PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State Budget dated December 16, 2002;
Pursuant to the Law on Credit Institutions dated February 12, 1997, and the Law Amending and Supplementing Certain Provisions of the Law on Credit Institutions dated May 16, 2004;
Pursuant to the Enterprise Law dated November 29, 2005;
Pursuant to Resolution No. 30/2008/NQ-CP dated December 11, 2008 of the Government on urgent measures to prevent economic decline, maintain economic growth, and ensure social welfare;
Considering the proposal of the Minister of Finance,
DECISION:
Article 1. This Decision promulgates the Guarantee Regulation for enterprises requiring guarantees to borrow funds from commercial banks legally operating in Vietnam.
Article 2. The Vietnam Development Bank shall implement guarantee transactions for enterprises requiring loans from commercial banks to carry out investment projects and business plans according to the Regulation issued together with this Decision.
Article 3. Local credit guarantee funds for small and medium-sized enterprises operate under Decisions No. 193/2001/QĐ-TTg dated December 20, 2001 on the establishment and operation of credit guarantee funds for small and medium-sized enterprises, and Decision No. 115/2004/QĐ-TTg dated June 25, 2004 amending and supplementing Decision No. 193/2001/QĐ-TTg dated December 20, 2001, and are amended and supplemented as follows:
1. Amend and supplement Clause 2, Article 15 of Decision No. 193/2001/QĐ-TTg dated December 20, 2001 with Clause 4, Clause 5, Article 4 of the Regulation issued together with this Decision.
2. Amend and supplement Clause 1, Article 16 of Decision No. 193/2001/QĐ-TTg dated December 20, 2001 with Article 6 of the Regulation issued together with this Decision.
Article 4. This Decision takes effect from the date of issuance.
Ministers, Heads of ministerial-level agencies, Heads of agencies attached to the Government, Chairmen of People's Committees of provinces and centrally governed cities, Chairmen of Management Councils, General Directors of the Vietnam Development Bank are responsible for implementing this Decision./.
