NO.: 138B/SL-QD DATE: DECEMBER 18, 1949

OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

CHAIRMAN

GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

 

Pursuant to Decree-Law No. 64 dated November 23, 1945 establishing the Special Inspection Board;

Pursuant to Decree-Law No. 9 - SL dated January 29, 1947 regulating arrest procedures and detention of government officials and members of the National Assembly;

At the proposal of the Deputy Prime Minister;

In accordance with the resolution of the Government Council after consultation with the Standing Committee of the National Assembly;

 

ISSUES THE FOLLOWING DECREE-LAW

Article 1

The Decree-Law No. 64 dated November 23, 1945 establishing the Special Inspection Board is hereby repealed.

Article 2

A Government Inspection Board directly under the Office of the Prime Minister shall be established comprising:

One Chief Inspector,

One Deputy Chief Inspector,

Three Inspectors.

The positions of Chief Inspector, Deputy Chief Inspector, and Inspector are appointed by decree.

Article 3

To assist the Inspection Board, an office and a number of inspection delegates shall be appointed by a decision of the Prime Minister.

Article 4

The Government Inspection Board has the following duties:

a/ Reviewing the implementation of government policies and directives.

b/ Inspecting members of the Council for National Defense and Security and officials regarding integrity.

c/ Investigating complaints from citizens.

Article 5

To fulfill these duties, the Government Inspection Board has the following powers:

a/ Scope of inspection: government agencies.

b/ Questioning members of the Council for National Defense and Security and officials, demanding necessary documents and records for inspection purposes.

c/ In special cases and emergencies, temporarily suspending the duties of those who have committed offenses:

- For members of the Council for National Defense and Security at provincial level or below. The inspector will immediately report to the authority with the power to appoint or recognize in order to make a decision on replacement;

- For officials at regional level or below. In such cases, the inspector will immediately inform the directly controlling Council for National Defense and Security to designate someone to temporarily replace until the appointment authority makes a decision.

Article 6

The judicial powers stipulated in Decree-Law No. 9 - SL dated November 29, 1947 for Ministers and Deputy Ministers are now applicable to members of the Government Inspection Board.

Article 7

The Prime Minister shall implement this decree-law accordingly.
