CIRCULAR
Guidelines for Implementing Mandatory Health Insurance for Officers' Dependents on Active Duty
Pursuant to the Health Insurance Charter issued together with Decree No. 63/2005/NĐ-CP dated May 16, 2005 of the Government and Circular No. 21/2005/TTLT-BYT-BTC dated July 27, 2005 of the Ministry of Health and Ministry of Finance guiding the implementation of mandatory health insurance; after reaching consensus with the Ministry of Health (in Circular No. 7191/YT-ĐTR dated September 9, 2005) and the Ministry of Finance (in Circular No. 11465/BTC-V1 dated September 13, 2005), the Ministry of National Defense issues guidelines for implementing mandatory health insurance for officers' dependents on active duty as follows:
I. OBJECTS, CONTRIBUTION LEVELS AND BENEFITS OF HEALTH INSURANCE
1. Objectives:
a) Applicable subjects:
Officers' dependents on active duty (hereinafter referred to as officers' dependents) shall be entitled to medical examination and treatment under the mandatory health insurance (BHYT) regime stipulated in Decree No. 63/2005/NĐ-CP dated May 16, 2005 of the Government, including:
- The father, mother of the officer; the father, mother of the officer's spouse;
- The foster father, foster mother, or legally recognized guardian of the officer, or of the officer's spouse;
- The spouse of the officer;
- The biological child, legally adopted child of the officer under 18 years old; the biological child, legally adopted child of the officer aged 18 or older but disabled and unable to work according to the law.
b) Non-applicable objects:
- Officers' dependents specified in Point a, Clause 1, Section I above who fall within one of the categories required to participate in mandatory health insurance under current regulations or when the officer ceases service on active duty.
- The biological or adopted child aged 18 years or older who does not belong to the category of disabled persons unable to work; the biological or adopted child under six years old according to the law.
2. Contribution level for health insurance:
The monthly contribution rate for BHYT for officers' dependents specified in Clause 1, Section I of this Circular is 3% of the national minimum wage as prescribed by the Government at the time of purchasing the BHYT card, which is guaranteed by the Ministry of National Defense from the state budget.
3. Benefits:
Officers' dependents holding a BHYT card in accordance with these guidelines shall enjoy medical examination and treatment benefits as prescribed in Sections I and II, Part II of Joint Circular No. 21/2005/TTLT-BYT-BTC dated July 27, 2005 of the Ministry of Health and Ministry of Finance guiding the implementation of mandatory BHYT.
II. DOCUMENTATION, PROCEDURES AND RESPONSIBILITIES OF INDIVIDUALS, AUTHORITIES, UNITS AND LOCALITIES IN PURCHASING AND ISSUING BHYT CARDS
1. Documentation for issuing BHYT cards:
a) Initial documentation for issuing BHYT cards:
- A declaration form of the officer regarding dependents entitled to BHYT benefits, confirmed by the personnel management authority (Form No. 01).
- A list of applications for purchasing BHYT cards for officers' dependents residing in the same locality as the officer (province, city), signed and stamped by the unit commander at the brigade level or higher (Form No. 02).
- A list of certificates of entitlement to BHYT benefits for officers' dependents residing outside the same locality as the officer (province, city), signed and stamped by the unit commander at the brigade level or higher (Form No. 03A).
- "Certificate of entitlement to BHYT benefits" for officers' dependents residing outside the same locality as the officer (province, city), issued by the unit commander at the brigade level or higher (Form No. 04).
- A list of applications for purchasing BHYT cards for officers' dependents residing outside the same locality as the officer (province, city), based onCertificate of entitlement to BHYT benefits" forms submitted by units, signed and stamped by the People's Military Commandant of the district (township) (Form No. 03B).
b) Documentation for issuing BHYT cards in subsequent years:
- A declaration form of the officer when there is a change or addition to dependents entitled to BHYT benefits (Form No. 01).
