Regarding the establishment of the Thanh Thuy Border Economic Zone in Ha Giang Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Investment Law dated November 29, 2005;
Pursuant to Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones;
Considering the proposal of the Minister of Planning and Investment and the Chairman of the People's Committee of Ha Giang Province,

DECISION:

Article 1. Establishment of the Thanh Thuy Border Economic Zone in Ha Giang Province.

1. The Thanh Thuy Border Economic Zone in Ha Giang Province is a geographical area with defined boundaries within the national territory and sovereignty, having its own economic space.

The Thanh Thuy Border Economic Zone includes the territories of seven communes: Thanh Thuy, Phuong Tien, Thanh Duc, Xin Chai, Lao Chai, Phong Quang (Vixuyen District) and Phuong Du (Hagiang City). The natural area is 28,781 hectares. The geographical boundaries of the Thanh Thuy Border Economic Zone are determined as follows:

- North bordering Zhouwenshan of Yunnan Province, China;

- South bordering Cao Bo Commune of Vixuyen District and Phuong Thien Commune, Quang Trung Ward, Nguyen Trai Ward of Hagiang City;

- East bordering Thu Hoa Commune and Minh Tan Commune of Vixuyen District;

- West bordering Then Chu Phin Commune, Duan Van Commune and Tung San Commune of Hoangsu Phi District.

2. The Thanh Thuy Border Economic Zone shall be organized into a tax-free zone and functional areas such as: industrial zones, entertainment zones, tourist zones, urban zones, residential zones, administrative zones, and other functional zones. The scale and location of each area shall be determined in the general planning and detailed planning of the Thanh Thuy Border Economic Zone.

Article 2. Activities and mechanisms, policies for the Thanh Thuy Border Economic Zone in Ha Giang Province shall be implemented in accordance with the Investment Law and guiding documents for the Implementation of the Investment Law, Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones, Decision No. 33/2009/QĐ-TTg dated March 2, 2009 of the Prime Minister promulgating financial mechanisms and policies for border economic zones, and other relevant laws.

Article 3. Implementation Provisions

1. This Decision shall take effect from January 15, 2010.

Repeal Decision No. 184/2001/QĐ-TTg dated November 21, 2001 of the Prime Minister on allowing the Thanh Thuy Border Gate in Ha Giang Province to apply border economic zone policies.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and the Chairman of the People's Committee of Ha Giang Province are responsible for implementing this Decision./.
