Regarding the delegation of authority to approve final accounts for completed investment projects in the transportation sector
THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 34/2003/NĐ-CP dated 04/4/2003 The Government has stipulated the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government on the issuance of the Investment Management and Construction Regulations; Decree No. 12/2000/NĐ-CP dated May 5, 2000 of the Government amending and supplementing certain articles of Decree No. 52/1999/NĐ-CP; Decree No. 07/2003/NĐ-CP dated January 30, 2003 of the Government amending and supplementing one article of Decree No. 52/1999/NĐ-CP and Decree No. 12/2000/NĐ-CP;
Pursuant to Circular No. 45/2003/TT-BTC dated 15/5/2003 of the Minister of Finance guiding the finalization of investment capital;
At the proposal of the Director of the Financial Department and the Director of the Legal Department
DECISION:
Article 1. Delegates to the Directors of the Vietnam Highway Administration, the Vietnam Maritime Administration, the Vietnam Civil Aviation Administration, the Vietnam Inland Waterway Administration, and the Chairmen of the Boards of State-Owned Enterprises (Enterprises 91, 90) under the Ministry of Transport the authority to approve the final accounts for completed investment projects of Category C (including projects that have not yet been approved for final accounts) decided upon by the Minister of Transport for implementation using state budget funds, state-guaranteed credit, and state development credit, specifically as follows:
1. The Director of the Vietnam Highway Administration shall approve the final accounts for completed investment projects of projects where units under the Vietnam Highway Administration and Departments of Transportation (Departments of Transportation and Public Works) are the project sponsors.
2. The Director of the Vietnam Maritime Administration shall approve the final accounts for completed investment projects of projects where units under the Vietnam Civil Aviation Administration are the project sponsors.
3. The Director of the Vietnam Civil Aviation Administration shall approve the final accounts for completed investment projects of projects where units under the Vietnam Civil Aviation Administration are the project sponsors.
4. The Director of the Vietnam Inland Waterway Administration shall approve the final accounts for completed investment projects of projects where units under the Vietnam Inland Waterway Administration are the project sponsors.
5. The Chairmen of the Boards of State-Owned Enterprises (Enterprises 91, 90) shall approve the final accounts for completed investment projects of projects where units under their respective enterprises are the project sponsors.
Article 2. The finalization of investment capital for completed projects must be carried out in accordance with Circular No. 45/2003/TT-BTC dated May 15, 2003 of the Minister of Finance guiding the finalization of investment capital, other current regulations of the State, and regulations of the Ministry of Transport.
Article 3. The decision approving the final accounts for completed investment projects and related reports and statistics in the field of finalizing investment capital for completed projects shall be submitted to the Ministry of Transport and relevant agencies and units as prescribed.
Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Any previous provisions contrary to this decision are hereby abolished.
Article 5. The Heads of the Office of the Ministry, the Directors of the Departments directly under the Ministry, the Director of the Inspection and Quality Control Bureau, the Director of the Vietnam Highway Administration, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Civil Aviation Administration, the Director of the Vietnam Inland Waterway Administration, the Chairmen of the Boards of State-Owned Enterprises (Enterprises 91, 90), the General Managers of Project Management Boards, the Directors of Departments of Transportation (Departments of Transportation and Public Works), and the Heads of related units are responsible for implementing this Decision./.
