dụng nhà ở và có trách nhiệm bảo trì nhà ở đó, trừ trường hợp nhà ở còn trong thời hạn bảo hành theo quy định của Luật này hoặc các bên có thỏa thuận khác.
2. Bên mua nhà ở trả chậm, trả dần chỉ được thực hiện các giao dịch mua bán, tặng cho, đổi, thế chấp, góp vốn nhà ở này với người khác sau khi đã thanh toán đủ tiền mua nhà ở, trừ trường hợp các bên có thỏa thuận khác.
Trường hợp trong thời hạn trả chậm, trả dần mà bên mua nhà ở chết thì người thừa kế hợp pháp được thực hiện tiếp các quyền, nghĩa vụ của bên mua nhà ở và được cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận sau khi người thừa kế đã trả đủ tiền mua nhà cho bên bán.
3. Trường hợp bên mua nhà ở có nhu cầu trả lại nhà ở đã mua trong thời gian trả chậm, trả dần và được bên bán nhà ở đồng ý thì hai bên thỏa thuận phương thức trả lại nhà ở và việc thanh toán lại tiền mua nhà ở đó.
Điều 126. Mua bán nhà ở thuộc sở hữu chung
1. Việc bán nhà ở thuộc sở hữu chung phải có sự đồng ý của tất cả các chủ sở hữu; trường hợp có chủ sở hữu chung không đồng ý bán thì các chủ sở hữu chung khác có quyền yêu cầu Tòa án giải quyết theo quy định của pháp luật. Các chủ sở hữu chung được quyền ưu tiên mua, nếu các chủ sở hữu chung không mua thì nhà ở đó được bán cho người khác.
Trường hợp có chủ sở hữu chung đã có tuyên bố mất tích của Tòa án thì các chủ sở hữu chung còn lại được quyền bán nhà ở đó; phần giá trị quyền sở hữu nhà ở của người bị tuyên bố mất tích được xử lý theo quy định của pháp luật.
2. Trường hợp chủ sở hữu chung bán phần quyền sở hữu của mình thì các chủ sở hữu chung khác được quyền ưu tiên mua; trong thời hạn 30 ngày, kể từ ngày nhận được thông báo về việc bán phần quyền sở hữu nhà ở và điều kiện bán mà không có chủ sở hữu chung nào mua thì phần quyền đó được bán cho người khác; trường hợp vi phạm quyền ưu tiên mua thì xử lý theo quy định của pháp luật về dân sự.
Điều 127. Mua bán nhà ở đang cho thuê
1. Trường hợp chủ sở hữu bán nhà ở đang cho thuê thì phải thông báo bằng văn bản cho bên thuê nhà ở biết về việc bán và các điều kiện bán nhà ở; bên thuê nhà ở được quyền ưu tiên mua nếu đã thanh toán đầy đủ tiền thuê nhà cho bên cho thuê tính đến thời điểm bên cho thuê có thông báo về việc bán nhà cho thuê, trừ trường hợp nhà ở thuộc sở hữu chung; trong thời hạn 30 ngày, kể từ ngày bên thuê nhà ở nhận được thông báo mà không mua thì chủ sở hữu nhà ở được quyền bán nhà ở đó cho người khác, trừ trường hợp các bên có thỏa thuận khác về thời hạn.
2. Trường hợp bán nhà ở đang cho thuê thuộc sở hữu nhà nước thì thực hiện theo quy định tại Mục 2 Chương VI của Luật này.
Điều 128. Mua trước nhà ở
Khi các bên đã ký kết hợp đồng mua bán nhà ở nhưng Nhà nước có nhu cầu mua nhà ở đó để sử dụng vào mục đích quốc phòng, an ninh, lợi ích quốc gia, lợi ích công cộng thì Chủ tịch Ủy ban nhân dân cấp tỉnh ban hành quyết định mua trước nhà ở đó. Giá mua bán, điều kiện và phương thức thanh toán tiền mua nhà ở được thực hiện theo thỏa thuận trong hợp đồng mua bán nhà ở mà các bên đã ký kết. Nhà nước bồi thường thiệt hại cho các bên (nếu có). Hợp đồng mua bán nhà ở do các bên đã ký kết không còn giá trị pháp lý.
Mục 3
CHO THUÊ NHÀ Ở
Điều 129. Thời hạn thuê và giá thuê nhà ở
1. Bên cho thuê và bên thuê nhà ở được thỏa thuận về thời hạn thuê, giá thuê và hình thức trả tiền thuê nhà theo định kỳ hoặc trả một lần; trường hợp Nhà nước có quy định về giá thuê nhà ở thì các bên phải thực hiện theo quy định đó.
2. Trường hợp chưa hết hạn hợp đồng thuê nhà ở mà bên cho thuê thực hiện cải tạo nhà ở và được bên thuê đồng ý thì bên cho thuê được quyền điều chỉnh giá thuê nhà ở. Giá thuê nhà ở mới do các bên thỏa thuận; trường hợp không thỏa thuận được thì bên cho thuê có quyền đơn phương chấm dứt hợp đồng thuê nhà ở và phải bồi thường cho bên thuê theo quy định của pháp luật.
3. Bên cho thuê và bên thuê nhà ở được Nhà nước bảo hộ các quyền và lợi ích hợp pháp trong quá trình thuê và cho thuê nhà ở.
Điều 130. Cho thuê nhà ở thuộc sở hữu chung
1. Việc cho thuê nhà ở thuộc sở hữu chung phải có sự đồng ý của tất cả các chủ sở hữu nhà ở đó, trừ trường hợp chủ sở hữu chung cho thuê phần nhà ở thuộc quyền sở hữu của mình.
2. Các chủ sở hữu chung có thể ủy quyền cho người đại diện ký hợp đồng thuê nhà ở.
Điều 131. Các trường hợp chấm dứt hợp đồng thuê nhà ở
1. Trường hợp thuê nhà ở thuộc sở hữu nhà nước thì việc chấm dứt hợp đồng thuê nhà được thực hiện khi có một trong các trường hợp quy định tại khoản 1 Điều 84 của Luật này.
2. Trường hợp thuê nhà ở không thuộc sở hữu nhà nước thì việc chấm dứt hợp đồng thuê nhà ở được thực hiện khi có một trong các trường hợp sau đây:
a) Hợp đồng thuê nhà ở hết hạn; trường hợp trong hợp đồng không xác định thời hạn thì hợp đồng chấm dứt sau 90 ngày, kể từ ngày bên cho thuê nhà ở thông báo cho bên thuê nhà ở biết việc chấm dứt hợp đồng;
b) Hai bên thỏa thuận chấm dứt hợp đồng;
c) Nhà ở cho thuê không còn;
d) Bên thuê nhà ở chết hoặc có tuyên bố mất tích của Tòa án mà khi chết, mất tích không có ai đang cùng chung sống;
đ) Nhà ở cho thuê bị hư hỏng nặng, có nguy cơ sập đổ hoặc thuộc khu vực đã có quyết định thu hồi đất, giải tỏa nhà ở hoặc có quyết định phá dỡ của cơ quan nhà nước có thẩm quyền; nhà ở cho thuê thuộc diện bị Nhà nước trưng mua, trưng dụng để sử dụng vào các mục đích khác.
Bên cho thuê phải thông báo bằng văn bản cho bên thuê biết trước 30 ngày về việc chấm dứt hợp đồng thuê nhà ở quy định tại điểm này, trừ trường hợp các bên có thỏa thuận khác;
e) Chấm dứt theo quy định tại Điều 132 của Luật này.
Điều 132. Đơn phương chấm dứt thực hiện hợp đồng thuê nhà ở
1. Trong thời hạn thuê nhà ở theo thỏa thuận trong hợp đồng, bên cho thuê không được đơn phương chấm dứt hợp đồng thuê nhà và thu hồi nhà ở đang cho thuê, trừ các trường hợp quy định tại khoản 2 Điều này.
2. Bên cho thuê nhà ở có quyền đơn phương chấm dứt thực hiện hợp đồng thuê nhà và thu hồi nhà ở đang cho thuê khi thuộc một trong các trường hợp sau đây:
a) Bên cho thuê nhà ở thuộc sở hữu nhà nước, nhà ở xã hội cho thuê không đúng thẩm quyền, không đúng đối tượng, không đúng điều kiện theo quy định của Luật này;
b) Bên thuê không trả tiền thuê nhà ở theo thỏa thuận từ 03 tháng trở lên mà không có lý do chính đáng;
c) Bên thuê sử dụng nhà ở không đúng mục đích như đã thỏa thuận trong hợp đồng;
d) Bên thuê tự ý đục phá, cơi nới, cải tạo, phá dỡ nhà ở đang thuê;
đ) Bên thuê chuyển đổi, cho mượn, cho thuê lại nhà ở đang thuê mà không có sự đồng ý của bên cho thuê;
e) Bên thuê làm mất trật tự, vệ sinh môi trường, ảnh hưởng nghiêm trọng đến sinh hoạt của những người xung quanh đã được bên cho thuê nhà ở hoặc tổ trưởng tổ dân phố, trưởng thôn, làng, ấp, bản, buôn, phum, sóc lập biên bản đến lần thứ ba mà vẫn không khắc phục;
g) Thuộc trường hợp quy định tại khoản 2 Điều 129 của Luật này.
