Regulations on operating motor vehicle inspection services

Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Road Traffic Law 2008 dated November 13, 2008;
Pursuant to the Enterprise Law dated November 26, 2014;
Pursuant to the Investment Law dated November 26, 2014; the Law Amending and Supplementing Article 6 and Appendix 4 on the List of Industries and Businesses Subject to Conditions for Investment dated November 22, 2016;
At the proposal of the Minister of Transport;
The Government promulgates a Decree stipulating regulations on operating motor vehicle inspection services.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree sets forth conditions for operating motor vehicle inspection services for automobiles, trailers, semi-trailers pulled by automobiles, and similar types of vehicles (hereinafter referred to collectively as motor vehicles); management, operation, and issuance of certificates confirming eligibility to operate motor vehicle inspection services.
Article 2. Applicability
1. This Decree applies to agencies, organizations, and individuals related to the management, operation, and provision of motor vehicle inspection services.
2. This Decree does not apply to agencies, organizations, and individuals conducting inspections of military and police motor vehicles used for national defense and security purposes.
Article 3. Explanation of Terms
2. Self-generated and self-consumed electricity is electricity produced and consumed by an organization or individual to serve their own needs.
1. Motor vehicle inspection (hereinafter referred to as inspection) is the initial and periodic examination of the technical safety quality and environmental protection of motor vehicles.
2. The Inspection Certificate for the technical safety quality and environmental protection of road motor vehicles (hereinafter referred to as the inspection certificate) is a certification confirming that a motor vehicle has been inspected and meets the standards, specifications, and regulations regarding technical safety quality and environmental protection.
3. A motor vehicle inspection unit (hereinafter referred to as the inspection unit) is an organization established in accordance with the law providing public service to carry out inspection work and issue inspection certificates for motor vehicles.
4. The Certificate of Eligibility for Motor Vehicle Inspection Operations is a certification confirming that the inspection unit is eligible to conduct motor vehicle inspection operations.
5. An inspector is a person with sufficient qualifications and skills who holds an Inspector Certificate to perform part or all of the motor vehicle inspection tasks. Inspectors are divided into two categories: Motor Vehicle Inspectors and High-Ranking Motor Vehicle Inspectors.
6. Inspection business personnel are persons with sufficient qualifications and skills who hold a Business Personnel Certificate to perform tasks such as receiving, returning, storing records, entering data, searching, checking, comparing motor vehicle inspection records, and printing inspection certificates.
7. Chain supervisor is a person with sufficient qualifications, skills, and experience in motor vehicle inspection work to ensure that motor vehicle inspections on the inspection chain comply with relevant regulations, procedures, standards, technical specifications, and guidance related to inspection work.
8. An inspection workshop is an area arranged with inspection positions, inspection equipment, supporting equipment, and inspection tools.
9. An inspection chain is a place where inspection positions are set up and inspection equipment is installed. Inspection chains are divided into two types:
a) Type I inspection chain is an inspection chain for motor vehicles with a weight distributed to each single axle up to 2,000 kg.
b) Type II inspection chain is an inspection chain for motor vehicles with a weight distributed to each single axle up to 13,000 kg.
Article 4. Principles for the operation of motor vehicle inspection services
Only organizations holding a certificate confirming eligibility to operate motor vehicle inspection services may engage in motor vehicle inspection activities.
Organizations operating motor vehicle inspection services must be legally and financially independent from organizations and individuals engaged in automobile transportation, maintenance, and repair of motor vehicles. Legal and financial independence means the following:
a) Not under the direct management of the same agency or organization;
b) Organizations and individuals engaged in automobile transportation, maintenance, and repair of motor vehicles do not hold shares or contribute more than 10% of the capital of the organization operating motor vehicle inspection services.
Chapter II
Article 1. Conditions for Issuing a Certificate of Compliance with Conditions for Motor Vehicle Inspection Activities
Article 5. General Conditions
An organization that meets the material conditions, inspection assembly lines, and human resources as stipulated in this Decree and the National Technical Regulations on Inspection Units issued by the Ministry of Transport shall be granted a certificate of compliance with conditions for motor vehicle inspection activities.
