DECREE

Regarding Officer Identification Cards of the Vietnam People's Army

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Officers of the Vietnam People's Army dated December 21, 1999;

The Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army dated June 3, 2008;

Upon the proposal of the Minister of National Defense,

DECREE:

PART I

GENERAL PROVISIONS

Article 1. Officer Identification Card of the Vietnam People's Army

1. The Officer Identification Card of the Vietnam People's Army (hereinafter referred to as the Officer Identification Card) shall only be issued to officers of the Vietnam People's Army who are currently serving on active duty.

2. The Officer Identification Card is issued for the following purposes:

a) To prove that the holder of the Officer Identification Card is an officer currently serving on active duty in the Vietnam People's Army;

b) To serve combat operations, protect the Socialist Republic of Vietnam, and perform civil transactions;

c) To serve the management of officers.

Article 2. Recipients of the Officer Identification Card

The Officer Identification Card shall be issued to individuals conferred with the rank of officer while on active duty, including graduates from officer training programs and those appointed to officer positions and conferred with the rank of officer.

Article 3. Reissuing, exchanging, and revoking the Officer Identification Card

1. The Officer Identification Card shall be reissued if lost, exchanged if damaged, expired, or when there is a change in:

a) Name, date of birth, ethnicity, place of permanent residence registration;

b) When promoted or demoted in rank among officers of the ranks of Lieutenant, Captain, and General.

2. The Officer Identification Card must be revoked when:

a) An officer exchanges their Officer Identification Card;

b) An officer ceases to serve on active duty; transfers to become a professional soldier or defense civil servant; or is disciplined with the revocation of their officer rank.

Chapter II

SPECIFIC PROVISIONS

Article 4. Format of the Officer Identification Card

1. Dimensions: 85.60 mm x 53.98 mm.

2. Presentation technique: There are three specified colors, red for General, brown for Captain, and blue for Lieutenant; both sides have frame borders and background patterns.

a) Front side: In the center is the National Emblem embossed with a diameter of 21mm, from top to bottom is the title "SOCIALIST REPUBLIC OF VIETNAM"; on the left is the Military Emblem with a diameter of 10mm, paired with pine branches; below is the photo of the cardholder and the expiration date; on the right of the Military Emblem is the text "OFFICER IDENTIFICATION CARD", from top to bottom are the lines for number, name; rank; issuing unit; date; signature and stamp of the authorized person issuing the card;

b) Back side, from top to bottom are the lines: date of birth, month, year; ethnicity; place of origin; place of residence; identification; blood group.

Article 5. Usage and Management of the Officer Identification Card

1. The Officer Identification Card shall be used in accordance with Article 1 of this Decree.

2. Officers are responsible for preserving and managing their Officer Identification Card; they shall not alter, rent, lend, damage, or misuse it.

3. Military agencies and units at all levels are responsible for managing the Officer Identification Card in accordance with Article 1 and Clause 2 of Article 3 of this Decree.

4. Strictly prohibited are the forgery, illegal retention, or use of the Officer Identification Card to impersonate an officer of the Vietnam People's Army. Individuals or organizations violating the usage and management of the Officer Identification Card will be subject to administrative penalties or criminal prosecution according to the provisions of the law depending on the severity of the violation.

Article 6. Responsibilities of agencies, organizations, and individuals in managing Officer Identification Cards

Clause 1. The Ministry of National Defense is responsible for producing the blanks of Officer Identification Cards and stipulating and guiding procedures and formalities for registration, issuance, replacement, and revocation of Officer Identification Cards in accordance with the provisions of the law.

Clause 2. When performing duties and engaging in civil transactions, officers must present their Officer Identification Cards to agencies, organizations, and individuals to facilitate the exercise of rights and fulfillment of obligations of officers as prescribed by law.

Clause 3. Agencies, organizations, and individuals have the responsibility and right to detect and report violations in the use and management of Officer Identification Cards to military units or competent state agencies.

Chapter III

IMPLEMENTING PROVISIONS

Article 7. Effective Date

This Decree shall take effect fifteen days from the date of publication in the Official Gazette;

Previous regulations concerning Officer Identification Cards that conflict with this Decree are hereby abolished.

Article 8. Responsibility for Implementation

Clause 1. The Minister of National Defense is responsible for guiding the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree./.
