This Circular guides the management transfer of investment projects from Group A to Group B in accordance with Government Decree No. 12/2000/NĐ-CP, specifying the procedures for approval and implementation of projects that have been approved or not yet approved.

Guidelines for handling the conversion of management of investment projects and construction in accordance with Decree No. 12/2000/NĐ-CP dated May 5, 2000
of the Government on amending and supplementing Decree No. 52/1999/NĐ-CP
The Government amends and supplements Decree No. 52/1999/NĐ-CP
NOn May 5, 2000, the Government issued Decree No. 12/2000/NĐ-CP to amend and supplement certain provisions of the Investment and Construction Management Regulations promulgated together with Decree No. 52/1999/NĐ-CP dated July 8, 1999, thereby changing the classification scale for investment projects into groups A, B, C.
Pursuant to Article 3 of Government Decree No. 12/2000/NĐ-CP regarding the organization and guidance on monitoring the implementation of this Decree, after reaching consensus with the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Construction, guidelines for handling the conversion of certain management provisions for investment projects under Government Decree No. 12/2000/NĐ-CP are as follows:
For investment projects (including component or sub-projects) classified as group A in Decree No. 52/1999/NĐ-CP, which now fall into group B according to the classification of investment projects under Decree No. 12/2000/NĐ-CP, the following handling procedures apply:
1. In cases where an investment project has not yet been approved by the Prime Minister, the approval process shall be carried out in accordance with the provisions for group B projects as stipulated in Government Decree No. 12/2000/NĐ-CP dated May 5, 2000.
2. In cases where an investment project has already been approved by the Prime Minister or certain subsequent stages have also been approved according to the provisions for group A projects, such cases do not need to be re-approved; subsequent steps shall be carried out in accordance with the provisions applicable to group B projects./.