Article 6. Material Conditions
1. The inspection unit's site is a place used to arrange facilities for motor vehicle inspections on the same land area, with the following minimum areas:
a) For an inspection unit with one type I inspection assembly line, the minimum site area for inspection activities is 1,250 square meters.2;
b) For an inspection unit with one type II inspection assembly line, the minimum site area for inspection activities is 1,500 square meters.2;
c) For an inspection unit with two inspection assembly lines, the minimum site area for inspection activities is 2,500 square meters.2;
d) For an inspection unit with three or more inspection assembly lines, the area used for inspection activities from the third assembly line onwards must increase by at least 625 square meters for each additional assembly line.2.
2. Inspection Workshop
a) Inspection workshop with only one type I inspection assembly line: Minimum clearance dimensions (length x width x height) are 30 x 4 x 3.5 meters;
b) Inspection workshop with only one type II inspection assembly line: Minimum clearance dimensions (length x width x height) are 36 x 5 x 4.5 meters;
c) For inspection workshops with multiple inspection assembly lines arranged side by side, the distance between the centers of the assembly lines must not be less than 4 meters, and the distance from the center of the outermost assembly line to the inner wall of the nearest workshop wall must not be less than 2.5 meters;
d) In cases where inspection assembly lines are arranged in multiple inspection workshops, the total minimum length of the workshops must equal the length corresponding to the type of assembly line specified in points a and b of this clause.
3. Inspection assembly lines must be equipped with testing devices and tools in accordance with national technical standards issued by the Ministry of Transport, ensuring comprehensive testing of all systems, assemblies, and components of motor vehicles participating in traffic to ensure technical safety quality and environmental protection as prescribed by the Road Traffic Law.
Article 7. Human Resource Conditions
Human resources in inspection units must meet the following conditions:
1. Each inspection assembly line must have a minimum of three inspectors, including at least one senior motor vehicle inspector.
2. There must be a head of the inspection assembly line. Each head of the inspection assembly line may manage a maximum of two inspection assembly lines.
3. There must be a leader of the inspection unit and technical staff who comply with the provisions of this Decree.
Chapter III
ISSUANCE, TEMPORARY SUSPENSION, AND REVOCATION OF CERTIFICATE OF COMPLIANCE WITH CONDITIONS FOR MOTOR VEHICLE INSPECTION ACTIVITIES
Article 8. Procedures for Issuing a Certificate of Compliance with Conditions for Motor Vehicle Inspection Activities
1. After completing the construction and installation of technical facilities of the inspection unit, the organization shall prepare one set of application documents for issuing a certificate of compliance with conditions for motor vehicle inspection activities to be sent to the Vietnam Inspection Agency, which includes:
a) A request for inspection and issuance of a certificate of compliance with conditions for motor vehicle inspection activities;
b) A list of personnel with copies of labor contracts certified according to regulations or decisions on acceptance for inspectors and technical staff; appointment decisions for heads of inspection assembly lines; and appointment decisions for leaders of inspection units (if applicable);
c) A comparison of regulations on material facilities and inspection lines according to national technical standards;
d) Layout plans of the overall site and workshop floor plans with inspection assembly lines and testing equipment;
đ) Documents on labor safety and fire prevention and control in accordance with the law.
2. Procedures and methods for issuing certificates of qualification for vehicle inspection activities
a) Within three working days, if the documents are complete and compliant with the regulations, the Vietnam Inspection Agency will notify the organization of the inspection and evaluation time for the inspection unit. If the documents are incomplete or non-compliant, the Vietnam Inspection Agency must notify the organization in writing, specifying the reasons;
b) Within five working days from the date of notification for inspection and evaluation, the Vietnam Inspection Agency will conduct an actual inspection and evaluation. The evaluation results will be recorded in a report according to the model prescribed in Appendix I attached to this Decree. If the requirements are met, the certificate of compliance with conditions for motor vehicle inspection activities will be issued within five working days; if the inspection and evaluation results do not meet the requirements, the Vietnam Inspection Agency must notify the organization in writing within five working days to rectify and re-inspect and evaluate.
