Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Construction Law dated November 26, 2003;
Pursuant to the Law Amending and Supplementing Certain Provisions of Laws Related to Investment in Construction Projects dated June 19, 2009;
Pursuant to Resolution No. 44/2001/QH10 of the 10th National Assembly at its 9th session on June 29, 2001 regarding the investment policy for the Son La Hydropower Plant project; Resolution No. 13/2002/QH11 of the 11th National Assembly at its second session on December 16, 2002 regarding the construction plan for the Son La Hydropower Plant;
Pursuant to Decision No. 92/QĐ-TTg dated January 15, 2004 of the Government Prime Minister approving the investment for the Son La Hydropower Plant project;
Pursuant to Decisions of the Government Prime Minister No. 09/QĐ-TTg dated January 15, 2004 establishing the State Steering Committee and No. 677/QĐ-TTg dated June 18, 2004 promulgating the Operation Regulations of the State Steering Committee for the Son La Hydropower Plant project;
Considering the proposal of the Minister of Industry and Trade,
DECISION:
Article 1. Amending and supplementing Article 15 of the Management Mechanism and Implementation of the Son La Hydropower Plant project issued together with Decision No. 207/2004/QĐ-TTg dated December 11, 2004 of the Government Prime Minister as follows:
"Article 15. Method of selecting contractors
Depending on the scale and nature of each component of the works or package, the selection of contractors for construction projects under the resettlement program shall be carried out as follows:
1. The Chairman of the People's Committee of the province is authorized to directly appoint contractors according to regulations with a 5% reduction in the approved budget estimate for construction packages up to VND 10 billion.
2. The Director of the specialized department, the Chairman of the People's Committee of the district (project investor) is authorized to directly appoint contractors according to regulations with a 5% reduction in the approved budget estimate for construction packages up to VND 3 billion.
3. Projects or components with construction packages valued over VND 10 billion must conduct bidding to select contractors in accordance with regulations."
Article 2. This Decision shall take effect from the date of signing.
Article 3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of the People's Committees of the provinces: Son La, Dien Bien, Lai Chau, Chairmen of the Management Boards and General Directors of the Vietnam Electricity Corporation are responsible for implementing this Decision./.
