Circular No. 14/2007/TT-BKHCN supplements Circular No. 09/2007/TT-BKHCN dated April 6, 2007, issued by the Ministry of Science and Technology guiding the implementation of certain provisions of Decree No. 89/2006/NĐ-CP dated August 30, 2006, of the Government on product labels.

CIRCULAR

SUPPLEMENTING THE CIRCULAR NO. 09/2007/TT-BKHCN OF APRIL 6, 2007 ISSUED BY THE MINISTRY OF SCIENCE AND TECHNOLOGY GUIDING THE IMPLEMENTATION OF CERTAIN PROVISIONS OF THE GOVERNMENT DECREE NO. 89/2006/NĐ-CP OF AUGUST 30, 2006 ON PRODUCT LABELS

Pursuant to the Government Decree No. 54/2003/NĐ-CP dated May 19, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and the Government Decree No. 28/2004/NĐ-CP dated January 16, 2004 amending and supplementing certain provisions of the Government Decree No. 54/2003/NĐ-CP;
Pursuant to the Government Decree No. 89/2006/NĐ-CP dated August 30, 2006 on product labels;
Pursuant to the Notification No. 137/TB-VPCP dated July 4, 2007 of the Government Office conveying the conclusion of Deputy Prime Minister Nguyen Sinh Hung regarding the recording of the name and address of organizations and individuals responsible for products on product labels;
The Ministry of Science and Technology supplements Circular No. 09/2007/TT-BKHCN dated April 6, 2007 issued by the Ministry of Science and Technology guiding the implementation of certain provisions of the Government Decree No. 89/2006/NĐ-CP dated August 30, 2006 on product labels as follows:

1. Supplementing point g at the end of Clause 3, Section II as follows:

"g) For the production of goods, the organization or individual responsible for the goods, being a legal entity registered for producing and trading goods with trademarks and product labels owned by themselves or licensed for use, shall be responsible for the quality of goods bearing such trademarks and product labels;

For organizations or individuals responsible for goods produced at multiple facilities, products bearing the same brand from these facilities may record the name and address of the organization or individual responsible for the goods if they are confirmed by competent state management agencies that the quality of these goods meets the quality standards published by the organization or individual responsible for the goods."

2. Implementation Clauses

This Circular takes effect fifteen days after its publication in the Official Gazette.

Pursuant to the Government Decree No. 89/2006/NĐ-CP dated August 30, 2006 on product labels, Circular No. 09/2007/TT-BKHCN dated April 6, 2007 of the Ministry of Science and Technology guiding the implementation of certain provisions of the Government Decree No. 89/2006/NĐ-CP, and this Circular within the scope and field assigned for management, ministries and ministerial-level agencies shall organize the confirmation of the quality of goods so that the facilities of organizations and individuals responsible for goods comply with the quality standards of goods published by those organizations and individuals according to the laws on standards and technical regulations.