3. Submission of applications and delivery of results shall be conducted directly at the Vietnam Inspection Agency or through postal services or other appropriate methods. The application documents for each method of submission must comply with the provisions of Clause 1 of this Article.
4. The certificate of compliance with conditions for motor vehicle inspection activities shall be in the form prescribed in Appendix II attached to this Decree.
Article 9. Procedures for Reissuing Certificates of Eligibility for Motor Vehicle Inspection Activities
1. The reissuance of certificates of eligibility for motor vehicle inspection activities that have been revoked shall be carried out according to the initial issuance procedures stipulated in Article 8 of this Decree.
2. In cases where the certificate of eligibility for motor vehicle inspection activities is lost or damaged, the inspection unit shall submit a request for reissuance of the certificate to the Vietnam Registration and Inspection Agency. The Vietnam Registration and Inspection Agency shall issue a new certificate of eligibility for motor vehicle inspection activities within five working days from the date of receipt of the request, clearly stating that it is a reissued certificate and that the previously issued lost or damaged certificate is nullified.
3. If there are changes in the location, premises, inspection workshop, or layout of the inspection line of the motor vehicle inspection unit, or if there are changes in testing equipment affecting the number of operational inspection lines, the unit must notify the Vietnam Registration and Inspection Agency (accompanied by a comparison of the provisions on physical facilities and inspection lines according to national technical regulations). Within five working days from the date of receipt of the notification, the Vietnam Registration and Inspection Agency will conduct an examination and evaluation of the changes. If the requirements are met, the certificate of eligibility for motor vehicle inspection activities will be issued within five working days; if the examination and evaluation results do not meet the requirements, the Vietnam Registration and Inspection Agency must notify in writing within five working days to allow the organization to rectify and undergo another examination and evaluation.
4. In cases where personnel changes affect the number of operational inspection lines, the unit must notify the Vietnam Registration and Inspection Agency. Based on the retained files, the Vietnam Registration and Inspection Agency shall reissue the certificate of eligibility for motor vehicle inspection activities within five working days from the date of receipt of the notification.
Article 10. Suspension of Business Operations for Motor Vehicle Inspection Services for a Specified Period
1. An inspection unit may have individual inspection lines suspended for one to three months if it violates any of the following circumstances:
a) Failing to meet one of the conditions, requirements, or regulations set forth in this Decree and national technical standards for inspection units;
b) Having two inspection officers suspended for a continuous period of twelve months;
c) Assigning inspection officers to inspect vehicles in a manner inconsistent with their inspection officer certification.
2. An inspection unit may have all its motor vehicle inspection activities suspended for one to three months under any of the following circumstances:
a) Conducting inspections and issuing inspection certificates for motor vehicles that do not comply with standards, technical regulations, provisions, or authority;
b) Having three or more inspection officers suspended or two or more inspection officers having their certificates revoked within a continuous period of twelve months;
c) Having two or more inspection lines suspended within a continuous period of twelve months;
d) Conducting inspections when testing equipment is damaged, lacks accuracy, and has not been inspected or evaluated as required.
3. Depending on the circumstances and severity of the violation, inspection units may also be subject to administrative penalties as prescribed by law.
Article 11. Revocation of Certificate of Eligibility for Motor Vehicle Inspection
The inspection unit shall have its Certificate of Eligibility for Motor Vehicle Inspection revoked in any of the following cases:
1. The Certificate of Eligibility for Motor Vehicle Inspection was issued due to fraud or falsification of application documents, papers, or materials.
2. The Certificate of Eligibility for Motor Vehicle Inspection has been intentionally altered or tampered with, causing distortion of its contents.