3. Bên thuê nhà ở có quyền đơn phương chấm dứt thực hiện hợp đồng thuê nhà ở khi bên cho thuê nhà ở có một trong các hành vi sau đây:
a) Không sửa chữa nhà ở khi có hư hỏng nặng;
b) Tăng giá thuê nhà ở bất hợp lý hoặc tăng giá thuê mà không thông báo cho bên thuê nhà ở biết trước theo thỏa thuận;
c) Khi quyền sử dụng nhà ở bị hạn chế do lợi ích của người thứ ba.
4. Bên đơn phương chấm dứt thực hiện hợp đồng thuê nhà ở phải thông báo cho bên kia biết trước ít nhất 30 ngày, trừ trường hợp các bên có thỏa thuận khác; nếu vi phạm quy định tại khoản này mà gây thiệt hại thì phải bồi thường theo quy định của pháp luật.
Điều 133. Quyền tiếp tục thuê nhà ở
1. Trường hợp chủ sở hữu nhà ở chết mà thời hạn thuê nhà ở vẫn còn thì bên thuê nhà ở được tiếp tục thuê đến hết hạn hợp đồng. Người thừa kế có trách nhiệm tiếp tục thực hiện hợp đồng thuê nhà ở đã ký kết trước đó, trừ trường hợp các bên có thỏa thuận khác. Trường hợp chủ sở hữu không có người thừa kế hợp pháp theo quy định của pháp luật thì nhà ở đó thuộc quyền sở hữu của Nhà nước và người đang thuê nhà ở được tiếp tục thuê theo quy định về quản lý, sử dụng nhà ở thuộc sở hữu nhà nước.
2. Trường hợp chủ sở hữu nhà ở chuyển quyền sở hữu nhà ở đang cho thuê cho người khác mà thời hạn thuê nhà ở vẫn còn thì bên thuê nhà ở được tiếp tục thuê đến hết hạn hợp đồng; chủ sở hữu nhà ở mới có trách nhiệm tiếp tục thực hiện hợp đồng thuê nhà ở đã ký kết trước đó, trừ trường hợp các bên có thỏa thuận khác.
3. Khi bên thuê nhà ở chết mà thời hạn thuê nhà ở vẫn còn thì người đang cùng sinh sống với bên thuê nhà ở được tiếp tục thuê đến hết hạn hợp đồng thuê nhà ở, trừ trường hợp thuê nhà ở công vụ hoặc các bên có thỏa thuận khác hoặc pháp luật có quy định khác.
Mục 4
THUÊ MUA NHÀ Ở XÃ HỘI
Điều 134. Thủ tục thuê mua nhà ở xã hội
1. Việc thuê mua nhà ở xã hội phải lập thành hợp đồng có các nội dung quy định tại Điều 121 của Luật này; trường hợp thuê mua nhà ở xã hội do các tổ chức, cá nhân đầu tư xây dựng thì hợp đồng thuê mua được ký kết giữa chủ đầu tư với bên thuê mua; trường hợp thuê mua nhà ở xã hội thuộc sở hữu nhà nước thì việc ký kết hợp đồng thuê mua được thực hiện theo quy định tại điểm a khoản 2 Điều 83 của Luật này.
2. Khi kết thúc thời hạn thuê mua nhà ở theo hợp đồng và bên thuê mua đã thanh toán hết tiền thuê mua theo thỏa thuận thì bên cho thuê mua phải làm thủ tục đề nghị cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận cho người thuê mua, trừ trường hợp bên thuê mua tự nguyện làm thủ tục đề nghị cấp Giấy chứng nhận.
Điều 135. Quyền và nghĩa vụ của bên thuê mua nhà ở xã hội
1. Bên thuê mua nhà ở xã hội phải thực hiện quy định tại Điều 62 của Luật này và các nghĩa vụ khác theo thỏa thuận trong hợp đồng thuê mua nhà ở.
Trường hợp chấm dứt hợp đồng thuê mua nhà ở mà bên thuê mua đã nhận bàn giao nhà ở thì bên thuê mua phải trả lại nhà ở này cho bên cho thuê mua; bên thuê mua được hoàn lại số tiền đã nộp lần đầu, trừ trường hợp quy định tại điểm e và điểm h khoản 1 Điều 84 và khoản 2 Điều 136 của Luật này.
2. Trường hợp bên thuê mua nhà ở chết thì giải quyết như sau:
a) Nếu có người thừa kế hợp pháp đang cùng sinh sống tại nhà ở đó thì người thừa kế hợp pháp đó được tiếp tục thuê mua nhà ở, trừ trường hợp người thừa kế hợp pháp tự nguyện trả lại nhà ở thuê mua;
b) Nếu có người thừa kế hợp pháp nhưng không cùng sinh sống tại nhà ở đó mà bên thuê mua nhà ở đã thực hiện được hai phần ba thời hạn thuê mua thì người thừa kế hợp pháp được thanh toán hết số tiền tương ứng với một phần ba thời hạn thuê mua còn lại và được cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận đối với nhà ở đó;
c) Nếu có người thừa kế hợp pháp nhưng không thuộc diện quy định tại điểm a và điểm b khoản này thì bên cho thuê mua được quyền thu hồi nhà ở và người thừa kế hợp pháp được hoàn trả số tiền mà bên thuê mua nhà ở đã nộp lần đầu có tính lãi suất theo quy định về lãi suất không kỳ hạn liên ngân hàng tại thời điểm hoàn trả;
d) Nếu không có người thừa kế hợp pháp thì số tiền thuê mua đã nộp lần đầu thuộc sở hữu của Nhà nước và bên cho thuê mua được thu hồi nhà ở thuê mua để ký hợp đồng thuê, thuê mua với đối tượng thuộc diện được thuê, thuê mua nhà ở xã hội theo quy định của Luật này.
Điều 136. Các trường hợp chấm dứt hợp đồng thuê mua và thu hồi nhà ở xã hội cho thuê mua
1. Trường hợp thuê mua nhà ở xã hội thuộc sở hữu nhà nước thì việc chấm dứt hợp đồng thuê mua và thu hồi nhà ở được thực hiện khi thuộc một trong các trường hợp quy định tại các điểm a, b, c, e, g và h khoản 1 Điều 84 của Luật này.
2. Trường hợp thuê mua nhà ở xã hội không thuộc sở hữu nhà nước thì bên cho thuê mua được chấm dứt hợp đồng thuê mua nhà ở, được thu hồi nhà ở đang cho thuê mua khi thuộc một trong các trường hợp sau đây:
a) Bên thuê mua tự ý cho thuê hoặc bán nhà ở thuê mua cho người khác trong thời hạn thuê mua;
b) Bên thuê mua không trả tiền thuê nhà từ 03 tháng trở lên mà không có lý do chính đáng;
c) Bên thuê mua tự ý đục phá, cơi nới, cải tạo, phá dỡ nhà ở thuê mua;
d) Bên thuê mua sử dụng nhà ở không đúng mục đích như đã thỏa thuận trong hợp đồng thuê mua;
đ) Thuộc trường hợp quy định tại điểm d khoản 2 Điều 135 của Luật này;
e) Các trường hợp khác theo thỏa thuận của các bên.
3. Bên thuê mua nhà ở xã hội không thuộc diện quy định tại khoản 1 Điều này được chấm dứt hợp đồng thuê mua theo thỏa thuận trong hợp đồng; trường hợp đã nhận bàn giao nhà ở thì phải trả lại nhà ở này cho bên cho thuê mua.
Mục 5: TẶNG CHO NHÀ Ở
Điều 137. Tặng cho nhà ở thuộc sở hữu chung
1. Trường hợp tặng cho nhà ở thuộc sở hữu chung hợp nhất thì phải được sự đồng ý bằng văn bản của tất cả các chủ sở hữu nhà ở thuộc sở hữu chung.
2. Trường hợp tặng cho nhà ở thuộc sở hữu chung theo phần thì chủ sở hữu chỉ được tặng cho phần nhà ở thuộc quyền sở hữu của mình và không được làm ảnh hưởng đến quyền và lợi ích hợp pháp của các chủ sở hữu nhà ở thuộc sở hữu chung khác. Sau khi nhận tặng cho phần sở hữu chung thì chủ sở hữu nhà ở mới không được làm ảnh hưởng đến các quyền và lợi ích hợp pháp của các chủ sở hữu chung khác.
Điều 138. Tặng cho nhà ở đang cho thuê
1. Chủ sở hữu nhà ở đang cho thuê phải thông báo bằng văn bản cho bên thuê nhà ở biết trước về việc tặng cho nhà ở.
2. Bên thuê nhà ở được tiếp tục thuê nhà ở đến hết hạn hợp đồng thuê nhà đã ký với bên tặng cho, trừ trường hợp các bên có thỏa thuận khác.
