Regarding the issuance of regulations on expenditures for welcoming, visiting, and congratulating certain subjects implemented by the Vietnam Fatherland Front Central Committee, provincial-level Vietnam Fatherland Front Committees, and district-level Vietnam Fatherland Front Committees
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on the Vietnam Fatherland Front dated June 12, 1999;
Pursuant to the Law on State Budget dated December 16, 2002;
Considering the proposal of the Minister of Finance,
DECISION:
Article 1. Scope and objects regulated
1. This Decision stipulates the regulations on expenditures for welcoming, visiting, and congratulating certain subjects implemented by the Vietnam Fatherland Front Central Committee; provincial-level Vietnam Fatherland Front Committees and city-level Vietnam Fatherland Front Committees under the central government; and district-level Vietnam Fatherland Front Committees.
2. The beneficiaries of these regulations include:
a) Individuals who visit and work with Vietnam Fatherland Front Committees at various levels or who are visited and congratulated by Vietnam Fatherland Front Committees at various levels, including:
- Revolutionary veterans, outstanding revolutionary fighters, and Mothers of Vietnam's Heroes;
- Religious dignitaries and individuals with significant influence among ethnic minorities who have made positive contributions to the construction and defense of the country and the consolidation of national solidarity;
- High-ranking leaders of the Party and State, and the Vietnam Fatherland Front;
- Senior leaders of the Party and State.
b) Delegations that visit and work with Vietnam Fatherland Front Committees at various levels, including:
- Delegations representing revolutionary veterans, revolutionary fighters, and Mothers of Vietnam's Heroes;
- Delegations representing ethnic minorities and religions that have made positive contributions to the construction and defense of the country and the consolidation of national solidarity;
- Delegations representing overseas Vietnamese with close ties and positive contributions to the construction and defense of the country and the consolidation of national solidarity.
Article 2. Sources of Funds
The financial resources to ensure the expenditures for welcoming, visiting, and congratulating mentioned above shall be provided by the budget of the respective level and included in the annual budget estimates of the Vietnam Fatherland Front Committees at various levels, specifically:
1. The central government budget allocates funds to support special activities of the Standing Office and the Executive Board of the Vietnam Fatherland Front Central Committee and balances within the annual budget estimate of the Vietnam Fatherland Front Central Committee.
2. Local government budgets allocate funds to support special activities and balance within the annual budget estimates of the Vietnam Fatherland Front Committees at the provincial and district levels according to the provisions of the State Budget Law.
Article 3. Content and amount of expenditure
Expenses for welcoming delegations and individuals visiting and working with the Fatherland Front Committees at all levels: Implemented according to the regulations of the Ministry of Finance on domestic guest reception expenditure.
Expenditures for welcoming delegations and individuals visiting and working with Vietnam Fatherland Front Committees at various levels. The expenditure limits are as follows:
- Social hospitality expenses: beverages, fruits, pastries, with a maximum limit not exceeding VND 50,000 per person per reception at the Vietnam Fatherland Front Central Committee; VND 30,000 per person per reception at provincial-level Vietnam Fatherland Front Committees; and VND 20,000 per person per reception at district-level Vietnam Fatherland Front Committees;
- In exceptional cases where a formal dinner invitation is necessary, it shall be carried out in accordance with the current regulations of the Ministry of Finance regarding domestic guest hospitality expenses.
2. Expenditures for gift-giving:
- Expenditures for commemorative gifts when welcoming delegations and individuals visiting and working with the Vietnam Fatherland Front Central Committee, provincial-level Vietnam Fatherland Front Committees, and district-level Vietnam Fatherland Front Committees:
Limit: not exceeding VND 300,000 per delegate visiting and working at the Vietnam Fatherland Front Central Committee; not exceeding VND 200,000 per delegate visiting and working at provincial-level Vietnam Fatherland Front Committees; and not exceeding VND 100,000 per delegate visiting and working at district-level Vietnam Fatherland Front Committees.
- Expenditures for birthday congratulations gifts for revolutionary veterans; Mothers of Vietnam's Heroes; religious dignitaries, and individuals with significant influence among ethnic minorities who have made positive contributions to the construction and defense of the country and the consolidation of national solidarity:
Limit: a maximum of not more than VND 200,000 per person.
- Expenditures for Tet holiday, festival, or major festival (the most solemn memorial day of each ethnic group or religious organization) congratulations gifts for revolutionary veterans, outstanding revolutionary fighters, Mothers of Vietnam's Heroes, religious dignitaries, and individuals with significant influence among ethnic minorities who have made positive contributions to the construction and defense of the country and the consolidation of national solidarity:
Limit: a maximum of not more than VND 400,000 per occasion given by the Vietnam Fatherland Front Central Committee; not more than VND 300,000 per occasion given by provincial-level Vietnam Fatherland Front Committees; and not more than VND 200,000 per occasion given by district-level Vietnam Fatherland Front Committees. The number of gift-giving occasions for Tet holidays, festivals, or major festivals in a year shall not exceed two times, and the Vietnam Fatherland Front Committees at various levels shall decide which festival to give gifts for in accordance with the characteristics of each subject.
3. Expenditures for illness慰问支出:
革命老前辈、优秀革命战士、越南英雄母亲;宗教领袖和在民族团结巩固工作中有突出贡献的少数民族中有威望的人士。
支出限额:中央级不超过每人每年200万越南盾;省级不超过每人每年100万越南盾;县级不超过每人每年50万越南盾。
特殊情况下,由有权机关决定慰问病患支出金额,但不得超过上述规定的两倍。
4. The expenditure limits specified in Clauses 1, 2, and 3 above are the maximum limits. Based on the budget capacity and actual conditions at the local level, the People's Committees of provinces and centrally-administered cities shall submit to their respective People's Councils for approval the expenditure limits for welcoming, visiting, and congratulating activities conducted by Vietnam Fatherland Front Committees at various levels; the Chairman of the Vietnam Fatherland Front Central Committee shall determine the expenditure limits for welcoming, visiting, and congratulating activities conducted by the Vietnam Fatherland Front Central Committee based on the allocated budget estimates.
Article 4. Preparation of budgets, execution, and settlement of funds
1. This Decision takes effect from February 5, 2013.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. This Decision takes effect from January 1, 2010.
2. The Minister of Finance, Chairpersons of the People's Committees of provinces and centrally-administered cities, and heads of relevant agencies are responsible for implementing this Decision./.