3. Ceasing motor vehicle inspection activities for more than twelve consecutive months.
4. Being temporarily suspended from all motor vehicle inspection activities for more than two times within twelve consecutive months.
5. Having five or more inspection officers suspended, or three or more inspection officers having their certificates revoked within twelve consecutive months.
6. The inspection unit being dissolved.
Article 12. Procedures for Temporary Suspension and Revocation of Certificate of Eligibility for Motor Vehicle Inspection
1. The Vietnam Registration Agency issues a decision to temporarily suspend or revoke the Certificate of Eligibility for Motor Vehicle Inspection, notifies relevant agencies to coordinate implementation, and publishes it on the Vietnam Registration Agency's electronic information website.
2. The inspection unit must return the Certificate of Eligibility for Motor Vehicle Inspection to the Vietnam Registration Agency (in case of revocation) and immediately cease motor vehicle inspection activities upon the decision taking effect.
3. An inspection unit whose Certificate of Eligibility for Motor Vehicle Inspection has been revoked may only be considered for reissuance of the Certificate of Eligibility for Motor Vehicle Inspection after thirty-six months from the date of revocation.
4. When temporarily suspended or having its Certificate of Eligibility for Motor Vehicle Inspection revoked, the leadership of the inspection unit and the inspection officers directly responsible for inspections continue to bear legal responsibility for the results of inspections issued by their unit that remain valid.
5. When temporarily suspended or having its Certificate of Eligibility for Motor Vehicle Inspection revoked, related organizations and individuals must continue to fulfill other obligations and responsibilities as prescribed by law.
Article 13. Procedures for Ceasing Motor Vehicle Inspection Activities
1. In the event of sudden cessation of operations for one day or more, the inspection unit must notify the local Department of Transport, the Vietnam Registration Agency, specifying the reasons for ceasing operations and remedial measures; and inform the waiting room for vehicle owners and maintain a department to handle matters related to inspection records.
2. In the case where the inspection unit requests to cease operations for up to twelve consecutive months.
a) The inspection unit must report in writing to the local Department of Transport and the Vietnam Registration Agency, clearly stating the reasons and duration of cessation of operations thirty days prior to cessation, and simultaneously inform the waiting room and publicize through mass media for vehicle owners to be informed;
b) Must maintain a department to handle matters related to inspection records.
3. In the case where the inspection unit requests to cease operations for more than twelve consecutive months.
a) The inspection unit must report in writing to the local Department of Transport and the Vietnam Registration Agency, clearly stating the reasons and duration of cessation of operations thirty days prior to cessation, and simultaneously inform the waiting room and publicize through mass media for vehicle owners to be informed;
b) Return the Certificate of Eligibility for Motor Vehicle Inspection;
c) Transfer all vehicle records managed by the unit to another inspection unit according to the guidance of the Vietnam Registration Agency.
Chapter IV
REGULATIONS ON MANAGEMENT AND OPERATIONS OF INSPECTION UNITS
Article 14. Vehicle Inspection Officers
1. Conditions for issuing a vehicle inspection officer certificate
a) Professional qualifications: Graduated from a bachelor's program in Mechanical Engineering with the following contents included in the curriculum: Automotive Theory, Automotive Structure, Automotive Structural Calculations, Automotive Technical Maintenance, Internal Combustion Engines, and Automotive Electrical Systems or equivalent content. In cases where these contents are not fully covered, supplementary training can be conducted at universities;
b) At least 12 months of practical training as a vehicle inspection officer according to the content prescribed by the Ministry of Transport;
c) A satisfactory assessment result for the professional qualifications of a vehicle inspection officer as stipulated by the Ministry of Transport. The assessment results are recorded on the Minutes according to the model prescribed in Appendix IV issued together with this Decree;
d) A valid driver's license for automobiles.