Mục 6: ĐỔI NHÀ Ở
Điều 139. Đổi nhà ở thuộc sở hữu chung
1. Việc đổi nhà ở thuộc sở hữu chung hợp nhất phải được sự đồng ý của tất cả các chủ sở hữu nhà ở thuộc sở hữu chung.
2. Trường hợp đổi nhà ở thuộc sở hữu chung theo phần thì chủ sở hữu nhà ở thuộc sở hữu chung chỉ được đổi phần nhà ở thuộc quyền sở hữu của mình và bảo đảm không làm ảnh hưởng đến quyền và lợi ích hợp pháp của các chủ sở hữu chung khác. Sau khi nhận đổi phần nhà ở thuộc sở hữu chung thì chủ sở hữu nhà ở mới không được làm ảnh hưởng đến các quyền và lợi ích hợp pháp của các chủ sở hữu chung khác.
Điều 140. Đổi nhà ở đang cho thuê
1. Chủ sở hữu nhà ở đang cho thuê phải thông báo bằng văn bản cho bên thuê nhà ở biết trước về việc đổi nhà ở.
2. Bên thuê nhà ở được tiếp tục thuê nhà ở đến hết hạn hợp đồng thuê nhà ở đã ký với chủ sở hữu nhà ở cũ, trừ trường hợp các bên có thỏa thuận khác
Điều 141. Thanh toán giá trị chênh lệch
Khi đổi nhà ở và chuyển quyền sở hữu nhà ở cho nhau, nếu có chênh lệch về giá trị nhà ở thì các bên đổi nhà ở phải thanh toán giá trị chênh lệch đó, trừ trường hợp các bên có thỏa thuận khác.
Mục 7: THỪA KẾ NHÀ Ở
Điều 142. Thừa kế nhà ở thuộc sở hữu chung hợp nhất
Nhà ở thuộc sở hữu chung hợp nhất mà người thừa kế là một hoặc các chủ sở hữu nhà ở thuộc sở hữu chung còn lại thì những người này được thừa kế nhà ở đó theo di chúc hoặc theo pháp luật; trường hợp có người thừa kế không phải là chủ sở hữu nhà ở thuộc sở hữu chung hợp nhất thì người thừa kế được thanh toán phần giá trị nhà ở mà họ được thừa kế, trừ trường hợp các bên có thỏa thuận khác.
Điều 143. Thừa kế nhà ở thuộc sở hữu chung theo phần
Nhà ở thuộc sở hữu chung theo phần thì phần nhà ở của người để lại thừa kế được chia cho những người thừa kế theo di chúc hoặc theo pháp luật; nếu nhà ở được bán để chia giá trị thì những người thừa kế được ưu tiên mua; nếu những người thừa kế không mua thì các chủ sở hữu nhà ở thuộc sở hữu chung khác được quyền ưu tiên mua phần thừa kế nhà ở đó và thanh toán cho những người thừa kế giá trị nhà ở đã mua.
Mục 8: THẾ CHẤP NHÀ Ở
Điều 144. Bên thế chấp và bên nhận thế chấp nhà ở
1. Chủ sở hữu nhà ở là tổ chức được thế chấp nhà ở tại tổ chức tín dụng đang hoạt động tại Việt Nam.
2. Chủ sở hữu nhà ở là cá nhân được thế chấp nhà ở tại tổ chức tín dụng, tổ chức kinh tế đang hoạt động tại Việt Nam hoặc cá nhân theo quy định của pháp luật.
Điều 145. Thế chấp nhà ở thuộc sở hữu chung
Việc thế chấp nhà ở thuộc sở hữu chung phải được sự đồng ý bằng văn bản của các chủ sở hữu nhà ở thuộc sở hữu chung, trừ trường hợp thế chấp nhà ở thuộc sở hữu chung theo phần. Các chủ sở hữu nhà ở thuộc sở hữu chung hợp nhất có trách nhiệm liên đới trong việc thực hiện nghĩa vụ của bên thế chấp nhà ở theo quy định của Bộ luật dân sự.
Điều 146. Thế chấp nhà ở đang cho thuê
1. Chủ sở hữu nhà ở có quyền thế chấp nhà ở đang cho thuê nhưng phải thông báo bằng văn bản cho bên thuê nhà ở biết trước về việc thế chấp. Bên thuê nhà ở được tiếp tục thuê đến hết hạn hợp đồng thuê nhà ở.
2. Trường hợp nhà ở đang thuê bị xử lý để thực hiện nghĩa vụ của bên thế chấp nhà ở thì bên thuê nhà ở được tiếp tục thuê đến hết hạn hợp đồng, trừ trường hợp bên thuê nhà ở vi phạm các quy định tại khoản 2 Điều 132 của Luật này hoặc các bên có thỏa thuận khác.
Điều 147. Thế chấp dự án đầu tư xây dựng nhà ở và thế chấp nhà ở hình thành trong tương lai
1. Chủ đầu tư dự án xây dựng nhà ở được thế chấp dự án hoặc nhà ở xây dựng trong dự án tại tổ chức tín dụng đang hoạt động tại Việt Nam để vay vốn cho việc đầu tư dự án hoặc xây dựng nhà ở đó; trường hợp chủ đầu tư đã thế chấp nhà ở mà có nhu cầu huy động vốn góp để phân chia nhà ở theo quy định của pháp luật về nhà ở hoặc có nhu cầu bán, cho thuê mua nhà ở đó thì phải giải chấp nhà ở này trước khi ký hợp đồng huy động vốn góp, hợp đồng mua bán, thuê mua nhà ở với khách hàng, trừ trường hợp được bên góp vốn, bên mua, thuê mua nhà ở và bên nhận thế chấp đồng ý.
Việc xác định nhà ở đã được giải chấp trước khi ký hợp đồng huy động vốn góp, hợp đồng mua bán, thuê mua nhà ở với khách hàng theo quy định tại khoản này được nêu rõ trong văn bản thông báo nhà ở đủ điều kiện được bán của cơ quan quản lý nhà ở cấp tỉnh nơi có nhà ở.
2. Tổ chức, cá nhân xây dựng nhà ở hình thành trong tương lai trên thửa đất ở hợp pháp của mình; tổ chức, cá nhân mua nhà ở hình thành trong tương lai trong dự án đầu tư xây dựng nhà ở của chủ đầu tư được thế chấp nhà ở này tại tổ chức tín dụng đang hoạt động tại Việt Nam để vay vốn phục vụ cho xây dựng nhà ở hoặc để mua chính nhà ở đó.
Điều 148. Điều kiện thế chấp dự án đầu tư xây dựng nhà ở và thế chấp nhà ở hình thành trong tương lai
1. Điều kiện thế chấp dự án đầu tư xây dựng nhà ở, thế chấp nhà ở hình thành trong tương lai được quy định như sau:
a) Trường hợp chủ đầu tư thế chấp một phần hoặc toàn bộ dự án đầu tư xây dựng nhà ở thì phải có hồ sơ dự án, có thiết kế kỹ thuật của dự án được phê duyệt và đã có Giấy chứng nhận hoặc quyết định giao đất, cho thuê đất của cơ quan nhà nước có thẩm quyền;
b) Trường hợp chủ đầu tư thế chấp nhà ở hình thành trong tương lai xây dựng trong dự án thì ngoài điều kiện quy định tại điểm a khoản này, nhà ở thế chấp phải thuộc diện đã xây dựng xong phần móng theo quy định của pháp luật về xây dựng và không nằm trong phần dự án hoặc toàn bộ dự án mà chủ đầu tư đã thế chấp theo quy định tại điểm a khoản này;
c) Trường hợp tổ chức, cá nhân thế chấp nhà ở quy định tại khoản 2 Điều 147 của Luật này thì phải có giấy tờ chứng nhận quyền sử dụng đất ở hợp pháp theo quy định của pháp luật về đất đai, Giấy phép xây dựng nếu thuộc diện phải có Giấy phép xây dựng.
Trường hợp người thế chấp nhà ở hình thành trong tương lai mua nhà ở của chủ đầu tư trong dự án đầu tư xây dựng nhà ở thì phải có hợp đồng mua bán nhà ở ký kết với chủ đầu tư, có văn bản chuyển nhượng hợp đồng mua bán nhà ở nếu là bên nhận chuyển nhượng hợp đồng mua bán nhà ở theo quy định, có giấy tờ chứng minh đã đóng tiền mua nhà ở cho chủ đầu tư theo tiến độ thỏa thuận trong hợp đồng mua bán và không thuộc diện đang có khiếu nại, khiếu kiện, tranh chấp về hợp đồng mua bán nhà ở hoặc về việc chuyển nhượng hợp đồng mua bán nhà ở này.
