Issuing the Fee Collection Schedule
for Mai Pha - National Highway 37 - Thai Nguyen Province

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities of state management by Ministries and agencies equivalent to Ministries;
Pursuant to Decree No. 178/CP dated October 28, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget;
After receiving the opinion of the Ministry of Transport (document No. 3610/BGTVT-TCKT dated October 18, 1999);
Based on the proposal of the Director General of the General Department of Taxation.

Article 1: The Fee Collection Schedule for Mai Pha - National Highway 37 - Thai Nguyen Province is hereby issued together with this Decision.
Article 2: Organizations and individuals using motor vehicles on national roads that actually pass through Mai Pha - National Highway 37 - Thai Nguyen Province must pay fees according to the rates specified in this Decision, except for the following categories which are exempted from payment.
- Special purpose vehicles for security and defense purposes.
- Vehicles dispatched for urgent and emergency tasks pursuant to orders from competent state authorities such as dike protection vehicles, flood and storm prevention vehicles, and epidemic control vehicles.
Article 3: The entity assigned the task of collecting fees at Mai Pha Bridge shall register and declare the collection and payment of fees to the local tax authority where the fees are collected in accordance with Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget.
Article 4: This Decision shall take effect fifteen days from the date of issuance.
Article 5: Organizations and individuals subject to fee payments at Mai Pha Bridge, entities assigned the task of organizing fee collection at Mai Pha Bridge, and related agencies are responsible for implementing this Decision.

Level Do đó, để thực hiện nhiệm vụ bán đấu giá đối với các loại tài sản nhà nước trên đây, cơ quan tài chính có thể thành lập Hội đồng bán đấu giá tài sản hoặc thành lập đơn vị sự nghiệp để tổ chức bán đấu giá các loại tài sản nhà nước. Vì thế, việc thành lập đơn vị sự nghiệp thuộc Sở Tài chính để thực hiện các nhiệm vụ có tính chất dịch vụ về quản lý tài sản nhà nước, bao gồm cả việc bán đấu giá tài sản nhà nước là phù hợp với các quy định hiện hành của pháp luật và thuộc thẩm quyền quyết định của Chủ tịch UBND cấp tỉnh. Tuy nhiên, để đảm bảo phù hợp với quy định tại Điều 36 Nghị định số 05/2005/NĐ-CP của Chính phủ, khi lập Đề án thành lập đơn vị sự nghiệp, thì tên gọi của đơn vị sự nghiệp đề nghị không sử dụng cụm từ "dịch vụ bán đấu giá tài sản" hoặc "bán đấu giá tài sản". Đối với các địa phương đã thành lập Trung tâm mà trong tên gọi của Trung tâm có sử dụng những cụm từ "dịch vụ bán đấu giá tài sản" hoặc "bán đấu giá tài sản", đề nghị Sở Tài chính phối hợp với Sở Nội vụ báo cáo UBND tỉnh, thành phố quyết định thay đổi tên gọi cho phù hợp. |
