DECISION OF THE MINISTER OF HOME AFFAIRS

Regarding the issuance of the Regulation on Training for Village Chiefs and Ward Heads

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

 Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 74/2001/QĐ-TTg dated May 7, 2001 of the Prime Minister approving the plan for training and upgrading cadres and civil servants for the period 2001-2005;

Considering the proposal of the Director of the Department of Cadre Training and Civil Servant Development under the State;

 DECISION:

 Article 1. The accompanying Decision hereby promulgates the Regulation on Training for Village Chiefs and Ward Heads.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city authorities are responsible for implementing this Decision./.

REGULATIONS

Training for Village Chiefs and Ward Heads

(Issued together with Decision No. 135/2005/QĐ-BNV dated December 15, 2005)

PART I

General Provisions

Article 1. This Regulation stipulates the training for Village Chiefs, including village chiefs, hamlet chiefs, ấp chiefs, bản chiefs, buôn chiefs, phum chiefs, sóc chiefs... and Ward Heads, including ward heads, khu phố heads, khối phố heads, khóm heads... (hereinafter referred to collectively as Village Chiefs).

Article 2. The purpose of training Village Chiefs is to equip them with basic knowledge about the Socialist Republic of Vietnam, relevant laws directly related to their functions, duties, and powers, necessary supplementary knowledge, and skills to enable them to perform their tasks effectively at the grassroots level.

Article 3. All individuals holding the position of Village Chief must be trained according to the content of the program and materials prescribed by competent state agencies.

Chapter II

Content of the program, materials, examination, and

issuance of certificates for training Village Chiefs and Ward Heads

Article 4. The content of the training program for Village Chiefs includes:

1. Basic knowledge about the Socialist Republic of Vietnam.

2. Functions and responsibilities of Village Chiefs.

3. Legal knowledge directly related to the activities of Village Chiefs in implementing their duties at the grassroots level as stipulated in Decision No. 13/2002/QĐ-BNV dated December 6, 2002 of the Minister of Home Affairs on the organization and operation of villages and wards and tasks assigned by the People's Committee of the commune.

4. Other necessary knowledge related to the tasks they must perform (regulations on grassroots democracy, population planning and family planning, poverty reduction, religion, ethnicity, scientific knowledge on agricultural extension, forestry extension, environmental protection...).

5. Skills for Village Chiefs.

Article 5. Authority to define the structure of the training program and compile training materials for Village Chiefs and Ward Heads:

1. The Ministry of Home Affairs decides on the structure of the training program, reviews, and issues the framework of training programs and materials. The National Academy of Public Administration guides the compilation of training materials.

2. The People's Committee of the province, based on the framework of the training program issued by the Ministry of Home Affairs and the guidance on compiling training materials from the National Academy of Public Administration, decides on organizing the compilation, review, and issuance of training materials for Village Chiefs. The agency or unit responsible for compiling and guiding the use of these materials is decided by the People's Committee of the province.

The framework of the training program and training materials for Village Chiefs must be reviewed before being issued and put into use.

3. The Ministry of Home Affairs and the People's Committee of the province are responsible for monitoring, inspecting, researching, and evaluating the training programs and materials for Village Chiefs after they are put into use, and have the responsibility to revise, supplement, and improve the programs and materials when there are appropriate proposals and recommendations from relevant agencies and units.

Article 6. All training sessions for Village Chiefs according to the programs and materials prescribed in Article 4 of this Regulation must be examined, evaluated, and awarded certificates upon completion. The form of examination, evaluation, and issuance of certificates is decided by the People's Committee of the province. The model of the certificate issued to trainees is guided by the Ministry of Home Affairs.

The organization of examinations, evaluations, management, and issuance of certificates for Village Chiefs is carried out by the training and upgrading institutions.

Chapter III

Lecturers, forms, and methods of training

Article 7. Lecturers for training Village Chiefs include lecturers from provincial political schools, report writers from county-level political training centers, or teachers from provincial-level cadre and civil servant training institutions: part-time lecturers are leaders or managers at the department level in districts, counties, or towns, or civil servants at the specialist level in departments or equivalent positions working in fields related to the content of the training program and materials or fields related to necessary supplementary knowledge for the activities of Village Chiefs.

Article 8. Each training session for Village Chiefs according to the programs and materials prescribed in Article 4 of this Regulation lasts for ten days.

Forms and methods of training Village Chiefs are researched and selected by the training and upgrading institutions to suit the characteristics of each region and the target group, ensuring practicality, quality, and effectiveness.

Chapter IV

Responsibilities and benefits of trainees during training

Article 9. Village Chiefs who are sent for training must strictly comply with the study plans of competent authorities and the regulations of the training and upgrading institutions. In case of violations during the study period, trainees will be subject to criticism and disciplinary measures decided by the People's Committee of the commune depending on the severity of the violation.

Article 10. Village Chiefs who are sent for training are fully funded for their studies, retain their original activity allowances and other benefits as prescribed. The study funding is decided by the People's Committee of the province.

Chapter V.

Implementation

Article 11. The Ministry of Home Affairs issues the framework of the training program, guides the compilation of training materials, and monitors the implementation by the People's Committees of provinces and training institutions in the compilation, issuance of training materials, and organization of training for Village Chiefs; revises the framework of the training program and supplements guidance on the compilation of training materials for localities.

Article 12. Provincial People's Committees issue and guide the use of training materials for Village Chiefs; develop plans and organize the implementation of training for Village Chiefs throughout the province. They establish systems and policies to ensure and encourage the improvement of Village Chiefs' qualifications based on general national regulations and local conditions.

Relevant agencies during the implementation process, if any issues arise, should reflect them to the Ministry of Home Affairs for research and consideration./.