2. Việc thế chấp dự án đầu tư xây dựng nhà ở và thế chấp nhà ở hình thành trong tương lai chỉ được thực hiện theo quy định tại Luật này; các trường hợp thế chấp tài sản là dự án đầu tư xây dựng nhà ở hoặc nhà ở hình thành trong tương lai không đúng với quy định tại Luật này thì không có giá trị pháp lý.
Điều 149. Xử lý tài sản nhà ở, dự án đầu tư xây dựng nhà ở thế chấp
1. Việc xử lý tài sản thế chấp là nhà ở bao gồm cả xử lý thế chấp nhà ở hình thành trong tương lai được thực hiện theo quy định của Luật này, pháp luật về dân sự và pháp luật có liên quan.
2. Việc xử lý tài sản thế chấp là dự án đầu tư xây dựng nhà ở được thực hiện theo quy định của pháp luật về dân sự và pháp luật có liên quan; tổ chức, cá nhân nhận chuyển nhượng dự án phải có đủ điều kiện làm chủ đầu tư dự án theo quy định của Luật này và phải đăng ký với cơ quan nhà nước có thẩm quyền giao dự án theo quy định của pháp luật về kinh doanh bất động sản.
Mục 9: GÓP VỐN BẰNG NHÀ Ở
Điều 150. Điều kiện, thủ tục góp vốn bằng nhà ở
1. Chủ sở hữu nhà ở hoặc chủ đầu tư dự án xây dựng nhà ở thương mại có quyền góp vốn bằng nhà ở để tham gia hoạt động kinh doanh trong các lĩnh vực mà pháp luật không cấm kinh doanh tại nhà ở đó. Việc góp vốn bằng nhà ở phải thông qua hợp đồng có các nội dung theo quy định tại Điều 121 của Luật này.
2. Nhà ở đưa vào góp vốn phải là nhà ở có sẵn và đáp ứng đủ các điều kiện quy định tại khoản 1 Điều 118 của Luật này.
Điều 151. Góp vốn bằng nhà ở thuộc sở hữu chung
1. Việc góp vốn bằng nhà ở thuộc sở hữu chung phải được sự đồng ý của tất cả các chủ sở hữu chung.
2. Các chủ sở hữu nhà ở thuộc sở hữu chung cùng ký vào hợp đồng góp vốn bằng nhà ở hoặc có thể thỏa thuận bằng văn bản cử người đại diện ký hợp đồng góp vốn bằng nhà ở.
Điều 152. Góp vốn bằng nhà ở đang cho thuê
1. Chủ sở hữu nhà ở đang cho thuê phải thông báo bằng văn bản cho bên thuê nhà ở biết trước về việc góp vốn bằng nhà ở.
2. Bên thuê nhà ở được tiếp tục thuê nhà ở đến hết hạn hợp đồng thuê nhà đã ký với bên góp vốn, trừ trường hợp các bên có thỏa thuận khác.
Mục 10: CHO MƯỢN, CHO Ở NHỜ NHÀ Ở
Điều 153. Cho mượn, cho ở nhờ nhà ở thuộc sở hữu chung
1. Việc cho mượn, cho ở nhờ nhà ở thuộc sở hữu chung hợp nhất phải được sự đồng ý của tất cả các chủ sở hữu nhà ở đó; trường hợp chủ sở hữu nhà ở thuộc sở hữu chung theo phần thì có quyền cho mượn, cho ở nhờ thuộc phần sở hữu của mình nhưng không được làm ảnh hưởng đến quyền lợi của các chủ sở hữu chung khác. Bên cho mượn nhà ở có quyền đòi lại nhà ở, bên cho ở nhờ có quyền chấm dứt việc cho ở nhờ khi chấm dứt hợp đồng theo quy định tại Điều 154 của Luật này và theo thỏa thuận trong hợp đồng.
2. Các chủ sở hữu nhà ở thuộc sở hữu chung có thể ủy quyền cho người đại diện ký hợp đồng cho mượn, cho ở nhờ nhà ở.
Điều 154. Các trường hợp chấm dứt hợp đồng cho mượn, cho ở nhờ nhà ở
1. Thời hạn cho mượn, cho ở nhờ đã hết.
2. Nhà ở cho mượn, cho ở nhờ không còn.
3. Bên mượn, bên ở nhờ nhà ở chết hoặc mất tích theo tuyên bố của Tòa án.
4. Nhà ở cho mượn, cho ở nhờ có nguy cơ sập đổ hoặc thuộc diện đã có quyết định giải tỏa, phá dỡ hoặc thu hồi đất của cơ quan nhà nước có thẩm quyền.
5. Theo thỏa thuận của các bên.
Mục 11: ỦY QUYỀN QUẢN LÝ NHÀ Ở
Điều 155. Nội dung, phạm vi ủy quyền quản lý nhà ở
1. Ủy quyền quản lý nhà ở là việc chủ sở hữu nhà ở ủy quyền cho tổ chức, cá nhân khác thực hiện các quyền và nghĩa vụ của chủ sở hữu nhà ở trong việc quản lý, sử dụng nhà ở trong thời hạn được ủy quyền. Việc ủy quyền quản lý nhà ở chỉ được thực hiện đối với nhà ở có sẵn.
2. Nội dung, thời hạn ủy quyền quản lý, sử dụng nhà ở do các bên thỏa thuận và được ghi trong hợp đồng ủy quyền; nếu các bên không có thỏa thuận về thời hạn ủy quyền thì hợp đồng ủy quyền có hiệu lực 01 năm, kể từ ngày ký hợp đồng ủy quyền.
3. Bên ủy quyền quản lý nhà ở phải trả chi phí quản lý, trừ trường hợp các bên có thỏa thuận khác.
Điều 156. Ủy quyền quản lý nhà ở thuộc sở hữu chung
1. Việc ủy quyền quản lý nhà ở thuộc sở hữu chung hợp nhất phải được các chủ sở hữu nhà ở thuộc sở hữu chung đồng ý; trường hợp chủ sở hữu nhà ở thuộc sở hữu chung theo phần thì có quyền ủy quyền cho người khác quản lý phần quyền sở hữu của mình nhưng không được làm ảnh hưởng đến quyền lợi của các chủ sở hữu chung khác.
2. Chủ sở hữu nhà ở thuộc sở hữu chung có trách nhiệm thông báo cho chủ sở hữu khác biết việc ủy quyền quản lý nhà ở, trừ trường hợp người được ủy quyền quản lý nhà ở đồng thời là chủ sở hữu chung của nhà ở đó.
Điều 157. Các trường hợp chấm dứt hợp đồng ủy quyền quản lý nhà ở
1. Hợp đồng ủy quyền hết hạn.
2. Nội dung ủy quyền đã được thực hiện.
3. Nhà ở được ủy quyền quản lý không còn.
4. Bên ủy quyền hoặc bên được ủy quyền đơn phương chấm dứt hợp đồng ủy quyền quản lý nhà ở theo quy định tại Điều 158 của Luật này.
5. Bên ủy quyền hoặc bên được ủy quyền quản lý nhà ở chết.
6. Bên được ủy quyền quản lý nhà ở mất tích hoặc bị mất năng lực hành vi dân sự theo quyết định của Tòa án.
7. Theo thỏa thuận của các bên.
Điều 158. Đơn phương chấm dứt thực hiện hợp đồng ủy quyền quản lý nhà ở
1. Bên ủy quyền quản lý nhà ở đơn phương chấm dứt hợp đồng ủy quyền thuộc một trong các trường hợp sau đây:
a) Nếu việc ủy quyền có chi phí quản lý thì bên ủy quyền không phải báo trước cho bên được ủy quyền biết về việc đơn phương chấm dứt thực hiện hợp đồng ủy quyền nhưng phải thanh toán cho bên được ủy quyền chi phí quản lý tương ứng với công việc mà bên được ủy quyền đã thực hiện và phải bồi thường thiệt hại cho bên được ủy quyền;
b) Nếu việc ủy quyền không có chi phí quản lý thì bên ủy quyền phải thông báo cho bên được ủy quyền biết trước ít nhất 30 ngày về việc đơn phương chấm dứt thực hiện hợp đồng ủy quyền, trừ trường hợp các bên có thỏa thuận khác.
2. Bên được ủy quyền đơn phương chấm dứt hợp đồng ủy quyền thuộc một trong các trường hợp sau đây:
a) Nếu việc ủy quyền có chi phí quản lý thì không phải báo trước cho bên ủy quyền biết về việc đơn phương chấm dứt thực hiện hợp đồng ủy quyền nhưng phải bồi thường thiệt hại cho bên ủy quyền (nếu có);
b) Nếu việc ủy quyền không có chi phí quản lý thì phải thông báo cho bên ủy quyền biết trước ít nhất 30 ngày về việc đơn phương chấm dứt thực hiện hợp đồng ủy quyền, trừ trường hợp các bên có thỏa thuận khác.
3. Bên ủy quyền và bên được ủy quyền phải thông báo cho bên thứ ba có liên quan biết về việc đơn phương chấm dứt thực hiện hợp đồng ủy quyền quản lý nhà ở.
