Decision No. 138/2006/QĐ-TTg On approving the Scheme for the reorganization and modernization of state-owned agricultural and forestry farms under the People's Committee of Thanh Hoa Province

DECISION OF THE PRIME MINISTER

APPROVING THE RESTRUCTURING AND MODERNIZATION PLAN FOR STATE-FUNDED AGRICULTURAL AND FORESTRY ENTERPRISES UNDER THE PEOPLE'S COMMITTEE OF THANH HOA PROVINCE belongs to the People's Committee of Thanh Hoa Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 170/2004/NĐ-CP dated September 22, 2004 of the Government on restructuring, modernization, and development of state-owned agricultural enterprises;

Pursuant to Decree No. 200/2004/NĐ-CP dated December 3, 2004 of the Government on restructuring, modernization, and development of state-owned forestry enterprises;

Upon the proposal of the Minister of Agriculture and Rural Development and the Chairman of the People's Committee of Thanh Hoa Province,

DECISION:

Article 1. The Prime Minister approves the restructuring and modernization plan for state-owned agricultural and forestry enterprises under the People's Committee of Thanh Hoa Province as follows:

1. Agricultural enterprises to maintain, consolidate, and enhance operational efficiency:

- Van Du Agricultural Enterprise;

- Ha Trung Agricultural Enterprise;

- Thong Nhat Agricultural Enterprise;

- Lam Son Agricultural Enterprise;

- Song Am Agricultural Enterprise;

- Yen My Agricultural Enterprise;

- Thach Thanh Agricultural Enterprise;

- Thach Quang Agricultural Enterprise.

2. Permitting the use of existing labor, land, technical facilities, materials, and capital of Sao Vang Agricultural Enterprise to establish a limited liability company with Lam Son Sugar Corporation according to the provisions of the law.

3. Forestry enterprises to be converted into Forest Protection Management Boards:

- Thanh Ky Forestry Enterprise;

- Nhu Xuan Forestry Enterprise;

- Sim Forestry Enterprise;

- Song Chang Forestry Enterprise;

- Song Dan Forestry Enterprise;

- Lang Chanh Forestry Enterprise;

- Song Lo Forestry Enterprise;

- Na Meo Forestry Enterprise;

- Thach Thanh Forestry Enterprise;

- Ha Trung Forestry Enterprise;

- Muong Lat Forestry Enterprise;

- Tinh Gia Forestry Enterprise.

Article 2. CHAIRMAN OF THE PEOPLE'S COMMITTEE OF THANH HOA PROVINCE:

1. Direct the implementation of the restructuring and modernization of state-owned agricultural and forestry enterprises as stipulated in Article 1 of this Decision.

2. Decide to adjust the area and boundaries of land allocated to agricultural enterprises and forest protection management boards in accordance with the local agricultural and forestry development plan; the development plan of each agricultural enterprise; and the management requirements of each forest protection management board as proposed by the Ministry of Agriculture and Rural Development in Document No. 1117/BNN-ĐMDN dated May 10, 2006.

Article 3. The Ministries of Agriculture and Rural Development, Finance, Planning and Investment, Natural Resources and Environment, Labor, Invalids and Social Affairs, Home Affairs, and related agencies shall coordinate with the People's Committee of Thanh Hoa Province in implementing this Plan.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Chairman of the People's Committee of Thanh Hoa Province and heads of relevant agencies are responsible for enforcing this Decision.