2. Conditions for issuing a certificate for a high-level vehicle inspection officer
a) Professional qualifications: Graduated from a bachelor's program in Mechanical Engineering with the following contents fully included in the curriculum: Automotive Theory, Automotive Structure, Automotive Structural Calculations, Automotive Technical Maintenance, Internal Combustion Engines, and Automotive Electrical Systems or equivalent content;
b) Has at least 36 months of experience as a vehicle inspection officer;
c) A satisfactory assessment result for the professional qualifications of a high-level vehicle inspection officer as stipulated by the Ministry of Transport. The assessment results are recorded on the Minutes according to the model prescribed in Appendix IV issued together with this Decree.
Article 15. Procedures for Issuing a Vehicle Inspection Officer Certificate
1. Individuals who meet the conditions specified in Article 14 of this Decree have the right to request the Vietnam Vehicle Inspection Agency to issue a vehicle inspection officer certificate. The application dossier for issuing a vehicle inspection officer certificate includes:
a) Application for issuance of a vehicle inspection officer certificate;
b) Professional history according to the model prescribed in Appendix III issued together with this Decree (for the first-time application for a vehicle inspection officer certificate and reissuance of a vehicle inspection officer certificate after revocation);
c) Photocopies certified from the original or photocopies certified or photocopies accompanied by the original for comparison of the bachelor's degree diploma and transcript;
d) A confirmation letter of practical training as a vehicle inspection officer from the inspection unit (for the vehicle inspection officer category);
đ) Color photographs measuring 4 cm x 6 cm, taken in the format of an identity card, within six months;
2. Procedure and method of implementation
a) Organizations and individuals complete the dossier in accordance with Clause 1 of this Article and submit it to the Vietnam Vehicle Inspection Agency. For the vehicle inspection officer category, the submission of the dossier must be completed within twelve months from the date of completion of practical training as a vehicle inspection officer;
b) The Vietnam Vehicle Inspection Agency receives and checks the dossier components; within three working days from the date of receiving the dossier; if the requirements are met, they notify the organization or individual applying for the vehicle inspection officer certificate about the time for practical assessment on the inspection line and evaluation of the mastery of standards, regulations, and provisions; if not met, they must provide a written response stating the reasons;
c) The Vietnam Vehicle Inspection Agency conducts the assessment of the vehicle inspection officer's professional qualifications, the assessment results are recorded in the Minutes of the vehicle inspection officer assessment according to the model prescribed in Appendix IV issued together with this Decree; if the assessment results are satisfactory, they issue the vehicle inspection officer certificate within five working days from the date of assessment. In cases where the assessment is unsatisfactory, the organization or individual has the right to request the Vietnam Vehicle Inspection Agency to reassess after one month from the date of assessment;
d) The receipt of the dossier and delivery of the results are carried out directly, through the postal service system, or by other appropriate methods.
3. The vehicle inspection officer certificate is valid for thirty-six months from the date of issuance and according to the model prescribed in Appendix V issued together with this Decree.
Article 16. Procedure for Reissuing the Inspection Certificate
1. Within thirty days before the expiration date of the inspection certificate, the inspection unit and the inspector shall submit a request for reissuance of the inspection certificate (accompanied by a color photograph measuring 4 cm x 6 cm, taken in the format of an identity card, not older than six months) to the Vietnam Inspection Agency.
Within five working days from the date of receipt of the request, the Vietnam Inspection Agency shall conduct an assessment of the inspector's inspection skills at the inspection unit where the inspector works. If the requirements are met, the inspection certificate will be issued three working days after the assessment date. If the requirements are not met, the reasons for non-compliance shall be clearly stated in the inspection assessment record; the inspection unit and the inspector have the right to request the Vietnam Inspection Agency to reassess after one month from the date of the non-compliant assessment.
2. In case the inspection certificate is lost or damaged, the inspector shall submit a request for reissuance of the inspection certificate to the Vietnam Inspection Agency. Based on the retained file, the Vietnam Inspection Agency shall issue the reissued inspection certificate within five working days from the date of receipt of the request, noting that the reissued inspection certificate is valid and the previously issued lost or damaged inspection certificate is invalidated. The reissued inspection certificate shall not exceed the validity period of the original inspection certificate.
