DECREE
 Amending and Supplementing Certain Articles of Decree No. 100/2024/NĐ-CP
dated July 26, 2024 of the Government on Detailed Provisions for Certain Articles of the Law on Housing Concerning the Development and Management of Social Housing (as amended and supplemented by Decree No. 261/2025/NĐ-CP and Decree No. 54/2026/NĐ-CP)
Based on the Law on Organization of the Government No. 63/2025/QH15;
Based on the Law on Housing No. 27/2023/QH15; Law Amending and Supplementing Certain Articles of the Land Law No. 31/2024/QH15, Law on Housing No. 27/2023/QH15, Law on Real Estate Business No. 29/2023/QH15, and Law on Credit Institutions No. 32/2024/QH15;

In accordance with the proposal of the Minister of Construction,

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 100/2024/NĐ-CP dated July 26, 2024 of the Government on Detailed Provisions for Certain Articles of the Law on Housing Concerning the Development and Management of Social Housing (as amended and supplemented by Decree No. 261/2025/NĐ-CP and Decree No. 54/2026/NĐ-CP).

Article 1. Amend and supplement certain articles of Decree No. 100/2024/NĐ-CP dated July 26, 2024 of the Government on Detailed Provisions for Certain Articles of the Law on Housing Concerning the Development and Management of Social Housing (as amended and supplemented by Decree No. 261/2025/NĐ-CP and Decree No. 54/2026/NĐ-CP) (hereinafter referred to as "Amended Decree No. 100/2024/NĐ-CP")

1. Amend and supplement paragraph 1 of Article 30 as follows:

"Article 30. Income Conditions

1. For the persons specified in paragraphs 5, 6 and 8 of Article 76 of the Law on Housing, they must meet the following income conditions:
a) In case the applicant is unmarried or confirmed as single, their average monthly actual income shall not exceed VND25 million calculated based on the wage table, salary issued by the agency, unit, or enterprise where the person works.
In case the applicant is unmarried or confirmed as single and supporting minors under the age of majority, their average monthly actual income shall not exceed VND35 million calculated based on the wage table, salary issued by the agency, unit, or enterprise where the person works.
b) In case the applicant is married in accordance with the law, both the applicant and the spouse of the applicant's total average monthly actual income shall not exceed VND50 million calculated based on the wage table, salary issued by the agency, unit, or enterprise where the person works.
c) The period for determining the income conditions as provided in paragraphs a and b of this paragraph is 12 consecutive months from the time the competent authority issues the confirmation.
d) Based on the conditions and income levels of each area within the province, preferential policies for housing for civil servants, public officials, staff members, and their dependents as provided by law, the People's Committee at the provincial level may decide the adjustment coefficient for the income limit specified in paragraphs a and b of this paragraph but shall not exceed the ratio between the per capita income of the province and the national average; also decide preferential policies to encourage access to social housing for eligible individuals with three or more dependents within the same household."
2. Amend and supplement paragraphs 1 and 2 of Article 67 as follows:
"1. In case the applicant is a single person, their monthly actual income shall not exceed twice the total income of a lieutenant colonel (including basic salary and allowances according to regulations, including all area-based allowances in remote, difficult areas, border regions, islands with harsh conditions) confirmed by the agency or unit where they work.

2. In case the applicant is married in accordance with the law:
a) Both the applicant and their spouse are persons specified in paragraph 7 of Article 76 of the Law on Housing, then their total monthly actual income shall not exceed twice the total income of a lieutenant colonel (including basic salary and allowances according to regulations, including all area-based allowances in remote, difficult areas, border regions, islands with harsh conditions) confirmed by the agency or unit where they work;

b) The spouse of the applicant is not a person specified in paragraph 7 of Article 76 of the Law on Housing, then their total monthly actual income shall not exceed the total income of a lieutenant colonel (including basic salary and allowances according to regulations, including all area-based allowances in remote, difficult areas, border regions, islands with harsh conditions) plus the salary specified at point a of paragraph 1 of this Decree confirmed by the agency or unit where the applicant works.

In case the spouse of the applicant is a person specified in paragraph 5 of Article 76 of the Law on Housing and does not have an employment contract, then the confirmation of income conditions shall be carried out in accordance with the provisions of paragraph 2 of this Decree."

3. Amend and supplement Form No. 01 at Annex II (application for purchase, lease-purchase, or rental of social housing).
In the case where the spouse of the applicant falls under the subject defined in Clause 5, Article 76 of the Law on Housing and there is no labor contract, the condition regarding income shall be confirmed in accordance with the provisions set forth in Clause 2, Decree No. this.

3. Amend and supplement Model No. 01 in Annex II (application for purchase, lease-purchase, or social housing rental).

Article 2. Transitional Provisions

Certificates proving income conditions for eligibility to receive social housing support policies that have been confirmed by the competent authority in accordance with regulations prior to the effective date of this Decree shall continue to be used and remain valid for a period of 12 months from the date of confirmation.

Article 3. Effective Date

This Decree takes effect on April 7, 2026.

Article 4. Implementation Responsibilities

1. The Minister of Construction shall be responsible for guiding and organizing the implementation of this Decree.

2. The Ministers, Heads of agencies at the same level as ministries, Chairmen of People's Committees of provinces and municipalities directly under the Central Government, and relevant agencies shall bear responsibility for implementing this Decree.
