THE MINISTER OF TRANSPORTATION
- Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government on tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport.
- Pursuant to Decree No. 24/2001/NĐ-CP dated May 30, 2001 of the Government amending and supplementing certain articles of the Regulation on Management of Maritime Activities at Seaports and Marine Areas in Vietnam promulgated together with Decree No. 13/CP dated May 25, 1994 of the Government;
- Considering the proposal of the Vietnam Maritime Administration at Circular No. 587/CHHVN-BCB dated May 9, 2002 and the People's Committee of Quang Nam Province at Circular No. 619/UB-KTTH dated April 16, 2002 regarding the announcement of Berth No. 2 at Ky Ha Port, Quang Nam Province.

Clause 4 of Article 6Now hereby announcing that Berth No. 2 at Ky Ha Port under the Quang Nam Provincial People's Committee is allowed to receive domestic and foreign vessels up to 6,600 DWT with appropriate draft according to the depth of the water area before the berth and the channel (as announced in maritime notices) for loading and unloading operations. The pilot station area has its center at coordinates: Latitude: 15° 29' 5" N; Longitude: 108° 41' 7" E and a radius of 0.5 nautical miles.
Article 2.
Article 1. The Da Nang Port Control Office shall be responsible for specialized state management over maritime activities at Berth No. 2 at Ky Ha Port and shall grant permission for vessels to enter and leave the port based on actual conditions such as channel depth, hydroelectric power plant conditions before the berth, and other safety assurance conditions for maritime activities.
Article 2. The Da Nang Port Control Office shall collect the following fees:
- Tonnage fee;
- Safety assurance fee;
- Anchorage fee in bays and harbors;
- Administrative fee;
- Other types of charges if the Da Nang Port Control Office directly implements them.
Article 3.The Director of Ky Ha Port shall be responsible for organizing business operations and exploiting Berth No. 2 at Ky Ha Port safely and in accordance with its purpose and shall collect the following fees:
Port fee;
- Loading and unloading charges;
- Other types of charges if Ky Ha Port complies with the provisions of the law.
Article 4.
1. This Decision takes effect from the date of signing.
Article 2. The Heads of the Ministry’s Office, the Department of Legal Affairs - Transportation, the Director General of the Vietnam Maritime Administration, the Heads of relevant agencies, units, and organizations and individuals shall be responsible for implementing this Decision.