Article 17. Suspension of Inspectors
An inspector may be suspended from participating in inspection activities for a period of one to three months in the following cases:
1. Altering inspection results.
2. Failing to comply with regulations, procedures, standards, technical norms, and related guidelines for inspection work.
Article 18. Revocation of the Inspection Certificate
An inspector's inspection certificate may be revoked in the following cases:
1. Violating any clause of Article 17 of this Decree to a degree causing serious consequences related to vehicle safety.
2. Fabricating documents to obtain an inspection certificate.
3. Being suspended from participating in inspection activities twice within a continuous twelve-month period.
4. Being convicted by a court judgment that has become legally binding.
5. Losing or being restricted in civil capacity.
6. Not directly performing inspection duties or guiding, assessing inspection skills for more than twelve consecutive months.
7. Simultaneously working at two or more inspection units.
Article 19. Procedures for Suspending Participation in Inspection Activities and Revoking the Inspection Certificate
1. The Vietnam Inspection Agency shall issue a decision to suspend or revoke the inspection certificate, notify relevant agencies to cooperate in implementation, and publish it on the Vietnam Inspection Agency’s electronic information website.
2. The inspector must return the inspection certificate to the Vietnam Inspection Agency (in the case of revocation of the inspection certificate) and immediately cease participation in motor vehicle inspections at the inspection unit upon the effective date of the decision.
3. An inspector whose inspection certificate has been revoked can only be considered for reissuance of the motor vehicle inspection certificate after thirty-six months from the date of revocation.
Article 20. Professional staff for vehicle inspection
1. The minimum professional qualification is a vocational college degree.
2. They shall be trained and issued with a certificate for professional staff for vehicle inspection in accordance with the regulations of the Ministry of Transport.
Article 21. Suspension of professional staff for vehicle inspection
Professional staff for vehicle inspection shall be suspended from participating in vehicle inspection activities for a period of one to three months in the following cases:
1. Altering records during vehicle inspection.
2. Not complying with relevant regulations, procedures, and guidelines in the inspection work.
Article 22. Procedure for suspending participation in professional inspection activities of professional staff for vehicle inspection
1. The Vietnam Vehicle Inspection Agency shall issue a decision on suspension and notify relevant agencies to cooperate in implementation.
2. Professional staff for vehicle inspection shall cease participating in vehicle inspection activities at the inspection unit immediately upon the decision taking effect.
Article 23. Supervisor of inspection lines
1. A supervisor of inspection lines must be a senior vehicle inspector.
2. They are responsible for the operation of vehicle inspection on the inspection lines they supervise.
Article 24. Leaders of inspection units
1. The leader of an inspection unit is responsible for organizing and managing the inspection activities of the unit and signing the inspection certification.
2. The leader of an inspection unit must be a vehicle inspector who has performed the duties of a vehicle inspector for a minimum of thirty-six months as stipulated by law.
Article 25. Provisions during the operation of inspection units
1. Conduct inspections and issue inspection certificates for vehicles in accordance with regulations, procedures, standards, technical norms, and related guidelines.
2. Maintain material conditions, human resources, and inspection lines.
3. Collect service fees, charges, and other revenues related to vehicle inspection activities and fulfill financial obligations in accordance with the law.
4. Within eighteen months from receiving the certificate of eligibility for vehicle inspection operations, the inspection unit must establish, implement, and maintain a quality management system according to ISO 9001 standards.
5. Publicly display at waiting rooms and inspection workshops information about procedures, inspection contents; fee schedules, charge rates, inspection cycles, hotlines of the Vietnam Vehicle Inspection Agency, and other notifications as prescribed.
6. Implement data transmission and reporting as required.
Article 26. Number of vehicles inspected by inspection units
The number of vehicles certified for inspection in a day (within eight working hours) must simultaneously meet the following requirements:
1. In the case where one inspector checks one vehicle on an inspection line, the number of vehicles shall not exceed twenty; in the case where multiple inspectors check one vehicle on an inspection line, the number of vehicles shall not exceed twenty times the number of inspectors.