- A list of applications for purchasing BHYT cards for officers' dependents residing in the same locality as the officer (province, city), prepared based on the initial list and adjusted for changes in the number of dependents in that year, signed and stamped by the unit commander at the brigade level or higher (Form No. 02).
- A list of certificates of entitlement to BHYT benefitsCertificate of entitlement to BHYT benefits" for officers' dependents residing outside the same locality as the officer (province, city), prepared based on the initial list and adjusted for changes in the number of dependents in that year, signed and stamped by the unit commander at the brigade level or higher (Form No. 03A).
- A list of applications for purchasing BHYT cards for officers' dependents residing outside the same locality as the officer (province, city), prepared based on the initial list and adjusted for changes in the number of dependents in that year, submitted by new unitsCertificate of entitlement to BHYT benefits" or notified of increases or decreases, signed and stamped by the People's Military Commandant of the district (township) (Form No. 03B).
2. Procedures and time limits for registering, purchasing, and issuing BHYT cards:
a) Procedures for purchasing and issuing BHYT cards:
- The officer prepares a declaration form regarding dependents entitled to BHYT benefits; registers primary healthcare facilities for dependents (Form No. 01).
- Units managing officers at the brigade level or higher:
+ Prepare a list of applications for purchasing BHYT cards for officers' dependents residing in the same locality (Form No. 02); directly sign contracts with the Social Security Office of the district (township) or province (city) to purchase BHYT cards for officers' dependents, and hand over the cards to the officers to deliver to their dependents.
+ Prepare a list of certificates of entitlement to BHYT benefitsCertificate of entitlement to BHYT benefits" for officers' dependents residing outside the same locality (Form No. 03A); issueCertificate of entitlement to BHYT benefits" for dependents and send them to the People's Military Commandant of the district (township) where the officers' dependents reside.
- The People's Military Commandant of the district (township) receivesCertificate of entitlement to BHYT benefits", compiles a list (Form No. 03B), and signs a contract with the Social Security Office of the district (township) to purchase BHYT cards, transferring them to the People's Military Commandant of the commune (township) to deliver to the officers' dependents.
b) Time limit for purchasing and issuing BHYT cards:
- Officers prepare a declaration form for registering medical examinations and treatments for dependents in September; complete the purchase and issuance of BHYT cards for officers' dependents by December of the previous year.
- Quarterly, officers prepare supplementary declaration forms for dependents entitled to BHYT benefits (if any) and have the unit purchase additional BHYT cards or issueCertificate of entitlement to BHYT benefits" in the following quarter.
3. Responsibilities of individuals, authorities, and units in declaring, registering for medical examinations and treatments; purchasing and issuing BHYT cards for officers' dependents:
a) For officers:
- Declare dependents entitled to BHYT benefits in accordance with regulations; register primary healthcare facilities (Form No. 01) and bear responsibility for the accuracy of the declarations.
- Deliver BHYT cards to dependents residing in the same locality and monitor the issuance of BHYT cards for dependents residing outside the same locality (province, city).
In the case of relatives of multiple officers, the registration, purchase, issuance of health insurance cards or issuance ofCertificate of entitlement to BHYT benefits" shall be carried out as follows:
+ Relatives living with which officer shall be declared and registered by that officer;
+ If relatives live with multiple officers, they shall be registered in the following order: sons, daughters, daughters-in-law, sons-in-law, legally adopted children (if in the same rank, the eldest child shall be declared and registered);
+ If both father and mother are officers, the mother shall declare and register for their children.
In cases where the order specified above is not followed, the person with favorable conditions shall declare and register, but must submit a written statement explaining the reasons, confirmed by the Head of the unit managing from battalion level and equivalent or higher.
- Quarterly, officers are responsible for reporting to the direct management unit's Head about the movement situation of relatives entitled to health insurance benefits (if any); reflecting to the unit's Head on the purchase, receipt of health insurance cards and medical examination and treatment of relatives at healthcare facilities.
b) For the relatives of officers:
- Relatives of officers residing outside the military base area (province, city) of the officer, when notified to the Military Command Board of the commune (ward) to receive the health insurance card.
