PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 730/2004/NQ-UBTVQH11 dated September 30, 2004, of the Standing Committee of the National Assembly approving the salary scale for positions, the position allowance scale for state leaders; the specialized salary scale and the professional salary scale for the Court sector and the Procuracy sector;
Decree No. Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on wage systems for civil servants, public officials, and members of the armed forces;
At the request of the Chief Prosecutor of the Supreme People's Procuracy after consultation with the Minister of Home Affairs and the Minister of Finance.
DECISION:
Article 1. Prosecutors at all levels of the People's Procuracy (including the Chief Prosecutor of the Supreme People's Procuracy), Investigators at all levels, and Inspectors at all levels shall be granted the responsibility allowance according to the following regulations:
1. The Chief Prosecutor of the Supreme People's Procuracy, Prosecutors of the Supreme People's Procuracy, and Senior Investigators shall receive a responsibility allowance equal to 20% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
2. Prosecutors of provincial-level People's Procuracies and Intermediate Investigators shall receive a responsibility allowance equal to 25% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
3. Prosecutors of district-level People's Procuracies and Junior Investigators shall receive a responsibility allowance equal to 30% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
4. Senior Inspectors shall receive a responsibility allowance equal to 15% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
5. Principal Inspectors shall receive a responsibility allowance equal to 20% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
6. Inspectors shall receive a responsibility allowance equal to 25% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
Article 2. The funds for paying the responsibility allowance for Prosecutors, Investigators, and Inspectors in the Procuracy sector shall be allocated in the annual state budget according to the provisions of the State Budget Law.
Article 3. The Supreme People's Procuracy shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to guide the implementation of this Decision.
Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Abolish the provisions on the allowance for Prosecutors and Investigators in the Procuracy sector stipulated in Article 1 and the Chief Prosecutor of the Supreme People's Procuracy stipulated in Article 4 of Decision No. 06/2001/QĐ-TTg dated January 10, 2001 of the Prime Minister regarding the allowance for certain judicial positions.
The responsibility allowance according to profession prescribed in this Decision shall be effective from October 1, 2004.
Article 5.The Chief Prosecutor of the Supreme People's Procuracy, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and centrally-run city People's Committees are responsible for implementing this Decision.
