DIRECTIVE

ON STRENGTHENING ENVIRONMENTAL PROTECTION WORK IN THE TRANSPORT INDUSTRY

Implementing Resolution No. 41-NQ/TW dated November 15, 2004 of the Politburo on environmental protection during the period of accelerating industrialization and modernization of the country and the Government's Action Program to implement Resolution No. 41-NQ/TW of the Politburo, the Ministry of Transport issued Decision No. 448/QĐ-BGTVT dated February 22, 2005 promulgating the Ministry's Action Program on environmental protection during the period of accelerating industrialization and modernization of the country and Directive No. 09/2005/CT-BGTVT dated June 3, 2005 on strengthening environmental protection work in the transport industry.

After three years of implementation, the entire transport industry has achieved certain results in the construction and implementation of regulatory legal documents on environmental protection; assessing environmental impact of investment projects for infrastructure development; inspecting and supervising the environment for motor vehicles; applying technology to treat and reduce environmental pollution; promoting and training to enhance knowledge on environmental protection for officials, civil servants, and employees. On September 1, 2008, the Minister of Transport issued Decision No. 2676/QĐ-BGTVT establishing the Department of Environment within the organizational structure of the Ministry to advise the leadership of the Ministry in managing environmental protection in transportation.

However, environmental protection work in the transport industry still requires innovation, concentration, and greater efforts from all agencies and units in the industry to fulfill new tasks assigned by the Government and to meet the rapid development of the national economy and society.

To further implement Resolution No. 41-NQ/TW of the Politburo, the Government's Action Program to implement Resolution No. 41-NQ/TW, and the National Target Program on energy conservation and efficiency, while intensifying the implementation of environmental protection tasks in the new situation, the Minister of Transport instructs the heads of agencies and units in the industry to focus on directing and organizing the implementation of specific tasks as follows:

1. Strengthening propaganda, education, and raising awareness about environmental protection and energy conservation and efficiency:

The Department of Environment shall take the lead and coordinate with the Vietnam Transport Environment Association and other subordinate agencies under the Ministry to disseminate and implement the Party's policies and State laws, and to promote and educate to raise awareness about environmental protection and energy conservation and efficiency among all cadres, civil servants, and workers in the transport industry.

2. Improving the organizational structure for managing and implementing environmental protection tasks throughout the industry in accordance with Decree No. 81/2007/NĐ-CP dated May 23, 2007 of the Government:

2.1. The Department of Organization and Cadre Affairs shall take the lead and coordinate with relevant agencies to continue reinforcing human resources for the Department of Environment and establish specialized departments for environmental protection within the organizational structure of General Departments and specialized management agencies.

2.2. Groups, Corporations, and state-owned enterprises in the transport industry shall organize specialized departments and staff responsible for environmental protection and energy conservation and efficiency within their enterprises.

3. Concentrating on directing the implementation of tasks assigned by the Government and the Ministry's Action Program on environmental protection during the period of accelerating industrialization and modernization of the country, specifically as follows:

3.1. The Department of Environment:

a/ Shall take the lead and coordinate with the Legal Department, General Departments, and specialized management agencies to organize the drafting and submission to the Ministry for issuance of regulatory legal documents, standards, and norms on environmental protection and energy conservation and efficiency in the transport industry.

b/ Shall take the lead and coordinate with the Information Technology Center and General Departments, and specialized management agencies to build databases on the transport environment to serve environmental management work.

c/ Shall take the lead and coordinate with the Vietnam Vehicle Inspection Agency to monitor and evaluate the implementation of environmental indicators and sustainable development in the transport industry according to Directive No. 26/2007/CT-TTg dated November 26, 2007 of the Prime Minister.

d/ Shall organize the implementation of programs, projects, proposals, and tasks on environmental protection and energy conservation and efficiency in the transport industry.

3.2. 3.4. General Departments and specialized management agencies under the Ministry:

3.4.1 Common tasks:

a/ Draft and submit to the Ministry and competent authorities for issuance of regulatory legal documents, standards, and norms on environmental protection and energy conservation and efficiency in their respective fields of management.

b/ Strictly implement environmental impact assessments for projects they are the main investors and organizers, and fully implement approved and confirmed environmental protection commitments, management, and monitoring programs.

c/ Develop plans, organize inspections, urge enforcement of environmental protection laws for transportation activities within their jurisdiction, and report to the Minister on the implementation results before December 31 each year.

d/ Direct proposals, registration, and implementation of projects, programs, and tasks related to environmental protection, energy conservation, and efficiency aimed at enhancing awareness among civil servants, employees, and workers about environmental protection, energy security, and evaluating, forecasting, reducing, and handling pollution caused by transportation activities within their management scope.

