Regarding the establishment of the Food Safety Quality Management Agency under the Ministry of Health "d) The original or a certified copy of the discharge summary or a summary of the medical record as prescribed in Appendix 3 and Appendix 4 issued together with this Circular. If the worker has not been hospitalized or treated as an outpatient, they must have documents related to the examination and treatment of occupational injuries or diseases corresponding to the time of the accident and the injury for which assessment is requested. 

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

To strengthen the management of food safety and quality

At the proposal of the Ministry Ministry of Science and Technology Y 2. Provide declarations of origin of farmed aquatic products for each raw material lot to processing facilities and other raw material trading facilities when selling raw materials; Director, Head of the Organizational-Cadre Board - Central Steering Committee for Anti-Corruption and Elimination of Negative Practices

DECISION:

Article 1. Establishing the Food Safety Quality Management Agency under the Ministry of Health to assist the Minister of Health in performing state management functions regarding food quality and safety throughout the country.

The Food Safety Quality Management Agency has legal personality, its own seal and separate account, with operational funds provided by the state budget. The agency's headquarters is located in Hanoi city.

Article 2. The Food Safety Quality Management Agency shall have the following main tasks and authorities:

1. Drafting or participating in drafting regulatory legal documents on food quality and safety to assist the Minister of Health in promulgating within their authority or submitting to the Government for approval.

2. Developing or participating in developing food quality standards, technical procedures and regulations ensuring food quality and safety for the Minister of Health to promulgate or provide comments to the competent authority.

Issuing guiding documents to implement food quality and safety standards, technical procedures and regulations, certifying food establishments meeting hygiene and safety conditions.

3. Compiling a list of foods requiring quality registration for the Minister of Health to promulgate and organize the implementation of food quality registration.

Issuing and revoking quality registration certificates and hygiene safety certificates for domestically produced foods, including industrially processed foods, within their authority.

4. Organizing inspections and audits of the implementation of laws on food quality and safety.

Conducting quality and safety inspections on imported foods in accordance with the law.

5. Participating and coordinating with relevant agencies in preventing and combating the production and circulation of substandard and unsafe foods.

Coordinating with related organizations under the Ministry of Culture, Sports and Tourism in managing advertising information for children's food, patient food, elderly food, pregnant women's food, and other specially regulated foods; organizing publicity and dissemination on food quality and safety.

Implementing international cooperation in the field of food quality and safety according to the division of labor by the Ministry of Health.

8. Managing organization, civil servants, assets, and allocated funds in accordance with the law and the delegation of the Minister of Health.

Article 3. The Food Safety Quality Management Agency shall have a Director and several Deputy Directors appointed by the Minister of Health.

The Director is responsible to the Minister of Health for all activities of the Agency. Deputy Directors assist the Director and are responsible to the Director for assigned tasks.

The Minister of Health is responsible for specifying the tasks, organizational structure, and staffing of the Food Safety Quality Management Agency after consultation with the Minister and the Head of the Organizational-Cadre Board of the Government.

Article 4. Local food safety and quality management tasks shall be carried out by the Department of Health.

Article 5. This Decision takes effect fifteen days from the date of signature. All previous provisions contrary to this Decision are abolished.

The Minister of Health, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and municipal People's Committees directly under the Central Government are responsible for implementing this Decision./.