- Keeping and preserving the health insurance card for medical examination and treatment. If there is any mistake, omission, or loss of the card, it must be reported to the Military Command Board of the commune (ward) to request resolution.
c) For units managing officers:
- Battalion level and equivalent:
+ Propaganda and dissemination to each officer in the unit; guide the preparation of declaration forms, registration of initial medical examination and treatment places for the relatives of officers according to the provisions of this Circular.
+ Prepare a list to purchase health insurance cards for the relatives of officers residing in the same military base area (province, city) as the officer (Form No. 02); contract with the Social Insurance Office of the district (or province/city) to purchase health insurance cards to transfer to the officers for their relatives.
+ Prepare a list of relatives of officers residing outside the military base area (province, city) as the officer (Form No. 03A) as the basis for issuing certificates.
+ Issue "Certificate of entitlement to BHYT benefits" for relatives and transfer to the Military Command Board of the county (district) where the relative of the officer resides.
+ Prepare a list and purchase additional health insurance cards for relatives of officers residing in the same military base area (province, city) or issue additional "Certificate of entitlement to BHYT benefits" for relatives of officers residing outside the military base area (province, city) when there is a change every quarter.
+ Timely notify the Military Command Board of the county (district) when there is a movement (change, increase, decrease...) in the situation of officers and relatives of officers residing outside the military base area (Form No. 08).
+ Summarize and report to superiors the results of purchasing and issuing health insurance cards and issuing "Certificate of entitlement to BHYT benefits" for relatives of officers (Form No. 05); summarize the number and list of increases and decreases (Form No. 06); report the number and classification of officers' relatives stationed by area (Form No. 07).
+ Settle accounts for the cost of purchasing health insurance cards according to regulations.
- Division level and equivalent:
+ Direct subordinate units to implement the purchase and issuance of health insurance cards and issuance
"Certificate of entitlement to BHYT benefits" for relatives of officers accurately, sufficiently, and promptly.
+ Summarize and report to superiors the results of purchasing and issuing health insurance cards and issuing "Certificate of entitlement to BHYT benefits" for relatives of officers (Form No. 05); report the number and classification of officers' relatives stationed by area (Form No. 07).
+ Settle accounts for the cost of purchasing health insurance cards according to regulations.
- Units under the Ministry of National Defense:
+ Direct and implement the health insurance system for relatives of officers according to the provisions of this Circular in a timely manner.
+ Summarize and report the results of purchasing and issuing health insurance cards and issuance "Certificate of entitlement to BHYT benefits" (Form No. 05); report the number and classification of officers' relatives stationed by area (Form No. 07) to the Ministry of National Defense (through the Policy Department - Political General Staff).
+ Settle accounts for the cost of purchasing health insurance cards according to regulations.
4. Responsibilities of local military authorities at all levels in implementing the purchase and issuance of health insurance cards:
- Military Command Board of the commune (ward):
+ Receive health insurance cards transferred from the Military Command Board of the county (district); transfer or notify relatives of officers to receive them promptly.
+ Report to the Military Command Board of the county (district) the results of transferring health insurance cards to relatives of officers; identify cases of duplicate issuance or errors in the issuance of health insurance cards.
- Military Command Board of the county (district):
+ Perform tasks as stipulated for battalion-level units in Clause C, Point 3, Section II above.
+ Collect "Certificate of entitlement to BHYT benefits" sent back by units managing officers; handle cases of duplicate issuance or mistakes; prepare a list to purchase health insurance cards; contract with the Social Insurance Office and purchase health insurance cards and transfer to the Military Command Board of the commune (ward) to hand over to relatives of officers.
+ Summarize the number and list of increases and decreases annually for the number of relatives who have moved, based on notifications from units (Form No. 06); adjust the list purchased in the previous year, prepare a list to implement for the next year.