3.4.2 Specific tasks:

a/ Vietnam Highway Administration:

- Direct research and implement comprehensive solutions to address environmental pollution from the Hai Van Road Tunnel operation; promptly report to the Ministry issues exceeding their authority.

- Strengthen research, application of environmentally friendly technologies and solutions to reduce dust, noise, slope failures, and flood prevention in road construction.

b/ Vietnam Vehicle Inspection Center:

- Intensify publicity, seek public opinion, and perfect the "Motorcycle and Motorbike Exhaust Emission Control Plan for Major Cities" to be submitted to the Ministry for review and submission to the Government in 2009.

- Develop the "Implementation Schedule for Euro 3, 4, 5 Emission Standards for Road Motor Vehicles" to be submitted to the Ministry for review and submission to the Government in 2010.

- Organize inspections, control, and establish a database on environmental pollution from transportation vehicles.

c/ Vietnam Maritime Administration:

- Organize pilot stations for receiving and treating waste from ships in the Haiphong - Quang Ninh area and expand their application to other coastal ports nationwide.

- Evaluate, develop, and pilot applications of solutions to mitigate the impact of climate change and rising sea levels on the Vietnamese port system.

d/ Vietnam Transport Health Administration directs hospitals, health centers, care areas, and rehabilitation zones under its jurisdiction to invest in waste collection, sorting, and treatment systems according to regulations and periodically monitor, measure, and evaluate environmental parameters such as wastewater and exhaust emissions according to Vietnamese standards; report to the Ministry on implementation results before December 31 each year.

đ/ Vietnam Construction Management and Transportation Project Quality Control Bureau organizes design reviews and quality management of environmental treatment projects in infrastructure investment and construction.

3.5. Project Management Boards strictly comply with regulations on environmental impact assessments for transportation construction projects; proactively propose environmental protection components and appropriate budget estimates from the project preparation stage for approval as a basis for implementation; strengthen the execution of environmental protection commitments, measures, and monitoring programs during each project phase, especially those in environmentally sensitive areas.

3.6. State-owned Enterprises and Companies in the Transportation Sector:

3.6.1 General Tasks:

a/ Establish and implement environmental management systems in business operations; strive to achieve by 2020 that 80% of enterprises in the Transportation Sector obtain Environmental Standard Certificates or ISO 14001 Certifications.

b/ Develop and implement fuel consumption norms and energy-saving and efficiency regulations in business operations; encourage research and improvements to enhance energy usage efficiency in enterprises.

c/ Invest in facilities and equipment to organize waste collection, sorting, and treatment according to regulations.

d/ Lead and coordinate with specialized organizations to regularly monitor, measure, and evaluate environmental parameters such as wastewater, exhaust emissions, noise, and vibration according to Vietnamese standards, particularly for enterprises operating in ship repair and construction, seaports, river ports, ship demolition, automobile and motorcycle manufacturing, and ship oil cleaning; report results to the Ministry before December 31 each year.

đ/ Fully comply with environmental protection laws in investment and construction activities and in production, business, and service operations.

3.6.2 Specific Tasks:

a/ Enterprises operating before July 1, 2006 without an approved environmental impact assessment report or environmental standard certification must urgently develop an environmental protection plan to be reviewed and approved by the competent authority according to Clause 9, Article 1 of Decree No. 21/2008/NĐ-CP dated February 28, 2008.

b/ Vietnam Railway Corporation develops a schedule and organizes the installation of waste disposal equipment on passenger trains; strive to reach 100% of passenger cars on Thunghat passenger trains equipped with waste disposal equipment by 2020 and 100% by 2025.

c/ Vietnam Shipbuilding Industry Group continues to cooperate with Hyundai Vinashin Joint Stock Company to thoroughly treat used grinding media NIX waste and remove the company from the list of serious polluters according to Decision No. 64/2003/QĐ-TTg dated April 22, 2003; intensify research and application of cleaner production technology for ship repair and construction facilities within the group.

Environmental protection and energy conservation and efficiency are key tasks of the sector to implement Resolution No. 41-NQ/TW dated November 15, 2004 of the Politburo on environmental protection during the period of industrialization and modernization, the Government's action program to implement Resolution No. 41-NQ/TW of the Politburo, and the National Target Program on Energy Conservation and Efficiency. The Minister requests heads of agencies and units assigned tasks to strictly implement this Directive.

Request the ministries, sectors, People's Committees at all levels to take responsibility for coordinating the implementation thereof./.