Chương IX
QUYỀN SỞ HỮU NHÀ Ở TẠI VIỆT NAM
CỦA TỔ CHỨC, CÁ NHÂN NƯỚC NGOÀI
Điều 159. Đối tượng được sở hữu nhà ở và hình thức sở hữu nhà ở tại Việt Nam của tổ chức, cá nhân nước ngoài
1. Đối tượng tổ chức, cá nhân nước ngoài được sở hữu nhà ở tại Việt Nam bao gồm:
a) Tổ chức, cá nhân nước ngoài đầu tư xây dựng nhà ở theo dự án tại Việt Nam theo quy định của Luật này và pháp luật có liên quan;
b) Doanh nghiệp có vốn đầu tư nước ngoài, chi nhánh, văn phòng đại diện của doanh nghiệp nước ngoài, quỹ đầu tư nước ngoài và chi nhánh ngân hàng nước ngoài đang hoạt động tại Việt Nam (sau đây gọi chung là tổ chức nước ngoài);
c) Cá nhân nước ngoài được phép nhập cảnh vào Việt Nam.
2. Tổ chức, cá nhân nước ngoài được sở hữu nhà ở tại Việt Nam thông qua các hình thức sau đây:
a) Đầu tư xây dựng nhà ở theo dự án tại Việt Nam theo quy định của Luật này và pháp luật có liên quan;
b) Mua, thuê mua, nhận tặng cho, nhận thừa kế nhà ở thương mại bao gồm căn hộ chung cư và nhà ở riêng lẻ trong dự án đầu tư xây dựng nhà ở, trừ khu vực bảo đảm quốc phòng, an ninh theo quy định của Chính phủ.
Điều 160. Điều kiện tổ chức, cá nhân nước ngoài được sở hữu nhà ở tại Việt Nam
1. Đối với tổ chức, cá nhân nước ngoài quy định tại điểm a khoản 1 Điều 159 của Luật này thì phải có Giấy chứng nhận đầu tư và có nhà ở được xây dựng trong dự án theo quy định của Luật này và pháp luật có liên quan.
2. Đối với tổ chức nước ngoài quy định tại điểm b khoản 1 Điều 159 của Luật này thì phải có Giấy chứng nhận đầu tư hoặc giấy tờ liên quan đến việc được phép hoạt động tại Việt Nam (sau đây gọi chung là Giấy chứng nhận đầu tư) do cơ quan nhà nước có thẩm quyền của Việt Nam cấp.
3. Đối với cá nhân nước ngoài quy định tại điểm c khoản 1 Điều 159 của Luật này thì phải được phép nhập cảnh vào Việt Nam và không thuộc diện được hưởng quyền ưu đãi, miễn trừ ngoại giao, lãnh sự theo quy định của pháp luật.
4. Chính phủ quy định chi tiết giấy tờ chứng minh đối tượng, điều kiện tổ chức, cá nhân nước ngoài thuộc diện được sở hữu nhà ở tại Việt Nam.
Điều 161. Quyền của chủ sở hữu nhà ở là tổ chức, cá nhân nước ngoài
1. Tổ chức, cá nhân nước ngoài quy định tại điểm a khoản 1 Điều 159 của Luật này được thực hiện các quyền của chủ sở hữu nhà ở theo quy định tại Điều 10 của Luật này; trường hợp xây dựng nhà ở trên đất thuê thì chỉ được quyền cho thuê nhà ở.
2. Tổ chức, cá nhân nước ngoài quy định tại điểm b và điểm c khoản 1 Điều 159 của Luật này có các quyền của chủ sở hữu nhà ở như công dân Việt Nam nhưng phải tuân thủ các quy định sau đây:
a) Chỉ được mua, thuê mua, nhận tặng cho, nhận thừa kế và sở hữu không quá 30% số lượng căn hộ trong một tòa nhà chung cư; nếu là nhà ở riêng lẻ bao gồm nhà biệt thự, nhà ở liền kề thì trên một khu vực có số dân tương đương một đơn vị hành chính cấp phường chỉ được mua, thuê mua, nhận tặng cho, nhận thừa kế và sở hữu không quá hai trăm năm mươi căn nhà.
Trường hợp trong một khu vực có số dân tương đương một đơn vị hành chính cấp phường mà có nhiều nhà chung cư hoặc đối với nhà ở riêng lẻ trên một tuyến phố thì Chính phủ quy định, cụ thể số lượng căn hộ, số lượng nhà ở riêng lẻ mà tổ chức, cá nhân nước ngoài được mua, thuê mua, nhận tặng cho, nhận thừa kế và sở hữu;
b) Trường hợp được tặng cho, được thừa kế nhà ở không thuộc diện quy định tại điểm b khoản 2 Điều 159 của Luật này hoặc vượt quá số lượng nhà ở quy định tại điểm a khoản này thì chỉ được hưởng giá trị của nhà ở đó;
c) Đối với cá nhân nước ngoài thì được sở hữu nhà ở theo thỏa thuận trong các giao dịch hợp đồng mua bán, thuê mua, tặng cho nhận thừa kế nhà ở nhưng tối đa không quá 50 năm, kể từ ngày được cấp Giấy chứng nhận và có thể được gia hạn thêm theo quy định của Chính phủ nếu có nhu cầu; thời hạn sở hữu nhà ở phải được ghi rõ trong Giấy chứng nhận.
Trường hợp cá nhân nước ngoài kết hôn với công dân Việt Nam hoặc kết hôn với người Việt Nam định cư ở nước ngoài thì được sở hữu nhà ở ổn định, lâu dài và có các quyền của chủ sở hữu nhà ở như công dân Việt Nam;
d) Đối với tổ chức nước ngoài thì được sở hữu nhà ở theo thỏa thuận trong các giao dịch hợp đồng mua bán, thuê mua, tặng cho, nhận thừa kế nhà ở nhưng tối đa không vượt quá thời hạn ghi trong Giấy chứng nhận đầu tư cấp cho tổ chức đó, bao gồm cả thời gian được gia hạn thêm; thời hạn sở hữu nhà ở được tính từ ngày tổ chức được cấp Giấy chứng nhận và được ghi rõ trong Giấy chứng nhận này;
đ) Trước khi hết hạn sở hữu nhà ở theo quy định của Luật này, chủ sở hữu có thể tặng cho hoặc bán nhà ở này cho các đối tượng thuộc diện được sở hữu nhà ở tại Việt Nam; nếu quá thời hạn được sở hữu nhà ở mà chủ sở hữu không thực hiện bán, tặng cho thì nhà ở đó thuộc sở hữu nhà nước.
Điều 162. Nghĩa vụ của chủ sở hữu nhà ở là tổ chức, cá nhân nước ngoài
1. Tổ chức, cá nhân nước ngoài quy định tại điểm a khoản 1 Điều 159 của Luật này có các nghĩa vụ của chủ sở hữu nhà ở theo quy định tại Điều 11 của Luật này.
2. Tổ chức, cá nhân nước ngoài quy định tại điểm b và điểm c khoản 1 Điều 159 của Luật này có các nghĩa vụ của chủ sở hữu nhà ở như công dân Việt Nam nhưng phải tuân thủ các quy định sau đây:
a) Đối với chủ sở hữu là cá nhân nước ngoài thì được cho thuê nhà ở để sử dụng vào các mục đích mà pháp luật không cấm nhưng trước khi cho thuê nhà ở, chủ sở hữu phải có văn bản thông báo về việc cho thuê nhà ở với cơ quan quản lý nhà ở cấp huyện nơi có nhà ở theo quy định của Bộ trưởng Bộ Xây dựng và phải nộp thuế từ hoạt động cho thuê nhà ở này theo quy định của pháp luật.
Trường hợp cá nhân nước ngoài kết hôn với công dân Việt Nam hoặc kết hôn với người Việt Nam định cư ở nước ngoài thì có các nghĩa vụ của chủ sở hữu nhà ở như công dân Việt Nam;
b) Đối với chủ sở hữu là tổ chức nước ngoài thì chỉ được sử dụng nhà ở để bố trí cho những người đang làm việc tại tổ chức đó ở, không được dùng nhà ở để cho thuê, làm văn phòng hoặc sử dụng vào mục đích khác;
c) Thực hiện thanh toán tiền mua, thuê mua nhà ở thông qua tổ chức tín dụng đang hoạt động tại Việt Nam.
Chương X
HỆ THỐNG THÔNG TIN VÀ CƠ SỞ DỮ LIỆU VỀ NHÀ Ở
Điều 163. Hệ thống thông tin về nhà ở
Hệ thống thông tin về nhà ở bao gồm:
1. Hạ tầng kỹ thuật công nghệ thông tin nhà ở;
2. Hệ thống phần mềm hệ điều hành, phần mềm hệ thống và phần mềm ứng dụng;
3. Cơ sở dữ liệu về nhà ở.
Điều 164. Cơ sở dữ liệu về nhà ở
1. Cơ sở dữ liệu về nhà ở phải được xây dựng và quản lý thống nhất từ trung ương đến địa phương, được kết nối với cơ sở dữ liệu và thông tin về đất đai.
