Decree No. 139/2020/ND-CP amends and supplements certain articles of Decree No. 13/2014/ND-CP dated February 25, 2014, of the Government detailing and providing measures to implement the Law on National Defense and Security Education.

DECREE

Amending and supplementing certain articles of Decree No. 13/2014/NĐ-CPdated February 25, 2014 of the Government detailing and implementing measures for the Law on National Defense and Security Education

Pursuant to the Law on the Organization of the Government dated June 19, 2015; the Law amending and supplementing certain articles of the Law on the Organization of the Government and the Law on the Organization of Local Administration dated November 22, 2019;

Based on the Law on National Defense Education and Security dated June 19, 2013;

"Based on the proposal of the Minister of National Defense;"

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 13/2014/NĐ-CP dated February 25, 2014 of the Government detailing and implementing measures for the Law on National Defense and Security Education.

Article 1. Amending and supplementing certain articles of Decree No. 13/2014/NĐ-CP dated February 25, 2014 of the Government detailing and implementing measures for the Law on National Defense and Security Education as follows:

1. Amend and supplement Point a Clause 1 Article 2 as follows:

"a) The Chairman of the Central Council for National Defense and Security Education decides to convene individuals under the management of the Politburo and the Secretariat, and persons who are

2. Amending and supplementing point a and point b of Clause 3, Article 2 as follows:

a) Amending and supplementing point a of Clause 3, Article 2 as follows:

"a) The Chairman of the Provincial Council for National Defense and Security Education decides to convene training on national defense and security knowledge for religious dignitaries and religious functionaries; cultural, social, scientific, and artistic activists within the province's territory not falling under the scope defined in Clauses 1 and 2 of this Article according to the plan approved by the Chairman of the Provincial People's Committee;"

b) Amend and supplement Point b Clause 3 of Article 2 as follows:

"b) The Chairman of the County Council for National Defense and Security Education convenes training on national defense and security knowledge for village elders and clan leaders within the county's territory according to the plan approved by the Chairman of the County People's Committee."

3. Amending and supplementing Clause 2, Clause 3, Clause 4, and Clause 5 of Article 3 as follows:

a) Amend and supplement Clause 2 of Article 3 as follows:

"2. The Political Academy under the Ministry of National Defense provides training on national defense and security knowledge for Object 2 belonging to state agencies and organizations, political organizations, and political-social organizations at the central level within the territory of Hanoi City; military schools of military regions provide training on national defense and security knowledge for Object 2 within their respective military regions; the Military School of the Hanoi Capital Command provides training on national defense and security knowledge for Object 2 of Hanoi City;"

b) Amend and supplement Clause 3 of Article 3 as follows:

"3. Training on national defense and security knowledge for Object 3 and equivalent to Object 3 is as follows:

a) The Military School of the Hanoi Capital Command provides training on national defense and security knowledge for Object 3 and equivalent to Object 3 in Hanoi City;

b) The Military School of the Ho Chi Minh City Command provides training on national defense and security knowledge for Object 3 and equivalent to Object 3 in Ho Chi Minh City;

c) Object 3 and equivalent to Object 3 within provinces and centrally-administered cities (except Hanoi City and Ho Chi Minh City) shall be provided with training on national defense and security knowledge by the Military Command of the province at the permanent regiment or infantry regiment, or training center for reserve forces mobilization within the province."

c) Amending and supplementing Clause 4 of Article 3 as follows:

"4. The Military Command of the county advises the same-level Council for National Defense and Security Education to organize training on national defense and security knowledge for Object 4 belonging to state agencies and organizations at the county level and equivalent to Object 4, representatives of the People's Councils at the commune level, village elders, and clan leaders within the territory, according to the plan approved by the Chairman of the County People's Committee.

State agencies and organizations at the central and provincial levels with headquarters within the county, and the Council for National Defense and Security Education at the commune level organize training on national defense and security knowledge for Object 4 under their management according to the plan approved by the Chairman of the County People's Committee."

d) Amending and supplementing Clause 5 of Article 3 as follows:

"5. The Chairman of the Provincial Council for National Defense and Security Education stipulates the location for training on national defense and security knowledge for the subjects specified in Point a of Clause 3, Article 2 of this Decree."