+ Summarize and report the results of purchasing and issuing health insurance cards and issuance "Certificate of entitlement to BHYT benefits" for relatives of officers (Form No. 05); report the number and classification of officers' relatives stationed by area (Form No. 07).
+ Coordinate with local Social Insurance Offices and healthcare facilities to monitor, inspect, and resolve issues related to the purchase and issuance of health insurance cards.
+ Settle accounts for the cost of purchasing health insurance cards with the superior financial authority according to regulations.
- Provincial (city) Military Command Board:
+ Perform tasks as stipulated for units in Clause c, Point 3, Section II above.
+ Monitor and direct agencies and units in implementing the purchase and issuance of health insurance cards for relatives of officers.
+ Coordinate with Social Insurance Offices to guide and inspect the signing of contracts for the purchase and sale of health insurance cards by localities and units stationed in the area; the medical examination and treatment of relatives of officers at healthcare facilities and resolving issues within the scope of management.
+ Report the results of purchasing and issuing health insurance cards and issuance "Certificate of entitlement to BHYT benefits" for relatives of officers as prescribed (Form No. 05); report the number and classification of officers' relatives stationed by area (Form No. 07).
+ Settle accounts for the cost of purchasing health insurance cards with the superior financial authority according to regulations.
5. Responsibilities of functional agencies of the Ministry of National Defense:
- Cadre Department - Political General Staff:
Direct and guide personnel agencies at all levels to review and confirm the relatives of officers eligible for health insurance benefits according to the provisions of this Circular based on files.
- Policy Department - Political General Staff:
+ Direct and guide subordinate units of the Ministry of National Defense to implement the purchase and issuance of health insurance cards for relatives of officers.
+ Summarize the number of relatives entitled to health insurance benefits; take the lead in coordinating with the Finance Department - Ministry of National Defense to prepare budgets for purchasing health insurance cards, allocate funds and fees to units.
+ To direct and coordinate with the competent agencies of the Vietnam Social Security and related agencies to guide and inspect the registration for medical examination and treatment; purchase, issue health insurance cards (BHYT), and resolve arising issues.
- Directorate of Finance - Ministry of National Defense:
+ To coordinate with the Policy Directorate to prepare the budget for purchasing health insurance cards for officers' dependents from the annual budget of the Ministry of National Defense; promptly notify the budget for purchasing health insurance cards to units; settle accounts for implementing health insurance with the Ministry of Finance according to regulations.
+ To coordinate in inspecting and supervising the purchase and issuance of health insurance cards; the use of funds to implement health insurance policies for officers' dependents.
- Military Health Service:
To direct and inspect healthcare facilities under the military regarding signing contracts with social security agencies and providing medical examination and treatment services for officers' dependents who have contracts for medical examination and treatment under the health insurance system.
III. IMPLEMENTATION
1. The funding to ensure health insurance benefits for officers' dependents is provided from the state budget within the annual budget of the Ministry of National Defense, including the cost of purchasing health insurance cards and administrative fees.
Administrative fees to organize and implement the registration for medical examination and treatment, purchase, and issuance of health insurance cards for officers' dependents (including publicity, implementation, printing forms, compiling lists, reviewing, purchasing, and issuing health insurance cards to each officer's dependent) shall be calculated at 2% of the total cost of purchasing health insurance cards for officers' dependents.
2. Any individual or unit commander who engages in false declaration or confirmation that does not reflect the truth in the implementation of this Circular, in addition to compensating for losses, must also bear administrative responsibility, disciplinary responsibility, or criminal liability if applicable.
3. This Circular takes effect fifteen days after its publication in the Official Gazette and replaces previous regulations on medical examination and treatment for officers' dependents serving in the military.
In the process of implementation, any difficulties should be reported to the Ministry of National Defense by relevant agencies, units, and localities for consideration and resolution./.
