Circular No. 137/2025/TT-BCA Amending and Supplementing Certain Provisions of Circular No. 35/2022/TT-BCA dated October 4, 2022, of the Minister of Public Security on Monitoring the Implementation of Laws in the People's Public Security Force

CIRCULAR

AMENDING AND SUPPLEMENTING SOME ARTICLES OF CIRCULAR NO. 35/2022/TT-BCA DATED OCTOBER 4, 2022 OF THE MINISTER OF PUBLIC SECURITY ON MONITORING THE IMPLEMENTATION OF LAWS IN THE PEOPLE'S POLICE

Pursuant to Law on Legislative Regulatory Documents No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;

Pursuant to Decree No. 80/2025/NĐ-CP dated April 1, 2025 of the Government on organizing the implementation of legislative regulatory documents;

Pursuant to Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security amended and supplemented by Decree No. 11/2025/NĐ-CP dated July 1, 2025 of the Government;

At the proposal of the Director of the Department of Legal Affairs and Administrative Reform and Judicial Affairs;

The Minister of Public Security promulgates this Circular amending and supplementing some articles of Circular No. 35/2022/TT-BCA dated October 4, 2022 of the Minister of Public Security on monitoring the implementation of laws in the People's Police.

Article 1. Amending and supplementing Clause 2 of Article 2

“2. Units under the Ministry’s agencies; academies, schools of the People's Police, agencies, units, groups, corporations, security enterprises, hospitals, and other organizations under the Ministry of Public Security; provincial and municipal police; village, ward, special zone police stations (referred to as police units and localities).”

Article 2. Amending and supplementing Clause 1 of Article 5

“1. Based on the Plan for Monitoring the Implementation of Legislative Regulatory Documents issued by the Prime Minister and the practical implementation of laws within the scope of the Ministry of Public Security’s administrative management, each year, the Department of Legal Affairs and Administrative Reform and Judicial Affairs shall take the lead and coordinate with relevant units to advise the Minister of Public Security to issue the Plan for Monitoring the Implementation of Legislative Regulatory Documents in the People's Police, to be sent to the Ministry of Justice before January 15 for monitoring and consolidation according to the provisions of the law.

Each year, the People's Police units and localities shall issue the Plan for Monitoring the Implementation of Legislative Regulatory Documents at their respective units and localities, to be sent to the Ministry of Public Security (through the Department of Legal Affairs and Administrative Reform and Judicial Affairs) before January 31 each year for monitoring and consolidation.”

Article 3. Amending and supplementing some clauses of Article 6

1. Amending and supplementing Clause 3 of Article 6 as follows:

“3. Inspection of the organization and implementation of laws in the People's Police shall be carried out in accordance with the provisions of Decree No. 80/2025/NĐ-CP dated April 1, 2025 of the Government on organizing the implementation of legislative regulatory documents and the regulations on inspection work in the People's Police.

In one year, inspections shall not be conducted more than once at a police unit or locality, except in cases of surprise inspections, where the advisory body must report clearly the reasons for the inspection and submit them for consideration and decision by the competent authority.”

2. Amending and supplementing Clause 4 of Article 6 as follows:

“4. The content of the inspection of the organization and implementation of laws in the People's Police shall be carried out in accordance with the provisions of Clause 2 of Article 14 of Decree No. 80/2025/NĐ-CP.”

3. Amending and supplementing Point a of Clause 5 of Article 6 as follows:

“a) Each year, based on the Plan for Monitoring the Implementation of Legislative Regulatory Documents in the People's Police, the Department of Legal Affairs and Administrative Reform and Judicial Affairs shall take the lead and coordinate with relevant units to advise the Minister of Public Security to decide on establishing inspection teams for the organization and implementation of laws at police units and localities. Units under the Ministry shall conduct inspections within their areas of management and according to the force system. The Investigation Department of the Provincial Police shall take the lead and coordinate with relevant units to advise the Provincial Police Director to inspect the organization and implementation of laws within their areas of management and jurisdiction.”

Article 4. Amending and supplementing Clause 1 of Article 9

“1. Based on the results of information collection, inspection, investigation, survey of the implementation of laws, and other sources of information, police units and localities shall promptly review, evaluate, and handle the results within their authority or propose the competent authority to handle the results according to one or several contents stipulated in Clause 2 of Article 13 of Decree No. 80/2025/NĐ-CP.”

Article 5. Amending and supplementing Point a of Clause 1 of Article 10

“a) Each year, based on the Plan for Monitoring the Implementation of Legislative Regulatory Documents, police units and localities shall build reports on the organization and implementation of laws within their management scope, area, and force system; to be sent to the Ministry of Public Security (through the Department of Legal Affairs and Administrative Reform and Judicial Affairs) before December 15 each year for consolidation and building of the Ministry of Public Security's report on the organization and implementation of laws, to be reviewed and signed by the Ministry of Public Security leadership and submitted to the Ministry of Justice for consolidation and reporting to the Government according to the law.

Village-level police units and subordinate units of provincial police shall send their reports to the provincial police within two working days from the date of finalizing the data.”

Article 6. Amending and supplementing some clauses of Article 12

1. Amending and supplementing Point a of Clause 2 of Article 12 as follows:

“a) Issuing and implementing plans for monitoring the implementation of legislative regulatory documents within their assigned areas of responsibility; plans for investigating and surveying the implementation of laws; coordinating to implement inspections of the organization and implementation of laws according to this Circular.”

2. Amending and supplementing Point c of Clause 2 of Article 12 as follows:

“c) Implementing the reporting system on the organization and implementation of laws according to this Circular.”

3. Amending and supplementing Point đ of Clause 3 of Article 12 as follows:

“đ) Building reports on the organization and implementation of laws within their assigned functions and tasks according to the provisions.”

Article 7. Abolishing some articles, clauses, and points

Abolish Article 4, Clause 2 of Article 5, Clause 2 of Article 7, Clause 1 of Article 8, Point b of Clause 1 of Article 10, and Point b of Clause 2 of Article 12 of Circular No. 35/2022/TT-BCA dated October 4, 2022 of the Minister of Public Security on monitoring the implementation of laws in the People's Police.

Article 8. Provisions on Implementation

1. This Circular takes effect from December 31, 2025.

2. When the provisions cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replacing documents.

3. The Director of the Department of Legal Affairs and Administrative Reform and Judicial Affairs shall be responsible for monitoring, guiding, inspecting, and urging the implementation of this Circular.

4. Heads of units under the Ministry’s agencies, Directors of provincial and municipal police, academies, and schools in the People's Police, agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular.

5. During the process of implementing this Circular, if there are difficulties or obstacles, police units and localities shall report to the Ministry of Public Security (through the Department of Legal Affairs and Administrative Reform and Judicial Affairs) for timely guidance./.