2. Cơ sở dữ liệu về nhà ở bao gồm các nội dung sau đây:
a) Cơ sở dữ liệu về hệ thống các văn bản quy phạm pháp luật về nhà ở;
b) Cơ sở dữ liệu về phát triển nhà ở bao gồm chương trình, kế hoạch phát triển nhà ở, điều tra, thống kê về nhà ở, các thông tin cơ bản về dự án đầu tư xây dựng nhà ở, số lượng, loại nhà ở, diện tích nhà ở, diện tích đất để đầu tư xây dựng nhà ở;
c) Cơ sở dữ liệu về các biến động liên quan đến quá trình quản lý, sử dụng nhà ở;
d) Các cơ sở dữ liệu khác có liên quan về nhà ở.
3. Định kỳ 10 năm một lần, Chính phủ tổ chức điều tra, thống kê nhà ở cùng với tổng điều tra dân số trong cả nước. Giữa kỳ điều tra, thống kê dân số và nhà ở quốc gia, Chính phủ tổ chức điều tra, thống kê điểm về nhà ở làm cơ sở cho việc hoạch định chính sách về nhà ở.
4. Các chỉ tiêu thống kê cơ bản về nhà ở phải được đưa vào bộ chỉ tiêu thống kê chung của quốc gia.
5. Kinh phí điều tra, thống kê về nhà ở do ngân sách nhà nước bảo đảm.
Điều 165. Thẩm quyền, trách nhiệm xây dựng hệ thống thông tin và cơ sở dữ liệu nhà ở
1. Bộ Xây dựng có trách nhiệm xây dựng và quản lý, khai thác hệ thống thông tin, cơ sở dữ liệu nhà ở quốc gia; các Bộ, ngành và Ủy ban nhân dân cấp tỉnh có trách nhiệm phối hợp cung cấp dữ liệu về nhà ở để Bộ Xây dựng cập nhật vào hệ thống thông tin nhà ở quốc gia.
2. Ủy ban nhân dân cấp tỉnh có trách nhiệm tổ chức xây dựng, quản lý, khai thác hệ thống thông tin và cơ sở dữ liệu về nhà ở tại địa phương, bảo đảm công khai, thống nhất giữa thông tin về nhà ở và thông tin về đất ở gắn với nhà ở đó.
3. Nhà nước bố trí vốn ngân sách để đầu tư xây dựng hệ thống cơ sở dữ liệu, thông tin về nhà ở và việc vận hành, duy trì hệ thống cơ sở dữ liệu và thông tin về nhà ở; Bộ Xây dựng đề xuất Thủ tướng Chính phủ quyết định cấp vốn ngân sách cho việc xây dựng, quản lý, vận hành, duy trì hệ thống này.
4. Chính phủ quy định chi tiết việc xây dựng, cấu trúc cơ sở dữ liệu, các thông tin, chỉ tiêu thống kê và việc quản lý, vận hành, khai thác hệ thống cơ sở dữ liệu, thông tin về nhà ở.
Điều 166. Quản lý, khai thác thông tin và cơ sở dữ liệu nhà ở
1. Cơ sở dữ liệu về nhà ở phải được quản lý chặt chẽ, bảo đảm khai thác, sử dụng có hiệu quả, đúng mục đích.
2. Các thông tin trong cơ sở dữ liệu về nhà ở được cơ quan có thẩm quyền cung cấp có giá trị pháp lý như hồ sơ, văn bản giấy.
3. Cơ quan quản lý cơ sở dữ liệu, thông tin về nhà ở quy định tại khoản 4 Điều này phải tạo điều kiện thuận lợi cho tổ chức, cá nhân khi có nhu cầu khai thác, sử dụng thông tin nhà ở theo đúng trình tự, thủ tục quy định.
Tổ chức, cá nhân khi có nhu cầu thì được cung cấp thông tin về nhà ở và phải nộp kinh phí khai thác sử dụng thông tin theo quy định, trừ trường hợp cung cấp thông tin theo yêu cầu của cơ quan nhà nước có thẩm quyền để phục vụ cho công tác quản lý nhà nước, phục vụ hoạt động điều tra, xác minh, xử lý hành vi vi phạm pháp luật.
4. Bộ Xây dựng thống nhất quản lý hệ thống cơ sở dữ liệu và thông tin về nhà ở trên toàn quốc. Cơ quan quản lý nhà ở cấp tỉnh, cấp huyện thực hiện quản lý hệ thống cơ sở dữ liệu và thông tin về nhà ở trên địa bàn.
Chương XI
QUẢN LÝ NHÀ NƯỚC VỀ NHÀ Ở
Điều 167. Nội dung quản lý nhà nước về nhà ở
1. Xây dựng và chỉ đạo thực hiện các chiến lược, đề án, chương trình, kế hoạch phát triển, quản lý nhà ở.
2. Ban hành và tổ chức thực hiện văn bản pháp luật về nhà ở, cơ chế, chính sách cho phát triển và quản lý nhà ở.
3. Xây dựng và ban hành tiêu chuẩn, quy chuẩn kỹ thuật, phân loại nhà ở và quản lý chất lượng nhà ở.
4. Quyết định chủ trương đầu tư dự án xây dựng nhà ở; thẩm định, phê duyệt, điều chỉnh, đình chỉ thực hiện dự án đầu tư xây dựng nhà ở.
5. Quản lý hồ sơ nhà ở; quản lý quỹ nhà ở thuộc sở hữu nhà nước; quản lý các dự án đầu tư xây dựng nhà ở.
6. Điều tra, thống kê, xây dựng hệ thống cơ sở dữ liệu, thông tin về nhà ở, quản lý, vận hành, khai thác và cung cấp cơ sở dữ liệu, thông tin về nhà ở.
7. Nghiên cứu, ứng dụng khoa học, công nghệ, phổ biến kiến thức pháp luật trong lĩnh vực nhà ở.
8. Đào tạo, bồi dưỡng nguồn nhân lực phục vụ yêu cầu phát triển và quản lý nhà ở.
9. Quản lý các hoạt động dịch vụ công về nhà ở.
10. Công nhận cơ sở đào tạo, bồi dưỡng chuyên môn, nghiệp vụ quản lý vận hành nhà chung cư; cấp giấy chứng nhận hoàn thành khóa đào tạo về quản lý vận hành nhà chung cư; công nhận việc phân hạng nhà chung cư; cấp, thu hồi giấy chứng nhận đào tạo, bồi dưỡng kiến thức, chuyên môn, nghiệp vụ trong lĩnh vực nhà ở.
11. Hướng dẫn, đôn đốc, kiểm tra, thanh tra, giải quyết khiếu nại, tranh chấp, tố cáo và xử lý vi phạm trong lĩnh vực nhà ở.
12. Hợp tác quốc tế trong lĩnh vực nhà ở.
Điều 168. Xây dựng Chiến lược phát triển nhà ở quốc gia
1. Trên cơ sở chiến lược phát triển kinh tế - xã hội của đất nước trong từng giai đoạn, Bộ Xây dựng có trách nhiệm xây dựng và trình Thủ tướng Chính phủ phê duyệt Chiến lược phát triển nhà ở quốc gia cho từng thời kỳ.
2. Chiến lược phát triển nhà ở quốc gia bao gồm các nội dung sau đây:
a) Quan điểm phát triển nhà ở;
b) Mục tiêu phát triển nhà ở bao gồm diện tích nhà ở tối thiểu, diện tích nhà ở bình quân đầu người tại đô thị, nông thôn và toàn quốc; tỷ lệ phát triển các loại nhà ở; nhu cầu diện tích nhà ở xã hội cho các đối tượng có khó khăn về nhà ở;
c) Nhiệm vụ và giải pháp để phát triển nhà ở, trong đó xác định rõ các chương trình mục tiêu phát triển nhà ở cho từng nhóm đối tượng thuộc diện được hưởng chính sách nhà ở xã hội;
d) Trách nhiệm của cơ quan chức năng ở trung ương và Ủy ban nhân dân cấp tỉnh trong việc phát triển và quản lý nhà ở;
đ) Các nội dung khác có liên quan.
3. Các chỉ tiêu cơ bản về phát triển nhà ở trong Chiến lược phát triển nhà ở quốc gia bao gồm diện tích nhà ở bình quân đầu người; số lượng nhà ở; diện tích sàn nhà ở xây dựng mới; chất lượng nhà ở tại đô thị, nông thôn và toàn quốc; đối tượng có khó khăn về nhà ở được Nhà nước hỗ trợ về nhà ở phải được đưa vào nhiệm vụ phát triển kinh tế - xã hội của đất nước trong từng giai đoạn.
