PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 25/2008/NĐ-CP dated March 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

CONSIDERING THE PROPOSAL OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT,

DECISION:

Article 1. Position and Functions

1. The Land Management General Department is an agency directly under the Ministry of Natural Resources and Environment, performing the function of advising and assisting the Minister of Natural Resources and Environment to manage state affairs related to land nationwide; implementing public services as prescribed by law.

2. The Land Management General Department has legal personality, a seal with the National Emblem, a separate account, and headquarters in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Land Management General Department shall perform the following tasks and powers:

1. To the Minister of Natural Resources and Environment:

a. Drafting normative legal documents, mechanisms, policies, strategies, national programs, plans, projects, and regulations on land management and utilization for issuance or approval within its authority or submission to competent state agencies for issuance or approval;

b. Drafting decisions, directives, circulars, national standards, national technical regulations, professional procedures, unit prices, and economic-technical norms in land management and utilization.

2. Directing, inspecting, and being responsible for organizing the implementation of normative legal documents, mechanisms, policies, strategies, national programs, plans, projects, and regulations on land management and utilization after they have been approved by competent authorities.

3. Taking the lead and coordinating to implement legal education activities aimed at raising community awareness about land management and utilization; answering and clarifying policies and laws on land for organizations and individuals.

4. Regarding land planning and utilization:

a. Organizing the preparation and adjustment of national land use planning and regional planning in accordance with the law;

b. Submitting to the Minister of Natural Resources and Environment for issuance of guidelines on the preparation and adjustment of provincial and centrally-administered city land use plans and land use plans for national defense and security purposes;

c. Organizing the review of the preparation and adjustment of provincial and centrally-administered city land use plans and land use plans for national defense and security purposes to submit to competent authorities for approval;

d. Taking the lead and coordinating with relevant ministries and agencies to compile land use needs of each sector and field to prepare the national land use plan and regional plans;

đ. Submitting to the Minister of Natural Resources and Environment for issuance of guidelines and organizing inspections of the implementation of provincial and centrally-administered city land use plans; land use according to sectoral and field plans after approval;

e. Organizing investigations and assessments of land potential and efficiency for state management of land and requirements for socio-economic development.

5. Regarding land registration and statistics:

a. Directing and inspecting: survey work for the preparation and revision of cadastral maps; the preparation and revision of cadastral records; land statistics and inventory work;

b. Directing and inspecting: land use right registration and changes in land use registration; issuing Land Use Right Certificates and certificates of ownership and use of attached assets; specialized activities of the Land Registration Office as prescribed by law;

c. Organizing the construction of a national land registration system;

d. Organizing the issuance and inspection of the management and use of blank Land Use Right Certificates and certificates of ownership and use of attached assets;

đ. Compiling data on land registration, cadastral surveys, issuance of Land Use Right Certificates and certificates of ownership and use of attached assets, preparation of cadastral records, land statistics, and inventory from provinces and centrally-administered cities;

e. Organizing land statistics and inventory, preparing current land use maps for the entire country;

6. Regarding land prices:

a. Building, submitting to the Minister of Natural Resources and Environment for promulgation, amendment, or supplementation within his authority or submission to the Government for promulgation, and setting the framework price for various types of land, principles, and valuation methods;

b. Submitting to the Minister of Natural Resources and Environment for issuance of guidelines and organizing inspections of the application of valuation principles, methods, and procedures; annual land price surveys, compilations, and statistics;

c. Taking the lead and coordinating with relevant ministries and agencies to resolve or submit to competent authorities for resolution of local recommendations regarding land prices in border areas between provinces and centrally-administered cities;

d. Preparing land price maps as a basis for determining land prices for individual plots;

đ. Proposing measures to stabilize land prices in the real estate market;

e. Inspecting the valuation of land by independent land valuation organizations;

7. Regarding compensation, support, and resettlement when the State recovers land:

a. Taking the lead and coordinating with relevant ministries and agencies to build, submit to the Minister of Natural Resources and Environment for promulgation within his authority or submission to competent authorities for promulgation, amendment, and supplementation of policies on compensation, support, and resettlement when the State decides to reclaim land;

b. Submitting to the Minister of Natural Resources and Environment for issuance of guidelines for identifying land users eligible for compensation, support, or neither, serving as a basis for calculating compensation and support; inspecting and handling violations of law in forced land reclamation; compiling land reclamation funds and costs of compensation, support, and resettlement when the State reclaims land;

c. Directing sectors, localities, and organizations in resolving difficulties and obstacles in compensation, support, resettlement, and post-evacuation land management and use;