4. Amending and supplementing point c and point d of Clause 1, Article 4 as follows:

a) Amending and supplementing point c of Clause 1, Article 4 as follows:

"c) Annually, the Office of the Provincial Council for National Defense and Security Education takes the lead and coordinates with the same-level Party Organization Department, the Provincial Department of Home Affairs, and related agencies to develop plans for training on national defense and security knowledge for Object 3 and equivalent to Object 3, religious dignitaries and religious functionaries, cultural, social, scientific, and artistic activists within the province for the following year, submitting them for approval by the Chairman of the Provincial People's Committee in July; developing plans for each session for approval by the Chairman of the Provincial Council for National Defense and Security Education and organizing implementation.

For Hanoi City and Ho Chi Minh City, the Office of the City Council for National Defense and Security Education directs military schools to develop plans for each session for approval by the Chairman of the City Council for National Defense and Security Education and organizing implementation."

b) Amending and supplementing point d of Clause 1, Article 4 as follows:

"d) Annually, the development of plans for training on national defense and security knowledge for Object 4 is carried out as follows:

The Office of the County Council for National Defense and Security Education takes the lead and coordinates with the same-level Party Organization Department, the County Department of Home Affairs, and related agencies to develop plans for training on national defense and security knowledge for Object 4 and equivalent to Object 4, village elders, and clan leaders of the county, and representatives of the People's Councils at the commune level for the following year, submitting them for approval by the Chairman of the County People's Committee in July; developing plans for each session for approval by the Chairman of the County Council for National Defense and Security Education and organizing implementation.

The Council for National Defense and Security Education at the commune level develops plans for training on national defense and security knowledge for Object 4 of the commune (excluding representatives of the People's Councils at the commune level) for the following year, submitting them for approval by the Chairman of the County People's Committee in July, developing plans for each session for approval by the Chairman of the County Council for National Defense and Security Education and organizing implementation.

The head of state agencies, political organizations, and socio-political organizations at the central level and provincial level with headquarters within the district territory shall develop the training plan for national defense and security knowledge for target group 4 under their jurisdiction for the following year, submit it to the Chairman of the People's Committee of the district for approval in July; develop the plan for each course, submit it to the Chairman of the National Defense Education Council of the district for approval and organize its implementation.

5. Amend and supplement Point d and Point e of Clause 2, Article 5 as follows:

a) Amend and supplement Point d of Clause 2, Article 5 as follows:

"d) The Commander-in-Chief of the Provincial Military Command; the Principal of the Military School of the Hanoi Capital Command, the Principal of the Military School of the Ho Chi Minh City Command shall decide on issuing, reissuing, revoking, and canceling certificates of completion of the national defense and security knowledge training program for the subjects specified in Clause 3, Article 5 of this Decree.

The Commander of the Hanoi Capital Command, the Commander of the Ho Chi Minh City Command, the Commander-in-Chief of the Provincial Military Command shall decide on issuing, reissuing, revoking, and canceling certificates of completion of the national defense and security knowledge training program for religious dignitaries and religious functionaries; cultural, social, scientific, and artistic workers in the area.

The Commander of the District Military Command shall decide on issuing, reissuing, revoking, and canceling certificates of completion of the national defense and security knowledge training program for target group 4 under the jurisdiction of district agencies and organizations equivalent to target group 4, representatives of the People's Councils at the commune level, village elders, and clan chiefs in the area.

The Chairman of the People's Committee at the commune level shall decide on issuing, reissuing, revoking, and canceling certificates of completion of the national defense and security knowledge training program for target group 4 of the commune.

b) Amend and supplement Point e of Clause 2, Article 5 as follows:

"e) The head of state agencies, political organizations, and socio-political organizations at the central level and provincial level shall decide on issuing, reissuing, revoking, and canceling certificates of completion of the national defense and security knowledge training program for target group 4 under their management."

Article 2. Effective Date

This Decree takes effect from January 15, 2021.

Article 3. Responsibility for Implementation

The Minister, Head of a ministerial-level agency, Head of an agency under the Government, Chairmen of People's Committees of provinces and centrally governed cities, relevant agencies, organizations, and individuals shall be responsible for implementing this Decree./.