Điều 169. Thông qua, phê duyệt chương trình, kế hoạch phát triển nhà ở
1. Việc thông qua và phê duyệt chương trình, kế hoạch phát triển nhà ở của địa phương được thực hiện như sau:
a) Đối với thành phố trực thuộc trung ương thì Ủy ban nhân dân thành phố xây dựng chương trình phát triển nhà ở theo quy định tại Điều 15 của Luật này và gửi lấy ý kiến của Bộ Xây dựng trước khi trình Hội đồng nhân dân cùng cấp thông qua. Ủy ban nhân dân thành phố phê duyệt và triển khai thực hiện chương trình sau khi Hội đồng nhân dân cùng cấp thông qua.
Nội dung lấy ý kiến Bộ Xây dựng bao gồm quy hoạch, bố trí quỹ đất để xây dựng nhà ở và phương án giải quyết chỗ ở cho từng nhóm đối tượng; chỉ tiêu diện tích nhà ở bình quân đầu người; số lượng, diện tích, tỷ lệ các loại nhà ở cần đầu tư xây dựng; dự kiến các nguồn vốn đầu tư; các cơ chế ưu đãi để phát triển nhà ở; trách nhiệm của các cơ quan liên quan trong việc triển khai thực hiện chương trình phát triển nhà ở;
b) Đối với tỉnh thì Ủy ban nhân dân tỉnh tổ chức xây dựng chương trình phát triển nhà ở theo quy định tại Điều 15 của Luật này để trình Hội đồng nhân dân cùng cấp thông qua;
c) Trên cơ sở chương trình phát triển nhà ở đã được phê duyệt, Ủy ban nhân dân cấp tỉnh có trách nhiệm xây dựng và phê duyệt kế hoạch phát triển nhà ở của địa phương theo quy định tại Điều 15 của Luật này; trường hợp trong kế hoạch có sử dụng nguồn vốn ngân sách để phát triển nhà ở thì phải lấy ý kiến của Hội đồng nhân dân cùng cấp trước khi phê duyệt.
2. Trình tự, thủ tục xây dựng và nội dung chương trình, kế hoạch phát triển nhà ở của địa phương được thực hiện theo quy định của Chính phủ.
Điều 170. Quyết định chủ trương đầu tư dự án xây dựng nhà ở
1. Đối với dự án đầu tư xây dựng nhà ở để phục vụ tái định cư, nhà ở xã hội, nhà ở công vụ bằng vốn đầu tư công thì trước khi lập, phê duyệt dự án, việc quyết định chủ trương đầu tư dự án thực hiện theo quy định của Luật đầu tư công. Trường hợp dự án đầu tư bằng nguồn vốn trung ương thì phải có ý kiến thẩm định của Bộ Xây dựng; trường hợp dự án đầu tư bằng nguồn vốn địa phương thì phải có ý kiến thẩm định của cơ quan quản lý nhà ở cấp tỉnh.
2. Đối với dự án xây dựng nhà ở khác thuộc diện quyết định chủ trương đầu tư theo quy định của Luật đầu tư thì thực hiện theo quy định của Luật đầu tư. Đối với dự án không thuộc diện quyết định chủ trương đầu tư theo Luật đầu tư thì phải thực hiện chấp thuận chủ trương đầu tư theo quy định của Chính phủ.
Điều 171. Hồ sơ đề nghị chấp thuận chủ trương đầu tư dự án xây dựng nhà ở
1. Đối với trường hợp quy định tại khoản 1 Điều 170 của Luật này thì ngoài hồ sơ đề nghị chấp thuận chủ trương đầu tư theo quy định của Luật đầu tư công còn phải có thêm các giấy tờ quy định tại điểm a và điểm b khoản 2 Điều này.
2. Đối với trường hợp quyết định chủ trương đầu tư theo Luật đầu tư thì ngoài hồ sơ đề nghị chấp thuận chủ trương đầu tư theo quy định của Luật đầu tư còn phải có các giấy tờ sau đây:
a) Văn bản đề nghị chấp thuận chủ trương dự án xây dựng nhà ở, trong đó nêu rõ cơ sở pháp lý, các nội dung cần chấp thuận và lý do đề nghị chấp thuận;
b) Bản vẽ quy hoạch chi tiết khu vực có dự án đã được cơ quan nhà nước có thẩm quyền phê duyệt.
Điều 172. Nghiên cứu, ứng dụng khoa học, công nghệ và hợp tác quốc tế trong lĩnh vực nhà ở
1. Nhà nước có chính sách khuyến khích và tạo điều kiện cho việc nghiên cứu, ứng dụng khoa học, công nghệ và hợp tác quốc tế phục vụ yêu cầu phát triển và quản lý nhà ở.
2. Nhà nước hỗ trợ kinh phí cho việc ứng dụng công nghệ mới, vật liệu mới trong xây dựng nhà ở bảo đảm chất lượng, tiến độ, tiết kiệm năng lượng và giảm chi phí xây dựng.
Điều 173. Đào tạo, bồi dưỡng kiến thức, chuyên môn, nghiệp vụ về phát triển, quản lý nhà ở
1. Công chức, viên chức làm việc trong lĩnh vực quản lý, phát triển nhà ở của các cấp, ngành phải tham gia khóa đào tạo, bồi dưỡng chuyên môn, nghiệp vụ về phát triển, quản lý nhà ở. Đối với cá nhân tham gia quản lý, điều hành, làm việc trong đơn vị quản lý vận hành nhà chung cư thì phải tham dự khóa đào tạo, bồi dưỡng kiến thức về quản lý vận hành nhà chung cư và phải có Giấy chứng nhận hoàn thành khóa đào tạo theo quy định của Bộ trưởng Bộ Xây dựng.
2. Bộ trưởng Bộ Xây dựng quy định chương trình, nội dung đào tạo, bồi dưỡng chuyên môn, nghiệp vụ về phát triển, quản lý nhà ở cho công chức, viên chức làm việc trong lĩnh vực quản lý, phát triển nhà ở trên phạm vi cả nước.
Điều 174. Cơ quan quản lý nhà nước về nhà ở
1. Chính phủ thống nhất quản lý nhà nước về nhà ở trong phạm vi cả nước.
2. Bộ Xây dựng chịu trách nhiệm trước Chính phủ thực hiện thống nhất quản lý nhà nước về nhà ở trên phạm vi cả nước.
3. Các Bộ, ngành có liên quan trong phạm vi chức năng, nhiệm vụ, quyền hạn của mình thực hiện trách nhiệm quản lý nhà nước về nhà ở và phối hợp với Bộ Xây dựng để thực hiện các quy định của pháp luật về nhà ở.
4. Ủy ban nhân dân các cấp có trách nhiệm thực hiện quản lý nhà nước về nhà ở trên địa bàn theo quy định của Luật này và phân cấp của Chính phủ.
Điều 175. Trách nhiệm của Bộ Xây dựng
1. Chủ trì xây dựng và trình Chính phủ, Thủ tướng Chính phủ văn bản pháp luật, chiến lược, đề án, chương trình, kế hoạch phát triển nhà ở.
2. Ban hành và tổ chức thực hiện các văn bản pháp luật về nhà ở theo thẩm quyền; quy định tiêu chuẩn, quy chuẩn kỹ thuật, phân loại về nhà ở, phương pháp, cách thức xác định giá thuê, giá thuê mua, giá bán nhà ở xã hội, nhà ở để phục vụ tái định cư, nhà ở thuộc sở hữu nhà nước; quy định nội dung, mẫu hợp đồng mua bán, cho thuê, cho thuê mua nhà ở xã hội, nhà ở để phục vụ tái định cư, nhà ở thuộc sở hữu nhà nước.
3. Cho ý kiến về chương trình phát triển nhà ở của các thành phố trực thuộc trung ương; tổ chức thẩm định, trình Thủ tướng Chính phủ kế hoạch phát triển nhà ở công vụ của cơ quan trung ương, thẩm định chủ trương đầu tư dự án xây dựng nhà ở; điều chỉnh hoặc đình chỉ thực hiện dự án đầu tư xây dựng nhà ở không theo quy định của Luật này.
4. Quản lý nhà ở, lưu trữ hồ sơ nhà ở thuộc sở hữu nhà nước của cơ quan trung ương.
5. Điều tra, thống kê, xây dựng hệ thống cơ sở dữ liệu, thông tin về nhà ở quốc gia và tổ chức quản lý, vận hành, khai thác, cung cấp cơ sở dữ liệu, thông tin về nhà ở quốc gia.
6. Tổ chức nghiên cứu, ứng dụng khoa học, công nghệ, phổ biến kiến thức pháp luật trong lĩnh vực nhà ở.
7. Tổ chức đào tạo, bồi dưỡng chuyên môn, nghiệp vụ về phát triển và quản lý nhà ở; công nhận cơ sở đào tạo, bồi dưỡng chuyên môn, nghiệp vụ quản lý vận hành nhà chung cư; quy định việc cấp giấy chứng nhận hoàn thành khóa đào tạo về quản lý vận hành nhà chung cư; quy định và công nhận việc phân hạng nhà chung cư.