8. Regarding land fund development, management, and development of the land use rights market in the real estate market:

a. Establish, submit to the Minister of Natural Resources and Environment for issuance within his/her authority or submit to the competent authority for issuance guidelines and organize inspections on the implementation of financial mechanisms and policies regarding land such as collecting money when allocating land, leasing land, recovering land, changing land use purposes, recognizing land use rights, developing land funds according to planning; direct and inspect the recovery of land, development of land funds, auctioning of land use rights, bidding for projects using land; manage and develop the land use rights market in the real estate market;

b. Establish and submit to the competent authority for issuance mechanisms and policies on creating land funds when constructing transportation works, works serving economic and social development, developing the real estate market, preventing speculation in land, creating resettlement land funds for people whose residential land has been recovered;

c. Inspect the implementation of plans, projects, programs for land fund development, compensation, support, and resettlement carried out by land development organizations and public service organizations in the field of land;

d. Submit to the Minister of Natural Resources and Environment for issuance within his/her authority or submit to the competent authority for issuance guiding documents on procedures and organization of inspections concerning land recovery, allocation of land, leasing of land, changing land use purposes; organizing auctions of land use rights, bidding for projects using land; management of resettlement land funds; land that has been cleared according to planning and transferring land from this fund to those allocated land, leased land, won the auction of land use rights, won the bidding for projects using land;

đ. Manage land funds allocated by the State without collecting land use fees for state agencies, political organizations, socio-political organizations, socio-political-professional organizations, public service organizations;

9. On land information and storage:

a. Organize the establishment of information systems and data storage on land; provide land information in accordance with the provisions of the law;

b. Store land files and data in accordance with the provisions of the law;

c. Submit to the Minister of Natural Resources and Environment for issuance within his/her authority or submit to the competent authority for issuance guiding documents and organize inspections on: collection, processing, provision of land information, files, and data; establishment of land information systems; storage of land files and data;

10. On inspection, supervision, dispute resolution, complaints, and denunciations:

a. Carry out specialized inspection on land throughout the country;

b. Provide professional guidance on inspection, supervision, handling of violations of land laws throughout the country as assigned by the Minister of Natural Resources and Environment;

c. Resolve disputes, complaints, and denunciations about land as assigned by the Minister of Natural Resources and Environment;

11. On international cooperation:

a. Propose participation in negotiations, signing of international treaties, agreements, joining international organizations, forums on land issues as assigned or authorized by the Minister of Natural Resources and Environment;

b. Serve as the focal point for implementing international treaties, agreements on land issues as assigned by the Minister of Natural Resources and Environment;

c. Organize the implementation of international cooperation projects on land issues as assigned by the Minister of Natural Resources and Environment;

12. Organize the appraisal and certification of products, proposals, projects on land management and use;

13. Organize research, transfer, application, and dissemination of scientific and technological advancements in land management and use;

14. Organize the implementation of public services on land in accordance with the law; direct and inspect the implementation of mechanisms and policies ensuring the operation of public services in the field of land management and use;

15. Implement administrative reform in land management and use in accordance with the Ministry of Natural Resources and Environment's administrative reform program and as assigned by the Minister;

16. Manage organizational structure and staffing; implement salary systems and incentive policies, commendation, rewards, and disciplinary measures; provide professional training for cadres, civil servants, and employees under the Land Management General Department; practice thrift, prevent waste; prevent corruption in the General Department; participate in training managers and researchers in land management as prescribed by law;

The Minister of Natural Resources and Environment shall submit to the Prime Minister for decision on establishing new, renaming, dissolving, restructuring, and reorganizing administrative organizations under the Land Administration General Department.

The Minister of Natural Resources and Environment shall decide on establishing public service organizations providing self-financed regular operational services under the Land Administration General Department in accordance with the law.

Article 4. Leadership

1. The Land Administration General Department has a Director General and not more than three Deputy Directors General. The Director General of the Land Administration General Department may concurrently hold the position of Deputy Minister of Natural Resources and Environment.

2. The Director General and Deputy Directors General are appointed, relieved of duty, or dismissed by the Minister of Natural Resources and Environment in accordance with the provisions of law.

3. The Director-General of the Land Management General Department shall prescribe the functions, tasks, authorities, and organizational structure of subordinate organizations under the Land Management General Department.

4. The Director General of the Land Administration General Department is responsible to the Minister of Natural Resources and Environment and to the law for all activities of the Land Administration General Department. The Deputy Director General of the Land Administration General Department is responsible to the Director General of the Land Administration General Department and to the law for the areas of work assigned to them.

Article 5. Effective Date

This Decision shall take effect fifteen days after the date of publication in the Official Gazette.

2. Abolish previous provisions that are contrary to this Decision.

The Minister of Natural Resources and Environment, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, and the Director of the Land Administration General Department shall be responsible for implementing this Decision./.
