Providing detailed regulations on certain provisions of Decision No. 25/2016/QĐ-TTg dated June 27, 2016 of the Prime Minister regarding the issuance of the management regulation for the activities of the international port of Cam Ranh - Ministry of National DefenseManagement of the international port of Cam Ranh - Ministry of National Defense

Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Pursuant to Decision No. 25/2016/QĐ-TTg dated June 27, 2016 of the Prime Minister regarding the issuance of the management regulation for the activities of the International Port of Cam Ranh - Ministry of National Defense;

At the proposal of the Chief of General Staff;

The Minister of National Defense issues this Circular providing detailed regulations on certain provisions of Decision No. 25/2016/QĐ-TTg dated June 27, 2016 of the Prime Minister regarding the issuance of the management regulation for the activities of the International Port of Cam Ranh - Ministry of National Defense.

Article 1. Scope of Regulation

This Circular stipulates detailed regulations on the scope of land and water areas of the International Port of Cam Ranh - Ministry of National Defense (hereinafter referred to as the International Port of Cam Ranh); organization and management of activities of military vessels of Vietnam in the water area of the International Port of Cam Ranh.

Article 2. Applicability

This Circular applies to military vessels of Vietnam operating in the water area of the International Port of Cam Ranh, relevant agencies, units, organizations, and individuals involved in the management, exploitation, and utilization of services at the International Port of Cam Ranh.

Article 3. Scope of Land and Water Areas of the International Port of Cam Ranh

The boundary is limited by straight lines connecting points in the following order: TCPC-1, TCPC-2, TCPC-3, TCPC-4, and from point TCPC-4 running along the shoreline back to point TCPC-1, with the following coordinates:

Article 4. Military Vessels of Vietnam Entering and Departing the Water Area of the International Port of Cam Ranh

1. At least 24 (twenty-four) hours before military vessels of Vietnam arrive at the International Port of Cam Ranh, the agency or unit owning the vessel must coordinate with Company Tan Cang - Petro Cam Ranh regarding the vessel's identification number, purpose of arrival, time of arrival, and duration of stay at the Port. Company Tan Cang - Petro Cam Ranh is responsible for arranging and assigning berthing positions for the vessels; within 12 hours from receiving the coordination information, if the position is not accepted, they must clearly inform the agency or unit owning the vessel of the reason.

2. Reporting of Military Vessels of Vietnam Arriving at the International Port of Cam Ranh

At least 02 (two) hours before the vessel is expected to reach the pilot station, the person handling procedures must report accurately to the Port Authority of the International Port of Cam Ranh (hereinafter referred to as the Port Authority) the time the vessel will arrive at the Port.

3. Issuing Permits for Military Vessels of Vietnam Entering the International Port of Cam Ranh

a) Within 02 (two) hours from receiving the report that the vessel has reached the pilot station, the Port Authority is responsible for designating a berthing position for the vessel within the Port.

b) Based on the type of vessel, cargo, wharf, and the Port's plan, the Port Authority reports to the General Director of Company Tan Cang - Petro Cam Ranh to issue a permit for entering the International Port of Cam Ranh according to Model No. 01 attached to this Circular. The Port Authority informs the vessel of the permit issuance through VHF radio, telephone, or other appropriate communication means.

4. Documents Required for Procedures for Military Vessels of Vietnam Entering the International Port of Cam Ranh

After berthing at the International Port of Cam Ranh, the person handling procedures is responsible for presenting to the Port Authority the original copies of the following documents:

a) Orders and plans for executing tasks approved by competent authorities;

b) Vessel registration certificate and inspection logbook corresponding to the registration number according to the unit's designation;

c) Safety technical certification;

d) Technical inspection report;

đ) Professional certificates corresponding to the position;

e) Crew list or decision on the list of officers and soldiers participating in the vessel's operation, passenger list (if applicable);

g) Officer identification card, Military Identification Card, Identity Card, Passport, Citizen Identity Card (when required);

h) Documents related to cargo (if applicable).

5. Reporting of Military Vessels of Vietnam Departing the International Port of Cam Ranh

At least 02 (two) hours before departure from the Port, the person handling procedures must notify the Port Authority of the vessel's name and the estimated time of departure from the Port.

6. Documents Required for Procedures for Military Vessels of Vietnam Departing the International Port of Cam Ranh

a) Documents to be presented (original copies): Certificates of the vessel, professional certificates of crew members, passenger lists if changed since arrival.

b) Documents to be submitted: Various documents issued during the vessel's operation at the Port.

7. Military Vessels of Vietnam Departing the International Port of Cam Ranh

After completing all procedures as stipulated in this Circular, the Port Authority reports to the General Director of Company Tan Cang - Petro Cam Ranh to issue a permit for departing the Port according to Model No. 02 attached to this Circular.

Article 5. Reporting System for Military Ships of Vietnam Entering and Departing from Cam Ranh International Port Waters

1. Not later than 12 (twelve) hours before the expected arrival at the Port, Tan Cang - Petro Cam Ranh Company must submit a notification document regarding the arrival of ships, crew list, passenger list (if any) to the Command of Naval Zone 4 (through the Security Protection Board). The content of the ship arrival notification includes: ship name, managing unit, reason for operating in the Port waters, estimated time of operation in the Port waters.

Upon receipt of the ship arrival notification document, the Command of Naval Zone 4 shall coordinate with Tan Cang Petro - Cam Ranh Company to ensure safety when ships enter the Port; and implement measures to ensure security and safety of the Cam Ranh Military Base.

2. Not later than 02 (two) hours before departure from the Port, Tan Cang - Petro Cam Ranh Company is responsible for notifying the Command of Naval Zone 4 (through the Security Protection Board) to ensure safety when ships depart from the Port and compile a report to the Navy Command. The content of the ship departure report includes: ship name, managing unit, time of departure from the Port.

Article 6. Pilotage System for Military Ships of Vietnam Entering, Departing, or Operating in Cam Ranh International Port Waters

1. When entering, departing, or operating within Cam Ranh International Port, the Ship Captain may use a pilot if deemed necessary and shall comply with the relevant laws of Vietnam.

2. In case of need to use marine pilot services, the person handling the procedures must submit a request to Cam Ranh Harbor Authority not later than 06 (six) hours before the time of boarding the pilot onto the ship.

Article 7. Effective Date

This Circular takes effect from July 6, 2017.

Article 8. Responsibility for Implementation

1. The Chief of General Staff, Director of the Political General Department, heads of agencies, units, organizations, and individuals concerned are responsible for implementing this Circular.

2. During the implementation of this Circular, if any difficulties or inconsistencies arise, agencies, units, organizations, and individuals shall promptly reflect them to the Ministry of National Defense (through the General Staff Department) for consideration and resolution./.