8. Hướng dẫn, đôn đốc, theo dõi, thanh tra, kiểm tra, giải quyết khiếu nại, tranh chấp, tố cáo và xử lý vi phạm trong lĩnh vực nhà ở.
9. Hợp tác quốc tế trong lĩnh vực nhà ở.
10. Thực hiện các nhiệm vụ khác trong lĩnh vực nhà ở được quy định trong Luật này hoặc được Chính phủ, Thủ tướng Chính phủ giao.
Điều 176. Thanh tra nhà ở
1. Thanh tra xây dựng thuộc Bộ Xây dựng, Sở Xây dựng thực hiện chức năng thanh tra hành chính và thanh tra chuyên ngành về nhà ở đối với tổ chức, hộ gia đình, cá nhân tham gia phát triển và quản lý, sử dụng nhà ở.
2. Thanh tra chuyên ngành về nhà ở bao gồm:
a) Thanh tra việc chấp hành pháp luật của tổ chức, hộ gia đình, cá nhân trong phát triển và quản lý, sử dụng nhà ở;
b) Phát hiện, ngăn chặn và xử lý theo thẩm quyền hoặc kiến nghị cơ quan nhà nước có thẩm quyền xử lý các vi phạm pháp luật về nhà ở.
3. Bộ Xây dựng chịu trách nhiệm chỉ đạo, tổ chức thực hiện thanh tra chuyên ngành về nhà ở trong phạm vi cả nước. Sở Xây dựng chịu trách nhiệm tổ chức thanh tra chuyên ngành về nhà ở tại địa phương.
4. Chính phủ quy định chi tiết Điều này.

GIẢI QUYẾT TRANH CHẤP, KHIẾU NẠI, TỐ CÁO VỀ NHÀ Ở
Điều 177. Giải quyết tranh chấp về nhà ở
1. Nhà nước khuyến khích các bên giải quyết tranh chấp về nhà ở thông qua hòa giải.
2. Tranh chấp về quyền sở hữu, quyền sử dụng nhà ở thuộc sở hữu của tổ chức, cá nhân, tranh chấp liên quan đến hợp đồng về nhà ở, hợp đồng quản lý vận hành nhà chung cư do Tòa án nhân dân giải quyết theo quy định của pháp luật.
3. Tranh chấp về quản lý, sử dụng nhà ở thuộc sở hữu nhà nước do Ủy ban nhân dân cấp tỉnh giải quyết đối với nhà ở được giao cho địa phương quản lý, Bộ Xây dựng giải quyết đối với nhà ở được giao cho cơ quan trung ương quản lý; trường hợp không đồng ý với quyết định của Ủy ban nhân dân cấp tỉnh hoặc Bộ Xây dựng thì có quyền khởi kiện tại Tòa án nhân dân theo quy định của pháp luật về tố tụng hành chính.
4. Tranh chấp về kinh phí quản lý vận hành nhà chung cư, quản lý, sử dụng kinh phí bảo trì phần sở hữu chung của nhà chung cư do Ủy ban nhân dân cấp tỉnh nơi có nhà ở đó giải quyết; trường hợp không đồng ý với quyết định của Ủy ban nhân dân cấp tỉnh thì có quyền khởi kiện tại Tòa án nhân dân theo quy định của pháp luật về tố tụng hành chính.
Điều 178. Khiếu nại, tố cáo và giải quyết khiếu nại, tố cáo về nhà ở
1. Việc khiếu nại, tố cáo và giải quyết khiếu nại, tố cáo liên quan đến phát triển và quản lý nhà ở được thực hiện theo quy định của Luật khiếu nại, Luật tố cáo.
2. Khi có quyết định giải quyết khiếu nại, tố cáo của cơ quan nhà nước có thẩm quyền về nhà ở hoặc bản án, quyết định của Tòa án đã có hiệu lực pháp luật thì các bên có liên quan phải thi hành các quyết định hoặc bản án đó.
Mục 2
XỬ LÝ VI PHẠM PHÁP LUẬT VỀ NHÀ Ở
Điều 179. Xử lý đối với người vi phạm pháp luật về nhà ở
1. Người có hành vi vi phạm pháp luật về nhà ở thì tùy theo tính chất, mức độ vi phạm mà bị xử lý hành chính hoặc bị truy cứu trách nhiệm hình sự theo quy định của pháp luật.
2. Người có hành vi vi phạm sau đây khi thi hành công vụ thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc bị truy cứu trách nhiệm hình sự:
a) Lợi dụng chức vụ, quyền hạn làm trái quy định của pháp luật trong việc quyết định chủ trương đầu tư dự án xây dựng nhà ở; thẩm định, phê duyệt dự án xây dựng nhà ở; quyết định, thẩm định giá bán, giá thuê, giá thuê mua nhà ở; thực hiện chính sách hỗ trợ về nhà ở; xác định nghĩa vụ tài chính về nhà ở; quản lý, cung cấp thông tin về nhà ở và quy định khác trong việc phát triển, quản lý, giao dịch về nhà ở quy định tại Luật này;
b) Thiếu trách nhiệm trong quản lý để xảy ra vi phạm pháp luật về nhà ở hoặc có hành vi vi phạm khác gây thiệt hại đến lợi ích của Nhà nước, quyền và lợi ích hợp pháp của tổ chức, hộ gia đình, cá nhân tham gia phát triển nhà ở, của chủ sở hữu nhà ở và người sử dụng hợp pháp nhà ở;
c) Vi phạm quy định về trình tự, thủ tục hành chính trong lĩnh vực nhà ở, quy định về báo cáo, thống kê trong phát triển và quản lý nhà ở.
3. Chính phủ quy định chi tiết Điều này.
Điều 180. Xử lý vi phạm pháp luật về nhà ở khi gây thiệt hại cho Nhà nước, tổ chức, hộ gia đình, cá nhân
Người có hành vi vi phạm pháp luật về nhà ở nếu gây thiệt hại đến lợi ích của Nhà nước, quyền và lợi ích hợp pháp của tổ chức, hộ gia đình, cá nhân thì ngoài việc bị xử lý theo quy định tại Điều 179 của Luật này còn phải bồi thường thiệt hại cho Nhà nước hoặc cho người bị thiệt hại.
Chương XIII
ĐIỀU KHOẢN THI HÀNH
Điều 181. Hiệu lực thi hành
1. Luật này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2015.
2. Luật nhà ở số 56/2005/QH11 đã được sửa đổi, bổ sung một số điều theo Luật số 34/2009/QH12 và Luật số 38/2009/QH12, Nghị quyết số 19/2008/QH12 của Quốc hội về thí điểm cho tổ chức, cá nhân nước ngoài mua và sở hữu nhà ở tại Việt Nam hết hiệu lực kể từ ngày Luật này có hiệu lực thi hành.
Điều 182. Điều khoản chuyển tiếp
1. Các dự án đầu tư xây dựng nhà ở được phê duyệt trước ngày Luật này có hiệu lực thì không phải thực hiện phê duyệt lại theo quy định của Luật này, trừ trường hợp thuộc diện phải điều chỉnh lại nội dung của dự án do Nhà nước điều chỉnh lại quy hoạch đã phê duyệt hoặc trường hợp phải dành diện tích đất trong dự án đầu tư xây dựng nhà ở thương mại để xây dựng nhà ở xã hội hoặc phải dành diện tích nhà ở xã hội để cho thuê theo quy định của Luật này.
Đối với dự án phát triển nhà ở xã hội không có trong chương trình, kế hoạch phát triển nhà ở của địa phương nhưng đã được chấp thuận chủ trương đầu tư dự án thì được tiếp tục thực hiện theo quy định của Luật này.
2. Trường hợp đã nhận bàn giao nhà ở thương mại từ chủ đầu tư nhưng đến ngày Luật này có hiệu lực mà chưa nộp hồ sơ đề nghị cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận đối với nhà ở đó thì được chuyển nhượng hợp đồng mua bán nhà ở theo quy định của Luật này.
3. Đối với nhà chung cư đã thành lập Ban quản trị trước ngày Luật này có hiệu lực thì các chủ sở hữu có thể tổ chức bầu lại Ban quản trị để hoạt động theo mô hình quy định tại Luật này hoặc giữ nguyên mô hình để hoạt động đến hết nhiệm kỳ của Ban quản trị.
4. Đối với trường hợp ký hợp đồng mua bán, hợp đồng thuê mua nhà ở trước ngày Luật này có hiệu lực mà các bên thỏa thuận về thời hạn bảo hành nhà ở, diện tích mua bán, thuê mua nhà ở khác với quy định của Luật này thì các bên tiếp tục thực hiện theo thỏa thuận trong hợp đồng đã ký hoặc thỏa thuận lại theo quy định của Luật này.
5. Chính phủ quy định chi tiết Điều này.
Điều 183. Quy định chi tiết
Chính phủ, cơ quan có thẩm quyền quy định chi tiết các điều, khoản được giao trong Luật.
Luật này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XIII, kỳ họp thứ 8 thông qua ngày 25 tháng 11 năm 2014./.
