Amending and supplementing certain provisions on medical examination and treatment for officers who have served at least

Pursuant to the Law on Legislative Documents of 2008;
Pursuant to the Government's Decree No. 104/2008/NĐ-CP dated September 16, 2008 on the functions, tasks, powers, and organizational structure of the Ministry of National Defense; Implementing Resolution No. 51/NQ-CP dated December 10, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of National Defense;
Upon consideration of the proposal of the Director of the Political General Department, the Minister of National Defense decides:
Article 1. Amending and supplementing certain provisions of the Regulations on medical examination and treatment for officers who have served at least fifteen years in the military, issued together with Decision No. 33/2003/QĐ-BQP dated April 7, 2003 of the Ministry of National Defense
Clause 1, Article 7 shall be amended and supplemented as follows:
"1. When retiring to their place of residence, retired officers shall register with the Military Command Board of the district, town, city, or provincial capital (hereinafter referred to collectively as the Military Command Board of the district). On the day of receiving the registration file for medical examination and treatment, the Military Command Board of the district shall be responsible for issuing an introduction letter for the retired officer to go to the military hospital according to the designated level to complete the registration process for the first time."
"2. The Medical Examination and Treatment Booklet shall be printed according to Model No. 01/2011/KB-SQPV issued together with this Circular, specifically as follows:
a) The booklet shall be printed in size A5, consisting of 34 pages (including the cover).
“Article 15. Violations of regulations on the operation of irrigation works
b) Printing regulations for the cover pages: Page 1: Print the name of the Medical Examination and Treatment Booklet for retired officers; Page 34: Print the usage regulations for the Medical Examination and Treatment Booklet for retired officers.
c) Printing regulations for the inner pages (from page 3 to page 32): Page 3: Print the brief personal history section; From page 4 to page 32 print the page number sequence with columns for hospitals to record when retired officers undergo medical examinations and treatments."
Article 16. Management and use of the Medical Examination and Treatment Booklet
Article 2. Amending and supplementing certain articles of Circular No. 158/2011/TT-BQP dated August 15, 2011 of the Minister of National Defense on implementing some benefits and policies contributing to the care of retired military personnel.
4. Article 16 shall be amended and supplemented as follows:
"1. The Medical Examination and Treatment Booklet shall be printed and issued by military hospitals at the designated level to retired officers, with charges based on the original printing cost at the time of printing the booklet.
2. The Medical Examination and Treatment Booklet shall be used for multiple medical examinations; when the booklet is full or lost or damaged, retired officers shall be issued a new booklet by the hospital where they registered for medical examination and treatment.
3. Between medical examinations and treatments, retired officers shall be responsible for managing the booklet to prevent loss or damage."
Point d, Clause 1, Article 18 shall be amended and supplemented as follows:
"d) Issuing an introduction letter for retired officers to register for the first time for medical examination and treatment at military hospitals according to the designated level and bearing legal responsibility for such introductions."
Point b, Clause 2, Article 18 shall be abolished and the clause shall be restructured as follows:
"The Military Command Board of the commune shall be responsible for managing the situation of retired officers within its jurisdiction."
This Circular shall take effect forty-five days from the date of issuance.
Article 2. Effective Date
Commanders of agencies and units under the Ministry of National Defense, local military agencies, military hospitals, and related individuals shall be responsible for implementing this Circular. During implementation, if there are difficulties, agencies and units shall report to the Ministry of National Defense (through the Policy Department) for consideration and resolution.