2. Not more than ninety vehicles for an inspection line type I and not more than seventy vehicles for an inspection line type II. For an inspection line type II used only for inspecting vehicles with a single axle load of up to 2,000 kg, the number of vehicles inspected shall be treated as for an inspection line type I.
Chapter V
IMPLEMENTATION
Article 27. Implementation Organization
1. The Ministry of Transport is responsible for guiding, organizing implementation, supervising, inspecting, and handling violations of this Decree's provisions; issuing national standards for vehicle inspection units.
2. Provincial People's Committees, municipalities directly under the central government shall direct provincial Departments of Transport and relevant agencies at the local level to coordinate in performing state management functions over the business of vehicle inspection services for inspection units within their jurisdiction in accordance with this Decree.
3. Establishment of inspection units
a) Be responsible for the legality of the application dossier for issuing certificates of meeting the conditions to operate vehicle inspections;
b) Notify the Vietnam Vehicle Inspection Agency before implementing the establishment of an inspection unit.
4. The Vietnam Vehicle Inspection Agency
a) Organize supervision and inspection of tasks assigned under this Decree regarding business conditions, management, and vehicle inspection activities;
b) Annually, inspect and evaluate the maintenance of material conditions, human resources, inspection lines, and inspection activities; calibrate inspection equipment at inspection units;
c) Develop, manage, and guide the uniform use of software management programs, inspection databases nationwide, internal data networks, and vehicle inspection data management;
d) Organize training for vehicle inspectors and professional staff for vehicle inspection upon request from vehicle inspection units, individuals, and organizations establishing vehicle inspection units; provide specialized training on inspection content and procedures as prescribed by the Ministry of Transport;
đ) Handle and propose handling of violations in accordance with the provisions of this Decree against organizations and individuals violating the provisions of this Decree;
e) Publish on the Vietnam Vehicle Inspection Agency’s website the list of inspection units granted, temporarily suspended, or revoked certificates of eligibility for vehicle inspection operations.
5. Inspection Units
a) Comply with the provisions of this Decree and related laws concerning business conditions and vehicle inspection activities; send vehicle inspectors to update and supplement inspection skills when there are changes in relevant standards, regulations, and technological advancements in vehicle inspection work;
b) Cooperate with competent state agencies in tasks related to traffic safety assurance, technical condition assessment, and environmental protection of vehicles;
c) Be subject to inspection and supervision by authorized agencies regarding business conditions and vehicle inspection activities;
d) Ensure normal inspection operations for a minimum of eight hours per day and five days per week; publicly announce inspection hours at the unit's headquarters.
đ) Transfer all relevant archival files concerning motor vehicles in accordance with the guidelines of the Vietnam Vehicle Inspection Agency when the inspection unit is dissolved or the certificate of eligibility for vehicle inspection is revoked.
Chapter VI
IMPLEMENTING PROVISIONS
Article 28. Transitional Provisions
1. The certificate of eligibility for vehicle inspection issued before the effective date of this Decree remains valid until its expiration date as stated on the certificate.
2. The inspector certification issued before the effective date of this Decree remains valid until its expiration date. Individuals currently undergoing training or internship to become inspectors shall still be issued inspector certifications in accordance with the regulations at the time of their training.
3. Motor vehicle inspection units that have been issued certificates of eligibility for vehicle inspection, and inspectors who have been issued inspector certifications before July 1, 2016 must fully comply with the conditions stipulated in this Decree from July 1, 2019, except for the provisions set forth in Clause 1, Clause 2 Article 6 and Point a, Point b Clause 1 Article 14 of this Decree.
Article 29. Effectiveness and Responsibility for Implementation
1. This Decree takes effect from January 1, 2019 and replaces Decree No. 63/2016/NĐ-CP dated July 1, 2016 of the Government regarding the conditions for operating vehicle inspection services.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central city administrations, and related organizations and individuals are responsible for implementing this Decree./
