DECREE
Regulations on decentralization and delegation in the field of statistics
On the basis of The Government Organization Law 2025;
On the basis of The Local Government Organization Law 2025;
Pursuant to Resolution No. Decision 190/2025/QH15 dated February 19, 2025 of the National Assembly regarding handling certain issues related to the restructuring of the state apparatus;
At the proposal of the Minister of Finance;
The Government promulgates this Decree to regulate decentralization and delegation in the field of statistics.
Article 1. Scope of Regulation
This Decree regulates the authorities in the field of statistics as prescribed in laws and decrees of the Government that need adjustment to implement decentralization and delegation.
Article 2. Principles of Delegation and Decentralization
1. Ensuring compliance with the Constitution; consistent with the principles and regulations on decentralization and delegation under the Law on the Organization of the Government and the Law on the Organization of Local Administration.
2. Ensuring thorough delegation of tasks between central state agencies and local authorities, ensuring the unified management authority of the Government, the executive power of the Prime Minister over the national administration in the field of statistics, and promoting the initiative, creativity, and accountability of local authorities in performing their administrative management tasks in the field of statistics.
3. Ensuring that the Government, the Prime Minister, ministries, and ministerial-level agencies focus on macro-level management tasks; building a coherent and unified institutional framework, strategy, planning, and maintaining a constructive role while strengthening inspection, supervision, and monitoring.
4. Promoting decentralization and delegation, clearly defining the authority of People's Councils, People's Committees, and Chairpersons of People's Committees; clearly distinguishing the general authority of People's Committees from the specific authority of Chairpersons of People's Committees; ensuring consistency with the responsibilities and capabilities of the agencies and individuals assigned such tasks.
5. Implementing decentralization and delegation among related sectors and fields in a comprehensive, integrated, and interconnected manner without omission or overlap of tasks; ensuring a legal basis for the normal, continuous, and smooth operation of agencies; preventing work interruptions, overlapping functions, tasks, areas, and jurisdictions.
6. Ensuring human rights and citizens' rights; ensuring transparency and creating favorable conditions for individuals and organizations to access information, exercise their rights and obligations, and follow procedures as stipulated by law; not affecting the normal activities of society, citizens, and businesses.
7. Ensuring that the implementation of international treaties and agreements to which the Socialist Republic of Vietnam is a party is not affected.
8. Resources for implementing delegated tasks shall be guaranteed by the State budget according to regulations.
Article 3. Delegation in the field of statistics
1. The decision to conduct a national census as provided for in point a, Clause 3, Article 28 of the Statistics Law shall be carried out by the Minister of Finance.
2. Adjustments and supplements to the national census as provided for in Clause 3, Article 29 of the Statistics Law shall be carried out by the Minister of Finance.
3. Assigning other agencies to carry out the national census as provided for in point b, Clause 2, Article 29 of the Statistics Law shall be carried out by the Minister of Finance.
Article 4. Delegation in the field of statistics
1. Issuing regulations on disseminating state statistical information of the centralized statistical system as provided for in Clause 4, Article 5 of Decree No. 94/2016/NĐ-CP dated July 1, 2016 detailing and guiding the implementation of certain provisions of the Statistics Law shall be carried out by the head of the national statistical agency.
2. The decision to conduct surveys assigned to the Ministry of Finance within the national survey program as provided for in point b, Clause 3, Article 28 of the Statistics Law shall be carried out by the head of the national statistical agency.
3. Organizing and coordinating advanced statistical method research and application activities in state statistical operations as provided for in Clause 3, Article 50 of the Statistics Law shall be carried out by the head of the national statistical agency.
Article 5. Effective Date
1. This Decree takes effect from July 1, 2025.
2. This Decree shall cease to be effective from March 1, 2027, except in the following cases:
a) Ministries and ministerial-level agencies report to the Government to propose and obtain the National Assembly's decision to extend the application period of this Decree in whole or in part;
b) Laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, resolutions of the Government, decisions of the Prime Minister that prescribe the authorities, responsibilities of state management, procedures, and formalities stipulated in this Decree are adopted or issued from July 1, 2025, take effect before March 1, 2027, and the corresponding provisions in this Decree become ineffective at the time these regulatory legal documents come into force.
3. During the period when the provisions of this Decree are effective, if the provisions on authorities, responsibilities of state management, procedures, and formalities in this Decree differ from those in related regulatory legal documents, they shall be implemented according to the provisions of this Decree./.
